A Case Study on the Fundamental Breach of Contract and its Application for the Avoidance of Contract and Requiring Substitute Goods under the CISG (국제물품매매계약에 관한 UN협약(CISG)상 근본적 계약위반과 이를 원용한 계약해제권과 대체품청구권에 관한 판례연구)

  • This study primarily concerns the fundamental breach of contract by a seller and a buyer's two remedies that are entitled to under the CISG. Regarding the breach of contract, the CISG simply provides a list of each party's obligations and regulates that both parties should fulfill the obligations under the contract as well as the Convention. When the CISG specifies the remedies for both parties, it requires to divide the fundamental breach of contract from breach of contract. By doing so, it provides different remedies to both parties depending on whether it is the fundamental breach of contract or not. From the point of buyer's view, the buyer has two remedies when there is the fundamental breach of contract by the seller; they are the right to declare the avoidance of contract and to require the delivery of substitute goods. The fundamental breach of contract is a pre-requisite condition to be fulfilled in order to exercise these two remedies. Although the CISG provides the definition of fundamental breach of contract, its meaning is not clear enough, so it is interpreted and applied case by case. Therefore, this paper will analyze recent cases focusing on the most debated issues regarding the interpretation of fundamental breach of contract; first, who determines the substantial deprivation and when is the time for determination, second, when is the time for unpredictability of substantial deprivation, and last, who has a burden of proof.

Multi-Phasic Mental Health Characteristics according to Harm-Avoidance and Self-Directedness Profile of Cloninger's Biopsychosocial Model (클로닌저의 생리심리사회 모델에서 위험회피-자율성 프로파일에 따른 다면적 정신건강 특성)

  • Objectives: The combination of Harm-Avoidance (HA) and Self-Directedness (SD) of Temperament and Character Inventory (TCI) has been reported pivotal for mental health; however its clinical usefulness in integrative medicine has not sufficiently reported. The purpose of this study was to illustrate multi-phasic mental health of subjective satisfaction with life, emotional well-being, and psychopathology, following the HA-SD profile groups. Methods: A total of 527 Korean university students reported HA and SD scores as to render their HA-SD profile, and multi-phasic mental health characteristics using Satisfaction with Life Scale (SWLS), Positive Affect and Negative Affect Schedule (PANAS), and Beck Depression Inventory (BDI) with composite well-being scales of SC (Sum of Self-Directedness and Cooperativeness score) and HI (Happiness Index, subtraction of Negative Affect (NA) score from Positive Affect (PA) score) as standardized. Pearson's correlation was used to report correlation coefficient, and the ANCOVA with age and sex as covariates, to show significant differences in mental health and well-being between the HA-SD profile groups. Results: The HA-SD profile groups showed distinctive multi-phasic mental health characteristics; health related scores of SWLS, PA, SC and HI decreased following the order of hS (low HA and high SD), HS (high HA and high SD), hs (low HA and low SD) and Hs (high HA and low SD) profile groups; however the non-health related scores of NA and BDI showed contrasting order. Conclusions: The HA-SD profile was found to be clinically useful for examining multi-phasic mental health and well-being status, and the TCI may be an imperative personality inventory for integrative medicine.

  • Purpose: This study aimed to understand the relationship between risk-sensitive factors and safety and unsafe behavior, and to clarify the relationship between risk-sensitive factors and demographic cha- racteristics through response matching analysis. To this end, a survey was conducted on 501 construc- tion site workers and data were analyzed using the SPSS program. Method: Six factors were derived through frequency analysis, cross-analysis, exploratory factor analysis, and reliability analysis for data purification. Multiple regression analysis and response analysis were conducted. Result: Risk-sensitive sensitivity and avoidance were found to have a significant effect on safety behavior and unsafe behavior, and the relationship was found according to age and occupation. Conclusion: Taken together, it shows that safety behavior is influenced by managing individual risk sensitivity and sensitivity, and properly managing avoidance. Accordingly, it suggests that intervention is necessary to manage risk sensitivity and sensitivity to promote safety behavior and maintain a sustainable safety culture, and to prevent excessive avoidance.

