A Review on End-of-life Care System between South Korea and the United States (한국과 미국의 생애말기케어 시스템 비교 연구)

  • This study aims to examine eligibilities, services and delivery of services for the current end-of-life care and analyze the quality control of services for end-of-life care. We analyzed the literature and laws on end-of-life systems in Korean and the United States. Current end-of-life care, hospice and palliative care in Korea is being provided mainly in hospital setting. Quality control for the services focuses on setting the criteria for structures in hospitals (i.e. staffing, facilities and equipment). Whereas American end-of-life care system has much broader eligibility for service beneficiaries and provides care mostly at home. Also quality control for services includes process (delivering service) and outcomes, such as monitoring performance indicators and consumer's satisfaction. This is linked to annual payment. The comparative analysis findings contributed to give the next direction of current Korean end-of-life care system. It is nessary to establish the better and extensive end-of-life care system in Korea in considering other countries' end-of-life care systems based on more future research.

Searching for Laws and Systems to Revitalize Private Archives (민간 아카이브 활성화를 위한 법·제도 모색)

  • From the beginning of the enactment and implementation of the Public Records Management Act, there has been a steady discussion on the establishment of local archives. Local archives include not only administrative records of local governments, but also private archives such as containing the lives of residents. Along with the academic discussion, there have been movements for local autonomy and decentralization. Currently, interest and discussion on private archiving are in the historical flow. In addition, private archiving has become a social concern because of the establishment of systems such as the Public Records Management Act and the Information Disclosure Act, the establishment of a digital environment, and the spread of the meaning and value of village community activities. There are several government agencies related to private archiving, and the grounds for performing their work are different, and there are many central administrative agencies to which they belong. Therefore, I propose that the National Archives take the lead and form a 'Consortium of Private archives Management Institutions'. The organization should promote first, cooperation of collection information and archives, second, coordination of tasks and functions between institutions, and third, establishment of a nationwide private archives management system. Now is our chance. Instead of reacting on an ad hoc basis, respond systematically with a long-term perspective.

  • The importance of manuals is emphasized because chemical accidents require swift response and recovery, and often result in environmental pollution and casualties. In this regard, the OECD revised OECD Guidelines for the Prevention, Preparedness, and Response to Chemical Accidents (referred to as the OECD Guidelines), in June 2023. Moreover, while existing research primarily raises awareness about chemical accidents, highlighting the need for a system-wide response including laws, regulations, and manuals, it was difficult to find comparative research on the attributes of manuals. So, this paper aims to compare and analyze the second and third editions of the OECD Guidelines, in order to uncover the information attributes and implications of the revised version. Specifically, TF-IDF (Term Frequency-Inverse Document Frequency) was applied to understand which keywords have become more important, and Word2Vec was applied to identify keywords that were used similarly and those that were differentiated. Lastly, a 2×2 matrix was proposed, identifying the topics within each quadrant to provide a deeper comparison of the information attributes of the OECD Guidelines. This study offers a framework to help researchers understand information attributes. From a practical perspective, it appears valuable for the revision of standard manuals by domestic government agencies and corporations related to chemistry.

  • As large-scale buildings, skyscrapers, and multi-purpose buildings recently increase in numbers dramatically, the internal space of such buildings becomes more and more large and complicated accordingly. Since such structures usually accommodate a number of random people, the potential possibilities of disastrous tragedies are high, and the rates of injury and physical damage caused by the complicated system of the building also increase as well. However, most of the shelter designs of the existing buildings are based on the specifications according to the assigned laws and involved regulations. In this case, only general criteria are referred to regardless of the characteristics of each structure while other disaster-related features are not taken into consideration sufficiently. Since any actual fire may cause a terrible calamity, in such plans, shelter inducement can be neither safe nor effective. Thus, this study examines and analyzes currently run disaster prevention systems and shelter inducement facilities with COEX Mall as its subject, and analyzes the responding system to each situation based on the fire scenarios by means of As-Is Model. Through this analysis, presented are the measures to solve the problems of current disaster prevention systems and to improve shelter inducement methods effectively.

  • The historical study reveals that our ancestors had maintained a system which could produce data on the number of population and households as well as on their characteristics. For example, such data on age structure of the population, number of births, number of deaths by age & sex, number of in & out migrants were found in an historical document for the year 755. The main purposes of maintaining the system at that time were taxation and conscription. As the system evolves, another function of identifying the legal status of people was also added. Looking into the figures for those days reveals that ommission rates of the number of population and households were high. Thus, in an effort to obtain a reliable data, the annual population survey system was introduced as of 1 September 1896. This date is now cerebrated as the Statistics Day. Since then, the survey system has been diversified. At the present time, there are three major data sources which produce the statistics on population and households: Civil Registration System (vital statistics), Resident Registratiton System (migration statistics) and Population Census. However, these three systems are found to have some problems to produce the accurate data. There are some inherent problems in the registration systems such as problems in its coverage, accuracies in contents and timeliness in reporting the vital events and publishing the results. The population census has also non-sampling errors such as errors in coverage, response and non-response. Apart from the above mentioned problems, there are also conflicting problems arised from having different three data source. We can find some overlapping problems in laws and difficulties in comparative studies between regions. In the future, these problems should be taken into consideration for the improvement of the quality of statistics on population and households.

