  • A staple of feminist literary anthologies which was instrumental in reevaluating the writer Susan Glaspell, Trifles(1916) has received numerous comments from feminist scholars so far. Most of them tend to concentrate on the themes of female solidarity and justice challenging the androcentric system of law and order. Lacking in the plethora of thematic approaches to the play's feminist subject, however, are formal analyses considering the way in which the play's generic form assists in communicating such thematic concerns of feminism. An alternative to the typical scenario at the courtroom whose mistreatment of women must have loomed large to the young Glaspell as she revisited the old trial of a midwestern murderess which she had covered as a journalist for a local newspaper in Iowa, Trifles serves as a corrective to the courtroom dynamics offering a 'dramatic justice' as opposed to a strictly legal procedure. What this article discovers at the heart of this dramatic justice is the celebration of the unsayable, or what Wolfgang Iser termed negativity, of women's experience which has no room for reflection in the legal discourse at the courtroom tyrannized by the sayable and the evident. Examining how the dramatic form of Trifles gives a voice to the unsayable of woman's experience, which can not be properly represented at the courtroom governed by the straightforward and definitive male rhetoric, the article argues that the play is a better form than its fictional adaptation "A Jury of Her Peers"(1917) in that it syntactically suppresses the monopolizing operation of the verbal by giving precedence to the scenic and non-verbal which is constituted of setting, props, gesture and eye contacts. As a theoretical frame of reference with which to examine the modes of the unsayable in the play the article brings the concept of 'negativity,' defined by Iser as textual effects or modes of the unspeakable and unsaid, into the discussion of the taciturnity of the absent heroine and the non-verbal representation of drama.

  • 한국의 경제 상황이 악화되면서 소비가 침체되고 있다. 특히 최저임금 인상, 글로벌 경쟁 상황의 심화 등 다양한 국내외 변수들로 인하여 일반 국민들의 소비 성향과 구매 의도 역시 현격하게 낮아지고 있다. 이러한 상황에서 크라우드 펀딩이라는 새로운 투자, 유통 채널의 등장은 창업 초기의 기업들에게 큰 성장 동력을 제공하고 있으며, 새로운 유통채널로서 소비 증대 효과도 기대할 수 있는 상황이다. 본 연구에서는 리워드형 크라우드 펀딩 진행 시 고객이 느끼는 서비스 실패와 회복 과정에서의 공정성을 절차적 공정성, 상호작용적 공정성, 분배적 공정성의 세가지 영역으로 구분하고, 고객이 인지한 공정성이 만족도와 충성도에 미치는 영향을 살펴 보았다. 이러한 연구 목적을 달성하기 위하여 리워드형 크라우드 펀딩에 대한 조사와 분석을 진행하였고, 서비스 실패와 화복을 경험한 고객들이 느끼게 되는 공정성이 만족도와 충성도에 긍정적인 영향을 끼친 것으로 나타났다. 특히 고객의 만족도에는 상호작용 공정성이 가장 큰 영향을 끼쳤으며, 고객의 충성도에는 분배 공정성이 가장 큰 영향을 끼친 것으로 나타났다. 따라서 크라우드 펀딩사는 서비스 실패를 경험한 고객이 공정성을 느낄 수 있는 회복 전략을 실행하도록 노력해야 한다.

싱가포르협약 이후 일본의 국제분쟁해결절차 활성화 동향: JCAA 중재규칙과 일본 중재법 개정안을 중심으로 (Efforts to Promote International Dispute Resolution under the regime of Singapore Mediation Convention in Japan: From the Perspective of Amendments to JCAA Arbitration Rules and Arbitration Act of Japan)

  • The United Nations Convention on International Settlement Agreements Resulting from Mediation (Singapore Mediation Convention) results in new challenges to the area of international dispute resolution by providing the enforcement regime for mediated settlement agreements, which have not been admitted as enforceable in some civil law countries, including Korea and Japan. Japan has struggled to promote international arbitration and international mediation, and such efforts were accelerated by the adoption of the Singapore Mediation Convention in 2018. In order to standardize arbitration proceedings and promote the practice of international arbitration, Japan produced two noticeable results: the new JCAA Arbitration Rules and the amendment to the Arbitration Act of Japan. In addition to that Expedited arbitration procedure and Interactive Arbitration Rules of JCAA present the new possibility of international arbitration procedure for civil law practitioners, the amendment to the Arbitration Act of Japan suggests significant implications to Korea for its manifest provisions regarding enforcement requirements and proceedings and its protection of Access to Justice for foreign law practitioners.

