This study analyzes the effect of institutionalization of Korean metropolitan councils on legislation productivity. Based on the theory of institutionalization of legislatures, three independent variables (stability, complexity and adaptability) were selected to measure the level of institutionalization of a metropolitan council and nine sub-analysis indicators. The main results of the analysis of the effect of the institutionalization of the metropolitan council on legislation productivity are as follows: First, the factors that determine the number of reported bills were the ratio of first-term lawmakers, average number of elected of the chairmen, number of special committees, number of legislative experts, actual age of metropolitan councils, and number of voters per lawmaker. Second, the factors that determine the rate of reported bills were the average number of elected of the chairmen, the number of special committees, the number of legislative experts, the actual age of metropolitan councils, and the number of voters per lawmaker. Third, the factors that determine the number of reported bills per lawmaker is the average number of elected of the chairmen, the actual age of metropolitan councils, and the number of voters per lawmaker. The above result points out that legislation productivity differences of past metropolitan councils can be understood as differences arising from legislative institutionalization levels and several policy considerations can be made to enhance legislation productivity of metropolitan councils.
Under representative democracy, members of the National Assembly exercise their authority to propose, enact, and revise bills on behalf of the people, and the legislation of such lawmakers has a great impact on individuals and society. There exist criticisms that the quality of legislator-sponsored bills has not improved while the number of them has been expanding recently. This study examines the type, productivity, and efficiency of legislation in the 17~19th National Assembly, and empirical analysis is conducted on how the lawmaker's legislations respond to election-related variables such as voter turnout and election competition. The results show that legislator-sponsored bills are mainly produced in the area of governance, finance, macroeconomic policy, social welfare, and health. The number of legislator's proposals increases, while the passing rate decreases, and the processing period extends. Constituents' participation in voting has been shown to enhance legislative efficiency. Based on the results, the paper emphasizes the enhancement of transparency in the legislative process, the improvement of the people's political knowledge, and the revitalization of election functions for the improvement of parliamentary legislation.

The Japanese fishery management system has been established on the basis of various experience accumulated over many years. The fishery management system in Japan, one of the oldest fishery management systems in the world, is aimed at ensuring comprehensive utilization of the water surface and developing fishery productivity, by giving protection of the breeding environment of aquatic animals and plants, enabling the appropriate use of fishery grounds, preventing and solving disputes over fishery grounds and making other fishery adjustments. Japanese Fishery Law has been changed largely into (1) The Feudal Era(to 1900), (2) The Oldest Fishey Law(1901~48), (3) Current Fishery Law(1949 to present). Japanese fishery legislation is designed as a single package combining coastal, offshore and distant-water fisheries. During the period of the old fishery law, numerous conflicts arose over the joint use of fishing grounds and fish stocks. Such conflicts occurred among users of the same gear as well as between users of different gears or of different sizes of fishing craft. Large scale conflict sometime occurred between neighbouring fishing communities due to a lack of fairness in principle and coordination in practice. Therefore, the new fishery law enacted in 1949. This law was designed primarily to realize the most effective and rational use of fishing grounds and fishery resources, the basic philosophy being that, through democratic organization by fishermen themselves, productivity would be stimulated and incomes and living standards eventually improved. Nowadays, Community Based Fisheries Management through democratic organization by fishermen themselves have to enforce at coastal fisheries. This Community Based Fisheries Management manage to fishery resources by fishermen themselves and harvest in collaboration with that resources. Therefore, this paper is intended to briefly to describe the entire system and the historical development of Japanese fishery legislation in order to assist in reform of our country fisheries management regime.

The fisheries resources control system in the Fisheries Act of Korea is introducing technical management method and input control method that controls fishing effort. Fishing effort control system of Korea aiming at realizing the maximum sustainable yield does not regulating the limitation of fishing quota and the limitation of fisheries object target fish. Therefore fishing operators who have fishing permit can use fishery resources without any restriction of fishing quota. But there are no rules that can controlling capacity of productivity of fishing by developing of fishing technic and fishing gear. For those reasons, productivity of fishing is superior to reproductivity of fisheries resources. Therefore, the Fisheries Act of Korea rearranges a legal basis for an introduction of fisheries resources management system by TAC, but the contents to be possible for a legal guarantee is not included and it is exceedingly defective as abstract and institutional devices. And that the affairs to be required for an enforcement of the said regime was placed in an administrative mandatory legislation and the danger to be degenerated is high in accordance with the bureaucratic self-righteous and/or the coercion of group's interest concerned and accordingly its substitute legislation system is keenly required. TAC system that is going to be introduced in our country is expected to enforce the Olympic fishing method and the individual quota method in parallel. This method is not certainly proper, because it occurs to overcapitalize and to compete fishing amounts between fishery operators. So as to prevent overcapitalization and fishing competition between fishery operators, and the exhaustion of coastal fisheries resources, individual transferable quota system should be introduced in Korean sea. Accordingly this thesis has attempted to constitute a view to improving problems of the traditional fisheries resources control system and introducing TAC fisheries resources control system.

