Examining the Disparity between Court's Assessment of Cognitive Impairment and Online Public Perception through Natural Language Processing (NLP): An Empirical Investigation (Natural Language Processing(NLP)를 활용한 법원의 판결과 온라인상 대중 인식간 괴리에 관한 실증 연구)

  • This research aimed to examine the public's perception of the "rate of sentence reduction for reasons of mental and physical weakness" and investigate if it aligns with the actual practice. Various sources, such as the Supreme Court's Courtnet search system, the number of mental evaluation requests, and the number of articles and comments related to "mental weakness" on Naver News were utilized for the analysis. The findings indicate that the public has a negative opinion on reducing sentences due to mental and physical weakness, and they are dissatisfied with the vagueness of the standards. However, this study also confirms that the court strictly applies the reduction of responsibility for individuals with mental disabilities specified in Article 10 of the Criminal Act based on the analysis of actual judgments and the number of requests for psychiatric evaluation. In other words, even though the recognition of perpetrators' mental disorders is declining, the public does not seem to recognize this trend. This creates a negative impact on the public's trust in state institutions. Therefore, law enforcement agencies, such as the police and prosecutors, need to enforce the law according to clear standards to gain public trust. The judiciary also needs to make a firm decision on commuting sentences for mentally and physically infirm individuals and inform the public of the outcomes of its application.

  • As the core infrastructure to lead technical innovation for the fourth industrial revolution, economic value and utilizations of radiowaves are increased rapidly. The objectives of this study are to recognize the growing trend of radio stations that transmit information using radiowaves, a limited resource of the country, and to propose developed plans for the radio stations operation system in line with the changing radio technology and use environment. To be specific, the detailed implementation procedures and methods of the system were derived in accordance with the government's plan to convert the complete inspection of radio stations into a SDoC(Self Declaration of Conformity) by the telco. SDoC is a policy that grants autonomy and responsibility for radio waves interference management to existing telecom operator recognized as having radio stations operating capabilities. It has significance in that the function of radio stations inspection, which is a representative technical regulation, is efficiently distributed to the government and the private sector. This study has significance in providing reference for expediting deregulation in the radiowaves management policy.

  • After participating in the Second Boer War in 1899, the Australian Army participated in world wars such as World War I, World War II, the Korean War, and the Vietnam War. To overcome the decline in the social recognition of soldiers and the continuous shortage of troops caused by the protracted war, the status and role of female personnel were expanded. The use of female manpower, which started as medical support during the Second Boer War, expanded to combat support missions such as communications, maintenance, driving, secret document management, and radar surveillance during World War II. After the Vietnam War, the Chiefs of Staff of the Australian Army, Navy and Air Force established a committee to expand women's participation in the military, improved service conditions for female personnel and supplemented regulations so that they were treated as soldiers, not women, and reached a turning point in expanding the role of female personnel in the Australian military. As a result, all combat positions, including special forces, were opened to women in 2014, and a plan was established to increase the proportion of women in each service by 2030. Like the Australian military, South Korea is also experiencing a demographic cliff and shortage of troops due to the continuing low birthrate problem. Numerical Ages and Petrological Characteristics of the Basalts designated as Natural Monument, Korea (국내 천연기념물 현무암체들의 형성시기와 암석학적 특징)

  • We investigated the radiometric ages and petrological characteristics of basaltic rocks with columnar joints, basalt gorge, pillow lava, and mantle xenolith, from the geoheritages designated as Natural Monuments of Korea in recognition of their historical, academic, and scenic excellence. A total of 7 Natural Monuments were selected. They are 'Basalt gorge along Daegyocheon Stream of Hantangang River', 'Basalt gorge and Bidulginangpokpo Falls of Hantangang River, Pocheon', 'Pillow lava in Auraji, Pocheon' distributed along the Chugaryeong Fault System, 'Peridotite xenolith-bearing basalt in Jinchon-ri Baengnyeongdo Island, Ongjin', 'Columnar joint in Daljeon-ri, Pohang', 'Columnar joint in Yangnam, Gyeongju', and 'Columnar joint along Jungmun and Daepo Coasts, Jeju'. They ranged in age from the Cenozoic Neogene Miocene to the Quarternary Pleistocene. Based on the composition of major elements, Hantangang Basalt corresponded to trachybasalt, Daljeon Basalt to phonotephrite, Eoil Basalt to sub-alkaline basalt, and Daepodong Basalt to alkaline basalt. And in the composition of trace and rare earth elements, only Eoil Basalt showed the characteristics of arc basalt, while the others showed the characteristics of oceanic island basalt.

