A study on Introducing Intelligent Electronic Monitoring System through the Analysis of the Electronic Supervision (전자감독제도의 실태분석을 통한 지능형 전자발찌 도입 방안)

  • Since the sexual violence crime has a high probability of repeated crime, the electronic monitoring system has been introduced as a measure to it. And this system allows the police to know the location of former criminal around the clock through the electronic device, the former criminal has the psychological/mental oppression which can restrain the intention of crime to a degree. However, there is a limit in blocking criminals with strong will from repeated crime. The next-generation intelligent electronic anklet currently under study collects and analyzes the change bio-data in real time through the location information of electronic monitoring target and attached sensor. This study is aimed to predict the symptom of crime occurrence in advance based on this and block the crime intention in advance or stop the ongoing crime before it is expanded.

The Effect of Disgust on Legal Judgment: Disgust Induced by the Crime Scene vs. Sexual Minority Stereotypes (혐오 정서가 법적 판단에 미치는 영향: 범죄현장으로부터 유발된 혐오와 성 소수자 고정관념에서 비롯된 혐오)

  • This study compared the nature of disgust caused by the crime scene with that by the stereotype of the sexual-minority defendant, and compared the effect of each type of disgust on evidence evaluation and legal judgment. A total of 600 participants (300 men, average age of 44.40) were randomly assigned to sources of disgust (crime scene, sexual minorities defendant, control condition), the existence of additional evidence of innocence (o/x), and the existence of judicial directives (o/x). As a result of the study, disgust under the condition of a cruel crime scene with strong physical disgust was significantly higher than that of the sexual minority defendant, interpreted the evidence in a more guilty direction, and was more prone to_evaluate that the defendant was guilty. It is noteworthy that evidence evaluation was a significant moderating variable between disgust and probability of guilt under conditions where the source of disgust was a sexual minority, but not under control conditions and crime scene condition. It means that the effect of disgust on legal judgment may not be direct when the defendant is a sexual minority. In addition, the existence of the judicial instruction had a significant inverse effect on the sentence. And simple effect analysis found that presenting judicial instruction lowered probability of guilt only under the control condition. This makes it reasonable to infer that disgust derived from the characteristics of the crime scene and the defendant can be recognized as integral emotions that are difficult to correct with instructions. Finally, pity for the defendant was significantly higher under the conditions of sexual minority which shows that an emotional response of sympathy may occur in addition to disgust for sexual minorities. After examining the nature of disgust (physical & moral), legal judgment according to the source and degree of disgust was reviewed. In addition, the meaning of disgust and sympathy for the sexual minority defendant was discussed.

Effects of Intensive Course Program on the Sexual Violence for the Re-crime Risky Group in the Sex Offender: Focused on Impulsivity, Anger Expression, Rape Myth, and Self Esteem (재범위험 성폭력사범 집중교육 프로그램의 효과: 충동성, 분노표현, 강간통념, 자기존중감을 중심으로)

  • The purpose of this study was to find out how effect does the second-stage which is the intensive course program for sexual offenders of three-stage(basic, intensive and advanced remedial) on impulsivity, anger expression, rape myth and self-esteem of sexual offenders. To this end, 10 people waiting for the second-stage intensive education among sexual violence offenders serving at M prison located in J province were selected as subjects for the study. To verify the effectiveness of the program, repeated measurement design(pre, post and one month post test) was conducted, and a total of 200 hours of 'Intensive Course Program on the Sexual Violence' was conducted to the subjects. The results of this study are as follows. It was confirmed that the intensive course program on the sexual violence for the re-crime risky group in the sex offender is effective in reducing impulsivity and anger expression, which are risk factors of sexual crime, bringing positive changes to rape myths, which are distorted sexual perceptions of sexual violence criminals, and improving self-esteem. Finally, it suggested the necessity of continuous development and improvement of sexual violence preventive programs targeting sexual offenders, and construction of systematic supervision and related system to ensure the effectiveness of remedial after release of sexual offenders.

  • The importance regarding the notion of immediate medical treatment and nursing for the victims of sexual crimes is not widely recognized yet in Korea. Throughout this research is focused on the nursing systems and the system of foreign countries in reference to sexual crime victims, and the conclusion is as follows. In Korea, there are currently no educational or medical institutes for the medical handling for the victims of sexual crimes, and the role of nurses in the medical institutes is insufficient. In addition, the basis for the standard of operation regarding the initial response, evidence collection, pursuit of systematical evidence and data is not established even in the sexual assault counseling/advocacy center. Therefore, it is necessary to foster the sexual assault nurse examiner for the sexual crime victims, and to develop adequate training programs based on the present situation in Korea. Though the cooperation among government, medical institutes, and social movement groups, it is essential to initiate effective and publicly-trusted specialized training programs for forensic nurses who will be fully charged with the treatment of sexual crime victims. By introducing the sexual assault nurse examiner system, it can be possible to develop advanced treatment for the child or adolescent victims of sex crimes.

  • The child sexual abuse is a serious social problem. The children are to seek the physical ability for protecting the mselves from crime. However there is no effective prevention program for that. The reason why the lack of understanding of society and the people's attitude as a fence sitter provoke in a roundabout way to the child sexual abuse. Thus this these conducted a survey research about the child sexual abuse for the common citizen. The questionnaire s were analyzed and composed of a frequency analysis and a cross-tabulations by using the tool SPSSWIN. The res ult was that the crime for child was often occurred nearby school and any effective prevention system.