Comparative Study of Institutional Approaches to Children's Playgrounds for Ensuring the Right to Play (놀이권 보장 측면에서 본 국내외 어린이놀이터 관련 법제 비교 연구)

  • The importance of play from a Children's Rights perspective has been continuously emphasized, and the need for play facilities and spaces has been reiterated. Meanwhile, in South Korea, despite the continuous increase in the number of play facilities, efforts to improve children's play spaces are required. Therefore, this study reevaluated the current regulations and policies concerning play and play spaces from the perspective of securing the right to play. An analysis of the legal concept of domestic playgrounds, related laws, construction standards, and regulations was conducted. The systems and characteristics of the related regulations in the UK, Canada, and Germany were analyzed. Based on the results of the comparative analysis, our directions for improving the system of playgrounds to ensure the children's right to play were proposed. First, a legal definition of the concept and scope of playgrounds should be established. Second, beyond safety-focused facility regulations, there is a need for institutional enhancements to ensure the right to play. Third, comprehensive management of playgrounds is required as a spatial concept rather than as individual facilities. Fourth, qualitative management is needed through specific guidelines and guidelines related to the establishment of playgrounds. These results can serve as a basis for establishing systems and promoting policy projects to ensure children's right to play in various fields, including urban planning, child welfare, and education in the future.

A Classification of Mountains in the Southern Part of Korean Peninsula based on the Mountain Ordering (산지 차수에 근거한 남한지역의 산지 구분)

  • The technique of mountain ordering developed by Yamada(1999) has been tested to two small islands (Namhaedo: 301km2, Geojedo: 378km2). The results and experiences above were extended and applied to the whole area of the southern part of Korean Peninsula. Three areas such as Seorak-Taebaek Mountains, Jiri-Deogyu Mountains, and Youngnam Alps are identified as the highest, 5th order mountains. 10 areas are classified as the 4th order and 87 areas as the 3rd order. It is suggested that the 5th order mountains are related to the axis of uplift and the 4th and 3rd order mountains have the same direction (NE-SW) as that of the secondary mountain systems in the Korean Peninsula. The logarithmic values of number, area, and relative altitude of the ordered mountains have the linear relationship with the order, as the laws of stream order. The several mountains which are not included in the existing mountain systems could be identified among the ordered mountains, and those mountains could be used as the basis to understand the geological structure of the Korean Peninsula. Most of the National Parks and the Provincial Parks are distributed on the 3rd, 4th, 5th order mountains. It is especially confirmed that the Songnisan National Park take a role to link the Seorak-Taebaek Mountains and Jiri-Deogyu Mountains as a important ecological axis. Therefore, it would be validated that the technique of mountain ordering has the practical values as well as the geomorphological significances.

Evaluation Index for U-city Status Diagnostic Assessment System based on Local Governments (지자체 U-City 수준진단체계 평가지표)

  • A Ubiquitous City (U-city, Smart City) is one that ties information communications technologies (ICT) into many facets of city construction, thereby implicitly intending to function as a smart city that aims to be efficiently managed as well as provide an enhanced standard of living for its residents. Laws related to the construction of such ubiquitous cities point to integrated city management centers, intelligent facilities, and U-City infrastructure, among others, as central components of U-Cities, but do not provide a standard for these structures. Consequently, building of U-Cities by local governments are based on arbitrary judgments constrained the myriad of practical limitations that they face. Such ambiguity brings to light the need to find ways to improve the quality of these efforts. The first and second stages of this research examine the status of the components of a U-City -ubiquitous planning, technology, infrastructure, and services - and undertakes a comprehensive review thereof, with evaluation criteria formulated on the characteristics of stability, connectivity, goal-orientation, and development potential. In the research's third stage, a realistic and detailed evaluation index by which U-Cities can be renewed, demonstrated, and applied (???) is introduced in a step-by-step fashion, which will allow for local governments to properly assess the standard of their U-City in relation to the realities of the locality. Through the research result, it is expected that the index will become a part of the continued development and advancement of the "smart" character of an autonomous U-City at the local scale, and contribute to the overall revitalization of the U-City.

Study on Preventing Retaliation against Crime Victims (범죄피해자에 대한 보복범죄 방지 대책에 관한 연구)

  • The guarantee of citizens' safety from crime is the reason for a nation's existence according to the social contract, and it is also a salient task in securing the citizens' right to the pursuit of happiness, which is a constitutional right expressing the nation's duty to its citizens. First, a procedure must be made mandatory that corresponds to the Miranda rule applied during the arrest of criminal suspect, which verifies whether there exists a risk of retaliatory crime to the victim of crime, crime reporter, or witness following their report of a crime or testimony. A measure to punish those who violate this should be devised. The second is the improvement of related laws and systems, such as expanding the scope of persons subject to protection from retaliatory crimes under the current law and strengthening information protection. Third, a retaliatory crime risk evaluation index must be developed, and the evaluation results must be quantified to clearly state measures and responsibilities, in detail, for personal safety at each level of intensity. The fourth is the expanded implementation of proactive personal safety measures for victims of crime and witnesses, as well as the development and application of advanced techniques. The last is a change in the perception s of those working for the judicial body. From the initial investigation stage of the crime to the diagnosis regarding the possibility of retaliation perpetrated on an ex-convict through psychological tests, systems of general cooperation, and mutual assistance must be established.
