The purpose of this study is to test the relationships between transaction justice and partnership, between transaction justice and project performance, and between partnership and project performance in the selection process in which a prime contract company chooses a subcontractor. For the empirical study, we chose a research model based on related studies and surveyed the real contractors in the field of construction. The results of this study are as follows. First, the partnership has a statistically significant positive effect on the interactional justice, procedural justice, and distributed justice. Second, the project performance is affected by the interactional justice and procedural justice. Finally, the transaction justice has a directly positive relation with the project performance and an indirectly positive relation with the project performance through partnership. In this study, we carried out empirical research into the relationship between transaction justice and project performance through partnership.

Staples - Office Depot 합병사건에서 연방거래위원회는 가격 자료에 의거한 계량분석 방법을 동원하여 대형 사무용품 매장을 통한 소모성 사무용품 판매시장이 별개의 시장이라는 점을 보여줌으로써 위원회 결정의 근거를 삼음과 동시에 법원을 설득하였고, 이를 통하여 공정거래 분야에서 경제분석의 중요성과 효과를 새삼 인식하는 계기가 되었다.

공정거래위원회(위원장 권오승)는 대 · 중소기업간 협력증진을 위한 기반 조성을 위해 「대 · 중소기업간 상생협력을 위한 바람직한 계약체결 가이드라인」, 「협력업체 선정 · 운용 가이드라인」, 「하도급거래 내부심의위원회 설치 · 운용 가이드라인」을 제정하여 기업의 사용을 권장키로 했다. 이 가이드라인은 의무사항이 아닌 권장사항으로 공정위는 기업들이 이를 사용할 경우 하도급벌점 감점 등 인센티브를 부여(과징금 부과시 감경, 과거 3년간 누적벌점 감점)키로 했으며 건교부 등 관련부처에서도 인센티브를 제공할 예정이다. 또한 하도급의 시정조치 강화 및 하도급거래 우수업체에 대한 인센티브 제공을 위해 「하도급거래공정화지침」(이하 공정화 지참)도 개정했다.

This study shows that it is favorable for Korean companies to maintain fairness and authenticity trading relationship with trading companies. It suggests that a positive reputation can be secured, trust relationships can be built, and transaction costs can be reduced. For this purpose, research hypothesis was established, questionnaires were collected for domestic companies, and a hypothesis test was conducted. As a result of the research hypothesis test, the perception of transaction fairness and the perception of transaction authenticity have a positive effect on reputation, and the reputation has a positive effect on trust. Trust has a positive effect on the reduction of transaction costs, and reputation and trust play a role in the perception of transaction fairness and transaction authenticity and the reduction of transaction cost, and trust is a parameter between reputation and reduction in transaction cost. Do it. In order for sustainable management activities to be carried out for Korean companies, it is necessary to improve fairness and authenticity in business relations. It is important to have a positive reputation. It has been demonstrated that securing a positive reputation can develop into a trust relationship and ultimately lead to a decrease in transaction costs.

행정지도에 대한 공정위의 기본입장은 먼저 행정지도의 근거가 법령에 명문화되어 있고 실제 행정지도의 목적, 수단, 내용 및 방법 등이 당해 법령의 규정에 합치되는 경우에는 이에 따른 사업자 또는 사업자 단체의 행위는 공정거래법 제58조에서 규정한 법령에 따른 정당한 행위에 해당되므로 원칙적으로 공정거래법상 문제되지 않는다고 할 것이다. 그러나 행정지도가 개별 법령에 근거 없이 이루어진 경우 이에 따른 사업자 또는 사업자단체의 행위가 부당공동행위로 인정될 때에는 원칙적으로 공정거래법에 위반된다고 할 것이다.

기업의 구조조정을 통한 국가경쟁력 향상을 위하여 최근 결합재무제표의 도입, 지배구조의 선진화, 외국인에 대한 적대적 M&A 허용 등이 진행됨에 따라 출자총액제한제도를 폐지하고 계열회사간의 채무보증을 조기에 해소하기 위해 신규채무보증을 금지하고 기존 채무보증은 2000년 3월말까지 완전해소토록 하는 내용을 주요 골자로 하는 공정거래법 제6차 개정안이 지난 1998년 2월 15일 제188회 임시국회에서 통과됐다. 이번에 개정된 공정거래법은 공시한 날부터 시행되는 출자총액의 제한 부분을 제외하고는 1998년 4월 1일부터 시행된다.

대한설비건설협회는 하도급자인 회원사의 권리보호와 원도급자의 불법 불공정 하도급 거래행위를 개선코자 국회, 국토교통부, 공정거래위원회 등 여러 관련 부처에 지속적으로 제도개선을 추진하고 있다. 특히, 원도급자가 하도급자에게 일방적으로 불이익을 강요하는 부당한 특약을 설정하거나, 원도급자의 하도급지급보증 사고발생 시 하도급자의 보증금 청구에도 보증기관이 보증금을 지급하지 않아 하도급자인 회원사의 피해가 빈번함에 따라 제도개선을 추진해 왔다. 이러한 노력으로 최근 공정거래위원회에서는 하도급법을 개정하여 하도급공사의 부당특약 금지조항을 신설하고, 하도급대금지급 보증기관의 보증금 지급사유를 법률에 명시하게 됐다.
