The Role of Reason in Aquinas' Theory of the Freedom of Will (의지의 자유선택에 있어서 이성의 역할 - 토마스 아퀴나스에게서 의지와 이성의 관계에 대한 하나의 고찰 -)

  • The overemphasis of the priority of reason over will runs the risk of resulting in intellectual determinism. On the contrary, it is also unfair to underestimate the role of reason in Saint Thomas Aquinas' theory of the free will to avoid intellectual determinism. For, according to Thomas, "the will inclines to the good, insofar as it is an appetite, and it follows the judgment of the reason in the pursuit of the good, insofar as it is a 'rational' appetite." It is the objective of this article to show that, for Thomas, the idea of the free will is not contradictory to that of the will's following the judgment of reason. For this purpose, it is decisive to adequately evaluate the role of reason in Thomas's theory of the free will. This article therefore proves that in principle Thomas argues the priority of the will over reason as well as the freedom of the will, and that he nevertheless recognizes the role of reason which precedes the choice of the will by making the second-level judgment even when the will chooses not to follow the first-level judgement of reason. It is entirely up to the will to follow the judgement and order of reason or not. It explains the freedom of the will. But 'not to follow reason' is contradictory to the essential determination of the will as the 'rational' appetite. For from the will's not following reason, wrong-doing follows; the human act which does not conform to reason. This article therefore argues that for Thomas, the 'true' liberty of the will corresponding to its determination as the rational appetite consists in its following the rule and order of reason, not in acting against the judgement of reason.

  • In our study, we tried to quantify Qi through establishing the interpretive method which would be used for inspecting the interrelationship between the Qi in Oriental Medicine and the physiological signals measured at the acupoint. We found out that some physiological signals measured at the acupoint of Meridian could be considered as a scientific Qi. Circulation rules of Qi probating the linkage between physiological signals and Qi are presented as promoting and counteracting rules of the Five Evolutive Phases within the traditional Oriental medicine literatures. We found that promoting and counteracting relations of the Five Evolutive Phases based on the New table about the rule of causing unbalance state(nTRCUS) can be widely used as a interpreting device for verifying the interrelation of human physiological signals and Qi. Standardizing the measured physiological signals into percentage could make relative comparison and judgement of the Five Evolutive Phases deviation possible. Though the physiological signals measured by instruments have different physical values, we could have the interpretation by the same promoting and counteracting rules of the Five Enolutive Phases. We measured EAV indices for 24 hours and discussed them in the view of Qi Circulation in Meridian.

  • This thesis is concerned with the study of the court attire the typical attire of the ju-dicial world in a point of time that more than 100 years have passed since the introduction of the modern judical system. In recognition of the fact that compiled data of the official uni-form or attire in Korea are insufficient this study placed its signification on the provision of information with focus on attire. As a result of studying court attire in Korea the conclusion was made as follows: Firstly Official attires in Yi Dynasty were divided by wearing embroidered insignia on the breast and the back of an official robe ac-cordint to court rank as well as by wearing Sa-mo in wadded clothes of Dan-ryeong and attaching all sorts of appurtenances including bands and shoes The Minister of Justice was equipped with Ho-pyo Dae-sa-heon equipped with Hae-chi the mayor of Seoul equipped with Un-an In the era of the Kng Young-jo the minister of Justice had no change in its of-ficial robe but the mayer(Pan-yun) of Seoul (Han-sung-bu) had Un-an(wild geese in clouds) changed into Un-hak In the King Ko-jog era the minister of Justice had Ho-pyo changed into Ssang-ho and the mayor of Seoul had Un-hak changed into Ssng-hak on embroideved insignia on the breast and back of an official robe. Laws and regulations concerning court attire began with the In-judgement Full-dress Uni-form Requlation for official-level Clerical Staff below the ordinary staff the Issue No. 14 of the Royal Ordinance in 1906 provided as $\ulcorner$the matter cincerning the Dress Regulation of the Tribunal staff of the Cho-sun Government-General$\lrcorner$the Issue No. 222 of the Royal Ordi-nance in 1911 and changed into$\ulcorner$the Regu-lation on the Dress of Judge Prosecutor At-torney and Law Count Clerk$\lrcorner$the Issue No. 12 of the Supreme Court Rule in 1953 affter the establishment of Korean Government since emancipation from the Japanese rule and into $\ulcorner$the Regulation concerning the Court Attire of Judge and law Court Clerical Staff$\lrcorner$the Issue No. 516 of the Supreme Court Rule in 1966. The judicial system in Korea is the system introduced from the foreign country rather than autogenously developed. And it came to pass through the Japanese colonial period it the beginning that it took root in Korea n was not stabilized in harmony with our native tradition. Accordingly the attare regulation in the judicial system took root in our society by accepting the Japanese attire regulation as it was and judical officials have come to wear the count attire similar to that of the Japanese imperialist era due to its influence though Korean independent goverment was established together with liberation form the Japanese rule. The more regrettable thing is that the current court attire has maintained the form greatly influenced by the U. S. court attire. Fortunately as the judicial circles have recently raised their voices for change in the court attire it has been told that the forma-tion of a meeting for a new court attire has been under way. The birth of the court attire into Which our tradition is sublimated is expected. This study end up with thinking that the must Korean thing is the most global thing in this era that people in the world are clamoring for globalization.