Effects, Perception, and Political Implication of Sexual Crime on Public Transportation (여성의 성범죄 피해경험이 교통행태에 미치는 영향분석 및 정책적 함의)

  • This study was performed to investigate the currents status of the sexual assaults on women public transportation users and to provide solutions in order to provide safe transportation services to women. Data was collected through in-depth interviews with career women in Gyeonggi-do. The main purpose of the interview was to understand their experiences about sexual assaults while using public transport and to investigate the extent to which their experiences affected their transportation-related behaviors. The effects of various related transport policies on women behaviors were also analyzed by estimating structural equation models. The results showed that among them, CCTV, accessible warning bells, and more police presence seemed to be more effective, but that woman-only sections were not as effective as others in reducing the number of crimes. The results implied that individual subjective norms and their perceived behavioral control, behavior intention were important factors. Based on these results, we recommended additional policies more effective in sexual crime reduction.

  • In this study, actual contact status to cyber obscene materials of high school students was grasped and the influence of contacts to cyber obscene materials on sex crime was analyzed. For this purpose, actual contacts status to cyber obscene materials, influence of cyber obscene materials, attitude of sex, and consciousness of sex crime were surveyed and accordingly correlation between each survey result were totally analyzed. This study result revealed that there is a close correlation between contacts to cyber obscene materials and sex crime. Obscene materials wrongly lead students who have big sexual curiosity to create distorted sexual behaviors and also commit sex crimes.

A Study on the Characteristics of the Spatial Distribution of Sex Crimes: Spatial Analysis based on Environmental Criminology (성폭력 범죄의 공간적 분포 특성에 관한 연구: 환경범죄학에 기반한 공간 분석)

  • The interest in the prevention of sex crimes and social secure is growing as the number of cases by sexual offences becomes higher. Although various punishable ways have been introduced so far, increasing sex crime is still going on. Thus, effectiveness of legal systems for preventing crimes is questionable. More recently, the approach for environmental criminology has been paid attention for reducing criminal opportunities through environmental design and management of crimes. This study attempts to look over the spatial distribution of sexual crimes in the context of environmental criminology, and examine the correlation between regional environmental factors and the occurrence of sexual crimes empirically. To do this, we visualized the map for sex crimes at the macro-scale and explored the spatial distribution of sexual crimes and spatial clusters based on various spatial statistics using sex crime data published online by the ministry of gender equality and family. Also, we derived the environmental characteristics of sexual crimes by multivariate regression analysis on a large number of explanatory variables of regional environment. Our results will help to understand the current situation and spatial aspects of sex crimes in the nation more realistically. Further, it is respected that our results might be useful basic information for establishing regional policies and plans for the prevention of the sexual crime and enhanced public policing.

The Current State and Legal Issues of Online Crimes Related to Children and Adolescents

  • There are two categories of online crimes related to children and adolescents: those committed by adolescents and those committed against children and adolescents. While recent trends in criminal law show consensus on strengthening punishment in cases of crimes against children and adolescents, there are mixed stances in cases of juvenile delinquency. One perspective emphasizes strict punishment, whereas the other emphasizes dispositions aligned with human rights. While various forms of online crime share the commonality in that the main part of the criminal act occurs online, they can be categorized into three types: those seeking financial gain, those driven by sexual motives, and those engaged in bullying. Among these, crimes driven by sexual motives are the most serious. Second-hand trading fraud and conditional (sexual) meeting fraud fall under the category of seeking financial gain and occur frequently. Crimes driven by sexual motives include obscenity via telecommunication, filming with discrete cameras, child and adolescent sexual exploitation material, fake video distribution, and blackmail/coercion using intimate images/videos ("sextortion"). These crimes lead to various legal issues such as whether to view vulgar acronyms or body cams that teenagers frequently use as simple subcultures or crimes, what criteria should be applied to judge whether a recorded material induces sexual desire or shame, and at what stage sexual grooming becomes punishable. For example, sniping posts, KakaoTalk prisons, and chat room explosions are tricky issues, as they may or may not be punished depending on the case. Particular caution should be exercised against the indiscriminate application of a strict punishment-oriented approach to the juvenile justice system, which is being discussed in relation to online sexual offenses. In the punishment case of online crime, juvenile offenders with a high potential for future improvement and reform must be treated with special consideration.

  • Recently crime against children is emerged as a serious social problem. Children should be protected in social. However, they have become major targets of the crime, as sexual abuse, abduction, abuse, domestic violence, school violence and so on. To solve these problems, it is important to educate crime prevention for children all above. Entertainment is one of the edutainment's elements. It attracts voluntary participation, immersion, and continuous learning from children. Edutainment contents for prevention of crime against children are far less fully studied than that of school subject as Mathematics, English, and so on. There is no serious study on edutainment contents for prevention of crime against children, as well as base study and approach way. Now more than ever, safety needs are strongly demanded in society. Accordingly, study on edutainment contents for prevention of crime against children have been demanded more than ever. In this paper we shall see basic approach principles and planning process of web-based edutainment contents for prevention of crime against children. This study lays the foundation for future work on edutainment contents for prevention of crime against children.
