건설정책 - 공공 건설공사 불공정 하도급계약 체결 제동

  • 정부가 공공 건설공사의 하도급계약 체결 자료를 일반에 공개하는 내용의 제도 개선을 추진한다. 불법 하도급을 통해 비자금을 조성하지 못하도록 하기 위한 것으로 발주기관에 거짓 하도급계약 자료를 제출하면 입찰참가자격이 제한된다. 국민권익위원회는 지난해 11월 28일 이런 내용을 담은 '공공 건설공사 불공정 하도급계약 개선 방안'을 마련해 기획재정부 등 8개 정부부처와 지방자치단체에 권고했다.

Influencing Factors Analysis for the Number of Participants in Public Contracts Using Big Data (빅데이터를 활용한 공공계약의 입찰참가자수 영향요인 분석)

  • This study analyze the factors affecting the number of bidders in public contracts by collecting contract data such as purchase of goods, service and facility construction through KONEPS among various forms of public contracts. The reason why the number of bidders is important in public contracts is that it can be a minimum criterion for judging whether to enter into a rational contract through fair competition and is closely related to the budget reduction of the ordering organization or the profitability of the bidders. The purpose of this study is to analyze the factors that determine the participation of bidders in public contracts and to present the problems and policy implications of bidders' participation in public contracts. This research distinguishes the existing sampling based research by analyzing and analyzing many contracts such as purchasing, service and facility construction of 4.35 million items in which 50,000 public institutions have been placed as national markets and 300,000 individual companies and corporations participated. As a research model, the number of announcement days, budget amount, contract method and winning bid is used as independent variables and the number of bidders is used as a dependent variable. Big data and multidimensional analysis techniques are used for survey analysis. The conclusions are as follows: First, the larger the budget amount of public works projects, the smaller the number of participants. Second, in the contract method, restricted competition has more participants than general competition. Third, the duration of bidding notice did not significantly affect the number of bidders. Fourth, in the winning bid method, the qualification examination bidding system has more bidders than the lowest bidding system.

  • 지방자치단체의 계약업무에 기초가 되는 지방계약법 시행령이 지난 11월 24일 공포되어 시행에 들어갔다. 이번 지방계약법 개정은 지난 해 12월 30일 개정된 국가계약법 시행령 제68조와 동일하게 제77조를 신설하여 '하자책임 구분이 용이하고 공정관리에 지장이 없는 공사에 대하여 기계설비공사와 같은 '설계서가 별도로 작성되는 공사로 명시함으로써 공공공사의 분리발주 활성화를 유도하는 내용을 담고 있다. 이로써 지방계약법에도 분리발주 허용 대상을 구체화 하고 발주기관의 장이 공사의 예산편성과 기본설계 등 사업의 계획단계부터 분리발주의 가능 여부 검토 조항이 명문화 됨으로써 지자체 분리발주가 더욱 활성화 될 것으로 예상된다. 이에 앞서 대한설비건설협회는 분리발주 법제화를 정부, 국회, 제18대 대선후보 등에 지속적으로 건의한 결과 박근혜 정부가 공공공사의 분리발주 법제화가 포함된 40대 중점 국정과제를 확정하고 공공공사의 분리발주 허용 대상과 활성화 조문이 포함된 국가계약법 시행령 제68조를 지난해 12월 30일 개정, 시행에 들어간 바 있다.

  • Many contractors have overlooked the construction contract general conditions and it was a bad construction practice. Today, construction project is very complex and complicated. This requires a networked contract document and results in a complicated contract conflict hardly to be solved. Therefore, to reduce the construction dispute and to enhance construction practice, clarification of definition of Owner, several conditions to be revised, insertion of design supervision were suggested in this paper.

A Study on Acquisition Processes in Public Libraries (공공도서관 도서구입 실태에 관한 조사연구)

  • This paper strives to examine the acquisition process in public libraries. It specifically attempts to survey the budget allocation, duties and organizational structures of acquisition departments in public libraries, and the overall process of book selection and acquisition. Data was drawn from a survey of 545 public libraries in the country. Specific statistics were gathered through literature and interviews to be analyzed, even though they were not very detailed in nature. In looking at the actual acquisition process, a thorough comparison on the backgrounds, outlines and characteristics of current projects and an analysis on the specifics of each project was also conducted.