남북중재규정 제정의 기본방향 (Basic Direction for the South and North Korea's Aybitration Rules)

  • Since the Agreement on Commercial Arbitration was signed by the Governments of South and North Korea last year, there has been quite a few discussions on the way for implementing the Agreement in both public and private sectors. The Department of Justice of South Korea was quite active in making the draft of arbitration rules representing the South Korean views in alliance with the Department of Reunification of South Korea and recently held an informal seminar to preview their draft. On the other hand, the Korea Arbitration Association, a main body of commercial arbitration which are composed of professors and lawyers, were carefully watching the steps and the draft made by the Department of Justice. The reasons are to assure that not only shall the commercial arbitration rules comply with comment norms of international arbitration but shall it be made to meet the needs of enterprises investing in the Special Economic District of Kaesung City in North Korea. The concerns of the Korea Arbitration Association can be accomplished if the Department of Justice would modify the provisions pointed out in the seminars. Five general principles shall be brought into the attention in promulgating the commercial arbitration rules. First, it should comply with the Agreement on Commercial Arbitration signed by South and North Korea. Second, it should accept common rules contained in UNCITRAL arbitration rules. Third, it should boost the promptness of proceedings when a case was filed. Fourth, it should feature unique aspects of trade between South Korea and Korea by differentiating it from purely international trade between a country and a country. Lastly, it should combine the respective rules of both South and North Korea, currently in effect. With the above five principles accomplished, it should be noted that the Agreement on Commercial Arbitration the upper authority of arbitration rules, mandates the following features. It declared that arbitration be processed by three arbitrators. Single arbitrator is not permitted. Arbitration can be adopted even if an arbitration clause does not exist in an agreement by the parties, provided that the dispute arose out of the scope of the Agreement on investment Guarantee signed by South Korea and North Korea. It excluded quick and simplified procedures even if the amount of claim in arbitration is minimal. All the procedures should take a formal procedure. It let the double administration offices operate. One is to sit in Seoul of South Korea and the other is to sit in Pyongyang of North Korea. This would intimidate the fastness of procedures. With the above principles and the features considered, each provision in the draft by the Department of Justice should be reviewed and suggested for change.

일부 병원행정직의 조직시민행동과 관련된 융복합 요인의 관련성 분석 (Analysis of the Relationship between the Convergence Factors Related to Organizational Citizenship Behavior of Some Hospital Administrative Staffs)

  • 본 논문은 병원행정직원의 조직시민행동과 관련된 융복합적인 요인을 찾아보고자 시도되었다. 설문조사는 무기명 자기기입식 설문지를 사용하여 임의로 선정된 J지역 22개 병원의 행정직원 274명에 대하여 시행되었다. 설문조사 기간은 2019년 7월 1일부터 7월 31일까지 약 한 달간 소요되었다. 위계적 다중회귀분석 결과, 조직공정성의 하위영역인 절차공정성이 높을수록, 집단내신뢰가 높을수록, 조직헌신도가 높을수록 조직시민행동이 높았으며, 이들의 설명력은 41.9%이었다. 이러한 분석결과를 볼 때, 병원행정직원의 조직시민행동을 높이기 위해서는 조직공정성의 하위영역인 절차공정성 및 분배공정성을 높이고, 집단내신뢰를 높이고, 조직헌신도를 높이는 노력이 필요하다. 이상의 결과는 병원행정직원의 조직시민행동을 높이는 의료기관의 인적자원관리 및 산업보건교육에 활용이 기대된다. 추후연구에서는 병원행정직원의 조직시민행동에 영향을 미치는 구조방정식 모형의 수립이 필요하다.

