중국 중재조정의 적법성에 관한 연구 (A Study on the Legality of Arb-Med in China)

  • According to Chinese Arbitration Law, combination of mediation with arbitration means that in the process of arbitration, arbitrator may conduct mediation proceedings for the case they are handling, provided both parties agree to do so. If mediation succeeds and the parties reach a settlement agreement, the arbitrators may render a consent award or a written mediation statement in accordance with the contents of the settlement agreement. If mediation fails, the arbitration proceedings will be resumed until the case is concluded by making of an arbitral award. There is no formal name of this system in China, it is called "combination of mediation with arbitration", "mediation in arbitration process" or "arbitration-mediation", the author of this thesis select "arbitration-mediation" and make it simply as "Arb-Med". This thesis concentrates on three issues that arbitrators and the parties have to clarify and pay attention to once they choose to use Arb-Med. The first part is about the 'waivable problems', include waive the right to challenge a arbitrator who act as a mediator at the same time with parties' approval, as well as the question about the waiver of the arbitrator's duty to disclose confidential information obtained during mediation. The second part is 'public policy in Arb-Med', introduces the concept of public policy, the bias may arise the complaint about public policy, and the due procedure problem. And the last part is about the award deals with a difference not contemplated by or not falling within the terms of the submission to arbitration, or it contains decisions on matters beyond the scope of the submission to arbitration, especially about the award including some contents which has relation to third party's interests.

Validation of 3D discrete fracture network model focusing on areal sampling methods-a case study on the powerhouse cavern of Rudbar Lorestan pumped storage power plant, Iran

  • Discontinuities considerably affect the mechanical and hydraulic properties of rock mass. These properties of the rock mass are influenced by the geometry of the discontinuities to a great extent. This paper aims to render an account of the geometrical parameters of several discontinuity sets related to the surrounding rock mass of Rudbar Lorestan Pumped Storage Power Plant powerhouse cavern making use of the linear and areal (circular and rectangular) sampling methods. Taking into consideration quite a large quantity of scanline and the window samplings used in this research, it was realized that the areal sampling methods are more time consuming and cost-effective than the linear methods. Having corrected the biases of the geometrical properties of the discontinuities, density (areal and volumetric) as well as the linear, areal and volumetric intensity accompanied by the other properties related to four sets of discontinuities were computed. There is an acceptable difference among the mean trace lengths measured using two linear and areal methods for the two joint sets. A 3D discrete fracture network generation code (3DFAM) has been developed to model the fracture network based on the mapped data. The code has been validated on the basis of numerous geometrical characteristics computed by use of the linear, areal sampling methods and volumetric method. Results of the linear sampling method have significant variations. So, the areal and volumetric methods are more efficient than the linear method and they are more appropriate for validation of 3D DFN (Discrete Fracture Network) codes.

Identification of Proteins Affected by Iron in Saccharomyces cerevisiae Using Proteome Analysis

  • To study the effect of iron on Saccharomyces cerevisiae, whole-cell proteins of Saccharomyces cerevisiae were extracted and subjected to two-dimensional polyacrylamide gel electrophoresis (2D-PAGE), and differentially expressed proteins were identified. The proteins separated were further identified by matrix-assisted laser desorption/ionization time-of-flight (MALDI-TOF) mass spectrometry and were compared with a protein database. Of more than 300 spots separated by molecular weight and isoelectric points, 27 differentially expressed spots were identified. Ten proteins were found to be differentially expressed at high iron concentration. Triosephosphate isomerase (TPI), YDR533C hypothetical protein, superoxide dismutase (SOD), 60 kDa heat-shock protein (HSP60), pyruvate dehydrogenase beta subunit 1 (PDB1), and old yellow enzyme 2 (OYE2) were upregulated, whereas thiol-specific antioxidant (TSA), regulatory particle non-ATPase subunit 8 (RPN8), thiol-specific peroxiredoxin 1 (AHP1), and fructose-1, 6-bisphosphate adolase (FBA) were downregulated by iron. Based on the result, we propose that SOD upregulated by iron would protect the yeast from oxidative stress by iron, and that TSA downregulated by iron would render cells hypersensitive to oxidative stress.

