Guidelines for Provisional Sum in Public Construction Projects (국내공공공사의 잠정금액(Provisional Sum) 집행기준)

  • Recently, the term 'Provisional Sum(PS)' has been used in domestic public construction projects especially for civil works. Nevertheless, the guideline for PS has not been clearly stipulated in contract documents or construction-related laws. Due to these ambiguous contract situations, disputes between owners and contractors are surely expected to settle down PS in construction projects. This paper focused on suggesting a guideline to settle down PS in these ambiguous contract situations. The guideline suggested in the paper is expected to be used as a reasonable method to settle down PS avoiding nonproductive disputes about PS in construction projects

The Rationalization of Contract Sum Adjustment through Case Study of Price Fluctuation Adjustment based on Index Adjustment Method (물가변동조정 사례분석을 통한 지수조정방법기반 계약금액조정 합리화방안)

  • In case of long time progressive construction work, we need contract sum adjustment due to escalation for a period of works and the process of applying, consistent and obvious criterion is required. In this study, it were attempted to figure out problem and study this rational improvement by giving examples based on core activities of escalation adjustment. Based on literature study and legal system analysis, we classified processes of contract sum adjustment for escalation and defined 20 core activities for each process. From this measured variable, we carried out case study by giving 37 examples of escalation. As a result of case study, problems of each process was found and we suggested rational improvement. As this study, providers will be able to waste budget and the other will be given smooth escalation adjustment.

법령과고시 - 정부시설공사 계약예규 개정

  • 기획재정부와 행정안전부는 계약 예규를 개정하고 지난 4월 2일부터 시행에 들어갔다. 기획재정부는 이번 계약예규 개정을 통해 등록기간 3년 미만 업체가 공동수급제에 참여할 경우 만점기준을 완화했고, 1억 이상 3억 미만 전문공사의 경우 만점기준이 발주금액에 대한 '3년 실적의 1/2배 이상'에서 '평가면제'로, 3억 이상 50억 미만 전문공사의 경우 '3년 실적의 2배 이상'에서 '1/2배 이상'으로 평가방법을 완화했다. 또한 발주기관에서 공공공사 예정가격을 산정할 경우 반드시 최신 표준품셈을 사용하도록 의무화했으며, 적정 노무비 보장 심사 강화 방안으로, 최저가낙찰제 공사에서 업체가 제출한 노무비가 발주기관에서 산정한 노무비의 80% 미만일 경우 탈락된다. 기획재정부는 이번 개정으로 시공경험이 부족하지만 기술력 등이 우수한 신설 중소 업체가 공공공사에 참여할 수 있는 기회가 늘어날 것으로 기대하고 있으며, 최저가낙찰 시 과다한 노무비 삭감 등으로 인한 건설 근로자 소득감소 및 내국인 건설업 기피 등을 막을 수 있을 것으로 기대하고 있다. 한편 행정안전부는 이번 계약예규 개정을 통해 지방자치단체 입찰 및 계약관련 예규를 현행 11개에서 2개로 통합했고, 지자체가 발주하는 50억원 이상~100억원 미만의 공사의 경우 참가자격 적격심사 항목 중 자산회전율 평가를 삭제했으며, 신용평가 등급을 완화해 지방 중소기업들의 입찰 참가 기회를 확대하기로 했다.

A Study on the Analysis of Actual costs and Maintenance costs for Elemental Classification hierarchy (부위별 분류 체계를 통한 공사비 및 유지관리비 분석 - 교육 시설물을 중심으로 -)

  • The purpose of this study is to analyze maintenance costs and estimation of elemental costs for educational buildings. The adapted research method selected four school buildings in seoul region as BTL projects. On the basis of the selected case, the study suggested a model to establish a system for each parts and estimate analyzed construction costs and maintenance costs according to that system. According to the analysis, the study proposed a partial construction costs analysis table and maintenance costs table and analyzed proper construction costs and maintenances costs. The results of this study are as follows 1) The average ratio followed by calculation of partial construction costs of the four school buildings are as followings. The total construction costs is analysed 6,666million won and each part of average rations is structure 47.15%, exterior of building 8.34%, interior of building 23.37%, electricity & fire fighting facility 5.74%, water supply & healthy facility 4.27%, heating & water supply facility 5.25%, landscape 1.36%, civil engineering works 4.51%. 2)The average ratio followed by analysis of partial maintenance costs of the four school buildings are as followings. The total maintenance costs is analysed 4,309 million won and each part of average ratio is exterior of building 11.02%, interior of building 41.81%, electricity & fire fighting facility 14.81%, water supply & healthy facility 11.22%, heating & water supply facility 12.76%, landscape 5.75%, civil engineering works 2.63%.

