Construction of Aluminum Curtain Wall with 3D Elevation for TRUTEC Building (트루텍 빌딩의 3차원 입체 커튼월 시공)

  • TRUTEC building, which is located at DMC B block is zone, is just one the office building in Soeul. TRUTEC building is designed by Barkow Leibinger Architeken in Germany, has 5 stories under and 12 stories above and has been finished with the unique three dimensional curtain wall unit. Big trial to make unique elevation succeeded as getting rid of the typical plain curtain wall unit. In addition, aluminum bars are treated by the latest CNC machine in order to achieve 3D section. Construction of curtain wall is highly focused from the moment of contract to keep the schedule because the contract period is 18 months. Regular design meeting and technical meeting between stakeholders including construction manager, designer, engineer, consultant and so on have been held during the construction to minimize the risks from the unique elevation and trial. Step by step mock-up test (design mock-up and visual mock-up on site) has been performed before functional mock-up test.

  • This study investigates the issues in relation to the introduction of the fund-based Korean occupational pension, examining the development plans in the members' perspective. The strong drive from Korean government to introduce the fund-based governance seems to be a sort of strategy to expand coverage in occupational pension. It is not logical that the introduction of the fund-based scheme is likely to cause increase in earning rate and, what is more important is to set the conditions to implement the active investment decision. Also, because the introduction of the fund-based scheme may increase possibility of insolvency, it is necessary to strengthen beneficiary protection or funding rule but, in the short term, it is better to focus on funding rule rather than protection scheme. The introduction of the fund-based scheme suggests the direction that members can actively participate in occupational pension, which means that it is possible to operate occupational pension in the direction of intent of the system.

  • This paper reviews the practical operations and exceptions to the independent principle by analyzing the leading cases of English documentary credit transactions. A bank's undertaking in L/C transactions differentiates between underlying contract and other contracts. The autonomy principle is the key principle governing L/C, but this principle may be connected with unfair (unjust) payment. English Law is strongly influenced by the developments in American Law in the case of fraud, but traditionally, British courts has been very reluctant to interfere in banks' independent undertaking under the L/C. The position of British case law relating to fraud is based on Sztejn. In practice, British courts recognize fraud as an exception to the autonomy principle in which the case is sufficiently serious to render it unjust to permit the beneficiary to receive payment. British case law has historically taken a narrow approach toward intervention in the independent principle of documentary credit. Therefore, innocent parties including beneficiaries are protected by these regulations regarding fraud.

  • This paper described the contents of theme entitled "Domestic Legislative Problems on the Civil Liability of Air Carrier in Korea" including the current example of fourteen countries' legislation ((1) Great Britain, (2) United States of America, (3) Canada, (4)European Union), (5) Germany, (6) France, (7) Italy, (8) Spain, (9) Swiss, (10) Australia, (11) Japan, (12) People's Republic of China, (13) Taiwan, (14) North Korea) relating to the aviation law or air transport law. Though the Korean and Japanese aviation act has provided only the public items such as (1) registration of aircraft, (2) persons engaged in aviation, (3) operation of aircraft, (4) aviation facilities including airport, (5) air transport business, (6) investigate of aircraft accidents etc., but they could not regulated the private items such as the legal relations of the air transport contract (1) air passenger ticket, (2) air luggage ticket, (3) airway bill, (4) liability of air carrier, (5) amount of compensation for damage caused by aircraft accidents, (6)jurisdiction, (7) arbitration, (8) limitation of action, (9) combined carriage, (10) carriage by air performed by an actual carrier other than contracting carrier, damage caused by aircraft to the third parties etc. in their aviation act until now. In order to solve speedily the legal problems on the limitation of air carrier's liability and long law suit and disputes between wrongdoers and survivors etc, it is necessary and desirable for us to enact a new "Draft for the Air Transport Act" including the abovementioned private items. I would like to propose personally and strongly the legislation of "Draft for the Air Transport Act" in Korea in emphasizing the importance of ensuring protection of the interests of consumers air passengers and shippers in carriage by air and the need for equitable compensation between air carriers and survivors caused by the aircraft accidents such as the German Air Transport Act (Luftverkerhrsgesetz).

