2016년 개정 중재법의 주요내용 (Important Issues of the 2016 Revision of the Korean Arbitration Act)

  • The Korean Arbitration Act (KAA) enacted in 1966 was entirely revised in 1999, adopting the 1985 UNCITRAL Model Law on International Commercial Arbitration. Korea is trying to be an international arbitration hub in the region, taking advantage of its geographical location in Asia and its highly open economy. KAA was revised in 2016 again in order to reflect the criticisms against the previous KAA, changes in the arbitration environment, and the 2006 amendment to the UNCITRAL Model Law. The basic direction of the revision was to maintain the UNCITRAL Model Law system and to deal with the national arbitration and international arbitration in the same framework. The scope of revision covers all fields of arbitration, including arbitration agreements, arbitrators, arbitral proceedings, interim measures of the arbitral tribunals, recognition/enforcement of arbitral awards, and their annulment. This paper aims to introduce the important issues of the 2016 revision of KAA, to offer important information discussed in the process of revision, and thus to help those concerned in the interpretation and implementation of KAA. The 2016 revision of KAA is expected to help greatly in promoting not only the national arbitration, but also the international arbitration in Korea.

철도기관사의 신념수정에 영향을 미치는 요인에 관한 연구 (A Study on the Factors of the Engine driver′s Belief Revision)

  • Belief revision involves integrating new information with the current belief. It is a ubiquitous human activity. A critical feature of belief revision lies in its sequential nature. Railroad system can be described as organic. Engine drivers take a great role in this system. Recently, Hogarth and Einhorn(1992) have posited a belief-adjustment model for updating beliefs. Based on a sequential anchoring and adjustment strategy, the model is important for decision makers. The sequential nature of information processing is affected by some task variables. The purpose of this study is to examin factors which influnce on the Enginr Driver's belief revision process. The factors are the order, experience and task. The difference of belief revision is due to the order and experience level.

The factors are the order and the experience. Thereby, this will contribute to the study of engine drivers' behavior. The result of this study is summarized as follows. The order effect due to the order of presentation of the evidence exist. The difference of belief revision is due to The experience level.

  • Purpose of this study is to maximize inflection of code DGPS for LBS. Compare calibration method with pseudo range revision method for this and decides revision method. Also, examine variation that occur by inconsistency of satellite association of user and standard department for problem solution by satellite association. Model revision information through AR model who use RLSLF and minimises satellite association problem. I wish to do optimized code DGPS of digital map so that is possible through an experiment.

Improving Fault Traceability of Web Application by Utilizing Software Revision Information and Behavior Model

  • Modern software, especially web-based software, is broadly used in various fields. Most web applications employ design patterns, such as a model-view-controller (MVC) pattern and a factory pattern as development technology, so the application can have a good architecture to facilitate maintenance and productivity. A web application, however, may have defects and developers must fix the defects when a user submits bug reports. In this paper, we propose a novel approach to improving fault traceability in web application by using software revision information and software behavior model to reduce costs and effectively handle the software defect. We also provide a case study to show effectiveness of our approach.

UNCITRAL 중재규칙 개정안의 내용과 쟁점에 관한 연구 (A Study on the Draft and Issues for the Revision of UNCITRAL Arbitration Rules)

  • The purpose of this paper is to make research on the contents and discussions of the draft of revised UNCITRAL Arbitration Rules that have been discussed and considered by the Working Group. At its thirty-ninth session (New York, 19 June-7 July 2006), the Commission agreed that, in respect of future work of the Working Group, priority be given to a revision of the UNCITRAL Arbitration Rules (1976). At its forty-fifth session (Vienna, 11-15 September 2006), the Working Group undertook to identify areas where a revision of the UNCITRAL Arbitration Rules might be useful. At that session, it was considered that the focus of the revision should be on updating the Rules to meet changes that had taken place over the last thirty years in arbitral practice. The largely amended provisions of the draft of revised UNCITRAL Arbitration Rules are as follows : Notice of arbitration and response to the notice of arbitration (Article 3), Designating and appointing authorities (Article 4 bis), November of arbitrators (Article 5), Appointment of arbitrations (Article 6), Appointment of arbitrators in multi-party arbitration (Article 7 bis), Challenge of arbitrators (Article 9), Replacement of an arbitrator (Article 13), Pleas as to the jurisdiction of the arbitral tribunal (Article 21), Interim measures (Article 26), Form and effect of the award (Article 32), and Liability of arbitrators (Proposed additional provisions). There are some differences between the draft of revised UNCITRAL Arbitration Rules and the KCAB Arbitration Rules. In order to jnternationalize the Korea's commercial arbitration system, it is desirable that the main articles of the draft of revised UNCITRAL Arbitration Rules should be admitted to the KCAB Arbitration Rules. In conclusion, the Commission was generally of the view of any revision of the UNCITRAL Arbitration Rules should not alter the structure of the text, its spirit, its drafting style, and should respect the flexibility of the text rather than make it more complex. The Working Group agreed that harmonizing the provisions of the UNCITRAL Model Law should not be automatic but rather considered only where appropriate.