  • In turn-key projects, escalation of cost by design errors is not allowed because a contractor prepares the design. Therefore, cost escalation by design errors results in increasing the cost of the prime contractor. The rate of profit decreases finally. In addition, design errors bring not only schedule delay but also serious quality problem by unknown errors. This study tries to dissolve problems, that of cost increase. process delay and a falling-off in quality by investigating cause of design errors and presenting a scheme for reducing design errors.

  • The bidding program uses statistical analysis method of the collected bidding information and the accumulated bidding results from the public/private sector; however, it is not easy to predict the accurate bidding price by winning the bid method through multiple lottery. Therefore, this paper analyzes the accuracy of the current state data of the electric construction bid from January 2015 to August 2019 acquired from the electric net, which is an electronic bidding site, We use MLP and RNN method, and proposes a technique to predict the bidding amount necessary for the winning bid by predicting the amount between the first and the lowest bidder.

  • 최근들어 냉난방시스템의 변화로 인하여 오피스텔, 원룸 등의 신축 및 개보수 공사에 시스템에어컨 등의 시공이 활발해짐에 따라 기계설비공사업을 등록하지 않은 장비제조 또는 판매업체가 시공하는 현상이 많아지고 있다. 이에 따라 대한설비건설협회는 건교부에“시스템에어컨의 설치금액이 1천만원 이상인 경우 기계설비공사업을 등록하지 않은 자가 설치∙시공할 경우 처벌조항”에 대하여 질의한 결과, 건교부가“냉난방 등을 조립∙설치하는 공사는 기계설비공사업의 업무내용에 해당되는 것으로 이를 어길 경우 1년 이하의 징역 또는 1천만원 이하의 벌금에 처한다”는 회신을 보냈다. 시스템에어컨이란 건축물에 냉방 및 난방을 하기 위하여 건물의 냉∙난방 시스템을 건물에 설치하는 공조시스템으로 냉∙난방을 위한 에너지원으로 가스(LNG, LPG)를 사용하는 GHP(Gas Engine Heat Pump)와 전기를 에너지원으로 하는 EHP(Electric Heat Pump) 방식으로 구분된다. 시스템에어컨을 설치하기 위해서는 압축기에 해당하는 실외기를 건물 외부에 설치하고, 여러 가지 타입의 다수의 실내기를 실내에 설치한 후 냉매배관과 응축수 배관을 연결, 시공해야 한다. 따라서 이러한 공사는 건설산업기본법시행령 별표의 1의 기계설비공사업의 업무내용에 포함어 있다. 대한설비건설협회가 질의한 내용과 건교부의 회신 내용은 다음과 같다.

  • Recently, the quantity of risk in construction project has been inflated due to the fact that current construction projects have been large and complicated. Therefore, a study on the risk management methods is necessary that can predict and respond to the need in complicated modern construction projects. In this study, the objective is to analyze the cause of accident in actual construction sites and develop a risk assessment model based on insurance claims records. To reach the goal of this study, first, the frequency and severity of accidents are analyzed the causes of accidents based on the classification; progress rate, season, and total construction costs. Second, a risk assessment model is developed by utilizing a multiple regression analysis. The dependent variable is loss ratio of material damage and three categories; natural hazards, geographic information, and construction method & ability, are used as the independent variables. The model's adjusted R-square is 0.455. The contributions of this study will be used as a material for a quantitative risk analysis model development and review of the construction risk factors for future study.

Improvement contract sum adjustment method caused by price fluctuation (물가변동에 의한 계약금액 조정방안 개선 기초연구)

  • Index adjusted ration method has been widely utilized in public construction secter for contract sum adjustment by price fluctuation. In this method. the Production Price Index are used for calculating the base ratio. but the PPI can't reflect the property of construction project in respect of the selected item and weight structure. In this research we prove the problem of using the index adjusted ration method in contract sum adjustment by price fluctuation. and improve it by using the construction cost index. which has the property of construction project. And the result. we figure out the difference between the PPI and CCI by $6.7\%$ in maximum value.

A Study on the Improvement of Long-Term Continuing Construction Contracts Dispute Using FGI (FGI를 활용한 장기계속공사계약 분쟁 개선방안 기초연구)

  • Given that most government contracts are based on a fiscal year, long-term continuing construction contracts require appropriate provisions as significant amounts of budget is supposed to be invested for several years. This study drew problems and improvements of the long-term continuing construction contracts by analyzing the contents of FGI and list of construction order. We found that a number of problems, such as the mismatch between laws and enforcement decrees, difference in calculating overheads due to the extension of construction period, many construction orders that are hard to see as budget efficiency and over investment in the final annual contract, were tangled up in the process. To solve the problems mentioned, we suggested several improvements as follows: (1) effect of total construction period and total amount should be guaranteed by a law, (2) it is suggested that the scope of long-term continuing construction contract is determined by a law, and (3) it should be clear about the calculation of overheads concerned with the extension of construction period as well as the estimation of construction period to prevent over investment in the final contract.
