본지는 매년 12월호에 지난 1년간의 발자취를 되돌아 보는 기회를 갖기로 했다. 지난 1년간 월간 설비건설에 게재되었던 주요 내용들을 되짚어 보는 의미는 한 해 동안 설비건설업계의 관심사항과 주요흐름을 점검하기 위함이다. 이러한 과정을 살펴봄으로써 지난 날들을 밑거름 삼아 다가오는 새해의 발전에 기여코자 하는 진정한 송구영신의 정신을 갖기 위함이다. 2007년은 건설업의 근간을 흔드는, 일반.전문 겸업제한 폐지를 포함한 건산법이 개정되는 역사적인 획을 긋는 해였다. 이밖에 상생바람을 타고 올해는 유난히도 하도급 관련 정책들이 쏟아지는 해이기도 했다. 지난 1년간 월간 설비건설에 게재되었던 주요 내용들을 살펴보자.

Because the construction is becoming bigger and the construction environment is rapidly changing, IT/IS(Information Technology and Information System) of the construction is recently suggested with the alternative proposal. So not only is a study progressed in the area of the BIM(Buidilng Information Modeling), VC(Virtual Construction) and CIC (Computer-Integrated Construction) but also of the information database of the construction for building the information infrastructure of the construction in the domestic construction. Because object-oriented 3D CAD improves the efficiency of a design work and includes the object information which can use with the base of the information database of the construction, it has the high value not only in the design level but also in the construction life cycle. But compared with the effect, the use of 3D CAD is sluggish in the construction. In this study, after surveying about lowly using 3D CAD on the point of AEC (Architect-Engineer-Contract), the result is analyzed with AHP(Analytic Hierarchy Process). So the aim of this study is to offer the base to find the solution of the Affecting factors about lowly using 3D CAD.

건설산업기본법시행령.시행규칙이 지난 해 12월 28일 개정되어 1월 1일부터 시행에 들어갔다. 이번에 개정된 시행령은 기계설비공사업 업역 확대 및 국민연금, 건강보험료 비용정산 등을 주요 내용으로 개정되었다. 대한설비건설협회는 시행령.시행규칙 개정 과정에서 업역확대를 주목표로 설정하고 신규 사업분야인 시스템에어컨 설치공사, 지열냉난방설치공사, 자동제어 분야에서 전기.통신과 업역다툼이 있었던 자동원격검침 설비공사, 지능형 제어시스템 설치공사 등을 기계설비공사업역에 추가시켰다. 이로써 지난 해 건산법 개정 시 기계설비만 겸업제한 폐지를 4년 유예시킨 성과에 버금가는 성과를 거두었다. 또한 대한설비건설협회는 국민연금, 건강보험료의 비용 정산을 민간공사에도 도입될 수 있도록 끊임없이 건의하여 이번에 개정됨으로써 회원사의 보험료 납부 부담을 줄일 수 있게 되었다. 건산법 시행령·시행규칙의 주요 개정 내용 및 설비건설업과 관련한 신.구조문 대비표는 다음과 같다.

Although the domestic industrial accidents have been decreased gradually, deaths in the construction sites have been occupied 49.9 percent of the total industry and deaths from fall accident have been accounted for 59.7 percent of the construction industry. In order to prevent fall accident, various safety activities and policy have been carried out. However, the impact on the domestic construction industry was inadequate. On the other hand, in advanced countries, such as the United States, Japan, EU, and Singapore Industrial accidents have been lower than domestic industry due to safety activities, the regulations and policies appropriate for each country's situation. In this study, we compare the major points of the Industrial Safety and Health Act in developed countries with those in South Korea to reduce the number of falls, and propose a revision. As a result of conducting research, three revisions have been proposed as 1) Enhance standards for fall height, 2) Improvement of upper safety rail height on guardrail, 3) Revision and research on Horizontal Sarety bar attachment system. This study will be utilized as a basic study for the analysis of cases in advanced countries.

The organic law on the Construction Industry, initially, this law was enacted with a view to preserving and fostering the specialty of each type of industry. By dividing each construction business boundary, it gradually settles the system of construction specialized on the basis of productive stages. Controversy over the abolishing regulations on business boundary still continues to swirl. Since the intensity of exclusion as well as rigidities become increased. This results from the fact that informations are not shared among business boundary and businesses under the protection of the business boundary regulations choose 'rent-sicking activity'. According to dissidents against this law, structure should be established not by artificially enforced institution but by voluntary efforts of participants in construction industry. This paper aims at improving the competitive of the construction industry by showing the efficient system of construction and proving the legitimacy of abolishing business boundary

Purpose: Ten years after basic safety and health education in the construction industry has been implemented, no more maintenance education has been provided, and those who have completed basic safety and health education are exempt from new employee education. As soon as possible, we will seek strategic measures to prevent unstable behavior and prevent safety accidents by legislating conservative education and new recruitment education. Method: In this study, basic safety and health education, which is construction safety education, and human error, which is unstable behavior of new employees, and structural relationship between violation behavior were conducted through survey. Result: The survey analyzed that basic safety and health education in the construction industry and new recruitment education had a significant impact on the human factors of the disaster, Human Error, and the reduction of violations, and confirmed that continuous safety education could increase safety awareness. Conclusion: The insolvency of safety education shall be prevented by the revision of the Act on the remuneration of basic safety and health education and the education of new employees.