  • A mis-handling of the ship operators show high rate among the whole marine accidents. Since the port conditions have been getting worse. also as her size and speed increase, collision risk has been increased so that ship needs the automatic control system for collision. From that purpose, this research has been proceeded. The research has based on the MMG mathematical model, used Surge-Sway-Yaw motion equation, the information from the position and estimated time of collision point (DCPA and TCPA) to determine the collision risk with Fuzzy theory. To verify this system, ship was simulated when the ship encountered multitude of ships around the coast. The simulation result shows good application in avoiding ship collisions around the coast.

  • Since the first Cubesat was launched in 2003, there have been more than 230 Cubesats launched so far. Due to their small size and lightweight, Cubesats were launched by utilizing the empty space of regular launch vehicle. However, this launch method has a weakness that has been easily affecting by the schedule of major payloads. As a new solution to this problem, it has been proposed that a robot arm installed on ISS would be used to launch Cubesats. The orbits of Cubesat deployed from the ISS in various angles and directions are analyzed in this paper. We also analyze the possibility of collision between the Cubesat and ISS within the operational orbit of the CubeSat and eventually calculate the optimal angle of a robot arm, which maximizes the lifetime of Cubesat and minimizes the risk of collision between the Cubesat and ISS.

Verification of the HACCP System in School Foodservice Operations - Focus on the Microbiological Quality of Foods in Heating Process and After-Heating Process - (학교급식소의 HACCP 시스템 적합성 검증 -가열조리 및 가열조리 후처리 공정의 미생물적 품질평가를 중심으로-)

  • The objective of this study was to evaluate and improve the microbiological quality of HACCP application in school foodservice operations. The microbiological quality of foods and utensils were evaluated two times at each critical control point (CCP) with 3M petrifilm in five Daegu elementary schools. Two processes were evaluated: Heating process and after-heating process. The CCPs of the heating process were receiving, cooking and serving temperatures. The CCPs of the after-heating process were personal hygiene, cross contamination avoidance and serving temperature. After the first experiment, 31 employees of five schools were classroom educated, trained on-site, and pre- and post-tested on HACCP-based sanitation with the goal of improving the microbiological quality of the foodservice. Scores representing knowledge of holding, thawing, washing, food temperature, sanitizing and food-borne illness increased after education. In the heating process, internal food temperatures in the first and second experiments were higher than 74$^{\circ}C$, the holding temperature in the first experiment was less than 6$0^{\circ}C$. In the second experiment, the serving temperature improved to a satisfactory level. The microbiological quality in the second experiment improved by decreasing the time from cooking to serving. In the after-heating process, the ingredients were boiled before being cut in the first experiment. In the second experiment, ingredients were cut before being boiled, improving microbiological quality. Also in the second experiment, cooking just before serving food improved its microbiological quality through time-temperature control. These results strongly suggest it is essential to measure microbiological quality regularly and to educate employees on HACCP continuously, especially time-temperature control and cross contamination avoidance in order to improve foodservice quality.

Korean Medication Algorithm for Panic Disorder 2008 : Diagnosis, Treatment Response and Remission of Panic Disorder in Korea (한국형 공황장애 약물치료 알고리듬 2008 : 공황장애의 진단, 치료 반응과 관해의 평가)