  • 현실감 있는 3차원 그래픽 영상을 지원하기 위해서는 3차원의 그래픽 데이터를 기반으로 사실감을 부여하여 2차원 영상을 생성하는 렌더링 기술과 방대한 양의 데이터에 대해 복잡한 연산을 효율적으로 처리할 수 있는 고성능 그래픽 프로세서가 요구된다. 이로 인해 그래픽 하드웨어는 급속히 발전하였고 기존에 실시간 처리가 불가능했던 여러 고급 렌더링 효과들을 가능하게 하고 있다. 과거에 비해 셰이딩 기술이 발전하면서 사실적인 영상의 렌더링이 가능하게 되었으나 아직 많은 계산 시간을 필요로 하고 있다. 실사와 같은 영상을 빠르게 처리하기 위해서 그래픽 프로세서는 많은 데이터에 대해 복잡한 부동소수점 연산을 효율적으로 처리 할 수 있도록 다수의 연산유닛이 집적되는 방향으로 발전하고 있다. 본 논문에서는 프로그램어블 통합 셰이더 프로세서에서 고성능 3차원 컴퓨터 그래픽 영상을 지원하기 위해 특수 함수 유닛을 설계하고 구현하였다. 설계한 특수 함수 유닛에 대해 기능적 레벨의 시뮬레이션을 하여 동작을 검증 하였으며, FPGA Virtex-4(xc4vlx200)에 구현하여 하드웨어 리소스 사용율과 동작속도를 확인 하였다.

초음파를 이용한 실측 두께 측정과 재질 렌더링 (A Novel Method for Material Rendering and Real Measurement of Thickness Using Ultrasound)

  • 본 논문에서는 초음파를 이용하여 재질의 두께를 실측하고 렌더링하는 방법을 제안한다. 두께는 광학특성과 함께 반사율과 투과율을 결정하는데 중요한 요소로서 물체를 더욱 사실적으로 표현하는데 영향을 준다. 지금까지의 연구는 두께를 추정하여 렌더링에 사용해왔다. 제안된 방법은 육안으로 두께를 측정할 수 없는 물체의 두께를 초음파를 이용하여 측정하여 렌더링하는 처음 시도된 방법이다. 이를 위해 기준시편의 음속을 측정하고, 같은 성질을 갖는 다른 물체들의 두께를 측정한다. 측정된 물체의 특성들은 최종적으로 렌더링되고, 영상 분석 모델을 통해 결과를 확인하며, 이를 통해 렌더링에서 두께의 중요성을 확인할 수 있다.

용안육 다식의 항산화 활성 및 품질 특성 (Antioxidant Properties and Quality Characteristics of Dasik Supplemented with Longanae Arillus)

  • This study was designed to evaluate the quality characteristics and antioxidant properties of Longanae Arillus powder (added in the ratios of 0%, 25%, 50%, 75%, and 100%), which is traditionally used to render the product more suited to the modern consumer's taste for the compound Longanae Arillus Dasiks. As the consumer consumption of the proportions of Longanae Arillus increases, the moisture content and pH of the Dasik supplemented with Longanae Arillus decrease, while at the same time, a soluble solid content increases (p<0.001). The color value showed the decrease in L and b values with the increase in Longanae Arillus content, and the increase in the value of the compound with the addition of Longanae Arillus (p<0.001) can be noted. The mechanical texture of Dasik was increased by the addition of Longanae Arillus considering its hardness, adhesiveness, cohesiveness, springiness, and chewiness (p<0.001). In the sensory evaluation of the Longanae Arillus Dasik showed that people expressed an overall preference at the addition of Longanae Arillus, such as noted as being preferred with 50% in color, flavor, taste, texture, and overall acceptance of the compound (p<0.001). Regarding the antioxidant activity of Longanae Arillus Dasik, the total phenolic, flavonoid contents, DPPH radical scavenging activity, reducing power, and superoxide anion levels were found to increase with the addition of Longanae Arillus (p<0.001) with its consumer use. It is believed that Longanae Arillus Dasik, is most preferred to be added at the concentration of 50% during the Dasik preparation.

싱가포르 국제중재제도에 관한 연구 (A Study on the International Arbitration System of Singapore)

  • These days, in line with the increase of opportunities in our country's firms to do transaction, large-scale M&A and investment with foreign firms incorporating arbitration clauses in the contracts have become general practice. Recently, Singapore has come to the fore as a place of arbitration and, particularly, Singapore International Arbitration Center (SIAC) was assessed as the favored international arbitration institution uniquely in Asia at the 2010 International Arbitration Survey: Choices in International Arbitration, along with the ICC, LCIA, and AAA/ICDR. Therefore, the country's firms need to understand properly the international arbitration procedure of Singapore. This study examines the international arbitration system of Singapore, focusing on the arbitration procedure of the SIAC. The Center revised arbitration rules twice in 2010 and 2013, and established the Court of Arbitration of SIAC in April 2013 for the first time in Asia in pursuit of stricter neutrality and promptness. It further seeks to run the arbitration procedure fairly by selecting a third country's people as an arbitrator, while its arbitration expenses are cheaper than those of the ICC. The study believes that for the country's international arbitration institutions such as the KCAB to jump forward as a world-class international arbitration institution, the Korean government should render positive support to them, learning from Singapore which does not spare any political and financial assistance to cultivate international arbitration institutions. On the other hand, KCAB should also try hard to improve in the aspects of neutrality, fairness, and promptness and to be selected as a trustworthy international arbitration institution by firms in Asian countries.

