Purpose - According to the actual change of the logistics concept, the outsourcing activities of companies are actively progressing, and this is proceeding to third-party logistics and fourth-party logistics. This change in logistics situation raises the need for an in-depth understanding of four-party logistics. Research design, data, and methodology - In this study, first of all, the theoretical aspects of changes in the logistics concept are identified, along with the outsourcing and third-party logistics. Finally, the concept of four-party logistics, the background of its introduction, and future prospects will be explored. Result - The meaning of physical distribution is now passing through the existing three-party logistics and entering the era of four-way logistics. In addition, cost reduction and improvement of customer service through advanced logistics strategy can be said to be the company's competitiveness. Through this study, it can be seen that the conceptual change of logistics and the introduction of four-party logistics are closely related to the survival of the company's deficit in the market. Conclusion - In modern society, logistical competitiveness is the competitiveness of a company, and logistical activities of a company can be achieved through the process of entering the four-party logistics from the existing third-party logistics based on outsourcing. Then more customer-oriented service can be provided.
What motivates split-ticket voting in mixed electoral systems, where voters choose one party in district races and another party on the party list ballot? While much of the literature assumes strategic intent, three aspects commonly are overlooked: the competitiveness of district races, the presence of a district candidate from one's preferred party, and whether voters know the electoral threshold for party list seats. Furthermore, few studies disaggregate types of split-ticket voting (e.g. not voting for one's preferred party in a district vs. party list). Taiwan provides an intriguing case study for analysis, not only as a relatively new adopter of a mixed system, but also the presence of additional conditions that would encourage at least the consideration of a split ticket. Using survey data from the Taiwan's Election and Democratization Studies (TEDS) after the Taiwan's 2016 Legislative Yuan election, this analysis finds that knowing the threshold, the winner's margin, and the placement of a district candidate from one's preferred party all influence split-ticket voting among those with a partisan preference. However, closer inspection identifies a distinction between defecting from the district versus the party list. Evidence shows that district competitiveness and candidate placement influences defection from the district candidate, while the electoral threshold influences defection from the party list. The results add to our understanding of strategic and non-strategic incentives in mixed systems.
This paper is to research on the role of party autonomy in the decision of applicable law for the arbitral proceeding, arbitral award and arbitration agreement, in the decision of the place of arbitration, in the composition of arbitration tribunal, and the choice of arbitral proceedings. The principle of party autonomy is fundamental to arbitration in general and to international arbitration in particular. Generally the tenn of party autonomy is used as the autonomy of the parties to decide all aspects of an arbitration procedure subject only to certain limitations of mandatory law. Party autonomy permits the parties to a commercial arbitration to choose the laws and make the rules which govern the arbitral proceedings. Party autonomy allows the parties freedom to choose the applicable laws for the arbitral proceeding and the place of arbitration. Party autonomy is recognized in relation to the choice of law for the merits of the dispute as well as for the arbitration agreement and the arbitration procedure. On the basis of the recognition of party autonomy in international treaties, national legislation and court decisions, arbitral practice has generally accepted and enforced party autonomy both regarding the procedure and the applicable substantive law. All modern institutional rules of arbitration follow that line. Today it is recognized by national legislators all over the world to the effect that the jurisdiction of national courts can be excluded by arbitration agreement and that the parties may choose the law applicable to arbitral proceedings. Limits on party autonomy are imposed by mandatory provisions of international or national law or of institutional arbitration rules regarding the procedure. Mandatory laws at the place of the arbitration or under any procedural law chosen by the parties may restrict party autonomy. These mandatory laws usually take the form of public policy considerations in the arbitration. Limitations on party autonomy have been reduced more and more, and the trend of modern national as well as international legislation on arbitration leans clearly in the direction of a maximum of party autonomy.
This paper is about a case on the arbitration of disputes between the parties of charter party. 'B' vessel owner on the original charter party first made a charter party with 'L' cargo owner on the original charter party. Then, 'B' entered into another charter party with 'D' vessel owner, who will actually take charge of carriage of the cargoes which is described on the original charter party. Therefore, 'B' is a carrier of cargoes of 'L' and 'D' is a carrier of cargoes of 'B', according to the contracts. The cargoes of 'B' is cargoes of 'L', by nature. In these circumstances, damages to the cargoes occurred in the transit by the vessel of 'D'. Who should take the responsibility for the damage of cargoes? Who must be liable for those, 'B' or 'D'?. According to the original charter party, 'L' signed 'as Charterers' and 'B' was the counterpart of 'L'. But 'B' signed as 'for and on behalf of 'B',' without 'as Owners'. Tribunal of arbitration award that 'B' should take the responsibility for the damage to the cargoes, because 'B' is the vessel owner. Although 'B' is a contract carrier, 'B' must bear the liability of transport of the cargoes. The counterpart of charterer, 'L' is 'B' who is presumed to be the vessel owner by the original charter party. 'D', actual carrier is not the privy of 'L', cargo owner. This case teach us that signature on the contract is the matter of great importance.
