  • 지리정보DB는 구축하는데 많은 비용과 노력이 수반됨에도 불구하고 비교적 간편하게 복제하여 활용할 수 있기 때문에 유통관리에 있어 법적 보호체계가 마련되어야 한다. 그러나 우리나라의 저작권법은 보호기준을 소재의 선택 또는 배열에 창작성으로 규정하고 있어 소재의 선택 또는 배열에 창작성이 낮거나 없는 데이터베이스는 보호받을 수 없는 실정이다. 본 연구는 이러한 현실적인 법 체계하에서 데이터베이스 제작에 따른 자료수집과 구성에 대한 노력 그리고 유통 및 활용에 따른 관련집단간의 이해갈등을 조정하기 위한 보호방안을 마련하기 위해 시도되었다.

패션기업에 대한 CSR기대와 브랜드 자산에 미치는 영향 (CSR Expectation from Fashion Firms and its Impact on Brand Equity)

  • This study explores the ideal corporate social responsibility(CSR) that fashion consumers expect from a fashion firm in the identification of dimensions and levels of consumer expectations as well as examines the impact of CSR expectations on customer-base brand equity. The data of 315 adults were collected through a nationwide online survey. In order to analyze the data, this study employed Confirmatory factor analysis (CFA), paired t-test, structural equation modeling(SEM), and descriptive analysis. This study first identified seven fashion CSR expectations (environmental, ethical, social, internal management, philanthropic, economic, and legal expectations). Internal management and environmental activities were highly expected from fashion firms; however, economic activity was low in expectations. Five models separately tested the relationship between CSR expectations and brand equity (trustworthiness, attachment, performance, social image, and value). Economic, environmental, internal management, social and ethical CSR expectations influenced customer-based brand equity; however, philanthropic and legal expectations did not influence any dimension of customer-based brand equity. This study provides a framework of ideal CSR from a consumer perspective and suggests that fashion marketers should focus on economic, environmental, internal management, social and ethical CSR activities to meet the expect Haitians of fashion consumers and build stronger brand equity.

  • In this study, we examine why there exist different legal systems in electronic commerce or online financial trading. When a fraud online transaction occurs and the online customer disputes the transaction, the online customer takes responsibility for the proof of her/his argument in many European countries while in the U.S., the burden of proof lays on the firm. This paper analyzes how these two different legal systems exist and how these can be applied to electronic commerce law. In particular, this paper intends to find the optimal level of e-commerce firms' investment on security and analyzes how security investments can be related to firm's profits and consumer's welfare depending on IT infrastructure and social trust environment. More on, this paper can be contributed to provide guidelines for regulatory framework on ecommerce online transactions and discuss social welfare implications.

국내외 뇌사, 존엄사와 안락사에 대한 인식의 변화와 윤리 - 소아를 중심으로 (The change of perspective on brain death, euthanasia and withdrawal of the life supporting medical treatments in Korea for pediatric patients)

  • A recent High Court's decision regarding the withdrawal of life supporting medical treatment (artificial ventilator) from an elderly female patient in the terminal stage has opened up a new era of the "euthanasia dispute" in Korea. With this decision, the legitimate withdrawal of life supporting treatment became possible under certain conditions and the Korean Medical Association is working toward the establishment of practical guidelines for the terminal-stage patients. However, there are still very few debates on the cases of pediatric patients in the terminal stage or suffering from fatal diseases. For pediatric patients, the core principle of autonomy and following procedure of "advance directives" are hardly kept due to the immaturity of the patients themselves. Decisions for their lives usually are in the hands of the parents, which may often bring out tragic disputes around "child abuse", especially in Korea where parents have exclusive control of the destiny of their children. Some developed countries such as the U.S.A., the U.K. and Canada have already established guidelines or a legal framework for ensuring the rights of the healthcare system regarding children suffering from severe illness, permitting the withdrawal of Life supporting medical treatment (LSMT) in very specific conditions when the quality of life of the children is severely threatened. For the protection of the welfare and interest of the children, we should discuss this issue and develop guidelines for the daily practice of pediatricians.

개인정보의 법적·기술적 특성을 고려한 라이프 사이클(Life Cycle) 모델 (The Life Cycle Model Considering Legal and Technical Characteristics of Personal Data)

  • 본 논문은 개인정보의 법적 및 기술적 특성을 고려한 라이프 사이클 모델들을 각각 검토했다. 그리고, 이를 토대로 국내 IT 기업에 적합한 '개인정보의 동의 관리 기반 모델'을 제안했다. 본 논문에서 제시한 모델은 기존의 모델이 간과하고 있던 '동의'와 '관리' 요소를 모델에 적극 반영했다는 특징이 있다. 본 모델의 타당성은 2가지 방식으로 검증했다. 첫째, IT 기업의 개인정보 라이프 사이클 구성 요소를 파악 후 모델별로 적용하여 '동의 관리' 모델의 우수성을 검증했다. 둘째, 개인정보의 라이프 사이클 전체 프로세스에 '동의'와 '관리' 내용이 포함됨을 입증했다. 본 연구 결과를 활용하면 IT 기업이 개인정보 활용 현황을 분석하고 보호 체계를 마련하는데 기여할 수 있을 것으로 기대된다.

