CONTENT PRISM / ETRI, 3D게임엔진 '드림3D' 개발

  • 한국전자통신연구원(ETRI) 3D 게임엔진 '드림3D'의 기술 이전료가 인하됐다. ETRI는 3D 게임엔진 '드림3D'의 기술 이전료를 당초 계약금 6000만원에 러닝로열티 2%를 받기로 했던 방침을 수정, 계약금 4000만원에 러닝로열티 1%로 하향 조정했다. ETRI는 이를 위해 기술이전 후 '드림3D' 개발진에 피드백을 전달, 3D 게임엔진 개선에 공헌할 것을 기술 이전료 인하조건으로 제시했다. '드림3D'는 정부가 세계적인 게임엔진을 개발, 저렴한 가격에 국내 업체에 공급함으로써 국내 게임개발 환경을 한 단계 끌어올린다는 목표 아래 ETRI 과제수행업체로 선정, 2년 만에 개발 완료한 '3D온라인 게임엔진'이다

  • The old sources of competitive edge and value added were land, labor, and capital. In today's knowledge-based economy in the 21st century, technology is attracting attention as a new engine of growth. That paradigm shift of world economy has resulted in the global spread of technology transfer and the gradual increase of trade of intangible goods including patents and know-how as well as tangible goods in international trade. An international license agreement is a representative form of technology transfer. In license agreements, the providers of technology keep their ownership of technology, allow the implementation of technology to the users of technology only for a certain period of time, and receive loyalty as a reward. Economic profit through such technology trade can be realized with the smooth implementation and termination of agreement. International license agreements are different from sales contracts, which represent international business transaction based on mutual obligation, in many aspects in that they target intangible goods of technology and aim for rent for a certain period of time. This study thus set out to examine issues that could be controversial in the main and individual obligation of the parties in international license agreements and provide implications helpful for the prevention of disputes in advance.

  • 본 연구의 목적은 정부출연연구소에서 연구개발된 기술이 민간부문에서 충분히 활용되지 못하고 있다는 문제의식으로부터 출발하여, 원천, 핵심기술의 확보가 국가경쟁력을 좌우하는 첨단기술경제시대에 막대한 국가자금으로 연구개발된 우수한 기술의 사장을 방지하고 궁극적으로 국가경제발전을 위한 전략적 기술이전 촉진 방안을 모색하는 것이다. 현재 국무총리산하 기초, 산업, 공공기술 연구회로 분류 조직되어 있는 3개 연구회 총 1개 정부출연연구소의 지난 10년간(1992-2001)의 연구예산규모, 보유특허수, 기술이전건수, 기술징수액, 기술실시계약서를 방문 조사하고 각 연구소의 기술이전전담조직의 실무자를 대상으로 설문 조사하여 설문 및 통계분석 결과를 토대로 기술이전관련 문제점 파악 및 기술이전 촉진을 위한 전략적 개선방안을 모색해 보았다. 먼저 기술이전 현황을 살펴보면 기술이전건수는 보유특허수의 3%미만, 기술료 징수액은 연구예산규모의 2%미만으로 기술이전 및 기술상업화율이 상당히 저조하다. 설문 및 통계분석 결과로부터 TLO 조직의 비효율적인 운영, 비전문성, 열악한 운영인력, 적극적인 기술이전을 위한 동기부족, 정부의 제도적인 지원부족, 기술실시계약서 조항들의 경직성 등을 기술이전 관련 문제점으로 도출해 낼 수 있었다. 이러한 문제점을 극복하고 기술이전 촉진을 위한 개선방안으로는 첫째, TLO 조직을 전략으로 개편해야 한다. 즉 기술이전 전담인력을 변리사, 전문 협상가, 연구원 둥 전문가들로 구성하여 지적재산권 관리, 기술평가, 시장조사, 기술마케팅, 사후관리 등을 효율적으로 수행해야 한다. 둘째, 정부의 정책적인 지원이 필요하다. 기술이전 전담조직에 대한 인센티브 시스템 기술이전을 위한 특별예산 편성 등을 정책적, 제도적으로 도입하는 등의 적극적인 지원이 요구된다. 셋째, 기술실시계약서 조항들을 기술실시자의 실질적인 기술 상업화에 도움이 되고 기술 유출 및 기술사장화를 방지하는 방향으로 개선하여야 한다. 특히, 전용실시권과 실시대가, 기술실시 및 지적재산권 관리와 관련된 제반 비용의 부담비율 등을 보다 유연하게 개선하여야 한다. 본 연구는 정부출연연구소에서 민간부문으로의 기술이전만을 고려하여 기술이전의 중요한 요소인 민간부문에 대한 고려가 전혀 없다. 따라서 보다 실질적이고 체계적인 결과를 도출하기 위해 민간부문을 고려한 연구가 진행되어야 한다고 생각한다.

