Factors Affecting the Intention to Adopt Self-Determination Rights of Personal Medical Information (개인의료정보 자기결정권 행사 의도에 영향을 미치는 요인)

  • With an extensive proliferation of information and communication technology, the volume and amount of digital information collected and utilized on the Internet have been increasing rapidly. Also on the rapid rise are side effects such as unintended breach of accumulated personal information and consequent invasion of personal privacy. Informational self-determination is rarely practiced, despite various states' legal efforts to redress data subjects' damage. Personal health information, in particular, is a subcategory of personal information where informational self-determination is hardly practiced enough. The observation is contrasted with the socio-economic inconvenience that may follow due to its sensitive nature containing individuals' physical and health conditions. This research, therefore, reviews factors of self-determination on personal health information while referring to the protection motivation theory (PMT), the long-time framework to understand personal information protection. Empirical analysis of 200 data surveyed reveals threat-appraisal (perceived vulnerability and perceived severity of threats) and coping-appraisal (perceived response effectiveness), in addition to individual levels of concern regarding provided personal health information, influence self-determination to protect personal health information. The research proposes theoretical findings and practical suggestions along with reference for future research topics.

  • This research examines technologies and systems regarding right to control information in the network era. For this purpose, It attempts an integrated analysis of technologies and systems on the basis of the tree components of cyberspace. And it examines the prior researches and cases on privacy, personal information, and right to control information with emphasis on technologies and systems of the cyberspace. To protect privacy information, it analyses vulnerability of element technology, platform service technology, and individual technology. In particular, it describes, from the perspective of right to control information, the risk and security measures for personal information to be used as relation-context in the Web 2.0 environment. The research result will assist the methodology of future researches for grand theory on privacy information and help understanding the interaction between technology and society.

  • The right to informational self-determination refers to the constitutional right for an individual, which is approved by the constitutional court, to decide what contents the collected information comprises and to control the circulation of information relation to oneself. It contains claim for inspection of personal information(The right to informational self-access) as a right for individual to review information of current state and processing history which information holders have. To assure the right to informational self-access, individual must be notified of the processing history of information by information holders regardless of individual's request(The unconditional right to informational self-access). This study will analyse current status of domestic and foreign legislation and global regulation which are related to the unconditional right to informational self-access. In addition, the action of domestic corporations will be introduced. Finally, it will be concluded with relevant problems and solutions to solve the problems.

  • 유럽연합(EU)의 GPDR(개인정보보호일반규정)시행에 따라 개인정보를 활용하는 사업자 입장에서는 개인정보 보호도 중요하지만 활용측면에 더 많은 관심을 보이고 있다. 개인정보 보호와 활용에 따른 균형점을 찾는 제도적 정착을 위해 개인정보 이동권에 대한 요구가 생겼다. 국내 개인정보 관련 법률에는 아직 근거가 없으며 개인정보처리자의 독립적 데이터 보유에 따른 책임 강화와 정보주체가 자신의 데이터를 관리하는 권리를 가지고 데이터 활용을 할 수 있는 개인정보 자기결정권이 더 요구된다. 이에 따라 본 논문에서는 GDPR의 개인정보 이동권에 대한 현황 및 준수사항을 알아보고 각 나라별 개인정보 이동(data portability)에 따른 개인정보 활용방안과 고려사항을 제시하고자 한다. 개인정보이동에 한 형태로 국내 마이데이터 시범 사업이 정착하기 위한 법칙, 기술적 대응사항을 제시하고자 한다.

  • Although the rights of data subjects are defined through laws such as the Personal Information Protection Act, the consent process for collecting personal information by financial institutions is only formal and does not guarantee the right of self-determination of personal information. Therefore, it is necessary to analyze the problem by information provision items of the current model, and to improve by changing the structure such as replacing the current method provided with the text with pictures and videos, and mandatory to provide the information subjects with personal information flow related images from the signing up stage. The improvement model is presented as a way to add a procedure to the current model. The effect was verified through a survey. It is hoped that the proposed model is actually reflected through the review to create an environment that can be a true meaning agreement that reflects the information subject's right to self-determination.

