의료민사소송은 그동안 의료행위가 지니고 있는 전문성, 밀실성, 폐쇄성 등의 여러 가지의 특수성으로 인하여 소송이 장기화되고 경제적 비용이 상당하게 소모되었다. 또한 법원의 판결이 이루어지더라도 당사자들이 이를 신뢰하지 못하는 등의 이유로 신속성과 공정성에 문제점이 지적되었다. 이 때문에 소송 대체적 분쟁해결제도로서 의료사고 피해구제 및 의료분쟁 조정 등에 관한 법률상의 의료분쟁조정 및 중재 절차가 탄생하게 되었다. 그러나 의료분쟁조정법 제27조 제8항에서 피신청인이 14일 동안 의사를 표명하지 않는 경우 거부의사로 간주되고, 이 경우 한국의료분쟁조정중재원장이 각하결정을 하여야 한다고 규율함으로써, 조정의 개시 조차 순탄치 않은 것이 현실이다. 본고에서는 우리나라 의료분쟁의 최근 현황을 확인해 본 후, 의료분쟁조정법상 조정의 신청에 관한 조문인 제27조에 대한 입법안을 비교 점검한 후 다른 ADR 관련 법률이나 민사소송법상의 조문과 비교하여 불합리한 점이 있는지를 검토하고, 동조의 개선방안을 제시하고자 한다. 또한 2013. 4. 8.부터 시행이 되고 있는 불가항력적 산과 사고에 대한 무과실보상제도와 관련하여 동조가 미치는 영향 등에 대해서도 논의하고자 한다.

본 연구는 $\ulcorner$방사성폐기물관리사업의 촉진 및 시설주변지역의 지원에 관한 법률$\lrcorner$의 관련 문제점을 이론적인 측면과 그간의 운영을 통한 경험적인 측면에서 검토한 것이다. 물론 이 법률의 미래 자체가 이제는 불투명해졌지만 본 연구에서는 방사성 폐기물 처분장 사업이 진행된다는 전제하에서 수행된 것이다. 본고는 이 연구의 결론 부문으로서, 본론의 각 장에서 다루어지지 못한 부분과 본론의 논의에 의거한 개선 방향을 제시한 것이다.

보건복지가족부는 '후천성면역결핍증예방법'을 일부 개정하여 지난 2월 21일 공포하고, 8월부터 시행한다고 밝혔다. 개정 법률은 에이즈 감염인의 사회적 차별과 편견을 방지하기 위해 기존 법률의 인권 침해적 요소를 개선하였으며 작게나마 HIV/AIDS감염인을 '감시와 격리'의 대상으로 취급해 왔던 현행 제도로는 달성하기 어려웠던 포괄적인 에이즈 예방의 목적을 달성할 수 있을 것으로 기대되고 있다.

환경부는 자원의 절약과 재활용촉진에 관한 법률 시행령 일부개정령(안)을 공고했다. 이번 시행령은 개정은 폐기물부담금에 관한 자발적 협약을 통하여 전국적인 회수 재활용체계가 구축된 윤활유 용기 등을 생산자책임재활용 제도로 전환하고, 중소 플라스틱 제조업체에 대한 폐기물부담금을 감면하는 등 현행 제도의 운영과정에서 나타난 일부 문제점을 개선 보완하고자 하는데 있다. 본 고에서는 주요 내용을 살펴보고 신 구조문을 비교해 본다.

This study analyzes and suggests improvement direction for the problems of housing related market laws and policies that cause sudden changes according to the application criteria. These laws and policies include income deduction from housing subscription, monthly rent loan for housing stability, high price house, penalty points from poor quality construction, and real estate brokerage commission. Each has one or more specific values that decide application criteria causing noticeable different results. Benefit or loss can be decided when an application range is changed by a small difference of the application value near to the boundary. This study suggest to use equations instead of a certain values to remove those sudden changes and to make them steadily increasing slopes which can be lines or curves. The concept can be applied to other laws and policies that have significantly different results between criteria.

As 4th industrial revolution era has come, autonomous driving vehiecle gets its attention for commercialization and development and thus its impact on society. To this end, several countries such as US, England and Germany are preparing their own legal systems to come up with commercialization of autonomous driving vehiecle. In this country, Korea is also developing autonomous driving vehiecle and looking forward its commercialization yet the legal system of Korea lacks of laws, regulations, rules, guidelines and so on. Hence, it is our intention to look into Korean legal system providing the analysis of current Korean legal system in detail. This paper also provides further directions to have balance between commercialization success and risk management in this country and, as a result creates a small step toward 4th industrial revolution society.
