  • Subsidiary business between mobile carriers and handset manufacturers has been banned by Korean regulator due to the concern that it may cause the unfair competition in the market. But the opinion that the current regulation has to be consolidated is increasing to follow recent market trends, ensuer the fair competition and increase the users' benefit. In this paper, I analysed trends of the mobile telecommunication market and proposed desirable direction of regulatory improvement.

A Study on Competitiveness Changes of Specialty Construction Firms Under No Restriction in General and Specialty Contracting (겸업제한 폐지에 따른 전문건설업체의 경쟁력 요소 변화에 관한 연구)

  • Recently, the restriction of contracting business between general and specialty contractors are deregulated, which means the elimination of the traditional market entry block in the Korean construction industry. It could be a threat and/or an opportunity to construction firms, and requires establishing new business strategies in order to obtain relative competitiveness between the general and the specialty. Under this change in the industry, this research performed to provide some suggestions for specialty firms in setting up their new business strategies by analyzing various changes of their competitiveness elements. This study extracted 20 core competitiveness elements from major 6 competitive categories required in doing specialty contracting business, and their relative importance between the 20 elements were measured. It was found that the specialty's relative competitiveness has been greatly changed and affected by the deregulation of the protective business restriction.

  • 건설교통부는 지난 7월 24일 일반 · 전문건설업간 겸업제한 제도를 폐지하고, 하수급인과 건설근로자에 대한 보호강화 등 건설산업의 경쟁력 강화와 건전한 발전에 필요한 제도적 기반을 구축하기 위한 건설산업기본법개정안을 입법예고 했다. 개정안의 주요 내용은 △일반 · 전문건설업간 겸업제한 폐지△시공참여자제도 개선△ 건설업체 부도시 하도급 대금을 발주처에서 직접 지급△건설산업 부조리 해소를 위한 규정 보완△ 발주자에게 하도급계획서 제출 등이다. 건교부는 그동안 "기업 · 학계 · 연구원 · 정부"합동으로 포럼을 구성하여 10여 차례 토의하였고, 공청회, 관련업계 간담회 등을 통하여 폭넓은 의견수렴을 거쳤으며, 입법 예고를 통한 추가적인 의견수렴(7.25~8.14)과 규제심사등 정부입법과정을 거쳐 금년 10월중 국회에 제출할 예정이다.

An Empirical Study on the Openness and Competition of Special Contractors Market in Korea (전문건설 시장의 개방성과 경쟁성에 관한 실증적 분석)

  • The purpose of this study is to examine the degree of openness and competition in special contractor's market. And the result of this study will present the basis of rational policy making. The literature research and time series analysis are adopted as research method. And the findings of this study are as followed. The study has shown that the degree of openness is high in korean special contractor's market by gradual deregulation of entrance barriers into special contractor's market. And the study has revealed that the degree of competition in special contractor's market is high, revealing that the rate of increase of contract account and the subcontract bid rate have decreased.

Financial Regulation and R&D Investment (금융규제와 R&D 투자 - 자기자본, 금리 및 업무영역 규제를 중심으로 -)

  • In this study, we made a critical review on the regulatory policies in financial sector of Korea, analysed their effects on the firm's innovation, and suggested some policy implications. Many innovation researchers and policy makers expected that such a liberal system of regulation would lead Korea's national innovation system to the quantum leap. Our analyses of financial regulations show, however, that changes of regulatory systems (deregulation for interest rate) in the last decade did not always promoted the firm's innovation. The firms now encounter Basel II, and since it could cause bipolarization between R&D performing firms, it is necessary to add complementary policy such as collateralization or netting. Finally, simple empirical anlysis shows that the trend of universal banking may affect R&D investment positively.

  • 대리운전업은 서비스업으로 세무서에 신고만 하면 사업자 등록을 하고 사업을 할 수 있고, 설사 신고를 하지 않고 영업을 하더라도 규제할 방법이 마땅치 않아 진입장벽이 없는 상태이며 대리운전업에 대한 규제법은 전무한 상태이다. 이들이 법적 관리로부터 방치되어 있는 결과 대리운전행위의 사회적 편익에도 불구하고 요금시비 등 서비스의 질, 생계형 운전미숙자의 진입, 주로 야간에 다수의 낮선 차량을 운전하여야 하고 겸업이 47.3%에 이르러, 과중한 노동으로 인한 피로누적, 주의력 산만, 과속경쟁 등 대리운전의 속성상 교통사고 발생위험, 사고발생시 피해보상책임, 절도나 성폭력행위와 같은 범죄유발 등 여러 가지 문제가 끊이지 않고 있다. 관련업계나 일부 단체에서는 대리운전업 종사자가 15만 명을 넘어섰다고 주장하며 당당한 직업으로 인정해 달라고 요구하고 있고, 근로형태나 조건 등 사업자 내부의 문제도 제기된다. 본고(本稿)에서는 대리운전으로 발생하는 범죄의 현황과 대책을 개괄적으로 조망하고자 한다.

