디지털 유산의 유형은 매우 다양하며 혼합성을 가진 정보의 특성상 민법의 상속 규정으로 해결될 수 없거나 기타 현행 개별법의 규정에서도 해결할 수 없는 경우도 있을 수 있다. 또한, 디지털 유산의 생성, 저장, 처리가 제3자인 정보통신서비스 제공자의 영역에서 이루어지며 현행 개인정보보호법제, 비밀준수관련법제 등 개별법상 정보통신서비스 제공자에 대한 법적 책임의 가능성이 있다는 점은 디지털 유산의 생산자(즉, 정보통신서비스 이용자)와 상속인에게 전통적인 상속법제를 적용하는데 실질적인 걸림돌로 작용하고 있다. 종래 국내에서 제안된 입법안들은 디지털 유산과 관련한 이러한 문제점을 인식하여 정보통신서비스 제공자에게 개별법상 책임의 가능성을 경감함으로써 디지털 유산의 법적 처리를 원활하게 하는 근거규정을 두고 있다. 그러나 디지털 유산의 범위, 디지털 유산 제공 대상자의 범위, 제공 대상자의 권한의 범위 등에 있어 많은 차이를 보였다. 이러한 점을 고려한다면 디지털 유산의 상속에 관한 타당하고 합리적인 해석론을 전제로 하되 추가적인 입법론적 논의가 필요하다. 입법론적 논의를 위해서는 디지털 유산에 대하여 실질적 지배영역을 가진 정보통신서비스 제공자에 대한 책임의 명확화와 더불어 디지털 유산을 둘러싼 관계인의 이해를 조화하는 방향성이 요구된다.

최근 중대재해처벌법 등 근로자의 안전 및 건강관리를 위한 인식이 확산되며, 기업들의 근로자 건강관리 솔루션으로 디지털헬스케어의 건강관리서비스 플랫폼이 주목받고 있다. 그러나 국내 디지털헬스케어 시장에서 건강관리서비스 플랫폼은 사업화 단계에서 어려움을 겪고 있다. 본 논문에서는 개인건강기록에 기반한 맞춤형 건강관리서비스 플랫폼의 성공요인의 우선순위를 도출하여 효과적인 운영을 위한 실질적 전략의 시사점을 제시하였다. AHP 방법론을 통한 플랫폼 공급자와 수요자 측면 전문가 집단 연구 결과 법/제도, 데이터 분석 및 플랫폼 설계, 시스템 보안성, 시스템 안정성순으로 나타났다, 본 연구의 우선순위 결과를 통해 건강관리서비스 플랫폼, 나아가 국내 디지털헬스케어의 활성화 및 경쟁력 제고에 기여할 수 있기를 기대한다.

아날로그방송 중단을 앞두고 케이블방송은 디지털 CATV 로 전환하기 위해 노력 중이다. 이를 위해 케이블방송은 단순히 방송의 디지털화 뿐만 아니라, PPV(Pay Per View), PVR(Personal Video Recorder), VOD(Video On Demand) 와 같은 서비스를 가입자에게 제공하기 시작했다. 이와 같은 서비스들은 대부분 유료서비스로 가입자의 수신권한을 확인하기 위해 다양한 종류의 CAS(Conditional Access System)를 사용하고 있다. 2008년 관련법의 정비와 함께 IPTV(Internet Protocol TV) 시범서비스가 시작 되었는데, IPTV 역시 실시간 방송, VOD 서비스를 기본 서비스로 규정하고 있기 때문에 CAS 의 사용이 필수적이다. 본 논문에서는 디지털 CATV 와 IPTV 에서 사용하는 수신제한시스템을 분석하고, 가입자와 방송사업자 모두에게 도움이 되는 발전방향이 무엇인지 제시하고자 한다.

