  • The COVID-19 pandemic can be deemed one of the greatest hardships faced by mankind in the 21st century. All industries have been severely affected and workers are still experiencing deep difficulties due to the changed working and living environment. Seafarers have been recognized by the international community as key workers since the pandemic began. They are also working internationally to establish a Level Playing Field through the protection of their rights through the Seafarers' Employment Agreement and the implementation of international labour standards. However, despite the obligations under international conventions to be implemented by State parties and the recommendations by international organizations, the rights of seafarers under the Maritime Labour Convention were violated were violated and their occupational safety and health of seafarers were further threatened throughout the pandemic. This article analyzes the impact of the international shipping industry and the implementation of the Maritime Labour Convention based on each country's measures during the COVID-19 pandemic. Furthermore, the amendments of the Maritime Labour Convention adopted through the fourth Special Tripartite Committee were analyzed based on the conference documents and reports to comprehend the implied meaning. The adopted eight amendments to the Maritime Labour Convention are expected to positively affect the seafarers' rights, safety and health in the future, but the international community's efforts should continue because the issues of maximum working hours, maximum service period on board, and the repatriation of seafarers still remain unsettled.

  • 노사정위원회가 경제위기 극복을 위한 고통분담의 대타협을 마침내 일궈냈다. 노동계ㆍ기업ㆍ정부 등 3대 경제주체의 대표가 지난 1월 15일 노사정위원회를 구성하고 20일 제1차 공동선언문을 발표한데 이어 2월 6일 협의를 마무리짓고 제2차 공동선언문을 발표한 것이다. 협의과정에서 계속된 철야회의, 팽팽한 의견대립, 일부 대표의 회의장 퇴장 등 우여곡절이 적지 않았다. 그러나 나라 전체에 걸친 신속하고도 근본적인 개혁의 단행없이는 도저히 극복할 수 없는 총체적 국가위기라는 데 인식을 같이 하고 공정한 고통분담으로 경제위기를 극복하고자 의견을 모았다.

Success Factors of Mediation: Labor Disputes (조정의 성공요인 : 노사분쟁의 경우)

  • This paper investigates the success factors of labor mediation using the Survey on the Problems and Improvements of Mediation Service by the Labor Relation Commission which was conducted by the Ministry of Labor in 2000. When the parties of labor and management which took mediation service belong to the manufacturing industry and the Minju-nochong, they are found to have less chance to change their negotiation attitude favorably toward agreement in mediation process and to adopt an agreement proposal made by the mediator. Those who took mediation service more frequently in the past tend to have lower chance to make use of mediation service successfully. Those who saw the mediators of their dispute to be qualified with fairness and expertise tend to have higher chance. As the time of mediation meeting lengthens, it is more likely for them to reach an agreement with assistance by the mediators.

An Economic Analysis of the Minimum Wage Commission (최저임금 결정구조의 경제적 분석)

  • This paper presents a model for the Minimum Wage Commission's decision process and analyzes the strategic actions of the participants in the process. The Minimum Wage Commission has used two ways of setting the minimum wage. The commission has voted either on the labor's against the management' final proposals or has voted on the public interest commissioners' proposal. According to the model, the minimum wage is determined at a level that is very close to or at a level preferred by the median voter among the public interest commissioners. But the probability of adopting labor or management proposal is ex-ante the same. Empirical evidence from the minimum wage decision process is consistent with the predictions of the model. The probability of adopting the labor's proposal in the minimum wage commission voting is not statistically significantly different from 50%. The model also suggests that the preference of the median voter among public interest commissioners determines the minimum wage level. Since the government appoints public interest commissioners and thus, in fact, the median voters, the government can decide the minimum wage level. This proposition is also consistent with data. The annual growth rate of the minimum wage under the progressive governments is higher than under conservative governments.

  • In April, 1995, ANC government was established in South Africa. The Black government set up Truth and Reconciliation Committee in November, 1995. The Committee investigated approximately 50,000 cases for 3years. Through this process, Black and White in SA could be united into one. Finally, the system of racial discrimination, lasting for about 300 years, was abolished. The Committee played a role as a social infra-structure, which was to perform and solidify democracy in SA. Reconciliation, agreement, Participation, equality, Communication, and Reformation of law system were practically implemented by the Committee. Many people evaluate TRC's activity, which had the reformative and democratic character of the object of investigation, investigative criterion, investigative process, and the approval of investigative result. But De Klerk evaluates that TRC retaliated the White with legal. J. Cronin evaluates that TRC transiently change democracy of the South Africa, and many other social movement groups had a negative view about TRC. But the Black and White in South Africa transformed 'discriminated society' into 'united one'. The Committee took the initiative in such a change. The Committee was not an organization needed for the policy, but the committee was the policy itself to change the former society to the new one. Now The ANC government was forwarding TRC's roles and functions to the truth and reconciliation bureau of the Justice Department for further action. The ANC government has to execute some policy for social reconciliation. Firstly, the government needs to build construction social and national system for making close investigation into the White's historical guilt. Secondly, it must be executed to TRC's recommendation pursuit social reform of social infra-structure in the South Africa. Thirdly, The government should execute policy for the Black's right as labors and social member. Lastly, the government must investigate still-remaining historic state violence and infringement of human right for social reconciliation.

A Study on the Improvement of Compulsory Arbitration System in Labor Dispute of Korea (한국노동쟁의에 있어서 직권중재제도의 개선에 관한 연구)

  • This article deals with the Improvement of Compulsory Arbitration System on Trade Union and Labor Relations Adjustment Act in Korea. If a labor dispute occcur, the settlement of labor dispute must be reached for the parties' own accord. The autonomy of the parties concerned is the fundamental principle in the settlement of labor dispute. If the Rights Which are guaranteed by art. 33 Constitutional Law belong to civil liberties, we should consider Trade Union Act as the restriction of basic rights. Arbitration is a procedure which permits the most positive intervention by the arbitrator. It is carried out by an arbitration committe which is composed of three arbitrators appointed by the chairman of the Labor Relations Commission. Compulsory arbitration system of the labor for parties should be improved. In case of necessary public enterprises, more strict requirements on assembly for labor disputes should be prepared and the government should support institutions to prevent labor-management disputes by educating experts on labor-management relations and improving the quality of arbitration.

표지인물과의 대화 - 서용교 국회의원(국회 환경노동위원)

  • "국가 또는 지자체는 환경전문공사를 다른 업종의 공사와 분리발주하여, 중소환경전문공사업체를 지원해야 합니다. 또 일정 금액 이하의 환경전문공사는 환경산업이 자리 잡을 수 있도록 일정기한 동안 대기업의 참여를 제한해야 합니다." 국회 환경노동위원으로 활동하고 있는 서용교 국회의원은 환경분야에도 대기업과 중소환경업체와의 상생의 길을 모색해야 한다고 강조했다. 서 의원은 이밖에도 폐기물 관련법 개정안 등 다수 입법발의 했다. 서용교 의원은 1968년 경상남도 밀양에서 태어나, 1993년 서울대학교 국사학과를 졸업했으며, 제18대 대통령선거 박근혜후보 중앙선대위 직능총괄본부 환경본부장으로 일 했었다. 제19대 국회의원 선거에서는 새누리당 부산 남구(을) 선거구 국회의원에 출마해 당선 되었다. 현재 서 의원은 국회 환경노동위원회에서 활동 중이다. 다음은 서용교 의원과의 인터뷰 내용이다.
