A Study on the Liability of the Builder in the Shipbuilding Contract and Products Liability. (선박건조계약상 건조자책임과 제조물책임)

  • A contract for the shipbuilding is usually a complicated and involves statement of rights, obligations and responsibilities which each party agrees vis-a vis the other. The ultimate purpose of the contract is the sale and transfer of the finished ship by the builder to the buyer. Contracts for the construction and sale of ships are categorized as contracts for the sale of goods under English, United States, Germany and some countries law. On the other hand, The shipbuilding contract may be classified, not as a contract of sale but as a contract for work and materials under Korea, Japan and some countries law. Especially, most of countries are now well settled with regard to liability of a manufacturer in tort for physical injury and on the other for pure economic loss to remote owners of chattels. Where there is either a breach of contractual warranty or an implied warranty, there may be admiralty jurisdiction, depending once again on the situs of the event and its relationship to traditional maritime activity. Contract principles will be applied to the first type of warranty and tort principles will be applied to the second. First of all, this thesis is dealt with the contents of contract under English Law. Secondly, this thesis is analysed into the liability of shipbuilder in Products Liability under English, American and Korean Law comparisons. In conclusion, the author tries to give some suggestions as countermeasures of Products Liability to the shipbuilder in Korea.

  • When existing trade creates a product, a series of processes is terminated when a seller or a buyer subscribes for transportation insurance and is guided through customs procedures according to the terms of the sales contract and then receives payment for it. Training practical Trade kowhow is also educated focusing on the procedures of these contracts. A new paradigm of the fourth industrial revolution was launched in the development of information communication technology and computer technology. Also, due to the Xinhuo tradeism triggered by the United States, the risk of commodity trading is further increasing. Currently, trade practical education of university and industry is carried out for most lecture and discussion. Since 2014, the curriculumof the department of trade has been increasingly managed by the NCS process. The curriculumof the department of trade department has the advantage of being managed in consideration of the characteristics of the company that wishes to find employment and the level of work content. Standardized, the curriculumcan faithfully reflect the characteristics of the company and the level of the work content. In the new era, a new educational method that reflects the trend of the 4th industrial revolution era is necessary. In this research, we propose that service trade practical education should be educated mainly on contracts, not on procedural basis as with traditional commodity trade education.

  • Traditional market which is characterized by the folksy retailing market has lost its competitiveness rapidly due to the emergence of the Internet and the change of customer's purchasing behavior. The recession of the traditional market contracts the regional economy. We suggest a u-Market, a traditional market with ubiquitous computing capability, to revitalize traditional market. The suggested u-Market system applies ubiquitous computing technologies characterized by communications between customers and objects without limitations of time and location. The proposed u-Market system offers location information and specific contents of traditional market to customers. Furthermore, u-Market system recommends the store and product list that customers are likely to visit and purchase based on their contexts, so they can save their time and effort to search the products or contents.

Research on Subcutaneous Pulse Shape Measurement by Near-infrared Moiré Technique

  • A pulse is generated when the heart pumps blood into the arterial system. The heart pumps blood only when it contracts, not when it relaxes; therefore, blood enters the arterial system in a cyclical form. Artery beating is visible in some parts of the body surface, such as the radial artery of the wrist. This paper mainly uses the feature in which near-infrared spectroscopy penetrates skin to construct a non-invasive measurement system that can measure small vibration in the subcutaneous tissue of the human body, and then uses it for the pulse measurement. This measurement system uses the optical moir$\acute{e}$ principle, together with the fringe displacement made by small vibration in the subcutaneous tissue, and an image analysis program to calculate the height variation from small vibrations in the subcutaneous tissue. It completes a measurement system that records height variation with time, and that together with a fast Fourier transform (FFT) program, they can convert the pulse waveform generated by vibration (time-amplitude) to heartbeat frequency (frequency-amplitude). This is a new and non-invasive medical assistance system for measuring the pulse of the human body, with the advantages of being simple, fast, safe and objective.