HSV 색상 모델과 영역 확장 기법을 이용한 동영상 프레임 이미지의 흑백 만화 카투닝 알고리즘 (A Black and White Comics Generation Procedure for the Video Frame Image using Region Extension based on HSV Color Model)

  • 본 논문에서는 비디오 영상에서 추출한 이미지를 이용하여, 흑백 만화로 변환하기 위한 알고리즘에 대해 논의한다. 대부분의 흑백 만화는 사람의 얼굴이나 손과 같은 살색 계통은 흰색 내지 엷은 색상으로 표현되며, 이미지의 어두운 영역은 해칭과 같이 규칙적이면서도 불규칙한 형태로 묘사한다. 그러므로 단순한 임계값을 이용한 이진화 알고리즘으로 흑백 만화를 렌더링 할 경우, 원본 색상 영상의 다양한 색상과 흑백 만화에서 사용되는 다양한 패턴을 렌더링 할 수 없다. 이러한 흑백 만화의 특징을 반영한 카투닝을 수행하기 위해서, 본 논문에서는 다음과 같은 작업을 수행한다. 먼저, 원본 이미지 영상의 미세한 색상변화를 제거하기 위해서, 1) Bilateral 필터를 적용한다. 그 후, 영상의 각 영역을 유사한 색상 정보로 클러스터링 하기 위해서, 2) Mean shift 세그멘테이션을 적용하였으며, 각 영역별 확장 작업을 수행하였다. 이때 각 영역의 색상이 유사한 정도를 계산하기 위해서, 사람의 색상인지 능력과 유사한 특성을 가진 HSV 색상 모델을 사용하여, 각 영역의 색상 유사정도를 계산하였다. 최종적으로 세그멘테이션된 색상정보를 바탕으로 흑백만화에서 일반적으로 활용되는 색상과 프레임 이미지의 픽셀값을 고려한 3) 이진화를 수행하고, 4) 스트록을 추가해 흑백 만화의 컷 이미지를 완성한다.

RGB 라이팅 파이프라인에 의한 그래픽 영상 조명효과 구현방법 (Method for making lighting effects in graphic image by RGB lighting pipeline)

  • 본 논문의 목적은 애니메이션 제작시 시간을 절약할 수 있는 새로운 형태의 RGB 라이팅 파이프라인 개발이다. 현재 방법의 문제점을 파악한 후 새로운 방법과 비교분석을 통해서 8단계로 연구하였고 연구결과로 해결책을 제시했다. 본 연구에 따른 RGB라이팅 파이프라인에 의한 그래픽 영상 조명효과 구현방법은 텍스처와 분리된 디지털 라이트(light)와 설정갯수 단위로 묶인 라이트 세트 별로 렌더레이어를 생성하고, 각각의 라이트가 RGB채널로 분리됨으로써 3가지의 라이트 정보가 하나의 레이어와 그래픽 영상 이미지에 저장될 수 있도록 하는 동시에 색 보정의 정확도와 정밀도가 향상될 수 있도록 하였다. 본 연구를 통해서 기존 방법과 새로운 방법 각 특성에 대한 장단점을 살펴보고 작업의 특성이나 업종별 특성에 따라 새로운 형태의 RGB라이팅 파이프라인을 제시하였다.

엘라스토머 임플란트를 사용한 엉덩이 확대 성형술 (Buttock Augmentation with Elastomer Implants)

  • Purpose: The buttocks region has been associated with allure and sex appeal for centuries. Gluteal implants enable buttocks remodeling in a way that is not possible in other methods. One of the reasons that render gluteal implant surgeries unpopular is the fear of complications, the main problems being seroma, wound dehiscence, extrusion, and a visible or palpable implant. The authors present the XYZ technique, which provides anatomical reference points to guide the intramuscular dissection procedure in a feasible and safe way, resulting in a lower complication rate. Methods: The XYZ procedure was done for buttock augmentation on 8 patients from December 2009 to June 2010. Patient's ages ranged from 27 to 44 with a mean age of 36. Seven patients were applied the 250cc sized Elastomer implants with one patient 290cc sized implant. Preoperative marking was done with the patients in the standing position. Bisection of the gluteus maximus muscle was done at the midpoint thickness to create a plane for implant insertion, which is called the sandwich plane. Results: The 8 cases were performed safely without major complications. However one patient had minor wound dehiscence, and was managed with conservative treatment. Another patient had a discomfort on the buttocks for a long time. The patients were followed up for average 6 months. All patients were satisfied with the aesthetic results. Conclusion: In performing the XYZ technique for gluteal augmentation, the surgeon must split the muscle into two equal halves with anatomical reference points to guide the muscle detachment in a symmetrical way at an adequate depth. This method provides a guideline for the surgeon in determining the ideal plane during intramuscular dissection and gives predictable results with low complication rates. Intramuscular gluteoplasty with gluteal implants offers predictable, aesthetically pleasing results without contour irregularities and only a low incidence of major complications.
