This article deals with the Improvement of Compulsory Arbitration System on Trade Union and Labor Relations Adjustment Act in Korea. If a labor dispute occcur, the settlement of labor dispute must be reached for the parties' own accord. The autonomy of the parties concerned is the fundamental principle in the settlement of labor dispute. If the Rights Which are guaranteed by art. 33 Constitutional Law belong to civil liberties, we should consider Trade Union Act as the restriction of basic rights. Arbitration is a procedure which permits the most positive intervention by the arbitrator. It is carried out by an arbitration committe which is composed of three arbitrators appointed by the chairman of the Labor Relations Commission. Compulsory arbitration system of the labor for parties should be improved. In case of necessary public enterprises, more strict requirements on assembly for labor disputes should be prepared and the government should support institutions to prevent labor-management disputes by educating experts on labor-management relations and improving the quality of arbitration.
Indicies of the labor productivity were assessed from 80 industry foodservice erstablishments in terms of meals served per labor hour, labor minutes per meal served, and labor cost per meal served. The labor productivity indicies were also assessed according to variables related to work such as working hours, paryment for the workers, volume of feeding, utilization of foodservice equipment, use of processed foods, and background of employees. The summary of the results was as follows: 1. Manufacturing sector among surveyed industry foodservice showed the highest labor productivity indicies followed by training institute. 2. 28.8% of surveyed establishments used dishwashing machine, while manual dishwashing was used in 71.3% of subjects, equipped rate point was 9.8 out of 20, and disposable dish was used in 30% of subjects. 3. A significant positive relationship was found between the number of meals and the labor procductivity indicies. As the number of meals increased, more meals were served per worker as per labor hour. 4. A significant negative relationship was found between price of meal and the labor productivity didicies. As the price of meal increased, less meals were served per worker as well as per labor hour.
To reduce labor market discrimination, there are lively discussions about the role of extant labor regime based on labor unions. It includes both the critical perspective on extant labor movement and the necessity of new actors for resolving discriminations within labor market. Among new actors, the present study focuses on contingent labor centers. Specifically, we have investigated on the development and identity of contingent labor centers as coalition of local government-labor organization. The core content of this study is to reconstruct the activities and strategies of contingent labor centers throughout the longitudinal approach. From many evidences, we can confirm that contingent labor centers have evolved via three phases such as differentiation, de- politicizing, and networks. This finding also provides insights about inside relationships between contingent labor centers and outside tensions between contingent labor center and extant labor organizations. We finally discuss on the theoretical implications of contingent labor center as new actor for contingent worker movement.
Recently, a long strike by hospital labor union emerged as a serious social issue. During the Worldcup Games in June, 2002, labor strikes broke up at 'C', 'K' and other hospitals, and in 2007, 'Y' hospital suffered much from a strike. Such series of extreme labor disputes have awakened people of importance of a more stable labor-management relationship for the medical institutions responsible for people's health than any other business organization. The purpose of this study was to examine the labor-management disputes at 'Y' hospital in 2007 and 'C' and 'K' hospitals in 2002. The results of this study can be summarized as follows; First, requests of the labor union such as pay raise, reemployment of the irregular workers as regular employees and participation of the labor union in personnel affairs are the long-held or core issues suffered by the medical institutions. Such issues are not independent from each other but complicated with each other surrounding the pay raise. Accordingly, it is not easy to determine the genuine bone of issue for labor-management disputes. Second, the model type of disputes between labor and management at medical institutions may be strike. However, it is conceived that the type of disputes would be subject to change as the essential medical service area system began to be operated since 2008. Third, the common characteristic of the labor strike among the 3 sample hospitals was occupation of the hospital lobby for a sit-in strike to maximize the negative effects of strike. Article 42 (Prohibition of Violence) of Labor Union and Labor Relation Coordination Act prohibits occupation of production or other important business facilities. In addition, since Ministry of Labor interprets that the hospital lobby belongs to the important business facilities enumerated by Article 42 of the above act, occupation of the hospital lobby for a sit-in strike may be too controversial to be admitted as a fair act of labor dispute when its legitimacy should be judged. Fourth, the counter-measures taken by the hospitals against the strike were observance of the principle 'no labor no pay,' closure, legal action, accusation, claim for recovery of damage, provisional seizure, disciplinary punishment, etc., but the principle of 'no labor, no pay' was not applied in a fair manner by 'C' and 'K' hospitals. However, 'Y' hospital applied this principle thoroughly to the strike; the hospital conduced to correction of the wrong labor-management relationship by refusing inclusion in the labor collective agreement of a provision about payment of wage during the period of strike or labor union's request to that effect during a strike. In addition, 'Y' hospital took an effective measure to end the strike earlier by notifying the labor union of cancellation of the collective agreement and banning the unionists from entering the hospital.