  • As science and technology advanced, specialized and massive, development through mutual cooperation or research based on patent licensing such as material transfer contract, technology transfer contract etc are actively taking place to minimize or separate the cost and risk of R&D. In R&D, such mutual work can enjoy the merit of division of labor by effectively allocating resources and manpower to accomplish its goal. Inevitably, however, there are also many possibilities of disputes regarding the ownership and use of intellectual property rights resulting from such mutual/post-studies, or inventions upgraded by using prior patents. The case reviewed by this paper is noticeable regarding the recent trend of upgraded inventions. In the case, a pharmaceutical company conducted tests/assessments on the complete technology of patent owned by a university on the premise of transferring the technology, and then terminated the technology transfer contract due to reasons of toxicity. The university then filed a damage claim suit against the company for infringing the contract. This is a dispute case betw een a university which developed a potential ingredient for new medicine and a pharmaceutical company which agreed to transfer and receive the technological later on. Regarding the upgraded inventions of source patents, this case has many implications on the protection of prior patents, research contract, and research security to protect the accomplishment of research. This paper reviews the subject ruling and the protection of upgraded patents and source technologies. As critical notes, the paper also summarizes the major issues of case ruling to observe the standard of ruling patent infringement related to the extortion of upgraded patents. Then, through the ruling of the case above, the paper suggests implications and future strategies.

  • With regard to the development of new drugs, what is most important for a Korean Biotech, where no global sales network has been established, is decision-making related to out-licensing of new drugs. The probability of success for each clinical phase is different, and the licensing amount and its royalty vary depending on which clinical phase the licensing contract is made. Due to the nature of such a licensing contract and Biotech's weak financial status, it is a very important decision-making issue for a Biotech to determine when to license out to a Big Pharma. This study defined a model called 'optimal timing for out-licensing of new drugs' and the results were derived from the decision tree analysis. As a case study, we applied to a Biotech in Korea, which is conducting FDA global clinical trials for a first-in-class new drug. Assuming that the market size and expected market penetration rate of the target disease are known, it has been shown that out-licensing after phase 1 or phase 2 of clinical trials is a best alternative that maximizes Biotech's profits. This study can provide a conceptual framework for the use of management science methodologies in pharmaceutical fields, thus laying the foundation for knowledge and research on out-licensing of new drugs.

  • New drug development requires 10 to 15 years of long time and more than $ 1 billion in funding, ranging from basic research${\rightarrow}$preclinical medicine${\rightarrow}$clinical medicine${\rightarrow}$product approval${\rightarrow}$sales. Many new drug development bio-venture companies will continue to pursue new drug development with funds secured through listing on the securities market. This study focuses on the impact of the listing on the market of bio-venture companies in the development of new drugs. It is necessary to determine whether the increase in registered patent, preclinical, clinical and technology transfer contracts at the time of listing (D) The results of this study are as follows. We also analyzed whether the registered patent, preclinical, and clinical effects had significant effect on technology transfer contracts at two years after listing and listing. The results of the analysis are as follows. First, Korea's new drug development bio-venture firms increased their registered patents but did not increase their pre-clinical, clinical and technology transfer contracts. Second, at the time of listing and two years after listing, pre-employment has a significant effect on Korea's technology transfer contracts and has a significant effect on overseas technology transfer contracts. However, registered patents and clinics have significant influence on technology transfer contracts. Korea 's new drug development bio-venture firms showed patent increase despite the stock market listing, but pre-clinical, clinical and technology transfer contracts did not increase. In order to strengthen technological commercialization of new drug development bio-venture companies in the future, it is required to establish R & D strategy for efficient use of IPO subscription funds, open innovation through strengthening industry-academia-partnerships, and more sophisticated preclinical and clinical strategy establishment.

An Analysis and Improvement Plan of the Technology Transfer Efficiency for Public Institute -Focusing on Dynamic DEA Model- (공공연구기관의 기술이전 효율성 분석 및 향상방안에 관한 연구 -동태적 DEA 모형을 중심으로-)