  • Objective : This article is a part of the Korean Medication Algorithm Project for Panic Disorder, which aims to build consensus regarding the diagnosis, treatment response and achievement of clinical remission for patients with panic disorder in Korea. Methods : The questionnaire used in this article had parts : 1) diagnosis, 2) treatment response, and 3) remission for patients with panic disorder. The questionnaire was completed by each of 54 Korean psychiatrists who had much experience in treating patients with panic disorder. We classified the experts' opinions into 3 categories (first-line, second-line, and third-line) using the ${\chi}^2$-test. Results : Five factors were considered in this research : panic attack, anticipatory anxiety, phobic avoidance, severity of illness, and psychosocial disability. Most reviewers agreed that the presence of a panic attack was the most important factor in the diagnosis of patients with panic disorder. Phobic avoidance was included in the first-line category, whereas the severity of illness and psychosocial disability were included in the second-line category. Most reviewers also agreed that the presence of a panic attack was the most important factor in determining the appropriate treatment response, and it was included in the first-line category along with several other items. To determine remission status, the patients' scores on tests pertaining to the severity of panic attack, anticipatory anxiety, phobic avoidance, severity of illness and psychosocial disability should be less than 3.0-3.3 on a 9-point Likert scale. Conclusion : We suggest useful information for making a diagnosisof panic disorder, determining the appropriate treatment response and identifying remission in panic disorder patients on the basis of the results of a nationwide survey of experts in Korea.

  • 본 논문은 DC모터와 Bluetooth모듈을 통해 직접 조종하여 움직이는 알람시계 형태로 로봇을 제작하여 단순한 알람시계가 아닌 재미와 편의를 제공하는 알람시계 로봇을 제안한다. Arduino Uno 보드(ATmega328 기반의 마이크로컨트롤러 보드)와 DC모터를 이용한 로봇 본체, 스마트폰과 통신하는 bluetooth모듈, 로봇을 작동하는 어플리케이션 등으로 구성된다. 알람이 작동되면서 랜덤하게 움직이는 로봇은 블루투스 통신으로 제어가 되고 사용자의 조종에 따라 움직인다. 로봇은 스마트폰과 블루투스 통신을 통해 받은 데이터로 조종되어 지정된 도착장소로 움직일 수 있다. 이러한 로봇을 제작하여 실생활에 상용화 가능하게 만들어 또 하나의 아이디어 알람시계가 되고자 하는 목표를 가진다.

  • 본 논문은 AGVS(Automated Guide Vehicle System)가 여러 작업환경 및 변경 시 좀더 유연하게 대응할 수 있도록 작업환경 내에서 AGVS에 필요한 작업공간요소로 분류하고 이들을 모델링하는 방법을 제안하였다. 또한, 최단경로 생성 시 $A^*$ 알고리즘에서의 평가함수 선정 방법과 최단경로 상에 존재하는 경로의 충돌 모델을 제안하였으며 시뮬레이션을 통해 제안한 방법을 증명하였다.

Biopsychological Validation of the Sasang Personality Questionnaire in Middle School Students (중학생에서 사상성격검사(SPQ)의 생리심리적 타당화 연구)

  • Objectives The Sasang Personality Questionnaire (SPQ) measures the Yin-Yang temperament of Sasang typology with proven structural and clinical validity in adults, however it was not examined with teenagers. The purpose of this study was to validate the biopsychological structure of SPQ in middle school students.Methods 681 Korean high school students (356 boys and 325 girls) completed SPQ, Junior version of Temperament and Character Inventory (JTCI), and height and weight measures. The correlation between SPQ and JTCI subscales were examined, and the differences of SPQ and JTCI subscales, Body Mass Index (BMI) and Pondera Index (PI) among high (30%), middle (40%), and low (30%) SPQ total score groups were investigated with Analysis of Variance (ANOVA). The profile analysis was also performed to compare JTCI subscale profiles of three SPQ total score groups.Results The SPQ score was significantly (p<0.001) correlated positively with JTCI Novelty-Seeking and negatively with JTCI Harm-Avoidance. The JTCI Novelty-Seeking score of high SPQ group was significantly (p<0.001) higher than that of low SPQ group, and the JTCI Harm-Avoidance score of low SPQ group was significantly higher than that of high SPQ group. The JTCI subscale profiles for three SPQ groups were significantly different for boys and girls. Significant correlations or differences for the PI and BMI among SPQ groups were not found.Conclusions This study presented that the biopsychological structure of SPQ is robust as shown in adults. The SPQ would be a useful clinical measures of Sasang typology in pediatric patients.
