A Study on Limitations on the Right of Reproduction and Right of Communication to the Public in Digital Networked Environment (디지털 복제권 및 전송권 제한에 관한 연구)

  • It has been criticized that the right of reproduction and right of communication to the public in the Copyrigt Act of Korea, which was amended in the year of 2000 in line with new environments around digital networks, limited the limitation to author’s property right in private use and library exemption too much. Solving the problem above, this study analyzes comparatively WCT, Amended Proposal for a Directive on Copyright and Related Rights in the Information Society, Copyright Law of the United States of America, Copyright Amendment(Digital Agenda), and Copyright Act of Korea. Based on the results from related case analyses and a survey on how stakeholders view copyright issue, in addition, this study presents a reasonable way of limiting rights of reproduction and rights of communication to the public.

  • The N Screen service has been focused because of the explosive growth of Smart media. However, between content producers and service providers have been causing the copyright issue while N-Screen service providing real-time channels. In this study, the current copyright issues are analyzed by examining at the right relationships associated with the right of communication to the public and private copy that caused by sling box which is activated N Screen.

The monitoring Case Analysis of Nutrition-related Programs Presented on Television Broadcast Media (TV 속에 나타난 식생활관련 정보의 모니터 사례 분석)

  • The purpose of this study was to analyze information about food and nutrition topics presented throughout the television broadcast media, thereby suggest the optimal communication method to give right information to the general public. To perform this study, total sixteen monitoring people were recruited and trained through monitoring practice before and during the study . Five domestic TV channels were selected to be monitored, for six months. For the best efficiency, all the monitoring people were divided into 8 teams based on the regional consideration. The statistical analysis of data was completed using SAS program. The main results of this study are as follows. First, the total reporting cases of information about foods and nutrition were 237 , among which about 30% was classified as appropriate and 70% as inappropriate based on the trained monitors' evaluation. Second, the analysis of contents about incorrect informations showed that the insufficient descriptions of terminology and contents were the highest. And insufficient scientific evidences, incorrect contents excessively entertainment-oriented, no provision of alternatives , improper selection of expert advisors were followed. These results suggest that systematical monitoring should be continued to reduce the frequency of incorrect communication thereby give the right information in food and nutrition area to the general public. And there should be a closely cooperated system to provide the professional information to broadcasting production team by establishing the strategic program. In order to do that, most importantly the advisory team should be organized to professionally connect mass media to corresponding specialists. In addition, more educational programs about food and nutrition should be developed to provide right information to the general public.

A Study on Legal Limitations of Teachers' Right for Expression (초.중.고교 교원의 정치적 표현과 제한법리에 관한 탐색적 연구: '시국선언' 관련 판례를 중심으로)

  • This study examined how the Korean courts have made a balance between rights of school teachers' expression and the public interests derived from regulating their rights for expression in related cases. Under the Korean laws such as National Public Service Law and the Law on Assembly and Demonstration, school teachers are considered as civil servants and basically not allowed to assemble to demonstrate for their own interests. The analysis revealed that in 24 cases from a total of 31 teacher-related court cases, teachers were found guilty in violation of related laws. In deciding whether the teachers' participation on anti-government assembly was guilty or not, the courts put an emphasis on public purpose of their expression, the degree to which their expressions affect the society, and specific contents of their expression. Conclusively, it was found out that in applying the related law, Korean courts tend to overweigh the public interests, rather than the teachers' right to express.

  • Information and Communication Technologies(ICTs) have substantially enlarged both the opportunities to realize one's human rights but have also resulted in the emergence of new challenges. ICTs are so deeply embedded and cental to almost all aspects of human activity. And ICTs are assuming an increasingly central role in all aspects of human and societal development across the world. But this is especially true of the right to privacy, which faces challenges such as profiling and data mining for public(including national security) and private purposes. ICTs access is a fundamental right for all humans in the information age. So we have need for regulation based on human rights in the digital age. And governments have a responsibility to protect individuals against violations of human rights and data protection by public authorities, but also by private entities. In addition, internet governance and multi-stakeholder principle have to be stressed on all of the internet issues because internet governance is included in the principle of democracy which have bottom-up communication and equality. So it is very importance that Internet Governance Forum is the space for a meaningful discussion on public policy issues relating to the internet.