This study estimates the employment relationship of domestic and foreign workers by establishing 16 municipal and provincial panel data for the period 2010-2018. It attempts to analyze industry-specific (manufacturing and construction), scale-specific (5-29, 5-29, 5-299 and 5 above) and uses the foreign worker's national share (foreigner's concentration index) as an instrumental variable to control the endogeneity of foreign workers. Finally, it compares the results of panel GLS, which does not consider the endogeneity of foreign workers, with the results using instrumental variable method that considers it. As a result of the analysis, the complementary relationship between domestic and foreign workers was confirmed in the panel GLS analysis. However, although the employment relationship between domestic and foreign workers was not statistically significant in the instrumental variable method, the analysis of the combination of manufacturing and construction industry showed a statistically significant substitute relationship. This study is highly regarded for the first time in Korea that an instrumental variable method was created to identify and control the endogeneity of foreign workers in estimating employment relationships between domestic and foreign workers.

3D(Difficult, Dirty, Dangerous) 산업의 대표적인 산업으로 인식되는 건설업은 현재 노무기능인력의 고령화와 신규 기능인력 육성의 어려움이라는 문제에 당면하였으며, 이러한 3D 산업이라는 이미지의 탈피 및 노동집약적 사업구조에 대한 변화에 대한 대안으로써 타산업과의 융복합을 통한 이미지 쇄신 및 생산성 향상을 위해 자동화 및 정보화를 위한 노력을 경주하고 있다. 본 연구에서는 건설 자동화 및 정보화를 위한 알고리즘 개발 연구방법론에 대한 기초연구로써, 초고층 공사에서의 물류 효율화를 위한 장비간 통신방법에 대한 모델을 설정하고, 해당 모델에 대해 적용 가능한 알고리즘을 도출하는 프로세스를 규명함으로써, 건설 자동화 및 정보화 연구를 진행하는 단계에서 최적화(Optimization)를 위한 알고리즘 규명에 대한 방안을 제시하고자 한다.

시공을 하다가 손해를 보았는데도 발주자 혹은 원도급업체에서 인정을 안해준다면 어떻게 해야 할까? "소송을 할까?", "다음 공사는 어떻게 해. 그냥 손해보고 말지 뭐", "아니야 그냥 넘어가기에는 너무 억울해" 설비건설업을 하다보면 누구나 한번쯤 이런 경험이 있었을 것이다. 이럴 경우 공정거래위원회에 문의 하거나 건설하도급분쟁조정협의회에 문의하다가 정 안될 경우 소송에 돌입한다. 소송의 경우 대법원의 최종 판결이 나기까지 2~3년은 고스란히 걸림은 물론 소송비용도 만만치 않다. 이렇게 기간이 길지 않고 가격도 저렴하면서 해결 가능한 방법은 없을까? 물론 있다. 공정거래위원회에 제소하면 된다. 공정거래위원회는 국무총리 소속의 장관급 중앙행정기관이자 합의제 준사법기관으로서 경쟁정책을 수립 · 운영하며 공정거래관련 사건을 심결 · 처리하는 역할을 하고 있다. 정부는 지난 84년 하도급자보호 및 소비자의 보호를 위해 「하도급거래공정화에 관한 법률 」과 「약관의규제에 관한 법률」을 84년과 86년에 각각 제정함으로써 상대적으로 약자인 하도급자도 법의 보호를 받게 되었다. 본지는 지난 7월호 대한상사중재원의 '중재제도'에 이어 이번 8월호에서는 건설하도급분쟁조정협의회를 게재했고, 이번호에는 공정거래위원회에 대하여 게재한다.

건교부는 일반.전문건설업간 겸업을 허용한 건설산업기본법 개정의 후속조치로 마련한 건산법 시행령 및 시행규칙 개정안을 지난 9월 5일 입법예고하고 9월 27일까지 의견수렴 기간을 거쳐 본격 개정에 들어가 내년부터 적용할 계획이다. 개정안은 겸업제한에 관한 특례에 따라 기계설비의 설치와 관련된 업종은 4년간 유예하는 내용을 포함하여 내년부터 일반.전문건설업간 겸업이 허용됨에 따라 본격화될 교차 진출 때 과거 공사실적의 인정기준이다. 또한 2009년 7월 시행이 예정도니 단순복합공사의 원도급 허용범위와 지난 8월 발표된 건설업 등록 때 기능인력 보유 의무조항 등과 함께 내년에 별도의 입법을 통해 추진된다. 이와 함께 개정안에는 건설공사 부실, 부조리에 대한 제재 강화 조항도 포함됐다. 이 중 기계설비공사업과 관련된 내용만 발췌하여 게재한다.
