청계천복원사업의 조경설계안 변경 요인 분석 (A Study on the Analysis of Factors for Landscape Architect Scheme Modification for the Restoration Project of Cheonggyecheon)

  • In this study, the implications for landscape architecture in the restoration Project of Cheonggyecheon will be shown through the analysis of factors for landscape architect scheme modification. The method of study consists of theoretical study, analysis of the plan and design of landscape architecture of the restoration project of Cheonggyecheon, and deduction of implications thereof. The controversial feints included the many difficulties in realizing the productive design of landscape architecture due to the selective collecting of public opinion and the problems of settling the complications, the design limit of the turnkey and MA systems, the lack of hydraulic knowledge and technology and the shortage of vegetation monitoring data and experimental materials. The alternative proposals are as follows: 1) there should be agreement between the government organization and the civil group, 2) in the turnkey bidding for the river restoration projects, the river restoration design based on the volume divided into some parts should be reconsidered in order to maintain consistency in the total design, 3) in order to maintain consistency in the planning policies, MA designs should also be introduced and applied from the first stage of the project through its completion, and 4) data such as the safe water level in case of flooding for the facilities and the vegetation and data in connection with the ecological restoration of river should be accumulated. If these controversies are not settled effectively, the river restoration project will be delayed due to complications with the citizens and wasted time and effort will result from the frequent design changes. In addition, landscape architecture in this kind of restoration project is bound to decrease in the future due to frequent changes in the hydraulic-centered design.

계약 조항의 애매모호성에 의해서 발생되는 공기지연 클레임의 책임 당사자 확인 프로세스 (The Process of Identifying the Responsibility Party of Caused Delay Claim by Ambiguity of the Conditions of the Contract)

  • 본 연구에서는 EPC/턴키 프로젝트에서 발생 가능한 클레임의 주요 원인들을 발주자와 건설사의 관점에서 분석하였다. 그 원인들은 EPC/턴키 프로젝트의 표준 계약서인 FIDIC 실버 북을 기반으로 도출하였다. 발생 빈도가 가장 높은 클레임의 유형은 공기지연으로 분석되었다. 그 후, 가장 발생 빈도가 높은 클레임에 대한 책임이 계약 당사자간에 누구에게 있는지를 분석하는 프로세스를 제안하였다. 제안된 프로세스는 2010년에 수행한 2건의 대규모 EPC/턴키 프로젝트들과 FIDIC 실버 북의 공기지연 클레임에 관련된 계약 조항들을 기반으로 제안되었다. 제안된 프로세스는 발주자가 공사기간 지연에 대해 배상금을 설정하는지에 대한 의도에 따라 분류된다. 본 연구의 주요 기여도는 사례 프로젝트의 계약 조건을 기반으로 다양한 계약 유형에 적용할 수 있는 프로세스를 제안한 것이다. 뿐만 아니라, 계약서 작성 전에 발생 가능한 클레임의 유형을 확인할 수 있고, 공사기간 지연 클레임이 발생할 경우에 책임 당사자를 예측할 수 있으므로, 명확한 계약서 작성에도 기여할 수 있을 것이다.

공공투자사업의 입·낙찰 분석 (Analysis on Procurement Auction System in Public Procurement Service)

  • 공공투자사업에서는 최저가낙찰제, 턴키 제도, 대안입찰제 등 다양한 방식이 사용되고 있다. 최근 가격경쟁을 통한 효율성 제고를 주목적으로 하는 최저가낙찰제가 확대되어 시행되고 있다. 본 논문은 우리나라 입 낙찰 제도의 현황과 특징을 파악하고, 대형 공공투자사업에 주로 적용되는 최저가 낙찰제, 턴키 대안 입찰제도하에서의 가격 경쟁효과가 직접적으로 드러나는 낙찰률을 비교 분석하는 것에 의미가 있다. 각 입찰제도의 성과는 경쟁의 행태에 달려 있음을 고려하여 경쟁률과 낙찰률을 중심으로 여러 입찰제도의 입 낙찰 현황을 분석하였다. 1,000억원 이상 사업의 경우 최저가낙찰제하에서 평균 입찰참여자 수는 33.75명, 평균 낙찰률은 61.18%로 나타나, 턴키 대안 입찰제의 평균 입찰참여자 수 2.94명, 평균 낙찰률 90.20%와 큰 차이를 보였다. 최저가낙찰제의 경우 규모의 차이를 고려한다 하더라도 낙찰률이 현저히 낮으며, 경쟁의 정도가 심한 것을 확인할 수 있다. 이러한 낙찰률의 차이는 근본적으로 제도의 차이로 해석할 수 있으며, 경쟁의 차이로도 일부 해석할 수 있다. 민간투자사업의 경우, 평균 입찰참여자 수는 1.88명이며, 평균 낙찰률은 90%에 이르고 있어 경쟁 활성화를 통해 효율성을 제고할 여지가 있음을 제시하였다.