Evaluating the Performance of Revenue Sharing Contract in Three Stage Supply Chain System

  • Purpose: Focusing on the complex supply chain operations beyond the simple dyadic relationship, this study evaluates the performance of the revenue sharing contract in three stage supply chain system. Research design, data, and methodology: The optimization model is developed to describe the supply chain system where one manufacturer, one wholesaler, and one retailer exist and pursue the maximum level of their own profits. In the numerical examples of the proposed supply chain model, two types of the revenue sharing contract, pairwise and spanning methods, are tested and their performances are compared with the traditional system. Results: The numerical analysis reveals that both types of the revenue sharing contract outperform the traditional system. All supply chain members can achieve the improved profits only when they determine the proper combination of revenue share ratios and price discount rates. Conclusions: This study finds out that both pairwise and spanning revenue sharing contracts can make the positive outcome that is acceptable to all members in three stage supply chain system. When the proper contract content is agreed among the supply chain members, the revenue sharing contract has the potential to be the practically feasible collaboration program for the multiple stage supply chain system.

  • This study proposes a Natural Language Query Framework (NLQF) on the semantic web to support the intelligent deduction at semantic level. A large number of former researches are focused on the knowledge representation on the semantic web. However, to revitalize the intelligent agent (IA)-based automated e-business contract with human customers, there is a need for semantic level approach to the web information. To enable accessing web information at semantic level, this paper discusses the pattern of complex natural language processing at first, and then the semantic web-based natural language inference in e-business environment. The NL-based approach could help the IAs on the web to communicate with customers and other IAs with more natural interface than traditional HTML-based web information. Therefore, our proposed NLQF will be used in semantic web-based intelligent e-business contracts between customers and IAs.

  • Recently, activation of related construction projects due to the large traditional gas resource development of frozen soil region of Russia are expected. It is necessary to provide a plan that can be utilized and collectively managed the occurrence data in the engineering & construction stage for continued contracts of the pipe construction. Therefore, this research is aimed to provide a management plan of occurrence data for efficient management in engineering & construction stage of pipeline business in frozen soil region. The data of the engineering & construction(related pipe construction projects) can be accumulated each version and multiply managed. Furthermore, I will be expected to be the foundation of the systematic management of the classifying based on metadata and the optimizing operations using big data method.

Classify and Quantify Cumulative Impact of Change Orders On Productivity Using ANN Models

  • Change is inevitable and is a reality of construction projects. Most construction contracts include change clauses and allowing contractors an equitable adjustment to the contract price and duration caused by change. However, the actions of a contractor can cause a loss of productivity and furthermore can result in disruption of the whole project because of a cumulative or ripple effect. Because of its complicated nature, it becomes a complex issue to determine the cumulative impact (ripple effect) caused by single or multiple change orders. Furthermore, owners and contractors do not always agree on the adjusted contract price for the cumulative Impact of the changes. A number of studies have attempted to quantify the impact of change orders on project costs and schedule. Many of these attempted to develop regression models to quantify the loss. However, regression analysis has shortcomings in dealing with many qualitative or noisy input data. This study develops ANN models to classify and quantify the labor productivity losses that are caused by the cumulative impact of change orders. The results skew that ANN models give significantly improved performance compared to traditional statistical models.

  • The purpose of this research is to explore the necessity of utilizing IPD methods along BIM based project operation in domestic construction market. IPD is relatively new project delivery methods focused on the collaboration of stockholders based on BIM technology. IPD is focused on the multiparty contract process rather than multiple bilateral contracts under Traditional Project Delivery Methods. The research method is to investigate the IPD standard contract documents, successful IPD project cases in the U.S. The research results are as follows. The model for an IPD standard contract needs to be developed for the application to a real construction projects. Various types of IPD model contract need to be developed to accommodate the requirements of industry and stockholders in Korea.

  • In this study, we analysed the current situation of Internet-based insurance services which can provide a non-traditional and cost effective communication channel between the customers and insurance companies. The service of Internet-based cyber-insurance extends from mere advertisement to on-line contracts through planning simulations and, furthermore, to customer monitoring. This cyber-insurance is the demand of the times and is not to be overlooked-by the Korean insurance companies which are suffering from accumulated loss and are facing severe economic depression. We performed a comparative analysis between the domestic cyber-insurance service and pioneers'. Also, we suggested future possibilities of cyber-insurance services, presenting an architecture for the construction of a cyber-insurance management module within the meta financial investment system.
