As the ability to use data becomes competitive power in the data-driven economy, the effort to create economic value by using personal data is emphasized as much as to protect personal data. EU's PSD2(the second Payment Service directive) became the initiative of the Open Banking trends all over the world, as it is the Mydata policy which protects the data subject's right by empowering the subject to control over the personal data with the right to data portability and promotes personal data usages and transfer. Korean government is now fast adopting EU's PSD2 in financial sector, but there is growing concerns in personal data abuse and misuse, and data breach. This study analyzes domestic financial Mydata policy in comparison with EU's PSD2 and focus on Personal information life-cycle risks of financial Mydata policy. Some suggestions on how to promote personal information and privacy in domestic financial Mydata Policy will be given.

최근 기후변화로 인하여 자연재해 발생 빈도가 증가하고 있으며 우리나라의 경우, 자연재해 중에서도 태풍, 호우 등 풍수해의 발생 비율이 높게 나타난다. 최근 곤파스(2010), 무이파(2011), 볼라벤(2012) 등 태풍의 영향으로 많은 인명피해와 1조원 이상의 직접손실이 발생하였다. 이로 인하여 자연재해 예측 및 피해저감을 위한 국가적 차원의 체계적인 방재정책을 수립하고자, 안전관리 기본계획 및 풍수해저감종합계획 등 풍수해 관리를 위한 관련 정책들을 정비하고 있다. 그러나 현행 법률구조상 효율적인 재난관리정책을 뒷받침할 법적 근거가 미흡한 실정이다. 이에 본 연구는 체계적인 풍수해 관리를 위하여 재난관리단계를 예방, 대비, 대응, 복구로 구분하고 관리 현황 분석을 진행하여 풍수해관리 중장기 전략을 제시하였다. 연구방법으로는 풍수해 관련 법령 및 법 제도 체계를 검토하였고, 루사(2002)와 볼라벤의 피해사례 분석을 통해 풍수해 관리 문제점을 파악하였다. 현행 방재정책은 사후복구위주의 중앙정부 중심 체계이며, 피해규모가 대형화되고 복합재난이 발생하는 등 새로운 재해상황을 반영하지 못하고 있는 것으로 분석되었다. 따라서 본 연구에서는 기존 풍수해 관리에 있어 (1)관련법 규정의 미흡, (2)재해정보의 부족 및 정보관리의 미흡, (3)대응체계의 복잡성, (4)방재산업에 대한 전략적 과학적 투자 미흡 등을 문제점으로 도출하였다. 이와 같은 문제점을 개선한 풍수해관리 중장기 전략은 첫째, 법 제도 개선을 통한 풍수해 관리수준 고도화, 둘째, 재해연보 개선을 통한 풍수해정보관리 고도화, 셋째, 풍수해 피해예측시스템을 활용한 계획적이고 체계적인 재난대응체계 구축, 넷째, 풍수해 저감 핵심기술 확보와 국내 방재산업 활성화 체계 구축으로 제시하였다.

Although regulation generally shall be based on the law, many regulations are not based on legislation. Shadow regulation that is not mandatory but functions as regulation may be developed and enforced by non-govermental body. This article examines shadow regulations of copyright protection online of the US, the EU and the UK and draws their implications for Korea. In case of self-regulation, the following factors shall be considered: to acquire the technology to filter copyright infringement and to solve the problems arising from the application of it, to prevent the infringement of freedom of expression, to ensure the appropriateness of the sanctions imposed on the alleged copyright infringement, to ensure the participation or monitoring of internet subscribers in the negotiation between the internet industry and copyright holders, and to clarify the government's role and responsibility.

The legal deposit is a comprehensive and systemic method for acquiring a country's publications. This study aims to compare laws and regulations about legal deposit among several countries that have different histories and traditions and to supplement laws and regulations of Korea's legal deposit. To do this, research papers and laws, regulations, guides, web sites and online systems about legal deposit of eight countries including USA, United Kingdom, Canada, Australia, France, Japan, Singapore, and Korea were reviewed. This study tried to compare and analyse several categories including publications to be deposited or not deposited, requirements, due dates, expenses, and numbers of copies for deposit, and penalty for noncompliance with legal deposit. Also, online publications to be deposited or not deposited, requirements and methods for deposit were compared and analysed. At last, some suggestions were also made for improvement in laws and regulations of in Korea.