A Study on The Status of Vessel Restricted in Her Ability to Manoeuvre in Narrow Channel (좁은 수로에서의 조종제한선의 항법상 지위)

  • The Supreme Court in Korea judged the conduct of vessels in narrow channel was applied in order to prevent a ship collision in narrow channel, regardless of kind of a ship or weather situation, as application was not excluded as vessel restricted in her ability to manoeuvre without other special circumstances such as receiving the right of keep her course and speed from the other vessel, any priority was not guaranteed for vessel restricted in her ability to manoeuvre in regard to the other vessel following the conduct of vessel in narrow channel. In this judgement, there is concern to cause disorder to interpretation in the rule of narrow channel and responsibility between vessels. Therefore, this study aims to suggest correct interpretation about the rule concerned.

New Scheme for Smoker Detection (흡연자 검출을 위한 새로운 방법)

  • In this paper, we propose a smoker recognition algorithm, detecting smokers in a video sequence in order to prevent fire accidents. We use description-based method in hierarchical approaches to recognize smoker's activity, the algorithm consists of background subtraction, object detection, event search, event judgement. Background subtraction generates slow-motion and fast-motion foreground image from input image using Gaussian mixture model with two different learning-rate. Then, it extracts object locations in the slow-motion image using chain-rule based contour detection. For each object, face is detected by using Haar-like feature and smoke is detected by reflecting frequency and direction of smoke in fast-motion foreground. Hand movements are detected by motion estimation. The algorithm examines the features in a certain interval and infers that whether the object is a smoker. It robustly can detect a smoker among different objects while achieving real-time performance.

  • Aiming at reducing deaths and injuries involving construction crane operations, OSHA has recently updated its 40-year-old crane safety standards with new rules addressing the use of cranes and derricks in construction. The goal of this change in rule is to deal with the leading causes of fatalities related to crane and derrick operations. Employers in the construction industry are mandated to ensure that employees in the work zone are trained to recognize hazards associated with the use of the equipment and any related duties that they are assigned to perform. However, those responsible at construction sites for the supervision and management of safe crane operations often lack the integrated knowledge of the standards, regulations and best practices for conducting or supervising daily, monthly, or quarterly inspection of cranes. As such, proper planning, management and implementation of crane operations, including inspections are just as paramount to reducing accidents on the construction site. It is important that engineers responsible for the management and planning of crane operations understand the latest OSHA crane and hoisting standards to ensure a safer work environment is maintained. Many on site engineers overseeing crane operations do not have adequate training, experience, and knowledge of the inspection requirements to assess safe crane operation and too often rely on the crane operator's judgement. This paper highlights recent research effort in defining significant changes in new crane and hoisting standards and provides basis for safety construction operations.