Clinically Correlated Anatomical Basis of Cricothyrotomy and Tracheostomy

  • Objective : Cricothyrotomy and tracheostomy are performed by physicians in various disciplines. It is important to know the comprehensive anatomy of the laryngotracheal region. Hemorrhage, esophageal injury, recurrent laryngeal nerve injury, pneumothorax, hemothorax, false passage of the tube and tracheal stenosis after decannulation are well known complications of the cricothyrotomy and tracheostomy. Cricothyrotomy and tracheostomy should be performed without complications and as quickly as possible with regards the patients' clinical condition. Methods : A total of 40 cadaver necks were dissected in this study. The trachea and larynx and the relationship between the trachea and larynx and the surrounding structures was investigated. The tracheal cartilages and annular ligaments were counted and the relationship between tracheal cartilages and the thyroid gland and vascular structures was investigated. We performed cricothyrotomy and tracheostomy in eleven cadavers while simulating intensive care unit conditions to determine the duration of those procedures. Results : There were 11 tracheal cartilages and 10 annular ligaments between the cricoid cartilage and sternal notch. The average length of trachea between the cricoid cartilage and the suprasternal notch was 6.9 to 8.2 cm. The cricothyroid muscle and cricothyroid ligament were observed and dissected and no vital anatomic structure detected. The average length and width of the cricothyroid ligament was 8 to 12 mm and 8 to 10 mm, respectively. There was a statistically significant difference between the surgical time required for cricothyrotomy and tracheostomy (p < 0.0001). Conclusion : Tracheostomy and cricothyrotomy have a low complication rate if the person performing the procedure has thorough knowledge of the neck anatomy. The choice of tracheostomy or cricothyrotomy to establish an airway depends on the patients' clinical condition, for instance; cricothyrotomy should be preferred in patients with cervicothoracal injury or dislocation who suffer from respiratory dysfunction. Furthermore; if a patient is under risk of hypoxia or anoxia due to a difficult airway, cricothyrotomy should be preferred rather than tracheostomy.

중재 활성화를 위한 중재비용 구조제도의 도입 방안 연구 - 민사소송법상 소송구조에 착안하여 - (A Study on Introduction Plans of the Arbitration Aid System for Vitalizing Arbitration - Inspired by the Litigation Aid System under the Civil Procedure Act -)

  • "Arbitration" is a procedure to settle a dispute over property rights or disputes based on non-property rights that the parties can resolve through a reconciliation, not by a judgment of a court, but by an award of an arbitrator, and is a kind of Alternative Dispute Resolution(ADR). Arbitration is the most representative and efficient ADR system in many fields, so by activating it, disputes can be resolved smoothly and ultimately, and social costs caused by a heavy increase in lawsuit can be reduced. Arbitration costs are often evaluated as 'cheap', but in reality, they can be similar to or exceed litigation costs. Nevertheless, unlike the Civil Procedure Act, which stipulates the litigation aid system for those who are hard to pay litigation costs, the Arbitration Act or the Arbitration Industry Promotion Act does not have the arbitration aid system for those who are hard to pay arbitration costs. However, considering ① the utility of arbitration compared to other dispute resolution procedures, such as litigation, ② the possibility of resolving trial delays through vitalizing arbitration, ③ the need to guarantee access to arbitration, ④ the feasibility of revitalizing arbitration by the arbitration aid system, it is necessary to introduce the Arbitration Aid System. To explain the details of the Arbitration Aid System, a person who intends to apply for arbitration or a party who continues arbitration could be the applicant. Regarding the judge, this paper suggests the establishment of a council for arbitration aid to prevent the possibility of prejudgment by the arbitral tribunal. Also, if the council accepts the application for arbitration aid, it would be appropriate for the arbitral tribunal to determine the allocation of arbitration costs considering the decision of the council and to include it into arbitral awards.

현행 즉결심판제도의 개선방안 연구 (A Study of the Summary Trial System's Reform Measures)