Objectives: This study was conducted to review the Toxic UseReduction Act of Massachusetts, USA, which has been evaluated as a successfulcase of a chemical reduction policy, and to search for ways to introduce it inKorea. Methods: We analyzed the implementation of the TURA by attending TUR Planning Course of the Toxic Use Reduction Institute in Massachusetts and researching the related literature. Results: As TURA took effect, the use of chemicals in Massachusetts was reduced, and cost savings were achieved in workplaces. The success factors for the legislation are considered to be support form the federal and state governments and the active participation of business and civic group. Domestic efforts to reduce toxic substances have already begun, so if the process of TURA is appropriately applied to domestic legislation of chemicals control, it would be expected to produce visible results. Therefore, we reviewed the 'Act on Chemicals Registration and Assessment', 'Act on Chemical Control' and 'Act on the Integrated Control of Pollutant-Discharging Facilities' and sought solution for applying TURA to each piece of legislation. For the first case, 'Toxic or Hazardous Substance List' and 'Establishment of Toxic Use Fee' is applicable. For the second case, 'Annual Toxic or Hazardous Substance Reports' is applicable. For the third case, 'Toxic Reduction Plans' and 'Toxics Use Reduction Institute and 'Toxic Use Reduction Planners' is applicable. Conclusions: The government should take notice appropriateness for the reduction of toxic chemicals and provide financial support. Businesses should invest in technologies that build trust with local communities, improve productivity, and reduce costs. Finally, civic group should cooperate with government and businesses.

Generative artificial intelligence is currently developing rapidly and expanding industrially. The development of generative AI is expected to improve productivity in most industries. However, there is a probability for exploitation of generative AI, and cases that actually lead to crime are emerging. Compared to the fast-growing AI, there is no legislation to regulate the generative AI. In the case of Korea, the crimes and risks related to generative AI has not been clearly classified for legislation. In addition, research on the responsibility for illegal data learned by generative AI or the illegality of the generated data is insufficient in existing research. Therefore, this study attempted to classify crimes related to generative AI for domestic legislation into generative AI for target crimes, generative AI for tool crimes, and other crimes based on ECRM. Furthermore, it suggests technical countermeasures against crime and risk and measures to improve the legal system. This study is significant in that it provides realistic methods by presenting technical countermeasures based on the development stage of AI.
The foremost aim of the paper is to evaluate the flexibility and stability of the Korean labor market through a cross-country comparison with OECD countries. Evaluating by the OECD Employment Protection Legislation Index, the flexibility of permanent job layoff in Korea is close to the average of OECD countries. Employment of temporary workers appears to be relatively flexible allowing for effective indicators such as the proportion of temporary workers among paid employees. As regards security, the levels of job security, income security and combination security are all far below the OECD average. A panel data analysis of OECD countries reveals that labor productivity increases as regulations on permanent job layoff become looser and regulations on temporary employment become more rigorous.
After the establishment of 'Staggers' Rail Legislation' in 1980, which established an atmosphere of free competition in rail freight transportation market, freight railway in America became larger and the proportion of freight railway in the market increased. In 2008, it took up 43% of the transportation market based on tonne/mile unit and the productivity of freight rail increased. On the other hand, in the case of Korea, the competing atmosphere is being set up under the influences of the renovation of the rail transportation industry in 2004. However, to make the rail transportation market more active and become more advanced, a lot of efforts are required to build a stronger foundation of free competition atmosphere. In this paper, we have deducted the political implications on the establishment of strengthened competition in Korean rail transportation industry from reviewing what kind of changes the rail transportation market in America went through and how it was developed. In this case, we have focused on the changes in industrial trend towards the restriction policy. Also influences of the deregulation policy after 1980 on the enhanced market efficiency were reviews.
Paradigm of Global economy is changing to creative economy. This study focuses on the role of creative economy to clarify (understand clearly) the impact (influence) which transition of economy system will bring about. The creative economy is basically came from New economy theory. According to the New economy theory, a state can achieve sustainable growth without an inflation, or higher growth rate under given inflation rate, through an investment on ICT. However, different from America, Korea had limited effect of New Economy. This is because Korean economy had factor-input driven growth model rather than New Economy mechanism. However, ICT is essential requirement to move toward New Economy(Digital Economy), it does not sufficiently explain the increase of productivity and economic growth. A crucial point to realize New economy is how to diffuse and spill over the technology development on ICT sector to other industry. ICT is not creative industry or creative economy per se, and it should play as an enabler to improve other industry's productivity. The creative economy can be understood as an extension of New Economy theory. It means the economy that creates values by cultural assets and human resource, as well as capital and labor factors. However, if we understand the meaning of creative economy as change of input factors, it is hard to bring real shape of creative economy.
The purpose of this research was to present the possibility of an alternative production base for clothing business of South Korea through the analysis about textile/clothing industry production activities in the Gaeseong industrial complex. It is necessary for the Gaeseong industrial complex to cope with the issue about FTA and country of origin, manpower supply and demand, paying wages and labor productivity, the exclusive industrial complex of clothing. The Country of Origin on imports and exports tells the country of manufacture or production, where the product comes from. Rules of Origin are the special regulations to determine the country of origin of a product and exist in the forms of international law, legislation, precedent and administrative decisions. But the economy in the North and the Gaeseong industrial complex is a comparative advantage combined with elements of North-South interdependence as a South-North economic cooperation business and can contribute significantly to the stabilization of the North-South relations. Among the models using criteria of the determination of origin, it has directly provided the models of general regulation for offshore products, of limited offshore products. These models are to help Korean exporters in understanding and utilizing the Rules of Origin for their manufacturing. In addition, the development of the Gaeseong industrial complex will contribute to establish peace on the Korean peninsula as well as in Northeast Asia. Also economic cooperation between South and North Koreas is essential for peace and prosperity of the Korean people.