A Theory on the Scope of Financial Activity (금융(金融)의 전업(專業) 및 겸업화(兼業化) 이론(理論): 금융산업조직론(金融産業組織論)의 모색(摸索))

  • This paper is intended as an introductory essay to explain endogenous changes in the scope of firm activities in the competitive structure of a deregulated, multi-product financial industry. Recently, the global financial industry has been experiencing a widespread reshuffling in its activities, reflecting both consolidation and specialization. The spread of the universal banking system, which involves the integration of various kinds of financial activities, has resulted in the so-called financial supermarket. At the same time, the traditional set of banking activities has been unbundled into so-called financial boutiques. A relevant question is where the current reshuffling process of integration and disintegration in financial activities might lead the financial industry. However, presently popular theories of the financial industry are not really appropriate for the analysis of this issue. This paper attempts to integrate the theory of specialization [George J. Stigler, "The Division of Labor is Limited by the Extent of the Market," Journal of Political Economy, Vol. LIX, No.3, June 1951] and the theory of the multi-product firm [William J. Baumol, John C. Panzar, and Robert D. Willig, Contestable Markets and the Theory of Industry Structure, Harcourt Brace Jovanovich, Inc., New York, 1982] and to apply the resulting hybrid theory, a theory on the scope of financial activity, to the financial industry. The implications of this theory for the issues raised above are formalized under five hypotheses on the reshuffling of financial activities as listed below: Hypothesis I: The differences in the organization of financial industries among countries are determined by differences in the size of the financial markets, other things being equal. Hypothesis II: A financial firm will separate those financial activities simultaneously having relatively strong economies of scale and relatively weak economies of scope (alternatively, diseconomies of scope) from other activities. Conversely, the firm will integrate those activities simultaneously having relatively weak economies of scale (alternatively, diseconomies of scale) and relatively strong economies of scope with incumbent activities. Hypothesis III: A competitive equilibrium in the deregulated financial industry will consist of both specialized and multi-product financial firms, resulting in a mixed form of specialized and universal banking systems. Hypothesis IV: As world financial markets fully integrate and all countries consequently face this single, common world market, the financial structures of individual countries will become increasingly similar. Hypothesis V: A more universal banking system will dominate the deregulated financial industry in countries with relatively small financial markets, while a more specialized banking system will dominate in countries with relatively large financial markets. However, equilibrium will ultimately be mixed, with specialized and universal banks coexisting, as stated in Hypothesis III. Based on these hypotheses, this paper interprets the historical development of specialized vs. universal banking systems in major industrial countries as a process driven by the evolution of the financial market in each country - i.e. the change in the size of the financial market over time. In addition, this paper anticipates that the final equilibrium of the world financial industry, which is currently under the pressure of financial innovations and deregulation, will be a mixed equilibrium with both specialized boutiques and universal supermarket-type financial firms, instead of an exclusively specialized or universal banking system. Future research should seek continued theoretical elaboration and empirical verification of this paper's hypotheses.

Risks and Supervisory Challenges of Financial Conglomerates in Korea (금융그룹화와 금융위험: 실증분석 및 정책과제)

  • This paper studies implications of financial conglomeration for both financial risk of individual conglomerates and systemic risk potential in post-crisis Korea. Our analyses suggest that we cannot conclude that financial conglomerates are taking on higher risks relative to non-conglomerate independent institutions. We also find that larger financial institutions show a significantly higher profitability and lower variability in profitability operating on a superior efficient frontier. However, it turns out that the consolidation has raised systemic risk potential as direct and indirect interdependencies among large banking institutions have substantially increased. Furthermore, financial conglomerates have become more vulnerable to contagion risks from non-bank sectors and capital markets. In the face of the shifting risk structure, financial supervisory and regulatory systems must be upgraded toward a more risk-based, consolidated supervision. Prompt corrective action provision for financial conglomerates must be based upon fully consolidated group risks, and effective supervisory devices need to be introduced to avoid inadvertent extension of public safety net to cross-sectoral activities of financial conglomerates. It is also critical to strengthen internal control and risk management capacities at financial conglomerates, and to establish strong market discipline by improving information transparency and monitoring incentives in the financial market.

  • The organic law on the Construction Industry, initially, this law was enacted with a view to preserving and fostering the specialty of each type of industry. By dividing each construction business boundary, it gradually settles the system of construction specialized on the basis of productive stages. Controversy over the abolishing regulations on business boundary still continues to swirl. Since the intensity of exclusion as well as rigidities become increased. This results from the fact that informations are not shared among business boundary and businesses under the protection of the business boundary regulations choose 'rent-sicking activity'. According to dissidents against this law, structure should be established not by artificially enforced institution but by voluntary efforts of participants in construction industry. This paper aims at improving the competitive of the construction industry by showing the efficient system of construction and proving the legitimacy of abolishing business boundary