Purpose: This study was purposed to survey pain, efficacy, and comfort during the first stage of labor and to identify correlations among them. Method: The subjects were 116 laboring women who were admitted to a baby-friendly hospital recommended by UNICEF for breast feeding. Data were collected using a structured questionnaire composed of labor pain, labor efficacy, and labor comfort with 10 cm visual analog scale respectively. The data were analyzed by frequency, Pearson's correlation, and ANOVA. Result: Labor pain, labor efficacy, and labor comfort in latent phase were positive correlation with them in active phase. The more pain, the less labor efficacy and the less comfort in latent phase. and the more pain, the less comfort in active phase. Labor efficacy was positively correlated with labor comfort in both phase. Lastly, women supported by their husbands had significantly higher labor pain than women supported by their mothers. Conclusion: The results suggest that nurses develop a labor efficacy program for pregnant women and their mothers or spouses.
The Korean system of labor adjudication on the cases of unfair dismissal and unfair labor practices has been criticized by labor and management in spite of the strong point that the Labor Relations Commission processes the cases quickly. This paper empirically investigates the effectiveness of labor adjudication dealt by the Labor Relations Commission with economic approach. It shows that the grievences of labor and management on the existing labor adjudication system have come from the inadequate processes of labor adjudication rather than the favorable or unfavorable ruling. It also shows that a major deterrent to make an effective labor adjudication system has been not the problems of the selfish attitude and expectation of labor and management but the improper attitude and quality of the member and staff of the Labor Relations Commission.
This paper aims to identify the class characteristics of tenants. To this end Patnaik's model is selected, because this model is most reasonable for sorting class structures of tenants. In his Model, "labor-exploitation criterion" is the main criterion for identifying class status. According to this criterion, there are five rural classes i.e. landlord, rich peasant, middle peasant, poor peasant, and full-time laborer. "Net labor ratio" is used for this purpose as empirical data handling. Net labor ratio is a ratio of net labor hired in to family labor, if hired in labor is more then this ratio is positive, and if hired out labor is more then the ratio is negative. Hired in and hired out labor includes not only direct labor but indirect labor such as labor employment or sales through rent. The results of this study are summarized as First, almost all tenants and owner cultivators are of the middle peasant class. Second, there are no rich peasant among the tenants, but 5% of owner cultivators are rich peasants, and 10% of tenants are poor peasants, owner cultivators are 1%. Third, the net: labor ratio of tenants is -0.211, and that of owners is 0.143. There are differences between tenants and owner cultivators even if land is much the same, and owner cultivators net labor ratio is positive except in the land size of 0.3-0.5ha, but that of the tenants' is negative. Fourth, proto-labor poor peasants earned 25% of income from labor, compared with under 10% of proto-tenant poor passant's. Rent to income ratio is almost 60% of proto-tenant, 27% of proto-labor among poor peasants.
