중국 농지임대차분쟁의 중재에 관한 고찰 (A Study of the Arbitration to the Rural Land Contract Disputes in China)

  • The Law of the People's Republic of China on the Mediation and Arbitration of Rural Land Contract Disputes, which was adopted at the 9th session of the Standing Committee of the 11th National People's Congress of the People's Republic of China on June 27, 2009, is hereby promulgated and shall come into force as of January 1, 2010. This Law is enacted with a view to impartially and timely settling the disputes over contracted management of rural land, maintaining the legitimate rights and interests of the parties concerned and promoting the rural economic development and social stability. The mediation and arbitration of disputes over contracted management of rural land shall be governed by this Law. The disputes over the contracted management of rural land include: 1) disputes arising from the conclusion, fulfillment, modification, cancellation and termination of rural land contracts; 2) disputes arising from the sub-contract, lease, interchange, transfer, holding of shares and other means of turnover of contracted management rights to rural land ; 3) disputes arising from the withdrawal and adjustment of the contracted land; 4) disputes arising from the confirmation of contracted management rights to rural land; 5) disputes arising from impairment to the contracted management rights to rural land; and 6) other disputes over contracted management of rural land as prescribed in law and regulations. The disputes arising from requisition of collectively owned land and the compensations therefor do not fall within the scope of acceptance by the rural land contract arbitration commission, they may be settled by means of administrative reconsideration or lawsuits. In the case of disputes over the contracted management of rural land, the parties may make reconciliation by themselves or may request mediation by the villagers' committee, people's government of the township (town), etc. This study analyzed each process and the main issues on the point of the Mediation and Arbitration of Rural Land Contract Disputes.

지적측량 적부심사 유형별 사례분석에 관한 연구 (A Study on the Case Analysis by Type of the Cadastral Surveying Screening)

  • 지적측량사가 지적경계복원측량을 통하여 지상에 표시한 경계는 소유자의 소유권의 한계를 명확히 밝힌 것으로 구속력과 확정력을 갖게 된다. 그러나 등록상의 오류라든지 측량상의 문제, 소유자의 경계점 인식 오류 등 제반 요인들로 인하여 매년 지적측량 분쟁에 따른 민원이 끊이지 않고 발생하고 있다. 지적측량 이해당사자들은 지적측량의 이의를 해결하기 위하여 먼저 민원제기에 따른 행정적 절차를 통한 해결 방법과 법원을 통한 경계확정소송을 통한 해결방안을 모색하게 된다. 그 결과 경계에 인접한 이해 당사자 들은 물론 관련 공적 기관들에 있어 민원 해결을 위한 어려움들이 발생하게 된다. 따라서 본 연구에서는 지적측량과 경계결정에 대한 사항을 고찰하고, 2016년부터 2021년까지 6년여 동안 중앙지적위원회에서 심의 의결한 지적측량적부재심사 사례를 유형별로 분류하고 그 대표적 사례들을 분석 제시함으로써 추후 지적측량을 실시함에 있어서 이들 사례를 참고하여 경계분쟁 사례를 줄이고 지적측량의 신뢰성 향상에 기여하고자 한다.

소비자 관점에서 본 주택 및 인테리어 하자 실태 분석 및 인테리어 서비스 평가 (Analysis on Defect Disputes in Housing & Interior Design from Consumers' Perspective and Interior Design Service Evaluation)

  • The purpose of the study was to investigate defect cases in residential interior design, to identify the state of defects, and to categorize types of defect and disputes. In addition, consumer appraisal to residential interior design service were analyzed. The results of this study could provide fundamental information regarding the defects and claims in residential interior design. First, we did literature review for defect disputes in architectural design and interior design. We identify the definition of defects by building life cycle, by state of construction, by activity, and by design performance. Second, we analysed interior design defects cases reported in Korea Consumer Agency & Ministry of Land, Infrastructure and Transport. A total of 49 cases of defect disputes in residential interior design from 2000 to 2015 were investigated. As a result, many defects appeared during the construction stage. A majority of defects cases fall into insulation, water-proofing/leakage work. In terms of design aspects claim, functional and aesthetic defects were claimed. Third, from Consumer Market Evaluation Indicators, raw data from 500 respondents were investigated for the housing repair and interior design. It is found that information comparability, responsiveness to consumer claim, price, and safety are important factors for consumer satisfaction in interior design.

