Practical Review of Analysis Techniques for Patronage Ramp-up (Ramp-up 분석기법에 대한 실증적 고찰)

  • This study examines the ramp-up analysis techniques which have been introduced till now and presents the strength and weakness of each method. The applicability of each technique was reviewed using a case study involving the data of Cheonan-Nonsan motorway usages where seasonal variations of the data were removed. The results showed that all the techniques except F-test have the same ramp-up period of 12 months. The level of Tamp-up was 65%-72% compared to that of the real traffic volume at the beginning of opening. The demand recovered to the stabilized level as time goes on. To apply the methodology to practical demand forecasts actual surveys of real data of traffic demand should be performed. With these efforts to the patronage ramp-up, more reliable demand analyses can be accompanied.

  • Recently, FTA may go beyond the agreement of the two countries, and also FTA is tinged aspects of Mega FTA between the economic sphere, under the situation that FTA and the business model are mutually intertwined in convergence industrial environments. Since South Korea came into force in 52 countries and 15 cases of FTA, South Korea have completed FTA network with the United States, as well as ASEAN and most of OECD member countries, and South Korea is now a critical time to take advantage of the FTA to determine the South Korea's economic performance. This paper examined the previous studies of FTA utilization and analyzed practical usages and problems of SMEs' FTA utilization. Through analysis, this paper suggests that the Training Plans of SMEs' Origin Management Specialist for the Improvement of FTA Utilization is as follows: to build up the effective management system of origin supports, to enrich the origin management competency, to reinforce the operation of supporting system, and to strengthen practical capacity of Origin administrative staff. Based on the results, it is expected to provide the policy implications for the FTA utilization in the future.

Legal Bases for the Interpretation of Contract Terms under the UNIDROIT Principles of International Commercial Contracts

  • Purpose - This paper examines the legal standards for the interpretation of contract terms in the UNIDROIT Principles of International Commercial Contracts (PICC) and the cases thereunder in order to provide academic implication to promoting an appropriate understanding of this topic in practical business. Design/methodology - This article uses the literature research and case study under the PICC. Findings - the contract terms shall be interpreted according to the common intention of the parties. If such an intention cannot be established, the contract shall be interpreted according to the meaning that reasonable persons of the same kind as the parties would give to it in the same circumstances. The statements and other conduct of a party shall be interpreted according to that party's intention if the other party knew or could not have been unaware of that intention. If not, the reasonable person standard will apply. In applying above articles, all relevant circumstances including the conduct of the parties, practices and usages shall be considered. Terms and expressions shall be interpreted in the light of the whole contract or statement in which they appear and contract terms shall be interpreted so as to give effect to all the terms rather than to deprive some of them of effect. Where contract terms supplied by one party are unclear, contra proferentem rule applies. Where there is discrepancy between several equally authoritative versions of a contract, a preference is given to the interpretation according to the version originally drawn up. Where the parties to a contract have not agreed regarding an important term for their rights and duties, a term which is appropriate in the circumstances shall be supplied. Originality/value - This article examines various cases regarding the topic that were determined under the PICC. By finding legal standards and rulings of relevant cases, this article will help readers in practical business to enhance the ability to apply the provisions to their contracts.

  • A motive and aim of enactment of UN Convention on the Use of Electronic Communication in Int'l Contracts is based on need to eliminate legal obstacles that might arise under existing int'l trade law instruments and promote int'l electronic commercial transaction. But when it is used with related articles, 14, 15, 16, 17 for offer under CISG, one of the most successful conventions which produces substantive law for the unification of int'l trade, questions of practical importance, for example possibilities of withdrawal, revocation, rejection of offer, the extent of its criteria arise from therewith. In conclusion, a effective electronic offer has to assure easily access and confirmation of trade terms besides criteria of offer under CISG. An offer can be withdrawal, if electronic message of withdrawal has entered the offeree's server before or at the same time when the offer has reached the offeree but agreement expressly or impliedly, between the parties about type, format, email address is a prerequisited. Implied consent could be presumed through prior conduct or trade usages between the parties under CISG articles 8, 9. The term "have reached" correspond to the time which is able to retrieve the electronic message of withdrawal. But without express or implied agreement between them about electronic communication of type, format, email address, an offer can be withdrawal before or at the same time when it has entered offeree's other e-mail address and confirmed by his retrieval. In case of the revocation, electronic message of the revocation is effective before the offeree's dispatching an acceptance. A prerequisite for the revocation by electronic communication is came as the above mentioned withdrawal except for concept of a time difference for reach. In case of a rejection of offer, when a rejection by electronic communication has entered the offeror's server, an offer is ended. But a prerequisite for the rejection by electronic message is same as the above mentioned withdrawal and revocation.

