This paper aims to draw practical measures for the Protection of the Rights of the private security guards. The results of the analysis, and presents the legal definition if need be introduced for the protection of private security guards right, are as follows. First, it must be established in Private Security Act the basic provisions that assure the economic status of the private security guards. Secondly, there is a need to clearly define the scope of authority of private security guards. Third, there is a need to clarify the scope of physical force or power in the regulations relating to the duty of the private security guards. This provision during the "displayed its power", there is a possibility that is too arbitrary interpretation, it must be deleted. Fourth, it must be established by weighting penalties for assault of a private security guards. Finally, Private Security Act and the Petition Police Act has a difference in personality and the purpose of the enactment. So it is not desirable to be directly applied to private security guards the provisions that apply to the petition police.

Recently in the condition of increasing of cruel-hearted crime, it is limited to keep the community safe by only police force and expanding role of private security is required. But current private security law and relation law have many delimitations. So reinforcing of Private security capabilities is needed and several measures are required. Integration of private security law and private police guards is the foundation of rule introduced of specific rights of private guards. Also authority of the private security should be ruled in private security law to prepare the conditions of performed guard duties. In relation to this, questioning of a suspicious person by a patrolman should be granted to the private security. Strengthening authority of private security can be helpful in preventing crime and policing.

The purpose of this paper is to study ways to improve the welfare of private security guards. For this reason, it was analyzed the actual situation of the private security guards' wage and welfare system. As a result of the analysis, the most important factors that affect the wages and welfare system of private security guards was such as contracting costs, the minimum wage level, professional duties. In particular, a private security guards have been recognized as the most low-level professionalism sorted by the simple laborers standard classification. Wages of guards in accordance with this recognition is only about 47% of major company on average, about 80% of the small business average. If the proposed future improvements include: First, we need to improve the professionalism of a private security. Second, It is established a mutual-aid project about private security guards. Third, It shall regulate the wage of private security guards on Private Security Industry Act. Fourth, we should adopt a selective welfare system.

As the axis of the private security maintain social order in order to achieve the original purpose of all society must move in the direction of motion, and so in order to be a private security based philosophical values and ideological composition should be based. In this process, to be followed by private security value or direction, philosophy private security is the norm. In this regard, this study pursued by the private security justification ever truly normative principles are intended to establish. The public nature of the ideology of private security, public, efficiency, legality, responsiveness and the like. Conflict occurs between the value of these ideals, although complementary are in harmony.

With regard to problems related to qualification of Private Security, this study is qualitatively to develop education & training program from the viewpoint of education for the purpose of checking professionalism of Security guard. Offering the solutions for improvement by analyzing problems of articles related to training for Private Security guard prescribed in existing 'Law of Guarding', I made studies of development of practical affairs-centered education & training program for Private Security guard on the basis of Private Security guard' duties. Education & training program for Private Security guard must be made up of practical affairs-centered one related to concrete duties. Also because it needs to be made on the basis of a model planned for the program with combined method, this study gave example of model and contests of education & training program based on duties of Facilities Security. Main duties of cPrivate Security guard can be divided into four duties; duties on their own posts, patrolling, control of going in and out, dealing with accidents and so on. Private Security guard are given main duties by each post, and after adjusting conditions according to personnel organization, they perform their own duties. As education & training program based on Private Security guard' duties, common education & training program for the new-appointed, practical affairs-centered education & training program, education & training program for superintendents, service education & training program and so on are provided.

The purpose of this study is to explore the underlying causes of the development of private security in the United States. These include the increasing crime rates and fear of crime, the poor performance of public policing, the decentralization of political authority, the increase of mass private property, economic growth and increase of personal income, commodification of security, insurance companies' demand for tighter security and fear of litigation, and historical events such as World War I & II. Based on the findings of this study, it is suggested that no single factor would account for the growth of private security in the United States. In other words, the rapid growth of private security in the United States should be attributed to the interrelated influences of the factors given above. Finally, it might be the contribution of this study that the future development of private security in Korea would be guided by understanding the case of the United States because of the similarities of the developmental process in private security industry of two countries.

The security law and security industry of Japan have a great impact on Korea. In a modern sense, there are little large disparities between the two nations in the history and development of private security. However, the way they look at private security is not the same in large part. In Japan, private security companies are highly regarded by Japanese people as organizations that guarantee their safety, owing to the efforts of private security companies themselves, the National Security Association and civic groups. Private security has especially been approved and supported since it was decided in the anticrime cabinet council in December, 2003, in line with the action plan for the realization of anticrime society to boost private security as an industry to ensure people's safety in daily routine life by curbing crimes that might pose a threat to peaceful life. Afterwards, there has been a dynamic collaboration between the Japanese police and private security in terms of education, crime prevention, disaster prevention/restoration and everyday life safety. As for Korea, the necessity of cooperation between private security and the police is increasingly stressed, and it's required to strengthen their partnership to ensure successful crime prevention in consideration of Japanese partnership cases. In Japan, the police, civic groups, the security association and security companies make every effort to satisfy Japanese people's safety needs in diverse ways and take disaster-prevention measures as well.

The suggestions that follow are about the effectual operating device for private security service. First, in legal and institutional policy, new establishment by law for private security and more support from government is asked. Moreover, the restructuring or M&A between petty companies and the pricing for security service should be performed. Second, in the structural aspect of private security industry, the professional education center for private security guards should be established and the terms of payment and welfare should be improved to the level above standard. In addition, it should be achieved to change the public to have a new and correct understanding of private security and develop the specialized parts suited to the characteristic and ability of each companies. Third, the construction of operating system for private security service should be achieved; recruit system for competent security guards, marketing strategy and enforcement system, widely known confidence to client, normal training system for security guards and post management system for client. This is also to be suited to the characteristic of each companies.

In Korea, Private security companies has steadily grown and amounts to 2,051 places as of November 30, 2002. Private security in korea is carrying out firm name role assignment to have held the police and public peace environment change factors for a standard faithfully, and protects social a little property that is a basic purpose, and it is spare no efforts in loss prevention. In spite of numeral increase of private security companies, private security companies have many problem. Moreover, they mostly did not have any remarkable in-house expertises in their own business under tough conditions. Under the unfavorable circumstances including insufficient investment and education in private security guard, there have been actually little further studies on private security business in practices. So this study mainly focused on addressing the installation security business managed by authorized companies, which amount to 96%(1,963 companies) of total 2,051 domestic security companies. Furthermore, the study formulated and modeled a series of business procedures in private security companies. The purpose of this study is to analyze and interpret the current situation of private security companies·guards for the past three years, security companies by size, general·special (new education), and qualification system provided by the Police Agency, Security Association, etc. It provides a theoretical foundation for private security and provides a new perspective for interpreting private security. As a result, through the current situation, this private security has a concentration of metropolitan area and facility security, an abnormal personal protection company contrast, the number of personal protection institutes, there is a special security shift to regular jobs, and the current continuous education On the other hand, the education of special security guards has been shown to be limited. In the qualification system, the utilization of security instructor qualifications and the utilization and public relations of personal probation officer qualifications will appear. The current state of typical private security is as follows. The first is the balanced development of private security and the clarity of business divisions. Second, the quality of private security education and educational institutions must be high. Third is the recognition of the qualification system and active public relations.
