Discussion of Education Laws on Compulsory Education and its Limitations for the Gifted (영재에 대한 의무교육 제도의 교육법적 검토)

  • The study attempted to articulate standpoints towards compulsory education system based on schooling age and year in careful considerations with the gifted. For these ends, literatures were reviewed and various education laws, regulations and documents and related law reports and judicial decisions were investigated. Literature review was conducted to develop that ideas of rights to compulsory education for regular students are closely related to those for gifted. Structures of general education laws and gifted education law and regulations were compared. Later, limitations of compulsory education were discussed when it was applied for the gifted. In conclusions, it is inappropriate that the gifted are ruled by compulsory education system based on schooling age. If compulsory education system is designated to provide an effective opportunity for all students, it should be duties and rights to enter elementary schools at schooling age. However, it appeared that the duties and rights to enter elementary schools at certain schooling ages function as inhibitors against the gifted with giftedness and potentials far beyond those of regular students. Therefore, the gifted should be separately ruled under flexible systems of compulsory education if their achievement level is assessed as sufficient to enter elementary schools before schooling age. On the other hand, legal systems of compulsory education are gradually evolved to flexible systems. However, it is necessary to establish social atmosphere and support system of educational administration in order to practice the flexible system of compulsory education for the gifted.

A Legal Study on the Electronic Ticketing (전자항공권의 법적 제문제에 대한 고찰)

  • Electronic ticketing ("e-ticketing") through the internet will be the most critical commercial tool in the international airline industry. Actually the International Air Transport Association(IATA) has announced that it's goal is to accomplish 100 percent implementation of e-ticketing worldwide by 2007. Domestically e-ticketing will be put into operation in a full scale from the next year(2007). Thus, we count on, sooner or later, e-ticketing will be accomplished globally. As a legal aspect, this e-ticketing raises many legal issues which are no longer subject to a static set of legal rules driven by judicial precedent because e-ticketing is carried out on the "cyber space" which is a new and developing law area. In this treatise, I studied these legal issues, specially on the time and place(jurisdiction) of the contract which are the most important issues based on the New Montreal Convention signed at Montreal on May 28, 1999, which would seem prove that the airline industry is receptive and capable of change. Upon this opportunity, I hope the more comprehensive legal study on the e-ticketing will be introduced in the near future.

  • VTS가 국제적으로 성공하기 위해서는 유엔해양법협약의 기본정신에 따라 IMO차원의 국제협약이 마련되어야 하며, 국내 이행입법이 도입되어 법적 실효성을 확보해야 한다. 또한 주변국가간 협력체제를 통한 광역 VTS의 도입으로 연안국의 관할권을 벗어나는 수역에서의 해양사고발생을 방지하고(사전 예방), 사고선박에 대한 해난구조체계(사후구제)를 효과적으로 운영하기 위한 국제법적 제도가 도입되어야 하므로, 이에 대한 기초검토로써의 의미를 가진다.

A Legal Study on the Certificate System for Light Sports Aircraft Repairman (경량항공기 정비사 자격증명제도에 관한 법적 고찰)

  • Recently, the aviation leisure business has been legislated, and related industries have become active base with increasing the light sports aircraft within the legislation system. However, in the light sports aircraft safety problem, it is often mentioned that the flight is in violation of the regulations, the lack of safety consciousness of the operator and lack of ability, and the personal operators have a risk of accident of light aircraft such as insufficient safety management and poor maintenance. At present, the maintenance of light sports aircraft is carried out by the A & P mechanic in accordance with the relevant laws and regulations, but it is difficult to say that it is equipped with qualification and expertise. It is not a legal issue to undertake light sports aircraft maintenance work on the regulation system. However, the problem of reliability and appropriateness is constantly being raised because airplanes, light sports aircraft, and ultra-light vehicle are classified and serviced in a legal method. Although legal and institutional frameworks for light sports aircraft are separated, much of it is stipulated in the aviation law provisions. Light sports aircraft maintenance work also follows the current aircraft maintenance system. In the United States, Europe, and Australia where General Aviation developed, legal and institutional devices related to maintenance of light aircraft were introduced, and specialized maintenance tasks are covered in the light aircraft mechanics system. As a result of analysis of domestic and foreign laws and regulations, it is necessary to introduce the qualification system for maintenance of light aircraft. In advanced aviation countries such as the United States, Europe, and Australia, a light sports aircraft repairman system is installed to perform safety management. This is to cope with changes in the operating environment of the new light sports aircraft. This study does not suggest the need for a light aircraft repairman system. From the viewpoint of the legal system, the examination of the relevant laws and regulations revealed that the supplementary part of the system is necessary. It is also require that the necessity of introduction is raised in comparison with overseas cases. Based on these results, it is necessary to introduce the system into the light aircraft repairman system, and suggestions for how to improve it are suggested.