The Precaution Duty and the Product Liability for Adverse Reactions to the Contrast Media (조영제 부작용에 대한 주의의무와 제조물책임)

  • Contrast medium is a useful drug for radiological examinations and usability of it gradually increases while it has some inevitable adverse reaction and it is difficult to predict the occurrence and the degree of adverse reactions. Although the patient consented permission for the use of contrast media, the hospital could not be exempted from the responsibility for the adverse contrast media reaction. During radiological contrast media examination, the radiologist and the contrast media producer have the duty of precaution, prediction and avoid adverse results. In addition, they have reliabi lity of patient remedy for neglecting the duty. Since contrast medium are manufactured or processed as movable properties, the manufacturers are bound to the product liability if damages occur due to the defects in pharmaceuticals. In consideration of the characteristics of product liability, it is necessary to demand high degree of duty of care and diligence from producer or to reduce patient's burden of proof in a product liability lawsuit. For securing compensation ability and liability implementation, products compensation liability insurance is required for contrast medium manufacturers. In conclusion, contrast medium producer has legal liability for adverse reactions and the contract concluded with producer and hospital including legal liability will reduce liability of hospital and radiologist, patient.

  • Most Consumers don't pay attention the process of giving consent for the provision of personal information. The terms of giving consent of personal information provision including 3rd party provision related contents. Although personal information leakage were related 3rd party sharing, consumers can't recognize the details. Therefore, this study focused on the perception of 3rd party provision of personal information. Consumers recognized 3rd party as who are related the service offer or not. Consumers want to know the cases of personal information sharing to the 3rd party, and if the business operators got benefit to share personal information with 3rd party, consumers want to know the facts. To understand the terms easily, the format have to be revised and to be standardized. Standardization of consent forms is very important for consumers to understand the difficult documents and the development of the business system to collect and use consumer's personal information to guarantee the right to self-determination of personal information.

A Study on Negotiation Decision Functions for Software Agents (소프트웨어 에이전트를 위한 협상 결정함수에 관한 연구)

  • Software agents reduce human involvement to a certain extent by automating routine tasks. However, most of agents have assisted with only a few steps in the multi-steps process of electronic transactions. In order to help users with the important steps in the electronic transactions, software agents need to persuade other parties to act in particular ways. While negotiations have many shapes and forms, this paper focuses on a particular class of negotiation, that is competitive business environment based negotiation. For negotiation with other parties in this contort, it is necessary for autonomous agents to consider environmental variables-the number of competitors, the number of negotiation parties, the maximum time by which they must finish their jobs, and user's preferences. Previous negotiation decision functions for the automated negotiation have used only time or the static numbs of negotiating parties as negotiation criteria, although competitive business environment should include potential competitors who can snatch negotiation parties away. This paper attempts to evaluate the performance of a negotiation decision function that considers the potential competitors in competitive market environment as well as that of a negotiation decision function that does not. For this evaluation, this study adopts the electronic marketplace as an application domain because many buyers and sellers compete for limited resources in the marketplace.

A Study on the Alienation and Inheritance of the Right of Publicity (퍼블리시티권의 양도성과 상속성에 관한 연구)