환경분쟁해결에 영향을 미치는 요인과 정책대안 (Factors Affecting the Resolution of Environmental Disputes and Relevant Policy Alternatives)

  • 오늘날 국가 또는 사회 문제 가운데서 가장 해결하기 어려운 것이 행정당국, 사업시행자, 해당 지역주민 그리고 시민단체 간의 환경분쟁이다. 이러한 분쟁은 환경파괴, 비용과 편익의 불공평성 등으로 인하여 입지과정에서 관련 지역공동체의 강력한 저항이나 반대, 즉 님비(NIMBYism)를 유발한다. 지역기피시설(locally unwanted land uses, LULUs)의 입지나 개발에 대한 반대는 지역공동체의 이기적 편협적인 님비에 기인하는 것이 아니라 삶의 장소와 생태계를 보호하려는 지역주민의 합리적이며 정당한 요구의 표현이다. 따라서 이러한 입지갈등을 해결하기 위해서는 종래와 같은 결정-발표-옹호(decide-announce-defend, DAD)로 표현되는 그들과 우리라는 적대적인 관계가 아닌, 이 해당사자들의 상호작용, 즉 협상에 의한 합의형성(consensus-building)을 하려는 상황이 이루어져야 할 것이다. 이러한 협상은 보다 바람직하며, 실행가능성이 높은 자발적인 과정으로 대안적 분쟁해결(alternative dispute resolution) 방법이다. 이러한 합의형성에 영향을 주는 요인으로 다음 3가지를 들 수 있는데 i)주민참여보장, ii)형평성제고 및 iii)신뢰성강화 등이 그것이다. 이러한 3가지 요인들은 상호 연계되어 상호작용을 하는 체제로 간주할 때 그 시너지효과는 보다 커질 것이다.

해양영토분쟁에서 동맹의 영향: 그리스와 튀르키예 에게해 분쟁 사례 (The Effect of Alliance on Maritime Territorial Disputes: A Case of the Aegean Sea Dispute Between Greece and Türkiye)

  • 제도주의에 따르면 동맹은 회원국 간의 영토분쟁을 방지하고 우호 관계를 증진시킨다. 그렇다면 나토의 회원국인 그리스와 튀르키예의 에게해 분쟁은 왜 계속되는 것일까? 이 연구는 회원국 간 분쟁을 방지하는 동맹의 역할이 해양영토분쟁에서는 제한적으로 나타나는 메커니즘을 설명한다. 해양영토는 육지영토와 다르게 다층적인 경계로 인한 복잡성을 가진다. 또, 기후변화 등에 따라 경계에 영향을 미치는 기준이 변화하는 유동성이 있으며, 해양영토에 상시 경계가 제한되어 대응의 임계점이 모호하다. 오랜 기간 에게해를 사이에 두고 적대적인 관계를 유지해온 그리스와 튀르키예는 1952년 나토에 가입하면서 동맹 관계를 맺게 되었다. 하지만 동맹의 제도에 따른 정보의 투명성과 지속적인 협력에도 불구하고 해양영토분쟁의 특징으로 인하여 동맹의 회원국 간 분쟁 방지 효과는 제한적일 수밖에 없었다. 특히, 석유 시추 등 자원을 둘러싼 문제로 인해 양국의 갈등이 나토의 다른 회원국들과의 관계 악화로 이어지며, 동맹의 결속과 억제력을 약화시키는 문제도 이어지고 있다. 이 연구의 결과는 대한민국의 주변국과의 해양영토 분쟁 및 동맹관계에도 정책적 함의를 주며, 동맹과 해양영토분쟁 연구에도 기여할 것으로 기대한다.

장애물 없는 생활환경(BF) 인증제도 계단 난간 높이 산정기준 개선안 (Improvement plan for the standard for calculating the height of the stair railing for Barrier Free (BF) certification system)

  • Among the Barrier Free (BF) certification evaluation items for public facilities, at which position the standard for the effective height of the stair railing handle should be calculated is not clearly determined. Because of this, not only the evaluation standards of the certification authority and the evaluation committee are different, but disputes are occurring between the ordering organization, the design company, and the construction company. Therefore, the stair railing installation standard laws for public facilities were analyzed and through a case study of institutions that obtained the BF certification, problems were analyzed. The results of problem analysis reveal the following. 1) The standards of the Ministry of Health and Welfare and the Ministry of Land, Infrastructure, and Transport were different. 2) The effective height calculation standard was ambiguous, and disputes occurred frequently. To solve this problem, we proposed improvement plans for calculating the height of the stair railing that can comply with laws while ensuring safety.