Trade Practice of Surrender Bill of Lading and Prevention of Its Disputes (권리포기 선화증권의 실무관행과 분쟁예방)

  • Two solution approaches have been suggested globally to solve the crisis of bill of lading; that is to say, electronic bill of lading and sea waybill. Electronic bill of lading is not unsettled as a solution to solve the crisis of bill of lading but sea waybill is used on a global basis to do so. The surrendered bill of lading is applied for practical usage instead of sea waybill in a short voyage among Korea, China, and Japan, owing to faster delivery at destination and lower cost than bill of lading. To surrender the original bill of lading, the consignor should submit all originals with a request letter to the carrier of goods with necessary surrender charges, if any, in doing so. Once after receiving the original bills of lading consisting of normally three originals but in some cases five, the carrier stamped "Surrendered" on the front of original bills of lading and sent a message to his counterpart at the port of destination, stating that the original bill of lading surrendered at the port of shipment and the consignee can take delivery of the goods without production of the original bill of lading at destination. The legal regime of the surrendered bill of lading is not settled as it is not considered legally as bill of lading, and the decisions rendered by each nation's courts are different according to the usages of the surrendered bill of lading. The purpose of this paper is to prevent the disputes between parties with regard to the surrendered bill of lading by studying the causes and precautions of disputes in relation to the surrendered bill of lading.

Development of Cross Reference R&D Information Model using Topic Map (Topic Map을 활용한 연구개발정보의 연계 모델 개발)

  • Recently, under the pressure of national necessity, the national S&T information system(NTIS) for collecting, managing and distributing various R&D information is under discussion. The close inter-connections and cooperations among elements in R&D process, activity, information and data levels are the basis of national S&T information system. In this paper, we propose a cross reference model of R&D information. The proposed model includes research project, person and output information which are essential in the R&D activities. By using the proposed model, a cross navigating and referencing among R&D information is possible. And various queries on the models from various viewpoints are also possible. XML Topic Map, ISO13250 Standard, is used for development of the proposed model. The efficiencies and further practical usages of proposed model are discussed by demonstrating the proposed model with an example.

A Comparison of Learning Styles between Gifted and Non-gifted (영재학생과 일반학생의 학습양식 비교)

  • This study has two purposes: The first is to compare gifted with non-gifted about learning styles and examine differences in the preference of learning styles between group characteristics depending on gender. The second is to examine differences between gifted and non-gifted about the preference of learning styles. The participants were 152 students from the middle schools in A City. 76 students of them belonged to the gifted group and the rest were non-gifted group. LSDI Learning Styles Diagnostic Inventory has been employed as measurement tools. Besides descriptive statistics, ANOVA, ${\chi}^2$ analysis were used to measure items. The results from data analysis are as follows. First, there was difference in learning styles between gifted and non-gifted. Second, there was not difference in the preference of learning styles between groups depending on the gender. Finally, this study discussed the results and their implication, the direction of future research in understanding and interpreting of learning styles for their practical usages.

  • Since appearance of smart devices and cloud computing services, the social and economical values of administrative information have been magnified as valuable information. In order to make better use of various administrative information by diverse government organizations efficiently and effectively, information sharing based on legal systems is essential because of several obstacles including privacy. To suggest practical ways for using administrative information, this study categorized the administrative information sharing process, and analyzed the regulations and legal systems that are contradictory to the regulations. The result of analysis appears that there is a need of legislative base for well-defined business use of information, and a need of the organizations, that available to collect and manufacture the information. The results of this study can be expected to make legislation contributions not only for industries, but also by suggesting the policy making and guidelines to protect privacy and improve the quality of citizens' life.

  • With advances of information technology (IT) and the Internet, it became much easier to search and collect information through many different types of web search engine. Such information only restricted to the intelligence services became available to the public, and the increased open source changed the intelligence collection activities of governments. Open Source Intelligence (OSINT) was introduced to organize and analyze the large volumes of information. OSINT is actively used after the 9/11 terrorist attack, and the United States government invest a huge amount of budget to conduct research and develope technology about OSINT. Although many Western countries recognize the importance of OSINT and deal with open source as priority, South Korea has not fully understand the important role of OSINT. Therefore, this study introduces the fundamental principles of OSINT and provides practical examples of OSINT usage. OSINT is an effective source to prevent terrorist attacks as well as a variety of crimes. Extensive discussion and suggestions for future usages are provided.

Self-calibration of a Multi-camera System using Factorization Techniques for Realistic Contents Generation (실감 콘텐츠 생성을 위한 분해법 기반 다수 카메라 시스템 자동 보정 알고리즘)

  • In this paper, we propose a self-calibration of a multi-camera system using factorization techniques for realistic contents generation. The traditional self-calibration algorithms for multi-camera systems have been focused on stereo(-rig) camera systems or multiple camera systems with a fixed configuration. Thus, it is required to exploit them in 3D reconstruction with a mobile multi-camera system and another general applications. For those reasons, we suggest the robust algorithm for general structured multi-camera systems including the algorithm for a plane-structured multi-camera system. In our paper, we explain the theoretical background and practical usages based on a projective factorization and the proposed affine factorization. We show experimental results with simulated data and real images as well. The proposed algorithm can be used for a 3D reconstruction and a mobile Augmented Reality.