대체비용법을 이용한 수치지형도 갱신사업의 편익분석 모형 연구 (Benefit analysis model of the national map revision program using replacement cost method)

  • 본 연구는 대체비용법을 이용하여 수치지형도 갱신사업의 편익을 분석하는 방법을 제안하였다. 대체비용법은 분석하고자 하는 사업의 기능을 기존 시장의 재화 또는 서비스의 기능으로 대체하는데 필요한 최소 비용으로 해당 사업의 편익을 측정하는 방법이다. 따라서 도시군관리계획수립과 같은 지방자치단체의 18개 행정 업무에서 1/5,000 수치지형도의 갱신에 관한 요구를 조사한 후 이들 요구를 현황측량 및 현장조사 용역으로 대체하기 위한 비용 모형을 건설분야 표준품셈과 GIS 기업을 대상으로 수행된 설문 결과를 이용하여 수립하였다. 그 결과 조사대상 지방차지단체에서 갱신사업의 연간 편익은 265,960,999원으로 측정되었다. 또한 0.5년에서 4년까지 갱신주기를 변화하면서 비용편익비를 분석하여 최적 갱신주기를 탐색하였다.

슬관절 재전치환술용 경골 삽입물 형상이 주대 말단부의 접촉압력과 응력 분포에 미치는 영향 (Effect of Stem Design on Contact Pressure and Stress Distribution of End-of-stem in Revision TKR)

  • In this study, the effect of stem-end design on contact pressure and stress distribution in revision TKR was investigated using finite element method. The finite element model of tibia, including the cortical bone, the cancellous bone and canal, was developed based on CT images. The implant models with various stem lengths, diameters, friction coefficients, and press-fit effects were considered. The results showed that the longer stem length, the stronger press-fit, the bigger stem diameter, and the higher friction coefficient increased both peak contact pressure and Von-Mises stress distributions. The results supported the clinical hypothesis that peak contact pressure and stress are related to the stem end pain. The results of this study will be useful to design the stem and reduce the end-of-stem pain in revision TKR.

Feasibility of Revision Cochlear Implant Surgery for Better Speech Comprehension

  • Background and Objectives: The purpose of this study was to evaluate the efficacy of revision cochlear implant (CI) surgery for better speech comprehension targeting patients with low satisfaction after first CI surgery. Subjects and Methods: Eight patients who could not upgrade speech processors because of an too early CI model and who wanted to change the whole system were included. After revision CI surgery, we compared speech comprehension before and after revision CI surgery. Categoies of Auditory Performance (CAP) score, vowel and consonant confusion test, Ling 6 sounds, word and sentence identification test were done. Results: The interval between surgeries ranged from eight years to 19 years. Same manufacturer's latest product was used for revision surgery in six cases of eight cases. Full insertion of electrode was possible in most of cases (seven of eight). CAP score (p-value=0.01), vowel confusion test (p-value=0.041), one syllable word identification test (p-value=0.026), two syllable identification test (p-value=0.028), sentence identification test (p-value=0.028) had significant improvement. Consonant confusion test (p-value=0.063), Ling 6 sound test (p-value=0.066) had improvement but it is not significant. Conclusions: Although there are some limitations of our study design, we could identify the effect of revision (upgrade) CI surgery indirectly. So we concluded that if patient complain low functional gain or low satisfaction after first CI surgery, revision (device upgrade) CI surgery is meaningful even if there is no device failure.