지방정부의 독자적 농촌발전계획의 수립과 추진을 위한 조례제정에 관한 연구 (A Study on the Local Ordinance for the Rural Development Planning)

  • Since about 2000. local government has started making ordinance related to the rural development planning which is revitalizing rural area through using rural resource. But, the ordinance of local government have not any contents relating to the land use planning system that is necessary in rural development planning. According to the present local autonomy act, ordinance can not have any regulations restricting basic human right without being allowed by law. In recent, central government is considering to hand power making land use planning system over local government. This paper is to study how to expand the legislative power of local government. This study discussed on logical bases through examining disputes on legal theories, the nature of local ordinance, range of local autonomy affairs and cases of local ordinance.

드론택시(UAM)의 토지상공 소유권 범위 법제화 방안 연구 (Study on the Means of Legislating the Range of Ownership of Air Space Above Land for Drone Taxi (UAM))

  • It is anticipated that there will be radical disputes over land ownership in the event of the advent of the era of UAM. As such, policy alternative is presented by analyzing and researching relevant laws at home and abroad on the means of legislating 'Regulations on compensation for use of air space above land' in preparation of such occurrence. As the results of the study, it is deemed to limit the range of the land ownership in accordance with UAM operation as follows. First, it is proposed to newly enact regulation to limit the ownership of air space of land owner to the public space above the elevation of 200m as stipulated under the Article 78 of the Aviation Safety Act. Second, as the result of analysis made for the option of making compensation from the perspective of the property right of land ownership and option of not making compensation from the perspectives of public interest and concerns in the event of operation of UAM within the air space below the elevation of 200m, it is deemed that legislative decision is necessary through more extensive studies in the future.

공동주택 욕실 벽타일 뒤채움과 하자발생량의 상관관계분석 (Correlation between Board Mortar and Defect Occurrence Rate in Apartment Bathroom Wall Tile)

  • The number of defect disputes occurring in apartment houses is increasing year by year, and among them, disputes caused by defects in tiles account for 28.2% of the total, which is an important defect in tiles. A representative tile defect in the defect dispute is the lack of tile backfill. Another dispute occurred that the standards for each organization are different as the 100% standard of the Ministry of Land, Infrastructure and Transport's building construction standard and 80% standard of the Architectural Institute of Korea's Building Technology Guidelines. In this study, it was analyzed the relationship between the amount of tile backfill and the amount of tile defects based on 100 defect litigation court appraisal documents. It was observed that the amount of defect in tile works tended to decrease as the amount of tile backfill increased. By presenting an appropriate amount of mortar to fill behind tiles in a defect dispute, the effect of reducing the defect dispute can be expected.

CVP 분석을 이용한 면허어업 손실보상액 평가 모형의 도출 (The Derivation of a Model to Estimate Compensation for Damages in Chartered Fisheries by Using CVP Analysis)

  • During the last several decades, Korea has been regarded as one of the fastest growing economies in the world. However, the small size of national land has not met the vigorous demand for land necessary to develop economic infra-structures such as large-scale harbors airports and highways. In order to satisfy the growing demand for land, the Korean government and industry have implemented the national land development programs to reclaim land from the sea fur the several decades. It is certain that these land development programs have resulted in a lot of property disputes between fishermen and public project administrators. This paper is to develop a quantitative model to estimate compensation for damages or restriction of charted fisheries resulting from large-scale public projects. In this paper, the compensation model is derived by using cost-volume-profit analysis framework because the compensation for charted fisheries basically depends on the factors such as the costs, production volume, profit of charted fisheries damaged or restricted by public projects. The model shows that the compensation for damages or restriction of charted fisheries is determined by the average annual profit, damage duration period, and the degree of fishery damages. In addition, the degree of fishery damages measured by the ratio of lost profit to annual average profit turns out to be determined by the following factors: annul profit, unit variable cost, decrease in production volume, the rate of increase in variable cost, and a change in fixed cost. Furthermore, this parer discusses the nam issues related to practices and regulation of the compensation for fishery damages in the current Fishery Act of Korea and suggests some appraisal methods which will be able to lead to theoretically correct and fair compensation for fisheries damages resulting from large-scale public projects.