최신 비침습적 산전 유전 검사(NIPT)의 임상 적용과 간호학적 의미 (Reviewing Articles Related to Recent Advances in Non-invasive Prenatal Testing and Nursing Implications)

  • Purpose: Nineteen articles were analyzed to gather opinions and nursing implications about NIPT recently launched. Methods: Nineteen articles were selected from EBSCO (eBook business collection), Google Scholar, and two Korean academic d-bases with key words 'prenatal screening testing', 'prenatal genetic diagnostic testing', NIPT or 'cell free DNA (cfDNA)'. Authors developed a framework for analyzing the 19 articles including opinions and suggestions for future implications. Results: Eleven articles written by the first author affiliated with medicine or genetics, viewed NIPT as promising because of safety, accuracy, early detectability and cost effectiveness. Articles written by journalists or authors affiliated with history and ethics were concerned with the possible risk of ELSI (ethical, legal, social issues), erratic interpretation of test results, and lack of genetic counseling service. Conclusion: With consideration of Korean clinical, and legal circumstances, not only pregnant women and families but also health professionals must prepare for clinical NIPT implications including updating prenatal genetic testing, counseling services, protecting ELSI and amulticultural team approach.

일본의 민유림 임도사업에 관한 고찰 (A Study on the Construction of Non-National Forest Road in Japan)

  • 본 논문은 우리나라 임도사업의 법적, 제도적 기틀을 위한 기초자료를 제공하기 위하여 임도사업의 경험이 축적된 일본의 민유림 임도사업에 대한 정비방침, 보조체계, 사업체계 및 관련법규에 대하여 자료를 정리 고찰하였다. 그 결과, 일본의 민유림 임도사업은 다양한 시대적 요청에 따라 법적 제도적 기틀을 마련하여 실행하므로서 효율적인 임업경영의 전개, 삼림의 적정한 유지관리, 산촌지역의 진흥 및 생활환경 등에 일익을 담당하고 있다.

중국계약법(中國契約法)상 무역계약불이행(貿易契約不履行)관련 규정(規定)의 연구(硏究) (A Study on the Law of Non-performance of International Sales Contract under the Contract Law of The People's Republic of China)

  • This study is to introduce the Chinese Contract Law against non-performance of the contract and to solve the wide range of problems involving to executing the trading contract. The parties' liability for the period of performance, the place of performance, the failure to deliver conforming goods together with it's nature of the lack of conformity, and the methods of compensation against damages and the force majeure clauses application. Those issues affect directly to commercial transactions in international business. The focus is more on the interrelationship of private individuals in its trade and on aiming to remove the legal obstacles from the Chinese Contract Law to freely flow of international trade. Reference may include foreign corrupt practices, Conventions on Contracts for the International Sale of Goods and Laws of England, France, and Japan. This study has brought the efforts of these issues in the full spectrum of performance and with concentrations on effectiveness to avoid the different viewpoints of the general principles of CISG and commercial practice founded pre-eminently. This study, in presenting the legal framework, will contribute to a better understanding of the purpose of rules of Chinese Contract -Law as they interact to the benefit of the parties involved in international trade transactions. The writer believes that a problem-oriented approach and the concentration as outlined above would offer a different perspective for law faculty teaching in this area and hope that this study can be sufficiently diverse to satisfy many of those views.

CISG의 적용에 관한 CIETAC 중재사례 연구 - 중국과 홍콩 당사자간 분쟁을 중심으로 - (A Study on CIETAC Arbitration Case about Applying the CISG - Focus on Dispute between China and HK Parties -)

  • The amount of international trade conducted through Hong Kong (HK) is increasing, thus rendering the legal framework governing contracts of sale between Mainland China (China) and HK is of particular importance. The status of HK under the CISG is currently unclear, however. First, the CISG entered into force in China in 1988. This important development had no legal effect for HK though as China lacked the power to enter into international conventions for HK. Second, the "Letter of Notification" deposited to the Secretary-General of the UN referred a list of treaties to be applied to HK, taking effect from July 1, 1997. This list, however, made no mention of the CISG. Third, China made a reservation in Article 95 of the CISG. Pursuant to Article 1(1)(b) of the CISG, the CISG cannot apply to HK. As a result, the Chinese Arbitral Tribunal apply the Chinese law according to the closest connection principle with the contract. In this case, attention must be given to the different result to which the CISG is applied. Liability for damages pursuant to the Chinese Contract Law (CCL) is just the same as Article 74 CISG, but CCL does not govern the case with substitute transaction and without substitute transaction when the contract is avoided. Therefore, the contract should be governed by the CISG from a business perspective when a contract is concluded between China and HK; otherwise, a promisee could not be fully compensated for all loss incurred.

환자안전 관련 법의 구조와 현황 (A Legal Framework for Improving Patient Safety in Korea)

  • This paper reviewed structure and current status of laws related to patient safety using patient safety law matrix to promote systematic approach in legal system of patient safety. Laws related to patient safety can be divided into three areas: laws for preventing; laws for knowing about; and laws for responding. In the case of Korea, gaps are especially prominent in the areas of laws for knowing about and responding. Patient safety law which will be enacted in July 2016 will fill the gap in the area of laws for knowing about. This law will be comprehensive law, covering the full spectrum of laws related to patient safety. However, after reviewing current patient safety law in Korea, the following drawbacks were identified: absence of code for grasping the current patient safety level; absence of code for mandatory reporting in patient safety reporting system; and absence of code for privilege about patient safety work product. Furthermore we need wider discussions about covering issues of open disclosure, apology law, coroners system, and complaint management system in patient safety law.