  • Companies using internet as a kind of marketing means are increasing rapidly according to the expansion trend of e-commerce through internet and consumers also use internet as the common means of purchasing necessary articles. E-commerce using internet has advantages without limitation to temporal and spatial accessibility and general consumers and unspecified individuals also use internet to purchase their goods as well as general transactions such as advertisement, contract, payment and claim settlement. 'In the age of information, invasion of personal information resulted from the development of information and communication technology is one of the greatest problems all the countries in the world face. Therefore, Personal information protection Act is one of basic laws to protect personal information and rights and it is also an essential law in the age of information. In that sense, new Personal information protection Act is the advanced act containing various items to minimize the national damages from the leaking of private information and protect right to informational self-determination in the information society. It is expected that this legislation contributes to reduce the leaking of private information, enhance the level of privacy protection and develop privacy related industries. However, active participation of all members of our society and improvement of their recognition should be preceded for the rational and legal use of private information and the settlement of its protection culture. While the purpose of Personal information protection Act can protect privacy from collection, leaking, misuse and abuse of private information and enhance national interests and protect personal dignity and value, it also must perform the roles of balancing privacy protection with liberal information flow.

  • As the ability to use data becomes competitive power in the data-driven economy, the effort to create economic value by using personal data is emphasized as much as to protect personal data. EU's PSD2(the second Payment Service directive) became the initiative of the Open Banking trends all over the world, as it is the Mydata policy which protects the data subject's right by empowering the subject to control over the personal data with the right to data portability and promotes personal data usages and transfer. Korean government is now fast adopting EU's PSD2 in financial sector, but there is growing concerns in personal data abuse and misuse, and data breach. This study analyzes domestic financial Mydata policy in comparison with EU's PSD2 and focus on Personal information life-cycle risks of financial Mydata policy. Some suggestions on how to promote personal information and privacy in domestic financial Mydata Policy will be given.

  • Personal Information Protection Act does not apply to certain personal information processings and personal information management as well as the data subject's right to access to their personal information collected by public authorities pursuant to Statistics Act. Such exclusion may lead to problems such as misuse and mishandling of personal information by data controllers as well as infringement upon the data subejct's right to control over their personal information. This study is to find solutions to the above problems, considering the public interests of statistics and the facilitation of the collection and the use of statistics. Ultimately, the study is to suggest recommendations for the Personal Information Protection Act to ensure the data subject's rights to request access and rectification as well as safe management of the collected personal information.

  • With the advent of the Internet and the development of mobile digital devices such as smartphones and tablet PCs, the communication service paradigm began to shift from existing voice services to data services. Recently, as social network services (SNS) are activated and 4th industrial revolution technologies centered on ICT (Information and Communication Technologies) such as Big Data, Blockchain, Cloud, and 5G/6G are rapidly developed, the amount of shared data type and the amount of data are increasing rapidly. As the transition to a digital society begins actively, the importance of using data information, as well as the economic and social values of personal information are becoming increasingly important. As a result, they are actively discussing policies to revitalize the data information industry around the world and ways to efficiently obtain, analyze, and utilize increasingly diverse and vast data, as well as to protect/guarantee the rights of information subjects (providers) in various fields such as society, culture, economy, and politics.. In this paper, in order to improve the self-determination right of personal information on data produced by information subjects, and further expand the use of safe data and the data economy, a differentiated data trusts system was considered and suggested. In addition, the components and data trusts procedures necessary to efficiently operate the data trusts system in Korea were considered, and the non-profit data trusts system and the for-profit data trusts system were considered as a way to flexibly operate the data trusts system. Furthermore, the legal items necessary for the implementation of the data trusts system were investigated and considered. In this paper, in order to propose a domestic data trusts system, cases related to existing data trusts systems such as the United States, Japan, and Korea were reviewed and analyzed. In addition, in order to prepare legislation necessary for the data trusts system, data-related laws in major countries and domestic legal and policy trends were reviewed to study the rights that conflict or overlap with existing laws, and differences were investigated and considered. The Data trusts system proposed in this paper is a reasonable system that is expected to recognize the asset value of data in the capitalist market economy system, to provide legitimate compensation for data produced by data subjects, and further to contribute greatly to the use of safe data and creation of a new service market.

  • Recent development and generalization of Internet technology contributes to the large scale of commerce and capital followed by appearance and growth of large portal sites. As a result, the personal data on the Internet not deleted for a long period of time is a new risk factor, for example, the invasion of people's privacy. In particular, exposing personal data like witch-hunts is a critical issue so that the person concerned cannot carry on with normal life. This study suggests the necessity of the right to request personal data deletion related to a person concerned on Internet sites, a method of introducing the right in Korea, and a method of improving the application.
