로스쿨문제가 사법개혁추진위원회의 손을 떠나 국회로 넘어갔다. 아직 정리되지 않은 가장 큰 문제는 정원의 규모다. 흔히 정원문제를 제도의 본질이 아니라 이해조정차원의 문제로 보곤 한다. 그러나 기존의 이익상황을 온존시키는 1,200명 안은 법조에 대한 진입장벽을 그 앞 단계인 법학교육 분야까지 확장하는 것이고, 지금까지 무제한으로 경쟁하던 법학교육 분야에 높은 진입장벽을 설정하여 과점화 시키는 것을 의미한다. 경쟁정책적으로 치명적인 문제가 있으며, 한국내의 제한된 최우수 인재의 효율적 배분과 관련해서도 나라의 미래를 내다보는 정책 형성이 필요하다.

2007년 4월 1일 체결된 한미 FTA 협약으로 법률시장의 개방 또한 불가피해진 상황이다. 협정 발효 후 5년 내에는 완전 개방이 이루어져 미국 로펌과 국내 로펌 간 동업사업체 설립이 허용된 상태이다. 이러한 시점에서 로스쿨법이 지난 7월 국회 본회의를 통과하였다. 로스쿨법의 시행을 앞두고 우리 법률시장의 현황 및 특징을 알아보고, 법률시장개방에 따른 대응책을 검토해 봄으로써 로스쿨이 성공적으로 정착하기 위해서는 어떤 요건들을 갖추어야 하는지 살펴보기로 하자.

In the area of legal studies, negotiation can be taught as a profession skill in legal matters such as making negotiating a contract or resolving disputes including alternative dispute resolution. Given recent changes in the legal services market such as the opening of the market, expected higher competition in the legal profession and a high expectation for lawyers' role in society, negotiation skills are an important element of legal expertise that should be developed in law schools. The main purpose of negotiation training should be to make law school students aware of their role as lawyers to help their clients resolve their problems using their legal expertise and negotiation skills in an appropriate and effective way.

지난 7월 20일, 미국 로스쿨(Franklin Piercie Law Center)의 과정인 PADIAS(Patent Application Drafting and Infringement Strategies)의 1회 수료식이 한국발명진흥회에서 거행되었다. 총 52시간에 걸친 미국 특허 출원 및 소송 전략에 관한 명품강의였다는 것이 참석자들의 중론이다. 이 프로그램 기획자이자 주 강사인 함윤석 변호사와 전화 인터뷰를 했다.

중국은 우리나라의 최대 수출입 무역국가로써 우리나라 경제에 매우 중요한 위치에 있다. 특히 동북3성을 기점으로 물류는 지리적, 정치적, 문화적인 중요성을 가지고 있어 국익의 관점에서 물류 활성화는 필수적인 요소로써 연구가 필요하다. 본 연구는 동북3성을 기점으로하는 해상물류에 영향을 미치는 요인을 분석하고 활성화를 위한 정책적 제언을 하였다.

It is not seen as discrimination based on reasonable grounds for the National Public Officials Act to discriminate between public officials entering general graduate schools and public officials entering law schools. The degree of discrimination cannot be said to be appropriate. Therefore, it is judged that it violates the principle of equality under Article 11 of the Constitution for the relevant laws and regulations to treat them differently by excluding those public officials who went to law schools from the application of the State Public Officials Act because the criteria for discrimination cannot be said to have a substantial relationship to realize its purpose. The degree of discrimination is not appropriate, so related laws and regulations are arbitrary legislation that discriminates against public officials entering law schools without reasonable reasons. Articles 71(2)3 and 72(6) of the National Public Officials Act and Article 90 of the Rules on the Appointment of Public Officials stipulate that public officials who want to go to "research institutions or educational institutions designated by the head of the central personnel agency" can use the training leave system. However, it is reasonable to assume that there is no reasonable basis for discrimination because it does not allow such benefits to public officials who wish to enter law schools. I think it is desirable to utilize a special admission system that allows students to enter night law school or to enter while working for a living.

중국 동북3성은 지리적, 경제적, 문화적으로 상당히 중요한 지역이지만 대부분의 교류가 해상으로 이뤄지고 있어서 지속가능성을 고려할 때 노후 카페리의 현대화 추진이 필요한 실정이다. 따라서 본 연구는 현재 운항중인 카페리선박과 운영항로를 분석하고 신조 대체에 필요한 재원규모을 파악하였다. 실질적인 선박금융펀드 조정에는 한국과 중국간의 선박금융과 조선산업의 경쟁력을 기반으로 공동운영을 제언하고자 한다.

본 연구는 해양치유자원에서 효능을 입증된 시각적 및 청각적인 자원을 포함한 해양경관자원을 디지털화 한 디지털 해양치유프로그램을 제안하고자한다. 이 프로그램으로 해양치유의 간접경험과 해양치유자원에 대한 올바른 정보를 제공함으로써 해양치유에 대한 수요를 촉진하고 지역경제 활성화로 기여할 수 있다.