  • 최근 들어 선진국에서는 LCC에 대한 평가 제도를 활발히 활용 중에 있고, 우리나라는 건설공사비용을 절감하기 위하여 그 제도를 신규로 도입하고 있는 실정이다. 그리고 새로운 정부공사 발주방식인 "기술제안형 입찰방식" 도입에 따라 시설물 LCC를 평가하는 가격평가방식이 필요하게 되었다. 그러나 현재 우리나라는 BTL과 턴키 프로젝트에서 LCC를 평가하고 있으나 평가요소와 기준이 불명확하여 평가에 어려움을 겪고 있고 BTL과 턴키를 제외한 공공건설사업은 LCC 평가가 이루어지지 않고 있는 실정이다. 따라서 본 연구에서는 LCC를 체계적이고 객관적인 평가를 위한 평가기준을 제시하고자 한다.

Tensile and fracture characterization using a simplified digital image correlation test set-up

  • Digital image correlation (DIC) is now a popular and extensively used full-field metrology technique. In general, DIC is performed by using a turnkey solution offered by various manufacturers of DIC. In this paper, a simple and economical set-up for DIC is proposed which uses easily accessible digital single-lens reflex (DSLR) camera rather than industrial couple-charged device (CCD) cameras. The paper gives a description of aspects of carrying a DIC experiment which includes experimental set-up, specimen preparation, image acquisition and analysis. The details provided here will be helpful to carry DIC experiments without specialized DIC testing rig. To validate the responses obtained from proposed DIC set-up, tension and fatigue tests on specimens made of IS 2062 Gr. E300 steel are determined. Tensile parameters for a flat specimen and stress intensity factor for an eccentrically-loaded single edge notch tension specimen are evaluated from results of DIC experiment. Results obtained from proposed DIC experiments are compared with those obtained from conventional methods and are found to be in close agreement. It is also noted that the high resolution of DSLR allows the use of proposed approach for fracture characterization which could not be carried out with a typical turnkey DIC solution employing a camera of 2MP resolution.

국제건설계약(國際建設契約) 실무상(實務上) 유의점(有意點) (Some Practical Issues on the International Construction Contract)

  • Many Korean construction companies have been performing a variety of overseas construction projects since the 1970s. It is unfortunate that in many cases they have had to suffer big losses caused by errors and defects in the design and construction of the projects. In the author's opinion, however, there were losses that could have been avoided if they had understood better the feature and content of the particular construction contract. Few lawyers and scholars in Korea have been interested in the research and study of international construction contracts. This is mainly because they do not have access to practical sources outside of Korea for them to research and study since the contracts undertaken have been dealt with by law firms in other jurisdictions to which the disputes apply. This article is aiming primarily at the introduction of the issues which the practitioners are likely to confront in the process of reviewing and performing the international construction contract. In some cases solutions are sought about these issues based upon the FIDIC standard terms and conditions, the actual experience of practice, and UNIDROIT Principles, etc. It is reasonable to say that all the issues related to the international construction contract cannot be covered in a short article like this. The author wishes this article could induce subsequent studies on international construction contracts for further research. It has to be noted that from time to time Korean construction practices have been compared to the international ones for better understanding. This article mostly includes cases where the Korean construction companies go overseas for their projects, while there are some cases where foreign developers and financial investors participated in domestic projects in which international construction contracts forms were adopted. A few precedent domestic writings about international construction contracts seems to lack emphasis on the points that there are several standard construction contract forms and that they are different. The differences are mainly in accordance with who bears the design responsibility, how the owner has to make progress payments to the contractor and who the funding source for the project is. This article tries to make it clear that there are significant differences between the standard contract forms, e.g. a simple construction form, a design-build form and an EPC/turnkey form of contract. Again, the author hopes that this article can arouse the interest in the international construction contracts from both academic and practical fields, so that many subsequent advanced articles can help our construction industry become much more competitive in the world through awareness of the methods of procurement and administration of the contracts.

  • In this study, design concepts of Seoul Subway Construction (901∼914) are reviewed in relation to the cases for temporary soil support wall systems which are revealed in highly developed design competitions such as Turnkey and Alternative based on. Especially soil and rock properties, various design schemes for dealing with soil and water pressures, new technology adopted etc are discussed very profoundly and broadly for the better understanding and additional clues for constructing new design technologies.