  • 형사소송절차는 ‘신속한 재판 및 소송경제’ 와 ‘실체진실발견 및 인권보장’을 주요한 목적 이념으로 하고 있으며, 이들 두 가지 가치는 서로 갈등관계에 있다. 즉결심판제도는 판사가 범증이 명백하고 죄질이 경미한 범죄를 신속${\cdot}$적정한 절차를 통해 심판하는 특별간이절차로서 심판절차를 신속하게 종결하여 즉결피의자나 피고인을 형사절차로부터 조속히 해방시키는 데 주된 목적이 있다. 그러나 이러한 취지를 지나치게 강조하다보면 사건의 충분한 심리나 피의자${\cdot}$고인의 인권보장에 소홀해지기 쉬운 것도 사실이다. 따라서 즉결심판제도는 이러한 부작용을 방지할 수 있는 제도적 장치가 반드시 요구된다. 바로 이러한 시각에서 현행 즉결심판제도를 면밀히 검토할 필요가 있는 것이다. 본 연구의 주된 목적은 입법론적 관전에서 현행 제도의 문제점을 분석하여 제도자체의 폐지를 포함한 다양한 개선방안을 강구하는데 있다. 결론적으로 말하자면 즉결심판제도는 단점보다는 장점이 훨씬 많은 제도이므로 현행대로 유지하되, 즉결피의자${\cdot}$피고인 이의제도를 도입하거나 구류형을 폐지하는 등 충분한 제도적 보완이 뒤따라야 한다고 본다.

범죄피해자의 정보권보장을 위한 방안 (The Guarantee of Criminal Victim's Information Rights)

  • 민사소송이든 형사소송이든 소송이 존재하는 가장 큰 이유는 진실을 밝히는 것이다. 당사자들은 서로 자기의 주장이 옳다고 주장하고 그에 따른 주장사실과 증거자료를 제출한다. 그리고 재판장은 당사자들의 주장사실과 당사자들이 제출한 증거자료들을 면밀히 살펴 누구의 주장이 옳은지 판결을 내린다. 당사자들은 승소를 위하여 자기의 주장을 논리 있게 주장하고, 상대방의 주장에 대하여 항변하며 그에 따른 증거자료들을 제출한다. 그런데 상대방의 주장사실을 제대로 이해하지 못하거나 파악하지 못한다면 당연히 그에 대한 항변을 제대로 할 수 없을 것이다. 이러한 점을 충분히 참작하여 민사소송에서는 원피고가 제출하는 모든 서류는 처음부터 원본과 상대방에게 송달할 부본을 만들어 제출하게 되고, 법원에서는 이를 그 상대방에게 송달해준다. 그럼으로써 상대방에서 어떤 주장을 하고 또 어떤 증거자료들을 제출했는지 쉽게 알 수 있도록 하고 그에 대한 항변이나 주장을 하라고 한다. 그러나 형사소송 특히 수사절차에서는 수사의 특수성 등을 이유로 고소장이나 피해자 진술조서, 피의자 진술조서, 각 당사자가 제출하는 증거자료 등을 일체 열람등사하지 못하도록 하고 있다. 이에 본 논문에서는 과연 수사의 특수성 등을 이유로 소송기록의 열람등사를 제한하는 것이 옳은지, 아니면 피해자 등의 정보권 보장을 위하여 소송기록의 열람 등사를 허용해야 하는지 등을 살펴보고자 한다.

Occupational Health and Safety Management and Turnover Intention in the Ghanaian Mining Sector

  • Background: The mining industry is considered as one of the most dangerous and hazardous industries and the need for effective and efficient occupational health and safety management is critical to safeguard workers and the industry. Despite the dangers and hazards present in the mining industry, only few studies have focused on how occupational health and safety and turnover intentions in the mines. Method: The study suing a cross-sectional survey design collected quantitative data from the 255 mine workers that were conveniently sampled from the Ghanaian mining industry. The data collection tools were standardized questionnaires that measured occupational health and safety management and turnover intentions. These scales were also pretested before their usage in actual data collection. Results: The correlation coefficient showed that a negative relationship existed between dimensions of occupational health and safety management and turnover intention; safety leadership (r = -0.33, p < 0.01); supervision (r = -0.26, p < 0.01); safety facilities and equipment (r = -0.32, p < 0.01); safety procedure (r = -0.27, p < 0.01). Among these dimensions, safety leadership and safety facility were significant predictors of turnover intention, (${\beta}=-0.28$, p < 0.01) and (${\beta}=-0.24$, p < 0.01) respectively. The study also found that turnover intention of employees is heavily influenced by the commitment of safety leadership in ensuring the effective formulation of policies and supervision of occupational health and safety at the workplace. Conclusion: The present study demonstrates that safety leadership is crucial in the administration of occupational health and safety and reducing turnover intention in organizations.