According to article 11 of the Public Records Management Act of Korea, metropolitan city, special self-governing city, province or special self-governing province should establish archival institutions for permanent preservation and management of records. As a result, the establishment and operation of archival institutions in Korea has been increase, but since it is still in the stage of introduction, the mission and role of these archives have not been specified by archives act. Therefore, we need to establish a proper legal basis to support it. To do this, it explores the archives act in China, Russia and Germany in terms of basic operational policy, collection and transfer of records, management of records, and service of records. As a result, the study presents some implications for the archives act for the management of archives in Korea.

The private military company(PMC) or the private military industry may be one of the most important, but little understood developments in security studies to have taken place over the last decade. This new industry, where firms not only supply the goods of warfare, but rather fulfill many of the professional service functions, is not only significant to the defence community, but has wider ramifications for global politics and warfare. The private military industry emerged in the early 1990s. Its underlying cause was the confluence of three momentous dynamics - the end of the Cold War and the vacuum this produced in the market of security, transformations in the nature of warfare, and the normative rise of privatization. In order to introduce MPFs(Military Provider Firms) into Korea, where in principle private citizens are prohibited to own a gun, unlike the United States, a special law should be enacted which allows them to possess weapons and fight in combat. Therefore, the National Assembly of Korea has been submitting and discussing "the Act on the Prevention and Conduction of Practice of Piracy" since 2014.

In the trend of continuously increasing collection and use of personal information, there are legal grounds for protecting personal information and various policies and systems are implemented, but there is insufficient analysis about education and its effect of personal information protection. In this study, we surveyed and analyzed the degree of awareness and actual perception level in the protection of personal information of college students, and investigated the satisfaction of personal information protection education. The results of the analysis showed that students' interest in privacy protection and concern about personal information exposure was very high, but the efforts to protect personal information and the perception level of rights and systems for protecting personal information was very low. In addition, the experience and satisfaction of education for personal information protection were found to be very low. Students felt that the necessity of education for personal information protection was strongly agreed and preferred regular and continuous education rather than one-time education.

The purpose of this study is to consider the perception, which education-related workers and parents have, associated with guaranteeing the right to learn for youth migrants in Korea. The study was especially intended to analyze the opportunities and adaptions of youth migrants and make policy suggestions accordingly. To this purpose, this study implemented one-on-one in-depth interviews with research participants to collect and analyze data. This research yielded four categories: initial settlement, social security support as a fundamental right, learning rights guarantees, and psychological support. Also, seven subcategories were elicited. The suggestions based on results are followings: first, the legal basis for learning support for middle-aged adolescents; second, curriculum composition for school maladjusted middle-aged adolescents; third, individualized support system; fourth, the active promotion of support systems such as information provision; fifth, the diversification of policy for psychological stability.

Since the late 1990s, public nursing hospitals have been established, and as of 2018, 79 hospitals account for 5.1% of all nursing hospitals. In this regard, the Dementia Management Act was revised in 2018 to provide a legal basis for the operation evaluation of public nursing hospitals, and this evaluation will begin in 2020. As part of the study to conduct the operation evaluation of public nursing hospitals to be implemented from 2020, the research established a function to foster public nursing hospitals as specialized institutions for dementia patients and competent institutions for treating rehabilitation patients during the period of recovery, and developed an evaluation system to evaluate their behavior as medical services, public nature and public institutions.

Recently, a great attention has been paid to a vehicle black box device in the auto markets since it provides an accident re-construction based on the data which contains audio, video, and some meaningful driving informations. It is expected that the device will get to promote around commercial vehicles and the market will greatly grow within a few years. Drivers who equips the device in their car believes that it can find the origin of an accident and help an objective judge. Unfortunately, the current one does not provide the integrity of the data stored in the device. That is the data can be forged or modified by outsider or insider adversary because it is just designed to keep the latest data produced by itself. This fact cause a great concern in car insurance and law enforcement, since the unprotected data cannot be trusted. To resolve the problem, in this paper, we propose a novel real-time integrity protection scheme for vehicle black box device. We also present the evaluation results by simulation using our software implementation.