  • 본 연구는 공공연구기관의 기술이전 효율성을 분석하기 위해 효율성 분석기법인 DEA를 활용하였다. 투입요소로 연구비, 연구인력, TLO 인력, TLO 운영비 네 가지를, 산출요소로 기술이전 계약건수, 기술이전 수입료 두 가지를 선정하여 기술이전 효율성을 산출하였다. 기술이전 효율성에 영향을 미치는 변수로 지역적 위치, 연구기관 유형, 민간부문 연구개발비 비중, 인센티브 제도 등을 고려하여 산출된 효율성을 비교하였다. 본 연구의 분석을 통해 다음의 4가지 시사점을 도출하였다. 첫째, 연구기관 지방이전 시 먼저 인프라를 구축하고 산학연협력이 제대로 이뤄질 수 있는 환경을 조성해야 한다는 것이다. 둘째, 연구기관별로 설립 목적에 맞는 R&D를 수행할 수 있도록 해야 한다. 셋째, 민간수탁 증대가 R&D 효율성(기술이전 효율성)과 직접적으로 연결이 될 거라는 단편적인 생각은 버리고 폭넓은 의견수렴과 심층적 조사가 필요하다. 넷째, 인센티브 제도나 규정을 운영함에 있어 TLO 인력에게 직접적인 동기요인으로 작용할 수 있는 장치를 만들어야 한다. 본 연구의 분석을 통해 정부 연구기관들의 기술이전 효율성에 대한 이해를 높이고, 도출된 시사점을 바탕으로 국가 R&D 체계를 개선하는데 유의미한 정책의 개발이 있을 것으로 기대한다. 또한 공공연구기관의 기술이전에 대한 관심과 논의가 확대되고, 향후 축적될 자료를 활용한 정교한 연구가 활발히 이어지기를 희망한다.

  • The purpose of this paper is to examine the several points at issue in international technology transfer contract from licensor's and licensee's perspectives, and to refer them when the licensor and the licensee draw up the contract. This author analyzed the critical points of the related provisions of ICC Model International Technology Transfer Contract(2009) by citing the explanations of the Introduction of the Model Contract. The provisions of the Model Contract are generally divided into two categolies; specific conditions and general conditions. This author selected four topics in the specific conditions; Contents of the Contract, Royalty, Modification and/or Improvements of Products, and Territory and Competition. Likewise this author selected three topics in the general conditions; Resolutions of Disputes, Applicable Law and Taxes. Both parties need to be mindful of the following points in the above topics, when they draw up the contract. First, both parties should make the definitions of special terminologies clear, which are included in the Contract. Second, before the parties sign the Contract, they should check any approvals to be necessary by the both countries' governments. Third, for the calculation of the royalty, they should clear the criteria, the scope, and the object. Fourth, as the local laws or regional laws regarding the territory limitation and taxation are mandatory, any provisions of the Contract should not be inconsistent with them. Therefore, both parties should check before-hand the local laws or rules related with the provisions of the Contract. Fifth, when the parties draw up the Contract, they should examine the Provisions of Dispute Resolution in consideration of the Governing Law. Thus both parties decide to make the technology transfer contract, the three aspects namely profitability, legal conflict with mandatory rules, and sustainability of the business resulting from the Contract should be examined in advance, and then proceed the business using the technology transfer.

  • Under the knowledge-based economy, the function of university as an institution to create and diffuse new knowledge and technology is emphasized than ever before. Today, universities around the world find themselves going beyond the traditional roles of research and teaching to drive the development of local economies through collaborations with industry. This study aims to examine the university-industry collaboration and identify the aspects of knowledge transfer and exchange between university and external agencies and intends to explain in particular how the knowledge transfer of the university affects the innovation and competitive advantage of regional businesses. The analysis on the case study of Chonnam National University focusing on the knowledge transfer, in particular examined through the contracted or commissioned researches suggests that only a small portion of the knowledge generated by the university is transferred to Gwangju and Jeonnam region, thus it can be seen that knowledge transfer of Chonnam National University partially affects the development of the regional economy. However, it is analyzed that this knowledge transfer differs somewhat depending on the client's sectors and the contents of research contracts.

  • The industrial technology (including trade secrets), which is commonly understood as systematic and applied technical knowledge, can be transferred to third parties by contracting for the transfer of technology or by granting of a licence. The activity of industrial espionage, due to the gradual increase of the economic interests of intellectual property, is displaying intensively in order to gain advanced technology information. With our outstanding high technology, but compared to the level of the advanced countries, the technical protection systems, the legal protection measures and the systematic management thereof may still be insufficient. Our industrial technology outflow abroad, due to the vulnerability to the security control system in our country, has been increasing since the 2000. Computer software and SNS, such as smart devices, appear as a rapid change in the technical information environment. In order to minimize the dead zone of a new industrial security, the country's organic activity is being conducted. In 2006, Industrial Technology Outflow Prevention and Protection Law was enacted, which emphasized the responsibilities of the country. In this paper for the economic entity's efforts to prevent technology leakage oversea, I have looked to how the industrial technology can be protected in terms of national security and economic benefits of our enterprises. To solve the above-mentioned problems hereof, Korean government should willingly establish a reliable legal system for supporting to enterprise's operations, and Korean companies should autonomously introduce a synthetic technology protection system and incorporate the confidentiality clauses in an international transfer of technology agreement with third parties.