  • This study investigated how quality outdoor play is implemented in preschools in England and Finland. The four preschools in each country which were known as high quality in terms of outdoor play were selected as samples. The researcher visited these institutions twice, once in warm season and once in cold season as the outdoor play is implemented differently according to the weather and seasons. She observed children's outdoor play, the environment of outdoor areas, resources and materials provided, the management of outdoor areas in terms of time and space. She also interviewed with the educators in order to find out their perspectives on the importance and values of outdoor play. The results showed that the outdoor areas of these preschools were characterized as 'towards nature', and the outdoor play was implemented for 'wellbeing and health'. The outdoor areas were opened in all weathers and risky play was allowed. However, challenges and safety were co-existed by achieving balance between proper safety check and challenging and risky play. They pursuit the integration of indoor and outdoor activities, beyond just simple outdoor play, through constitution of a variety of areas and various resources and materials in outdoor environment. They encouraged children's autonomy and independence through child-initiative play and activities among children by regarding children's interests and choices. In preschools in our country, we need to consider these characteristics of outdoor play in England and Finland in order to promote children's wellbeing and health, connection and extension of indoor and outdoor play and activities, children's initiatives, imagination, creativity, and problem-solving capacity.

A Study on Kim, Yong-Hwan's Works of Art in Japan: Focusing on the Illustrations between 1930s and 1940s (김용환의 일본에서의 작품 활동 연구 : 1930~40년대 삽화를 중심으로)

  • Kim, Yong-Hwan is a one of the South Korean major cartoonists between 1940s and 1960s. Kim, Yong-Hwan drew a variety of genres from children's cartoon to current-affair cartoon. Furthermore, Kim, Yong-Hwan took the lead in publishing cartoon magazine and newspaper after the Independence, and has been highly appreciated as a pioneer of Korean cartoon. Kim, Yong-Hwan created many works in the fields of illustrations, Oriental painting, history painting, caricature, etc. After going study for painting to Japan, Kim, Yong-Hwan made his debut as an illustrator called Kita Koji in Japan. However, not much is known about his works in Japan, only there is a simple data about his Japan period and some pieces of illustration during Japan years. In this paper, I examined in detail about Kim, Yong-Hwan's work activity in Japan which has been little known in Korea for a long time. I studied on illustrations in magazines and books which he drew in the name of Kita Koji, on the basis of the data of the National Diet Library of Japan. I could know that Kim, Yong-Hwan worked actively in a diversity of publishers and magazines. In addition, I could realize that many magazines in which Kim, Yong-Hwan drew illustrations were very popular ones. This demonstrates that Kim, Yong-Hwan was much recognized in Japan for his talent. However, a large number of Kim, Yong-Hwan's illustrations were published from late 1930s to mid-1940s. This period was the years that Japan concentrated all her energy for World War II. All the publishing were severely censored during this period. A majority of publishing in this period supported Japanese militarism, and glorified Japan's war policy. Kim, Yong-Hwan's illustrations were no exception, too. It was really sorry about his activity during his Japan period. This essay means a lot to a field of cartoon studies in terms of a collection of materials during Kim, Yong-Hwan's Japan period. Besides, I think that henceforth, this paper can contribute to a follow-up study on Kim, Yong-Hwan' work and his broad background.

The Present and Future for the Protection, Management and Planning of Landscape in the Country - A Perspective from Holism - (국토경관 보호·관리·계획의 현재와 미래 - 전체론의 관점을 중심으로 -)

  • Nowadays, in the European countries, landscape is spoken of its importance as often as environment, by those who are engaged in such fields as politics, administration, research and civil society. In Korea, while recognizing such an international trend, academics and administrators have made a series of efforts to reflect landscape concept on a variety of policies. However, it is recognized that the effects of these policies have not been satisfactory. Under these circumstances, this paper aims to examine the complex values and multiple meanings in the landscape, which have been discussed by landscape experts in the European countries. Then, it aims to the explore the future direction of policy and research on the landscape to be pursued in Korea, where there is relatively less interest in the issues of landscape. It is argued that landscape should be approached and understood from a holistic perspective, because it is a very complex concept with multiple meanings that have been coined differently depending on the situation. All the academic fields, involved in the landscape research, should try in co-operation to develop the comprehensive approach rather than the inter- and multi-disciplinary approach to the landscape study. In Korea, moreover, it is also necessary in the legislation to recognize the fact that degradation and retreat in the quality of landscape would make a negative effect on the quality of human daily life. Natural and cultural heritages contained in the rural landscape are also now in danger of disappearing. These heritages, therefore, should become an important subject for research and policy on landscape before the countryside is completely evacuated after the aging population die out. To make this happen, it is very urgent that evaluation and classification of landscape character should be undertaken from the holistic perspective, which is equipped with a methodology overcoming as well as encompassing the boundaries of academic fields. It is also equally very urgent that education on landscape should be provided to the politicians, citizens and students as well as the officials dealing with landscape matters. Finally, government should strive to make the landscape concept penetrate deeply as well as widely into the spatial planning and legislation process while designing and implementing a comprehensive landscape policy at the national level.

