  • Since technological innovation is such an important factor that it can determine a company's economic growth and competitive enhancement, all the companies make lots of investments and efforts for technological innovation. As outcomes of technological innovation, there are patents, trademark and copyrights, etc. and they are mostly approved as a legal right called 'Intellectual Property Right'. To activate such an intellectual property right, financing techniques are needed for enterprises to raise funds through collaterals, such as technological and intellectual patents. In reality, however, any IP-related financial system is not really activated due to the lack of surety-related regulations in Korea. Thus, on the premise that it is important to carry out an objective and reliable valuation on IP as a collateral for the activation of IP finance, this study intends to investigate various different methods of patent valuation needed for IP finance.

  • Previous studies related to evacuation guidance systems are focused on the system construction, and research on manual of the standard evacuation map is insufficient. Therefore, this research is a basic study to establish the standard evacuation map, and analyzed the decision-making time according to the type and size for each component of the evacuation map. Experimental elements were derived through the review of previous studies and legal regulations. After that, decision-making time was analyzed according to the type and size of the component display method. An experiment was conducted to analyze the decision-making time according to the type and size of the component display method. Afterwards, through the statistical test, the evacuation map guidelines for smartphones were proposed.

  • The purpose of this study is to investigate the problem of installing VR theme park in Korea and to find a solution for it. VR is expected to play a leading role in the fourth industrial revolution as a new industry, but it is a reality that it is hard to feel its value in actual field. This is a reality that can not move one step further because it is trapped in the existing legal network rather than the essence of VR because it sees VR from the existing law frame. Because VR is regarded as an amusement device in the amusement facility and is regarded as a game, the former is applied to the Tourism Promotion Law and the latter is applied to the game industry law. When one content and hardware are applied to both laws at the same time and other regulations are applied to it, it is practically impossible to operate VR properly. In order to solve this problem, it is necessary to revise each law little by little in each law and amend the law that can apply VR itself. This study is expected to contribute to the revitalization of VR industry by presenting the ultimate problems and solutions in creating VR theme parks in Korea.

  • Despite continuous efforts by the construction industry to achieve better quality, it doesn't seem that much has been improved. This is mainly because current specifications do not satisfy a change in the market environment, which is that a higher level of quality is now demanded by users. Quality improvement efforts have been satisfied merely to meet specifications. On the other hand, advanced countries have been experienced great success in their construction techniques and have reduced costs by introducing apay adjustment system to the construction industry, in which compensation is based on performance. Following their example, Koreashould introduce such a pay adjustment system in order to motivate the members of our construction industry to achieve better quality and a higher level of construction techniques. However, there has been a lack of a rational approach to the development of a system for cost coordination, as well as performance and quality inspection. Thus, in this study a legal and logical plan was developed that can be used to adjust the construction cost, along with the performance inspection of quality results, in order to introduce a pay adjustment system that is appropriate for domestic regulations.

Operational Direction of Regional Building Safety(RBS) Center for Preliminary Review of Architectural Administration in Korea

  • In Korea, local government officials are in charge of buildings, and as such are supposed to review submitted documents related to the architectural administration to ensure that they comply with the legal standards. However, these officials generally put a greater emphasis on the preparation of the set of documents required for the administrative work than the content the documents contain. For this reason, many experts point out that the shortage of officials specialized in buildings and construction, as well as the lack of expertise among the building officials in the local governments, may result in repeated safety accidents during building construction. The purpose of this study is to propose the operational direction of a Regional Building Safety (RBS) center to secure the performance and safety of buildings by utilizing private resources. In this study, we carried out a pilot project to verify the effects of an RBS center and to derive the specific number of experts required. As a result, the technical matters were resolved in approximately 15% of the total cases of the document processing procedure, and the level of technical specialization among the officers has also been improved through the provision of guidance. The research findings support the validity and effects of the introduction of the RBS center. Finally, this study proposes (1) the types of RBS Centers that should be established, (2) the roles and business scope of the RBS Center, (3) the specific number of experts required, (4) the qualifications of the experts, and (5) the business regulations of the RBS Center.

Suggestions for Activation of Sport Convergence Enterprises (스포츠 융합기업 활성화를 위한 제언)

  • This study was intended for suggestions enabling sports enterprises to lead the sports industry convergence. The method of study was literature reviews and discussed on improvements of the current law through examining the relevant law and regulations in the future. In the result, the current sports industry is faced with many matters. Despite the convergence availability of sports industry, professional sports industry human resources shortages, the absence of dedicated organizational mechanisms, R&D investment shortage and insufficient legal aspects can be presented. Fostering human resources with expertise and the installation of organization that can support sports industrial convergence are required to solve these problems. In conclusion, since sports industry has a value added area higher than other industries and bring economic ripple effect as a result of convergence activities, a climate for promoting sports convergence enterprises should be created.