  • In Korea mobile phone subscribers exceeded 1 million people in 1995, and ten million people in 1998. Prevalence of the mobile phone increased dramatically over 110% compared to the population. Almost every family members including children uses more than one mobile terminal. Mobile phone is obviously more necessary good than washer, vacuum cleaner and passenger car. Our daily life are conveniently positioned with mobile communication, but communication related costs including the price of the device and service charges become a big burden on the household. But the government does not seem to do the right role at the right time to prevent the market failure to maximize consumer welfare and social welfare through supporting fair competition. This principal-agent problem issues of mobile communication policies will be understood in perspective of public choice against joint use of the mobile communication network, number portability, separation of phone distribution and phone service, network neutrality, mobile phone subsidy since the early 1990s when mobile phone service was introduced in Korea.

  • The article is devoted to the problems and prospects of integration of informational technologies in the administration of justice as a necessary component of the development of the informational society in Ukraine. In general, informational technologies make it possible to create new forms of organization and interaction of bodies of public authorities with society, to introduce innovative solutions for legal regulation and organization of public relations. More and more services for citizens are moving to electronic format. Judicial reform is aimed at ensuring more comfortable and convenient interaction with the courts. The need for the usage of informational technology in the proceedings is preconditioned by the global informatization of modern society, the development of new forms of interaction in the civil sphere with the usage of electronic means of communication: the global Internet, mobile, and satellite communication systems and more. "Electronic justice" involves the use of information and communication technologies in the implementation of procedural law.

Achieving the Naked-eye 3D Effect for Right-angled LED Screen by Off-line Rendering Production Method

  • As a new trend in the development of urban public spaces, the use of right-angle LED screens perfectly combines building facades with naked-eye 3D visual effects, providing designers with a brand-new creative platform. How to create a realistic naked-eye 3D effect on a right-angle LED screen and bring an immersive visual experience to the audience has become a question worth exploring. So far, production companies have yet to announce the relevant design ideas and complete production methods. In order to explore the production principle and production process of the naked-eye 3D effect of the right-angle LED screen, we summarize the basic production principle of the naked-eye 3D impact of the right-angle LED screen through case analysis. Based on understanding the production principle, the actual case production test was carried out, and a complete production process of the naked eye 3D visual effect of the right-angle led screen was tried to be provided by off-line rendering. For the problem of how to deal with image deformation, we provide two production methods: post-production software correction and UV mapping. Among them, the UV mapping method is more efficient and convenient. Referring to this paper can help designers quickly understand the production principle of the naked eye 3D effect of right-angle LED screens. The production process proposed in this paper can provide a reference for production method for related project producers.

BACS : An Experimental Study For Access Control System In Public Blockchain (BACS : 퍼블릭 블록체인 접근 통제 시스템에 관한 실험적 연구)

  • In this paper, we propose an access control system using cryptography as a method to protect personal data in public blockchain. The proposed system is designed to encrypt data according to the access policy, store it in the blockchain, and decrypt only the person who satisfy the access policy. In order to improve performance and scalability, an encryption mechanism is implemented outside the blockchain. Therefore, data access performance could be preserved while cryptographic operations executed Furthermore it can also improve the scalability by adding new access control modules while preserving the current configuration of blockchain network. The encryption scheme is based on the attribute-based encryption (ABE). However, unlike the traditional ABE, the "retention period", is incorporated into the access structure to ensure the right to be forgotten. In addition, symmetric key cryptograpic algorithms are used for the performance of ABE. We implemented the proposed system in a public blockchain and conducted the performance evaluation.

Alternative Financial Resource and Option for the Funding of Public Broadcasting (공영방송의 대안적 재원과 재원산정구조의 모색)

  • The public broadcasting in Korea are currently financed primarily through license fees paid by anyone who holds a TV set. This paper aimed for other options; How can we have a stable cash flow for public broadcasting account for right incentives, lack of sufficient government intervention, efficiency and quality? As this paper shows, bringing taxes more efficient and fairer, while a solid foundation for the public broadcasting finance; combined with an incentive based payment system this may be a sensible alternative to the forthcoming poll tax.