  • Recently the entertainment and sports/advertisement industry have developed rapidly, and the name or identities of celebrities such as entertainers or athletics for the advertisement so that following troubles are occurred continually. Some celebrities actually started a suit for there right of publicity was violated, and won the case. Meanwhile, the right of publicity has become a growing issue in the society. In the States, the right of publicity which controls using one's identity for commercial use, and it is recognized as a right of property separated from the right of privacy. But in Germany, the right of publicity is protected as a human right. On the other hand, in Korea, there is an argument that the mental human right and the right of publicity which has property-characteristic are not separated clearly, and also the attitude of precedent toward the right of publicity is not unified. Especially in Korea, where it is taking the written laws principally, it is not easy to recognize the right of publicity which is a monopoly and exclusion without basis such as any actual laws such as regulation of agreement or any conventional laws. Therefore, as the right protection of celebrities is becoming the social state and there is an agreement with the constituents of the society, now Korea shall progress legislation about the right of publicity, and prepare a legal basis which regulates the remedies for the realization condition, alienation, inheritance, objectives, duration and violation of the right of publicity.

The Privity of the Contract Carriage of Goods by Sea (해상운송계약(海上運送契約)에 있어서 당사자관계(當事者關係)에 관한 연구(硏究))

  • This study is focused on the privity of the contract of carriage of goods by sea, so to speak, privity between B/L holder and carrier by transfer of bill of lading, privity by attornment to delivery order and conflict between bills of lading and charterparty terms. Under a CIF contract, possession of the bill of lading is equivalent to possession of the goods, and delivery of the bill of lading to the buyer or to a third party may be effective to pass the property in the goods to such person. The bill of lading is a document of title enabling the holder to obtain credit from banks before the arrival of the goods, for the transfer of the bill of lading can operate as a pledge of the goods themselves. In addition, it is by virtue of the bill of lading that the buyer or his assignee can obtain redress against the carrier for any breach of its terms and of the contract of carriage that it evidences. In other words the bill of lading creates a privity between its holder and the carrier as if the contract was made between them. The use of delivery orders in overseas sales is commen where bulk cargoes are split into more parcels than there are bills of lading, and this practice gives rise to considerable difficulties. For example, where the holder of a bill of lading transferred one of the delivery orders to the buyer who presented it to the carrier and paid the freight of the goods to which the order related, it was held that there was a contract between the buyer and the carrier under which the carrier could be made liable in repect of damage to the goods. The contract was on the same terms as that evidenced by, or contained in, the bill of lading, which was expressly incorporated by reference in the delivery order. If the transferee of the delivery order presents it and claims the goods, he may also be taken to have offered to enter into an implied contract incorporating some of the terms of the contract of carriage ; and he will, on the carrier's acceptance of that offer, not only acquire rights, but also incur liabilities under that contract. Where the terms of the charterparties conflict with those of the bills of lading, it is interpreted as below. First, goods may be shipped in a ship chartered by the shipper directly from the shipowner. In that case any bill of lading issued by the shipowner operates, as between shipowner and charterer, as a mere receipt. But if the bill of lading has been indorsed to a third party, between that third party and carrier, the bill of lading will normally be the contract of carriage. Secondly, goods may be shipped by a seller on a ship chartered by the buyer for taking delivery of the goods under the contract of sale. If the seller takes a bill of lading in his own name and to his own order, the terms of that bill of lading would govern the contractual relations between seller and carrier. Thirdly, a ship may be chartered by her owner to a charterer and then subchartered by the chaterer to a shipper, to whom a bill of lading may later be issued by the shipowner. In such a case, the bill of lading is regarded as evidencing a contract of carriage between the shipowner and cargo-owners.

