A Study on Improving the Legal System for the Expedited Preservation of Digital Evidence (디지털 증거의 긴급한 보전을 위한 법제 개선 연구)

  • The proportion of digital evidence in criminal cases has increased, while at the same time, the spread of the Internet has made it easy to delete information that is stored in another place and thus, the Internet is being used to delete online criminal evidence. To respond quickly and effectively to cybercrime, 29 countries signed the Convention on Cybercrime in 2001 through the Council of Europe. Article 16 of the Convention relates to the expedited preservation of stored computer data and requires signatories to adopt legislative measures to enable its competent authorities to order expeditious preservation of specified computer data where there are grounds to believe that the data is particularly vulnerable to loss or modification. More than 60 countries have joined the Convention since 2001 and have made efforts to improve their legal system in line with it. The United States legislated 18 U.S.C. § 2703(f) to preserve electronic evidence pending the issuance of a court order. The German Code of Criminal Procedure §§ 94~95 allows prosecution authorities to seize evidence or issue production orders without court control in urgent circumstances. A custodian shall be obliged to surrender evidence upon a request that evidence be preserved, and non-compliance results in punishment. Japan legislated the Criminal Procedure Act § 197(3) and (4) to establish a legal base for requesting that electronic records that are stored by an ISP not be deleted. The Korean Criminal Procedure Act § 184 outlines procedures for the preservation of evidence but does not adequately address the expeditious preservation of digital evidence that may be vulnerable to deletion. This paper analyzes nine considerations, including request subjects, requirements, and cost reimbursement to establish directions to improve the legal system for the expedited preservation of digital evidence. A new method to preserve online digital evidence in urgent cases is necessary.

  • Companies of Build-to-Order(BTO) strive to achieve customer responsiveness and cost efficiency simultaneously. The success of BTO depends upon the high volume production based on product plat form and delayed differentiation principle on the one hand, and upon the rapid estimation of delivery and cost for the customer orders on the other hand. Expeditious processing of a specific order requires the rearrangement of production resources and the schedule, which results in increased cost. This paper describes a cost estimation method using activity-based costing depending on the schedule change caused by urgent customer orders.

In order to establish firm the context of inter-disciplinarity that is still feeble, it is urgent to continuously develop geoscientific models and systematic infra for interdisciplinary cooperation such as well-prepared geo-spatial database and knowledge base network that can support multi-lateral cooperation between multiple disciplines and multi-phase international cooperation.

  • In Soft ground of south-western coast of our country necessity of marine indutrial complex and container facility has been remarkable. Site construction for habor facility is one of the most urgent problems. Consolidation of dredged fill has become important task. In addition, volume change of dredged fill should be examined carefully. This study dealt with consolidation of dredged fill by PCDDF and in order to secure trafficability of heavy equipment for surface treatment should be studied.

  • Many countries around the world have actively used biogas to reduce greenhouse gases in order to improve the environment. Recently, South Korea has invested a lot of money in technology development for organic waste and expanded the policy to supply renewable energy. The use of biogas would also increase our country's energy security. Therefore, I would suggest that our government adopt the relevant laws and systems regarding biogas in the near future.

  • Every year in Europe, soils covering an area larger than the city of Berlin are lost to urban sprawl and transport infrastructure. Soil sealing causes an irreversible loss of the biological functions of soil. As water can neither infiltrate nor evaporate, water runoff increases, sometimes leading to catastrophic floods. Landscapes are fragmented and habitats become too small or too isolated to support certain species. In addition, the food production potential of land is lost forever. There is an urgent need to use this valuable resource more wisely, in order to secure its many vital services for future generations. The EU faces new territorial challenges.

On exploring factors for enhancing export competitiveness in IT Convergence industries

  • Purpose - The IT convergence industry, which is the subject of this study, is the main strategy field during the 4th industrial revolution era. Against this background, it is urgent to establish policy measures to survive and spread export products in the global industries. Research, design, data and methodology - In order to achieve this goal, we conducted the Importance - Performance Analysis (IPA) and found that it is necessary to develop tailor - made marketing support for small and medium sized IT exporters and to develop export strategy products with competitive technologies. Results - Above all, customized marketing support for IT export-related SMEs was needed. Next, in the first quadrant, strategic products, qualitative level, global, value added, and information systems were included, and it was found that 'development of export strategic products with competitive technologies' was necessary. In the third quadrant, related variables calculated at present time are not urgent variables. Conclusions - In this study, it would be necessary to calculate the additional implications of the variables that are not considered in this study, including future studies, because the methods considered here as analysis variables are carried out in comparison with the previous studies.

  • Two years ago, an emergency arbitrator procedure in accordance with the international arbitration rule has been finally adopted in Korea?a decade after its introduction. Arbitral institutions provide interim measures in the course of tribunal proceedings to avoid litigation in open court that is often expensive and time-consuming. An emergency arbitrator procedure offers an urgent relief prior to the constitution of an arbitral tribunal, thus enhancing the speed and effectiveness of the arbitration procedure even further. Although most of the arbitral institutions interpret that the emergency arbitration rulings are binding on the parties, enforcing the emergency arbitration provisions have some difficulties in practice, and it is not clear whether or not arbitral interim measures will be enforceable under the newly adopted provisions in Korea. In this study, experiences in other countries are explored in seeking for the possible problems and solutions of enforcing the emergency arbitration rulings. For example, Singapore and Hong Kong insert terms such as "finality," "enforceable in the same manner as an order or direction of the Court," "same effect as an arbitral tribunal or interim measures" in their emergency arbitrator legislation to enhance enforcement. Moreover, "urgency inherent" are considered.

  • In communication networks used in safety-critical systems such as control systems in nuclear power plants there exist three types of data traffic : urgent or asynchronous hard real-time data hard real-time periodic data and soft real-time periodic data. it is necessary to allocate a suitable bandwidth to each data traffic in order to meet their real-time constraints. This paper proposes a method to meet the real-time constraints for the three types of data traffic simultaneously under a timer-controlled token bus protocol or the IEEE 802.4 token bus protocol and verifies the validity of the presented method by an example. This paper derives the proper region of the high priority token hold time and the target token rotation time for each station within which the real-time constraints for the three types of data traffic are met, Since the scheduling of the data traffic may reduce the possibility of the abrupt increase of the network load this paper proposes a brief heuristic method to make a scheduling table to satisfy their real-time constraints.

Diminishing Procedural Boundaries in International Arbitration

  • The surge of cross border trade and transactions has seen international arbitration fast emerging as the preferred mode of dispute resolution. This phenomenon is especially remarkable in the Asian region. The Singapore International Arbitration Centre ("SIAC") aspires to contribute to this growth as one of the leading arbitral institutions. The objective of this article is to provide an insight into the key features of SIAC Rules. This article has been divided into two parts; the first part discusses how the SIAC Rules are helpful in building bridges in international arbitration between the common law and civil law systems. We have attempted to throw light on how the SIAC Rules may be tailored by the parties to bring about a harmonization in the common law and civil law practices in the conduct of the arbitration proceedings. In the second part of the article, we discuss the two most popular procedures introduced in the SIAC Rules in 2010 i.e. 'Emergency Arbitration' and 'Expedited procedures'. The emergency arbitration provisions enable a party to obtain order(s)/award for urgent interim relief(s) upon commencement of arbitral proceedings but pending the constitution of the main Tribunal. The expedited Procedure provisions give parties the option of having their disputes determined in six (6) months from the date of the constitution of the tribunal.