  • Basically, diagnosis is a comprehensive judgement of the biochemical data which were collected from the patient directly. Therefore, no matter what kinds of well-managed data control are there, if data sample itself is not perfectly appropriate for any reason. we can not rule out high possibility of misunderstanding or wrong diagnosis. Among many possible reasons inadequate sample were collected maybe three situation and circumstances could be assumed as follows. 1. Client did not know what they are supposed to do for sampling 2. Technicians are to qualified or less-experienced on the job 3. Wrong managing or careless treat of the biochemical data sample If it is true, we could manage these problems to be solved through the information sharing and education. In order to verify this hypothesis, actually 5,800 cases were studied from January to August this year. Owing to the thorough education the rate of unappropriated samples reduced to 0.4% from 1.2%. This outcome strongly support the hypothesis of the mutual relation between the proper sample and well-designed education in advance. The importance of information sharing on right process of sample collection should be emphasized.

  • This article discusses the validity of selective/unilateral arbitration agreement that provides arbitration as one of several dispute resolution methods. The Supreme Court has held selective/unilateral arbitration agreement that is conditional invalidity since the judgement of 2003Da318 decided on Aug. 22, 2003: In the following judgements of 2004Da42166 decided on Nov. 11, 2004 and 2005Da12452 decided on May 27, 2005, the Court stated that the selective/unilateral arbitration agreement that stipulates to resolve a dispute through arbitration or mediation would be valid as an effective arbitration agreement only if a party elects and proceeds an arbitration proceeding and another party responses to the arbitration proceeding without any objection. The definition of arbitration agreement, the formation of selective/unilateral arbitration agreement, the summary of relative judgements and academic theories will be reviewed in order to examine the appropriateness of the series of judgements of the Supreme Court. Based on such reviews, this article will investigate the adequacy of the Supreme Court judgements from the perspectives of i) the principle of party autonomy, ii) the structure of dispute resolution methods, iii) legal provisions of Arbitration Act, iv) legal stability, and v) the policy to revitalize the use of arbitration. At conclusion, this article will suggest the change of precedents of the Supreme Court's judgements with regard to the selective arbitral agreement.

A Study on the Investigation and Analysis of Collisions at Sea (선박충돌사고의 원인조사 및 분석방법에 관한 연구)

  • The collisions at sea among marine casualties are not reduced as the tonnage and speed of ship's increase as well as the traffic quantity increase at sea, in spite of the improvement of nautical equipment, enforcement of crew's education and training as well as improvement of quality standard according to the implementation of ISM code. The measures to prevent the collisions at sea are simple, and are composed of six stage.: The first stage is that the officer on duty detect the target from his eye or radar information. The second stage is determining the type and kind of target-ship. The third stage is target tracking; calculation of target speed, course, CPA and TCPA from radar information or visual check. The fourth stage is determination of vessel in danger after calculation of third stage. The fifth stage is the judgement of situation if own ship is stand-on or give way vessel according to the 1972 COLREG. The last stage is to carry out proper action according to 1972 COLREG, under the circumstances. But by the case, the situations are so different under the different external conditions; for example, natural/navigational conditions, crew's human factors, ship's particular, rule or regulation, management system on board, the condition of watch keeping. Therefore the reasons and casualties are so complicated. This study aims to investigate the collision casualty at sea which needs to clarity all these causal factors of afore-mentioned, and to analyze the causes of problems so as to utilize them to establish the measures of preventing marine accidents. This study, described the concepts of causal factors into three groups; environmental factor, and company/on board management system and navigator's act. Also described how to investigate and analyzes the casual factors. Even though it was described in this paper how to detect the causal factors and reasons of collisions, and how to analyze the inter-relation of each causal factors, it is necessary to do further study how to analyze between the liability of concerned parties and the casual factors involved.

Realization of a Automatic Grading System for Driver's License Test (자동차 운전면허 시험을 위한 자동 채점 시스템 구현)

  • It is important to estimate objectively in the driving test. Especially, the driving test is examined by totally driving ability, rule observation and situational judgement. For this, a grading automation system for driving test was presented by using GPS, sensor data and equipment operation informations. This system is composed of vehicle mounted module, automatic grading terminal, data controller, data storage and processing server. The vehicle mounted module gathters sensor data in the car. The terminal performs automatic grading using the received sensor data according the driving test criterion. To overcome the misposition of vehicle in the map due to GPS error, we proposed the automatic grading system by map matching method, path deviation and return algorithm. In the experimental results, it was possible to grade automatically, display the right position of the car, and return to the right path under 10 seconds when the vehicle was out of the shadow region of the GPS. This system can be also applied to the driving education.
