THE STUDY ON THE PROBLEMS OF MARITIME FACILITIES(GAS PLANT) INSURANCE REGULATIONS

  • The purpose of this study is to provide the problems of insurance system of maritime facilities(Gas Plant) in korea. In order to find out the problems of insurance system of construction work, the literature research and case study on the maritime facility construction are adopted as research method. And this study analyzed the construction cases of maritime facilities(Gas Plant) to which the national contract law was applied for the first time. The findings of this study are as follows: In the case analysis of 00 facility construction, the contractor pay additional insurance fees for the construction. And the regulations on insurance registration are not stated clearly relating to the enforcement ordinance of the national contract law.

  • This study empirically validates whether the effect of strengthening the legal regulations in the construction industry under the 'Construction Business Act' is true in order to expand the direct construction of the comprehensive construction corporation. Checking the effectiveness of the legal regulation that can force direct construction of the required scope of construction will not only be a logical background in the strengthening of law regulations but also suggest arguments that contradict some construction companies called legal regulation.

철도 위험물 수송 안전관리제도 개선 방안 (Improvement Plan for Safety Management of the Transport of Railway Dangerous Goods)

  • As the lack of management for HAZMAT transportation leads to fatal accidents, the interest in the problem is rapidly increasing in the world. Thus UN-RTDG recommends to establish regulations for HAZMAT transportation, and related ministries in Korea make rules and policies according to the regulations. However, there are few researches carried out on railway HAZMAT transportation. In this paper, issues such as present condition of laws and policies related to railway HAZMAT transportation, HAZMAT transportation procedure and regulations, HAZMAT signs of railway etc. are analyzed. Through analyzing these issues the problems and improvements of railway HAZMAT transportation are drawn. These results are respected to help to establish regulations and policies for HAZMAT transportation management. In the future, more detailed plan is needed for putting these improvements to practices.

건설공사 공기단축으로 인한 추가비용의 산정규정에 관한 연구 (A Study of the Regulations for Calculation of Acceleration Costs on Construction Work)

  • 본 연구는 건설 공사도중 계약상대자의 책임 없는 사유로 인하여 공사기간이 단축되는 경우 발생하는 추가비용과 관련하여 계약 당사자 사이에 발생하는 분쟁을 예방하는 방안의 연구를 목적으로 하였다. 공기단축으로 인한 추가비용에 대한 클레임 사례 및 법원의 판결 사례등을 검토한 결과 추가비용 산정에 대한 규정의 미비가 대표적인 문제점으로 나타났다. 이러한 문제점에 대한 연구의 결과로 1단계에서 추가비용을 처리하는 절차를 제시하였고, 절차 중 공기단축 계획 및 승인과정을 거치도록 하여 계약 당사자 사이의 추가비용에 대한 다툼을 예방하도록 하였다. 2단계로 추가비용 산정과 관련된 현행 규정의 미비한 문제점을 해소하는 규정의 제정 및 개정 방안을 제시하였다. 본 연구에서 제시한 절차 및 규정의 제 개정 방안을 통하여 공기단축과 관련한 현행 규정이 미비한 문제점을 해소하고 분쟁을 예방하며 이로 인한 손실 등을 방지하는 등 선진화된 계약관리의 기초가 되도록 하고자 한다.

한약・생약제제 품목허가신고심사 규정 변화에 관한 고찰 - 건국이후부터 2012년까지 - (A Study on the Changes in Regulations Regarding Approval, Notification and Review of Herbal Medicinal Preparations and Crude Drug Preparations - From 1948 to 2012 -)

  • Objectives : The purpose of this study was to analyze and identify the problems of the changes in regulations that are relevant to approval, notification, and review of herbal medicinal preparations and crude drug preparations. Methods : I collected the regulations of approval, notification, and review of medicinal products mostly from official gazettes, analyzed enactment and amendments regarding herbal medicinal preparations and crude drug preparations, and studied it from the view point of Korean medicine field. Results : Regulations in regards to approval, notification, and review of herbal medicinal preparations and crude drug preparations were first established in 1978. Herbal drugs started to be categorized as crude drug preparations in 1981 and the regulatory outlines were completed in 1999. From 2008 to 2012, the regulatory standards that let crude drug preparations be new drugs from natural products were established. Through those procedures, the followings became crude drug preparations: 1) wholly new prescriptions that are not recorded in Korean Medical Classics, 2) prescriptions that are recorded in Korean Medical classics but prepared with new standard, composition and efficacy, 3) prescriptions that are recorded in Korean Medical classics but prepared with new formulation, and 4) herbal drugs. In case of herbal medicinal preparations, however, only regulations that are related to 1) drugs prepared with new compositions that are not recorded in Korean Medical Classics, 2) drugs with same prescription and same formulation, and 3) drugs with new formulation were arranged. Conclusions : Actual circumstances on crude drug-oriented regulations regarding approval, notification and review and future forms of prescription and drug administration in Korean Medical Institutions can be expected due to expansion in range of herbal medicinal preparations and shrink in that of on-site preparations. Reasonable improvement in efficient usage of modernized herbal medicinal preparations in Korean medical institutions and prospective cooperation from related pharmaceutical industry are needed.