세계는 1990년대 중반 '정보화 혁명'에 이어 2000년대 중반 이후에는 '디지털 융합 혁명'이라는 새로운 물결에 직면해 있다. 디지털기술의 발전과 전송망의 광대역화에 따라 전통적으로 서로 다른 영역이었던 통신과 방송이 네트워크, 서비스, 단말기, 콘텐츠 차원에서 경계가 허물어지는 통신.방송 융합현상이 가속화되고 있다. 이에 따라 IPTV, DMB, 웹캐스팅, 데이터방송 등 기존의 통신과 방송의 속성을 모두 가진 서비스가 우리들의 실생활에 속속 등장하고 있다. 이러한 융합현상은 이용자에게는 새로운 융합서비스 이용을 통한 편익 증진뿐만 아니라 통신.방송 전반의 산업구조까지 근본적으로 변화시키고 국가 경쟁력을 높일 수 있는 좋은 기회가 될 것으로 보고 있다. 이미 세계 주요국은 IPTV서비스를 도입하고 있으나, 세계 최고의 정보통신 인프라를 보유하고 있는 우리나라는 안타깝게도 법제도 정비의 지연으로 아직 도입을 못하고 있다. 우리나라는 IPTV 도입뿐만 아니라, 디지털방송 활성화, 디지털콘텐츠 육성 등 풀어나가야 할 현안들이 산적해 있다. 또한 방송과 통신 전반에 걸쳐 정책과 규제체계를 융합환경에 맞추어 새롭게 설계해야 하는 과제도 있다. 이러한 과제를 순조롭게 해결하기 위해서는 우선적으로 정책과 규제기구를 융합환경에 맞게 개편하는 것이 시급하다. 이번호에서는 방송통신 융합의 주요 이슈 가운데 가장 시급하게 해결해야할 방송.통신 기구개편과 대표적인 방송통신융합서비스인 IPTV서비스 도입정책방안 그리고 방송통신융합법에 대해 전문가들의 특별기고를 통해 살펴보는 자리를 마련한다.

Korea-EU FTA, which came to an agreement in April of 2007, was resolved at the National Assembly in May of 2011, thereby having been concluded the ratification. As for the procedure of opening a market in legal service according to settlement and ratification of Korea-EU FTA, Step 1 is allowed the establishment of representative office(law firm with foreign-law consultation) at home by EU member countries' law firms. Step 2 is made available for law firm with foreign-law consultation to jointly handle and distribute profits as for a case that is mixed the domestic law firm and the domestic & foreign laws. Step 3 is allowed EU member countries' law firm to establish a joint venture with domestic law firm. This study researches into a change and influence upon legal service and forensic investigation according to Korea-EU FTA ratification. Also, it researches into position and prospect that digital forensic evidence, which possesses the majority of legal evidences, takes up in the middle of court-oriented trials. The prediction of influence in digital evidence as professional proof upon judgment will led to being capable of coping with the opening of legal service market and of wisely preparing for the advance to domestic market by law firm of Anglo-American Law.

The healthcare industry is a digital healthcare that combines technology based on the 4th Industrial Revolution, dealing with information on individual health and medical care, and is a fusion of health care services and medical science and technology. It is questionable whether digital healthcare according to the paradigm change can be discussed by the concept of medical practice under the existing Medical Act. There is no clear definition of the concept of medical practice in the Medical Service Act, but the concept is established through precedents. In addition, under the Medical Service Act, the subject of medical practice is limited to medical personnel. However, digital healthcare sometimes diagnoses and treats diseases using digital technology by medical personnel. On the other hand, what is possible by non-medical personnel is digital healthcare. This is because digital healthcare is understood as a concept that includes health care such as exercise, eating habits, and weight control. For this reason, if the concept of medical practice under the "Medical Act" on digital healthcare is included, it is subject to criminal punishment for "unlicensed medical practice" prescribed in Article 27 of the "Medical Act". In the health and medical industry, digital transformation and convergence with information and communication technology are rapidly progressing. As a result, there is a need to newly define it as 'digitalized medical practice' or 'information and communication technology (ICT)-based medical practice' separately from existing medical practices. The concept of medical practice has variability, not a fixed and invariable concept. However, in response to this demand, it is not an infinite expansion of the concept of medical practice, but a request to reset its scope. Therefore, the concept of medical practice should be legislated by reflecting the demand of consumers for the medical service system.