주요국가에 있어서의 경쟁법$\cdot$경쟁정책의 개정 움직임

  • 세계 경제질서의 급속한 변화에 따라 최근에 많은 선진국들이 경쟁법을 개정하거나 앞으로 개정할 움직임을 활발히 전개하고 있다. 특히 이중에서 글로벌 경제의 급속한 진전에 따라 여기에 대응하기 위한 경쟁법의 개정 움직임도 활발하게 이루어지고 있음을 음미해보아야 할 것이다. 미국은 반트러스트법의 개정을 검토하기 위하여 공청회를 개최하고 ''95년 5월 ''새로운 하이테크 글로벌 시장에서의 경쟁정책''이라는 보고서를 발표하였으며, 이에 따라 합병심사에서 효율성을 앞세워 미국 국내기업의 해외 진출을 지원하고 합병을 용이하게 하도록 ''92년에 제정된 합병 가이드라인을 개정하였다. EU의 구주위원회도 기업결합의 글로벌화가 촉진되도록 ''96년 7월 합병규제규칙을 개정하여 업계가 손쉽게 합병을 할 수 있도록 절차에 있어 일원적 처리의 범위를 확대하였으며, 기업의 규제대상이 되는 연간 매상고기준을 인하하고 합병심사의 대상기업이라도 경쟁상 중대한 문제가 발생하지 않는 것으로 판단되면 공동체 시장에서 적합성을 선언할 수 있도록 하고, 경쟁제한법 협정의 적용제외 규정에서 수직적 제한에 대한 경쟁법 적용여부의 결정은 당사자의 시장점유율을 고려해서 적용여부를 결정하는 등 폭넓은 선택이 가능하도록 개정하였다. 이에 따라 EU국가인 독일, 영국, 프랑스 등의 EU회원국들은 EU합병규제규칙 및 EU경쟁법과의 조화가 이루어지도록 자국의 법체계를 정비하고 있다. 이에 따라 독일은 지난 ''97년 7월 31일에 경쟁제한금지법 제정 이후 40년만에 근본적인 개정의 필요에 따라 EU경쟁법과의 조화, 카르텔에서 적용제외 규정을 글로벌 경제구조에 맞도록 과감히 삭제$\cdot$축소하고, 합병규제대상의 매상고기준을 상향(5억$\right$10억마르크)하고 법체계를 명확하고 알기 쉽게 정리하는 개정(안)을 발표한 바 있다. 그리고 영국 무역산업성 장관은 지난 ''97년 8월 7일 영국의 경쟁법개정(안)을 금년 가을까지 성립을 목표로 발표하였는데, 그 주요 내용은 반경쟁적 협정 및 시장지배력 남용에 대한 강력한 억제력과 중대한 남용행위에 제재금을 부과함으로써 경쟁을 통한 소비자의 이익과 선택을 확보하고 산업계의 불필요한 부담을 경감토록 하여 글로벌시장 경쟁에서 혁신과 투자를 자극하도록 유도하였고, 프랑스는 생산업자와 유통업자에 의한 부당염매금지 제도를 도입하고 경쟁제한행위금지 위반시의 벌칙을 강화했다. 일본은 치열한 국제경쟁에 대응하고 경제구조의 개혁과 사업자활동을 보다 촉진하기 위하여 지난 1997년 6월 11일 일본독점금지법을 개정하여 독점금지법에 위배되지 않는 범위에서 지주회사 설립 금지를 해체하고 대규모회사 주식보유총액제한 규제대상을 완화하는 한편 국제계약신고제도를 폐지하였다. 캐나다는 합병신청서 제출기간을 연장하고 통신판매를 직접규제대상으로 경쟁법 개정을 준비하였고, 호주는 거래관행법을 개정하여 연방정부와 주$\cdot$준주 정부간의 경쟁정책의 법적용을 통일하고 거래관행법 적용을 모든 사업에 확대하며, 재판매가격유지행위의 금지대상에 용역(전기통신서비스)도 포함시키고 시장참입을 촉진하는 제도를 신설하였다. 뉴질랜드는 합병이 국내시장에 영향을 주는 경우에는 외국에서의 합병에도 경쟁법을 확대적용하도록 하였다. 위와 같이 세계의 많은 국가에서 경쟁정책에 대한 새로운 동향과 공정거래법에 대한 개정작업이 활발히 이루어지고 있는데, 본고는 미국, EU, 독일, 영국, 프랑스, 일본, 캐나다 및 호주와 뉴질랜드 등 주요선진국에서의 공정거래법 개정 동향에 대한 주요 내용을 소개한 것이다.