An in-depth Interview Study to Examine the Performance Status of the Legal Risk Assessment of Musculoskeletal Disorders (근골격계부담작업 유해요인조사 이행 실태 파악을 위한 심층 면담 조사)

  • The purpose of this study is to investigate the performance status of the ligal examination of risk factors of musculoskeletal disorders(MSDs). The study was based on in-depth interviews with the persons in charge of the examination in 63 sampled companies, which are various in location, type of industry and size. The interviews were carried out based on detail questions as well as a predefined checklist. The main findings are as follows: 1) More than half of the companies did not properly comply with the laws in performing the examination of MSDs risk factors; 2) In about 60% of the companies, the examination has been carried out by their own persons; 3) 38% of the companies conducting the survey of musculoskeletal symptoms did not diagnosed musculoskeletal symptoms based on the survey; 4) Most companies performed the prevention activities for MSDs such as education/training, stretching, etc.; 5) It was revealed that the 11 high-risk tasks were not considered to be properly defined by the people in the industries, which results in some difficulties such as ambiguity in defining the 11 tasks and unit tasks; 6) The period of the examination of risk factors, classification of periodic and occupational examinations and legalization of employers' obligation for preventing MSDs are considered to be acceptable or desirable, while it was pointed out that regulations for the method of the risk assessment and the person who in charge of the examination need to be modified.

  • Korean fishery wage system has been evolved with the different titles. However, Since the law of fishing crew was enacted in 1984, the fishery wage system has been established as a rate system, which is a legal term. The present rate system in practice shows various contents and modalities, depending on fisheries and regions, but the fisheries of large trawl cooperative employ a rate system of fixed plus rate wage. However, such change did not transform basically the properties of pure rate scheme. As well known, fishing vessel owners face an awful lot of difficulty in managing and controlling effectively the production process because fishing activities are carried out in the seas remote from the land. Thus, it tend to be inevitable for vessel owners to employ a rate system to induce fishermen's positive motivation for promoting productivity and saving operating costs. However, the rate system has worked out as a driving force, which induce an increase in production more strongly under the expansion of vessel numbers and power and the keener competition of fishing activities. Even though the control mechanism of fishing instruments are well established, fishermen become naturally to have an incentive to increase their fishing effort for maximizing production since they are able to raise their shares by maximizing the quantity harvested. Thus, as far as the rate system exists, fisheries administration may have much difficulty in realizing its fishery management goals only through vessel reduction and fishing gear regulations. Also, under the rate system fishery management authority may be in face of a serious dilemma between the spontaneous rate system and vessel reduction policy. If the realistic aspect of the rate system is recognized and resource restoration and profit promotion are main policy goals, it is necessary to develop effective ways to control vessel owners' and fishermen's production-maximizing motives at an appropriate level. From this point of view, it seems reasonable to introduce TAC system by species or by fisheries into the existing fishery system. The research results suggest that if the fisheries administration could understand clearly the spontaneous fisheries wage system, it would know the norm of TAC and the basic reasons for illegal fishing activities and thus it would be able to develop and implement more realistic resource management policies.

Challenges of Accessibility to Information Resources by Prison Inmates

  • Prisons are mostly filled with social deviants and like other correctional institutions, deserve organized information (provision) centers such as library. A study on library resource needs and accessibility by prison inmates was conducted at Kuje prison, Abuja and Kaduna prison, Kaduna, Nigeria, both of which have functional libraries. A sample of 898 inmates was randomly selected from all the convicted inmates in the two prisons. A total of 106 inmates were selected from Kuje prison and 792 from Kaduna prison. A well-structured questionnaire was used to collect data from the inmates. All the 898 inmates responded. A total of 786 (87.9%) males and 112 (12.4%) females were involved in the study. With regards to the educational level attained by the inmates, 347 (38.6%) had Junior Secondary School Certificate while 323 (30.0%) had Senior School Certificate both accounting for 74.6% of the sampled population. In areas of information needs, 94.5%, 96.1%, 98.7%, 99.4%, 100%, and 100% of the respondents indicated that information on current affairs, survival and coping, educational support, legal aid, skill acquisition, and health, respectively were highly needed by the inmates. Out of the 12 information resources listed, only newspaper, novel, handbook and manual, and bulletin were readily accessible with percentage accessibility of 60.7, 7.8, 6.8, and 1.9, respectively. One major reason adduced by the respondents for limited access to information resources was the very strict rules and regulations in the prison. Providing more library resources and granting the inmates more access to the library would assist in character reformation and rehabilitation of the inmates.

A Literature Analysis on Medicinal Use and Research of Cannabis in the Meiji Era of Japan

  • Cannabis is a historical plant which has been used as a medicine in East Asia. These days, there are active debates about using cannabis in clinical field. Collecting and comparing cannabis research articles which had been published in the Opening of Japan to spot the interactions between the traditional medicine of Japan, Rangaku which was established in Edo Period and the European medicine which is transferred after Perry Expedition is academically meaningful. This study searched publications, which were listed on Open-Access databases by Dec. 11th, 2019. We collected research articles which had been published from January 3rd, 1867 to July 30th, 1912 also known as Meiji era and uploaded on OpenAccess databases. Our searching databases were J-stage, CiNii (Scholarly and Academic Information Navigator), Tokyo Metropolitan Library, The National Diet Library, IRDB (Institutional Repositories DataBase) and KAKEN (Grant-in-Aid for Scientific Research Database). Searching keywords were cannabis, hemp and all their Japanese synonyms and available combinations. We selected final 15 studies which met every selection criteria in the 346,393 collected studies. Cannabis was prescribed in Meiji era of Japan to alleviate pain and cure the digestive, respiratory, urinary, and nervous system diseases such as indigestion, asthma, tuberculosis, gonorrhea and its complications, insomnia, and nervous prostration. Cannabis was medically used in Meiji era of Japan and the reporting and sharing of its clinical effect was published on the medical journals like present days. There were already Cannabis regulations in that era, but its medicinal use was more liberated than nowadays. It may be a chance to reconsider the current legal system, which strictly controls the use of Cannabis.