  • Certification by Civil Aviation Law is necessary for aircraft parts and appliances as well as aircraft, engines, and propellers to ensure safety and reliability in operation. Advanced countries in aerospace industry as like U.S.A require Parts Manufacturer Approval for aircraft parts and Technical Standard Order Authorization for designated appliances. However, there are no legal requirements for certification of aircraft parts and appliances in Korea until now. This study presents the draft to revise Civil Aviation Law, which is applicable to set up domestic certification system and maintain it equivalent to U.S. Federal Aviation Regulation.

원유의 세균학적 질:법적요구와 지불제도 - EU와 IDF 회원국 현황 -

  • 유질은 성분과 위생상태로 결정되어 진다. 질/위생은 사람건강 보호와 적정소비에 대한 관점에서 보면 장점인 영양적 중요성에서 오는 욕망을 이르키는 성질과 일정범위의 좋은점 사이에 원유변화와 만나게되는 것이 필요하다. 높은 질/위생적 원유에 대한 가치의 주요 평가는 : - 부패미 생물의 낮은 수 - 유방염 병원성균이 포함된 병원성군이 없거나 대단히 낮은 수 - 가능한 한 멀리 피할 것은 잔류와 오염 그리고 또는 최고잔류한계(Maximum Residue linits. )이하를 지킬 것. 우유내 부패세균은 다음 군에서 주요 우유성분에 대한 공격의 그들 주요점에 의하여 세분할 수 있다. - 당분해(Glycolytes) - Streptococci, lactobacill; - 단백질 분해(Proteolytes) - Pseudomonads, Enterobacteriaceae, Aerobic sporeformer - 지방분해(Lipolytes) - Pseudomonads, Micncocci, Aeromonads, Coryneb acteria 원유내 부패세균의 존재와 분열은 우유성분 변화와 생산품의 질에 영향을 줄 것이다. 더구나 원유의 맛은 역의 영향이 될 것이며 열 안정성 세균성 효소는 생산품에서 계속적으로 작용된다. 특히 오랜 저장시에 그러하다. 그리고 안정성, cream의 맛과 UHT 우유에 나쁜 영향을 준다. 이 병원성 세균을 고전적 미생물과 최근 발견된 미생물이 포함된다. 현재는 Salmonella, 병원성 E. Coli 균주, Listeria monocytogenes, Campylobacter Jejuni, Yersinia enterocolitica, Staphylococcm aureu는 대단히 중요하다. 원유의 세균학적 질과 지불제도에 대한 법적요구는 우유위생지침 92/94 EEC와 IDF설문 2893/A(전문가모임 A8군)의 결과를 기준으로 설명되었다. IDF Nr. 305/1995는 농장 지불제도에 관한 정보가92/93년 동안 IDF국가들 사이 차이나는 실제적 위치가 실려있다. 지불제도의 차이나는 현상은 보고의 초점과 연관 유질, 위생적 질, 우유시료채취, 수집방법론 그리고 여러가지 지불공식과 관계된 조사는 논쟁이 있었다. 현재 있는 자료를 제시한 몇 나라는 1992년에 응용한 것이고, 기타는 그후 응답으로 1993년과 1994년에 있던 것이 제시되었다. 식품위생에서 법적인 요구는 HACCP제도가 더욱더 추가로 포함된다. 더우기 위험분석은 위생과 질에 관련시켜 모든 연결결정에 대하여는 과학적 근거가 있어야 한다.