Improvement of Contract Change Order System for the Fairness of Subcontracting in Public Construction Projects (공공건설공사의 하도급 거래 공정화를 위한 계약변경 제도개선 방향)

  • Subcontracting of construction is essential to carry out public construction projects. Subcontractor of the construction work shall enter into a contract with the original contractor without directly entering into a contract with the owner. Subcontracts are therefore greatly affected by the original contract with the owner. To protect subcontractors, the Fair Trade Act is enacted and the construction company's standard subcontracting contract is in operation. However, subcontracts are not properly reflected in the Government contract system, which deals with the relationships between the owner and the original contractor. In particular, the subcontractor may complain of difficulties at the public construction site as such procedures are not properly reflected in the construction work standard subcontract, although various procedures shall be carried out depending on the amount when change order occurs in subcontracts. Thus, the direction of improvement of subcontracting systems was proposed in the case of change order at public construction project sites as follows: First, the rights of subcontractors should be strengthened. Second, in order to resolve the information non-identity, subcontractors should have access to information related to subcontracts. Third, the status of subcontractor shall be guaranteed by reflecting the characteristics of the subcontract when the original contract for public works is concluded. Fourth, the dispute settlement method should be prioritized over litigation in order to fair subcontracting.

법령과 고시 - 표준시장단가(실적공사비) 제도 관련 계약예규 개정

  • 국가 발주 공사는 3월 1일, 지방자치단체 발주 공사는 3월 9일 예정가격을 작성하는 사업부터 표준시장단가 제도가 적용된다. 대한설비건설협회(회장 이상일)를 비롯한 건설관련 유관단체에서는 실적공사비의 불합리한 공사비 산정 기준 및 운영관행에 대해 폐지 건의를 지속적으로 해왔다. 정부는 이같은 건의를 받아들여 지난해 12월 17일 실적공사비 제도개선을 위한 공청회를 개최하고 개선안을 발표했으며, 이번 계약예규 개정을 통해 개선됐다. 이에 따라 실적공사비 제도를 대체하는 새로운 공공공사비 산정 방식인 표준시장단가 제도가 지난 3월 1일부터 시행에 들어감에 따라 기획재정부는 국가계약예규를, 행정자치부는 지방계약예규를 개정해 각각 지난 3월 1일과 3월 5일 공포하고 시행에 들어갔다. 각 개정 계약예규는 실적공사비의 명칭이 표준시장단가로 변경됨에 따라 용어를 수정했고, 실적공사비 제도 적용배제 범위를 신설했다. 또한 적용배제 공사범위는 300억원 미만 공사 중 100억원 미만 공사는 실적공사비(표준시장단가) 적용을 폐지하고, 100억원 이상부터 300억원 미만 공사는 2016년 12월 31일까지 한시적으로 적용하지 않는다. 정부는 100억원~300억원 공사에 대한 '실적공사비 적용 배제제도' 연장 여부를 2016년 하반기에 실적공사비 현실화 수준 등을 평가하여 재검토할 예정이다. 한편, 표준시장단가 제도는 공사비를 산정할 때 현행 계약단가 외에도 시공단가와 입찰단가 등 다양한 시장 거래가격을 반영하는 제도로, 지난 1월 22일 국가정책조정회의를 거쳐 확정된 '공공건설 공사비 적정성 제고방안' 후속조치의 일환으로 공공공사비 예정가격 산출방식의 하나인 실적공사비제도를 개선한 것이다.

  • Characteristics of Contactor's Defect Liability was too many discussed. But it's not clearly defined yet. Because recent Government Construction Projects are very complex and executed through long time, too many conflicts were appeared related to Contactor's Defect Liability. Therefore to analyse and to resolve the conflicts legal aspects of Contactor's Defect Liability stated in Civil Law and Government Contract Act was systematically compared. The result of this research is as follows : (1) Characteristic of Contactor's Defect must be regarded as a breach of Contract and be an incomplete contract implementation. (2) To decide the range of Damage, Characteristic of Defect must be regarded. (3) Contactor's Defect Liability must be effectual from the day of delivery. (4) Retainage must be added to secure the completion during the Contract Period and Defect Repairing Liability must be omitted in the Contract performance Security.

  • 장기계속건설공사에 있어 수급사업자에 대한 원사업자의 계약이행보증금 중도반환 규정이 신설됐다. 이에 따라, 연차별로 계약의 이행을 완료한 원사업자는 국가 등 공공발주자로부터 계약보증금을 반환받을 수 있는 날부터 30일 이내에 수급사업자에게 연차별 하도급계약이행보증금을 중도에 반환해야 한다.

  • Recently, interests for SRM have been increasing rapidly to automate the whole processes of supply chain from sourcing to procurement and improve the whole efficiency of supply chain by strategically managing the relationship with external partners (suppliers). The national procurement service of Korea is trying to build new paradigms by introducing SRM for improving the competitiveness of national public procurement service. For this, a new assessment model for evaluating and selecting suppliers with fairness and objectivity should be developed. In this paper, we propose a new SRM solution including a model that evaluates and grades of suppliers' capabilities of performing the contracts. We also explain the innovation of national public procurement system through this SRM solution.