지방자치단체의 도서관 자치법규 분석 (Analysis of Local Laws and Regulations Related to the Library)

  • 본 연구는 전국 245개 광역 및 기초자치단체가 제정하여 운영하고 있는 도서관 자치법규를 전수 조사하여 분석하였다. 연구의 분석결과를 통하여 자치법규 제정현황을 점검하고, 도서관 설치 및 운영을 뒷받침하는 법제적 근거로 작용할 수 있는 자치법규 제정의 개선방안을 제시하고자 한다. 조사결과 우리나라 245개 광역 및 기초자치단체가 운영 중인 도서관 자치법규는 조례가 393건, 규칙이 187건, 훈령(규정)이 43건, 예규(지침)가 6건으로 모두 629건으로 조사되었다. 또한 도서관 관련 자치법규가 전무한 지방자치단체는 32개이며, 도서관운영 조례가 없는 지자체는 40개, 작은도서관 운영조례가 없는 지자체는 144개, 독서문화진흥조례가 없는 지자체는 196개에 이르고 있는 것으로 조사되었다. 본 연구결과는 향후 우리나라 지방자치단체에서 도서관 자치법규 제정의 기초자료로 활용할 수 있을 것이다.

부산권 도시성장 잠재지역의 특성 및 토지이용규제 실태 분석 (Analysis of Characteristics and Land Use Regulation of Urban Growth Potential Area in Busan Metropolitan City)

  • 토지이용의 합리화를 위하여 도입된 토지이용규제는 사회경제적인 발전과 함께 복잡다기화 되면서 국민경제생활에 불편을 초래한다는 이유로 최근 규제 완화로 패러다임이 변화하고 있다. 이에 본 연구에서는 CA 모델을 이용하여 시뮬레이션 함으로써 부산권 도시성장의 잠재지역을 도출하고, 토지이용 규제지역과 함께 공간적 특성을 분석하였다. 분석을 통해 토지이용규제 제도가 실제로 도시성장을 억제하고 토지이용의 효율화를 도모하고 있는지, 또는 국민생활에 불편을 초래할 수 있는 다른 요인이 있는지를 검토하였다. 분석결과 도시외부의 개발압력이 높은 지역에 존재하는 개발제한구역은 토지이용규제라는 역할을 수행하고 있었지만, 많은 지역에서 토지이용에 대한 다중규제가 존재하는 것으로 나타났다. 따라서 순기능을 하고 있는 토지이용규제는 최대한 유지하면서, 도시성장 잠재력이 높은 지역에 존재하는 다중규제를 재고하는 등 다양한 접근과 검토가 필요할 것으로 사료된다.

유럽연합, 미국, 한국 및 일본의 합성수지 용기.포장재에 대한 현행 이행실험 규정 비교 (Comparison of the Current Migration Testing Regulations for Plastic Containers and Packaging Materials in EU, USA and Korea or Japan)

  • Packaging materials and articles that are used in food contact applications can transfer constituents in the foodstuffs. This kind of risk of possible health hazards to consumers has been generally recognized for a long time with the consequence of establishing corresponding food regulations in most developed countries. However, the language of these laws, their interpretation, and their level of enforcement vary from country to country. Accordingly, the actual migrating levels from packaging materials can be varied depending on the migration testing methods as prescribed in the national legislation in each countries. Therefore, there are needs of elimination of non-tariff trade barriers raised by sanitary and phytosanitary or technical measures under the Final Act of the UR Agreement. In this connection, the EU and USA are currently in an ongoing process of legislation harmonization to overcome potential barriers to free trade. In general, regulations governing component transfer in the USA are more complicated and comprehensive than similar regulations in Europe. In future, standard migration testing procedures for microwave heat susceptor materials and for the use of fatty food simulant should be established and also harmonized among countries. The objective of this investigation is to compare the current regulations for migration testing for plastic containers and packaging materials in USA, EU and Korea or Japan. For those regulations, Korean standards are required to be kept up with the international standards. By doing this, the related Korean regulation could be amended along with the worldwide progress for harmonization.

물질안전보건자료 및 표시제도의 개선 방향 제안(2) - 유럽연합의 CLP 제도 고찰에 근거하여 (How to Improve the Reliability of MSDS and Labels?(2): A Review on the EU CLP(REGULATION(EC) No 1272/2008))

  • Objectives: The major objectives of this study are to review the EU CLP Regulations to propose ways of improving the reliability of MSDS and labels. Methods: To review the EU CLP Regulations, we used EU documents including directives and regulations on chemical management. In addition, we used EU governmental agency reports to illuminate the history and background of the CLP. We found the EU CLP's instruments for reliable hazard communication and evaluated the operations of the instruments. Results: EU CLP Regulations have four instruments for the EU CLP Regulations to make hazard communication reliable. These instruments are GHS, the harmonized CMR and respiratory sensitive substances classification list, C&L inventory and restriction of trade secrets. These are highly useful for achieving the objectives of REACH and CLP(no data-no market and changing the burden of proof). Conclusions: Changing the burden of proof is a key principle for achieving a society safe from hazardous chemicals. Chemical manufacturers and importers alone should bear the responsibility for reliable MSDS. We recommend benchmarking the EU CLP Regulations in order to change efficiently the burden of proof. Trade secrets should be limited to low-hazard substances and be approved by the government before the chemical product is on the market. Like the C&L inventory, chemical product information including substances identification and hazard properties should be notified, aggregated and be opened to public on the Internet. Finally, we recommend a MSDS registration system once again.
