A Study on the Use of Police Force in the Public Assembly: Focused on the Vehicle-wall-blocking and water cannon (집회현장에서의 경찰의 물리력 사용현황과 개선방안: 차벽과 물포 사용을 중심으로)

  • The freedom of assembly is the fundamental freedoms guaranteed by the Constitution. However, as far as our reality is concerned, the freedom of assembly is guaranteed only when it is under the control of the police, and otherwise it is perceived as an object to be suppressed. Police say even that they will not tolerate even a small illegal law while referring to the "broken window theory". Therefore, regardless of the peaceful nature of the rally, it is too obsessed with 'compliance'. This attitude is causing the citizens who participated in the assembly to be put to the object to be suppressed. This paper analyzes the requirements and current status of police force, focusing on the vehicle-wall-blocking and water cannon as a means of using the police force, which is a recent problem, and suggests ways to improve it. First of all, the installation of the wall cuts off the essential communication function of the assembly by separating the meeting place from the object of protest. Thus, despite the warning for prevention in the face of illegal acts, other than installing a barrier, it should be allowed only in the 'urgent case where there is a risk of causing damage to the life, body or property of the person'. Without this urgency, the vehicle-wall-blocking should not be allowed to be proactive as well as preventive. Secondly, the water cannon is a police force that is likely to harm people's life and body. Therefore, aiming shots, which could pose a significant risk to the human body, should in principle be prohibited. However, considering its risk, it should be supplementary used only when there is no other alternative, only when the direct risk to the legal interest of the other person or the order of public well-being is 'obvious'. In addition, as for the use standard of such a thing, it is necessary to be specified by law.

Seasonal Change in the Soil Chemical Properties from Sweet Persimmon Orchard in Gyeongnam Province (경남지역 단감 재배 토양의 화학성 변화 평가)

  • Field monitoring was performed to evaluate the soil chemical properties of 31 sweet persimmon orchard soil samples every two months from April to October in 2008 at Gyeongnam Province. Soil chemical properties such as pH, organic matter, available phosphate, exchangeable potassium, exchangeable calcium, exchangeable magnesium, exchangeable sodium, ammonium nitrogen, and nitrate nitrogen were analyzed. The soil chemical properties of both top soil, and subsoil showed that soil pH was significantly increased whereas ammonium nitrogen, and nitrate nitrogen were significantly decreased. The insufficient levels of nutrients in top soil, and subsoil were higher in 69.4%, and 84.7% for pH, 63.7%, and 84.7% for organic matter compared to optimum range. Meanwhile, the excessive levels of available phosphate showed 70.2% in top soil, and 46.8% in subsoil compared to optimum range. The experimental results showed that the optimum fertilization based on soil testing was the most important thing in soil nutrients management for sweet persimmon.

A Novel Runner Design for Flow Balance of Cavities in Multi-Cavity Injection Molding (다수 빼기 사출성형에서 캐비티간 충전균형을 위한 새로운 런너의 설계)

  • Small injection molded articles are generally molded by multi-cavity injection molding. The most important thing in multi-cavity molding is flow imbalance among the cavities because it affects the physical property and the quality of products. The cavity filling balance can be achieved by flow balance in the runner through the thermal balance. In this study, novel screw type runner or helical type runner has been developed for the flow balance in the runner and performed experiment and computer simulation. Flow balance has been observed using various screw type runners for several resins such as amorphous and crystalline polymers including low and high viscosities grades. Flow balance experiments have been performed for various injection speeds since the flow balance can be affected by injection speed among the injection conditions. Experimental results have been compared with computational results and they showed good agreement. The cavity filling balance can be achieved by the screw runner where the temperature distribution is uniform through the circulation flow along the screw channel in the screw runner. It has been verified that the novel screw runner is very effective device in flow balance in the multi-cavity injection molding. cavity filling imbalance, multi-cavity injection molding, runner design, screw runner, thermal balance.

  • As the network environment develops and speeds up, a lot of smart devices is developed, and a high-speed smart society can be realized while allowing people to interact with objects. As the number of things Internet has surged, a wide range of new security risks and problems have emerged for devices, platforms and operating systems, communications, and connected systems. Due to the physical characteristics of IoT devices, they are smaller in size than conventional systems, and operate with low power, low cost, and relatively low specifications. Therefore, it is difficult to apply the existing security solution used in the existing system. In addition, IoT devices are connected to the network at all times, it is important to ensure that personal privacy exposure, such as eavesdropping, data tampering, privacy breach, information leakage, unauthorized access, Significant security issues can arise, including confidentiality and threats to facilities. In this paper, we investigate cases of security threats and cases of network of IoT, analyze vulnerabilities, and suggest ways to minimize property damage by Internet of things.

A Legislative Study on the Plans for its Improvements and Problems of the Lien in the Real Estate Auction (부동산경매에서 유치권의 문제점과 개선방안에 대한 입법론적 검토)

  • A lien is the right to possession the thing until receiving repayment of its bonds in some cases that the property of other person or the occupant for marketable securities receive the bond that has occurred on that property or marketable securities. This has own purpose to break 'principle of creditor equality' to protect especially the bond of the subject occupant in terms of justice. These lien on our civil law come according to the law in prepared certain requirements. However, an incomplete real rights granted by way of security that does not have a preferential performance right or seniority on the exchange value of the object suffer from the problems a lot in the real estate auction process because of the feature that is not announced in the register unlike the mortgage. In addition, the lien of real estate is not lapsed in an auction process. There is no preferential performance righ in a positive law as providing that can oppose to the buyer(a successful bidder) until received repayment the secured bond price to be compliant with the lien(Civil Case Execution Law the 91st clause of Article 5). However, as asserted the super preferential performance righ to a buyer in real terms, acts as primary cause of breaking unexpected loss and according unfair law relation to a senior mortgagee and seizor, etc. and the principles of the creditors equality to the persons concerned in other words, the principles of justice. All of these issues are the establishment of the lien and theory conflict on the effects. In spite of the fluctuations of a real right about real estate is announced as a registration by the current law, only the lien come into unclear announcement means for possession. In addition, Civil Case Execution Law argument is caused by the adoption abernahmeprinzip about the lien (Civil Case Execution Law the 91st clause of Article 5).