요즘 한창 휴대폰의 도청 가능성 여부를 놓고 정국이 시끌벅적하지만, 이에 못지 않게 논란이 됐던 게 바로 휴대폰을 이용한 위치 추적 사건이었다. 모 대기업에서 근로자의 휴대폰을 불법적으로 위치 추적하면서 불거졌던 이 사건은 결국 무혐의로 상황 종료되긴 했지만 위치정보법에 대한 필요성을 부각시킨 사례 중 하나라 할 수 있다. 최근 이러한 위치정보에 대한 법률적인 기반이 마련됐다. 지금까지 LBS(Location Based Service) 분야로 기반 환경 조성 차원의 투자 단계가 진행됐다면, 이제 본격적으로 법적인 제도화를 통해 안정적인 서비스 단계로의 전이가 일어나려는 수순이라 하겠다. 지난 달 디지털콘텐츠의‘이슈’코너에서도‘차세대 킬러 앱'LBS’뜨거운 감자’라는 내용으로 이에 대해 자세히 소개한 바 있기도 하다. 이번 모바일 핫토크에서는 이 LBS 관련 모바일 서비스들에 대한 전망에 대해 소개한다.

Digital Broadcast Service is being very popular and the delivery mechanism for digital broadcast content through IP network has progressed constantly, due to the advance of video and audio compression and network technologies. From these trends, in Korea, the commercial IPTV service starts in this year after the law related to IPTV is enacted last year. Since IPTV service, which integrates broadcast and communication services, can give an infrastructure for fusion of communication and interactive multimedia data service, IPTV service is attractive. Recently, by the advent of various wireless connection technologies and the mobile devices of high capability, Mobile IPTV, which has an advantage of not only IPTV but also mobile TV, has gained much interest. In this paper, we review a necessary ingredient for Mobile IPTV in the next generation wired/wireless convergence network environment which consists of heterogeneous wireless access networks. In addition, we propose the scheme for user mobility and service session mobility management using RTSP protocol and introduce the service gateway concept to guarantee the extension of IPTV service platform.

Currently information related service such as internet banking, chatting, social network services are quite well smeared into our daily life. Moreover, a rapid growth of service using smart devices brought an importance of security in internet services and a research activation of digital forensic in a crime investigation. This paper presented a previous digital forensic research trend and based on this, suggested a technology-strategy integrated digital forensic process platform, taking a mid-long term government leading ICT R&D strategy and ICT paradigm shift into account.

본 고는 스마트TV 광고 시장 및 기술 동향에 대하여 소개한다. 2012년은 디지털 방송 전환과 스마트TV, 3DTV 등 신규 서비스 출현 등으로 오랜 세월 집안의 강력한 엔터테인먼트 기기 중 하나인 TV의 변화가 본격적으로 시작된 해이다. 방송 미디어 서비스의 변화는 디지털 방송 전환에 따른 단순한 시청 품질의 향상뿐만 아니라, 양방향 서비스, 부가데이터 제공, TV 연계형 개인 휴대단말과의 동기화된 미디어 서비스 등 다양한 형태로 나타날 수 있다. 광고는 방송 미디어의 주 비즈니스 모델이며, 위와 같은 TV 환경의 변화에 큰 영향을 받을 것으로 예상된다. 변화에 대응하고 방송광고 시장의 활성화를 위해서는 광고 관련 법, 제도 정비, 표준화와 함께 광고 특화된 기술 개발이 필요하다. 광고 산업계에서 요구하는 기술 수요는 변화하는 미디어 환경에서의 광고물의 제작, 중개 및 유통, 소비, 효과 측정 및 분석 등 광고 생태계상의 전 영역을 포함하며, 각 영역에서의 당면한 기술적 이슈에 대해 소개한다.