Legal status of Priave Transaction Regarding the Geostationary Satellite Orbit (지구정지궤도의 사적 거래의 국제법상 지위에 관한 연구)

  • The rights and obligations of the Member States of ITU in the domain of international frequency management of the spectrum/orbit resource are incorporated in the Constitution and Convention of the ITU and in the Radio Regulations that complement them. These instruments contain the main principles and lay down the specific regulations governing the major elements such as rights and obligations of member administrations in obtaining access to the spectrum/orbit resource, as well as international recognition of these rights by recording frequency assignments and, as appropriate, any associated orbits, including the geostationary-satellite orbits used or intended to be used in the Master International Frequency Register (MIFR) Coordination is a further step in the process leading up to notification of the frequency assignments for recording in the MIFR. This procedure is a formal regulatory obligation both for an administration seeking to assign a frequency in its network and for an administration whose existing or planned services may be affected by that assignment. Regulatory problem lies in allowing administrations to fulfill their "bringing into use" duty for preserving his filing simply putting any satellites, whatever nationlity or technical specification may be, into filed orbit. This sort of regulatory lack may result in the emergence of the secondary market for satellite orbit. Within satellite orbit secondary market, the object of transaction may be the satellite itself, or the regulatory rights in rem, or the orbit registered in the MIFR. Recent case of selling the Koreasat belongs to the typical example of orbit transaction between private companies, the legality of which remains doubtedly controversial from the perspective of international space law as well as international transaction law. It must be noted, however, that the fact is the Koreasat 3 and its filed orbit is for sale.

A Study on the Access in the Government Archives & Records Service of Korea (한국 정부기록보존소의 역사기록물 공개에 관한 검토)

  • The ultimate goal of preserving and maintaining the records is to use them practically. The effective use of records should be supported by the reasonable recordskeeping systems and access standards. In this report, I examined the Korean laws and administrative systems related to the public records access issues. After I pointed out major problems of the access laws, the Government Information Opening Act (GOIA), and the problems in practices, I suggested some alternatives for the betterment of the access system. The GIOA established "eight standards of exemption to access" not to open some information to protect national interests and privacy. The Public Records Management Act (PRMA) applies to the archives transferred to "professional archives." The two laws show fundamental differences in the ways to open the public records to public. First, the GIOA deals with the whole information (the records) that public institutions keep and maintain, while the PRMA deals with the records that were transferred to the Government Archives. Second, the GIOA provides with a legal procedure to open public records and the standards to open or not to open them, while the PRMA allows the Government Archives to decide whether the transferred records should be opened or not. Third, the GIOA applies to record producing agencies, while the PRMA applies to public archival institutions. One of the most critical inadequacies of the PRMA is that there are no standards to judge to open the archives through reclassification procedure. The GIOA also suggests only the type of information that is not accessible. It does not specify how long the records can be closed. The GARS does not include the records less than 30 years old as its objects of the reclassification. To facilitate the opening of the archives, we need to revise the GIOA and the PRMA. It is necessary to clearly divide the realms between the GIOA and the PRMA on the access of the archives. The PRMA should clarify the principles of the reclassification as well as reclassifying method and exceptions. The exemption standards of the GIOA should be revised to restrict the abuse of the exemption clauses, and they should not be applied to the archives in the GARS indiscreetly and unconditionally.

Legal Status of Space Weaponization (우주공간에서의 무기배치와 사용의 법적 지위)

  • The protection of space asset has been new major cause of space militarization. For such purpose, it has been officially announced that a policy of deterring and denying any adversaries from accessing the outer space. Space militarization is to be conversed into a new concept of space weaponization. The USA has announced its policy of space weaponization, while China and Russia have not revealed their plan or policy. Latter States, however, have proposed a draft treaty limiting the deployment of warfare in the outer space. The terms of the Outer Space Treaty, reflecting three significant United Nations General Assembly resolutions from the 1960s, support the position that ground rules must be observed in the exploration and the use of outer space, particularly in the absence of specific space law rules. Yet the combination (and culmination) of these two approaches to the legal regulation of outer space-specific rules as and when agreed by the international community and the translation of principles developed for terrestrial regulation to outer space-still leaves much room for uncertainty and exploitation for military and strategic purposes. As space weaponization may contribute to deterring the use of weapon, it may be not against the UN Charter Article 2(4). If space weaponization might generate the space debris such that the outer space is no more available for exploration and use, it is against the proportionality principle and discrimination principle enshrined in the laws of the war. But, if the limitation upon the kind and use of space weaponization is agreed among the States, then the space weaponization may not be against the laws of the war, and be considered permissible within the rationale of limited war.