The sustainability of fishing villages is threatened by manpower shortages due to population aging and poor settlement conditions. In the reality of poor fishing villages, the importance of women's labor is more emphasized than that of the past because female workers are key workers in fishing labor, processing and sales of marine products. However, policy support for female fishermen is not sufficient. The reason for this is that policy makers did not properly recognize the labor value of female fishermen. In fact, fishing villages have emphasized the importance of female workforce as a slogan, but there has been no attempt to estimate the labor value. There was not even a review of the methodology for estimating the value of labor that was attempted in similar fields. As a result, the policy importance of female fishermen was underestimated for there was no attempt to evaluate their value even though women had been continuously participating in the fishery from the past. Female fishermen's labor is under the dual labor structure of housework and fishing labor. Therefore, in this study, housework and fishing labor were estimated separately and the total labor value was calculated. The basic data necessary for estimating the labor value of female fishermen were obtained through a survey. The method of estimating the labor value of female fishermen was used in combination with the present income method and the total replacement cost method. As a result of the study, the total labor value of female fishermen was about 4.4 trillion won, which is about half of the total fishery production of 9 trillion won in Korea.
Contemporary US metropolitan areas have undergone divergent economic transformation, and as a result labor markets have become the focus of concern in their role as determinants of earnings attainment. Explanations of individual earnings attainmnent as a lobor market outcome have been established in two diafferent stances one who emphasizes personal or group attributes in the human capital perspective and the other who emphasizes economic structure in the labor market segmentation perspective. While remaining at the conceptual level and yet relatively unexplored, the importance of place in labormarket operation is a significant advancement as it appears in labor market areas and local labor markets considering that labor market areas represent the intersection of labor market structure and individual labor market experiences at specific geographic places. The substantive inquiry of this study was to explore labor market characteristics and their differentiation across large metropolitan areas, and assess their effects on the individual earnings attainment. Integating individual attributes and labor market characteristics as major factors of labor market operation, this study intended to contextualize individual earnings attainment with geographic labor market areas. Using 1990 US population census 5% "Public-Use Microdata Samples, " the largest 65 metropolitan areas were first selected and employed male workers who are aged between 25 and 50 for whites, blacks, asians, and hispanics. As an initial step earnings differentials between racial/ethnic groups and selected 65 metropolitan areas were examined using analysis of variance, and then earnings differentials were attributed to the individual attributes such as education, age, and immigration status, and four dimensions of metropolitan labor market differentiation devised by principal component analysis of industrial and occupational segments: Public versus Blue Collar Core(CS1), Finance-Core Utility versus Blue Collar Local Monopoly (CS2), Oligopoly versus Blue Collar Periphery(CS3), and Self Employed-White Collar Periphery versus Low-Skill Core(CS4). As a final analysis, individual earnings were related to each individual attribute and its interaction with metropolitan labor market characteristics to examine how the differentiated metropolitan labor market characteristics alter the role of individual attributes on earnings attainment. The findings indicated that individual attributes, education in particular exert significant effects on earnings attainment, but their effects were significantly altered by metropolitan labor market characterristics. Particularly important dimensions were: Oligopoly differentiated from Blue Colla Periphery metropolitan areas enhancing earnings returns to individual attributes for all groups but minority groups (black, asians, hispanics) rely more on this, and Finance-Core Utility differentiated from Blue Collar Local Monopoly metropolitan areas provide higher earnings returns to whites exclusively. These findings suggest that individuals with identical individual attributes involving racial/ethnic categories would have different earnings atteinments depending on the metropolitan labor market characteristics where they reside. Referring back to the major traditions of the human capital and the labor market segmentation in labor market research, the interaction between individual attributes and metropolitan labor market haracteristics on earnings attainment highlights the complimentary nature of the two on earnings determination in particular geographic places, Hence, labor market characteristics differentiatcd across metropolitan areas are an integral part of labor market operation which should be considered for the explanation of individual earnings attainment and racial/ethnic group earnings differentials. Gcographic places are the important contexts for labor market segmentation and individual labor market experiences. In conclusion, this study brings geographic labor markets to the forefront in the examination of individuals' earnings attainments. The empirical vaidation of the role of metropolitan labor market charecteristics on earnings attainment, while exploratory contributes towards a broader perspective of geographic labor market research that recognizes that individuals' labor market experiences are intertwined with geographic contexts of labor market operatin. operatin.

This study examines the association between ownership structure and labor investment efficiency. Specifically, this study investigates whether owner-manager firms, where managers own a large percentage of shares in the firm, involve in more efficient labor investment. Based on the management entrenchment hypothesis, managers are more likely to make labor investment decisions to maximize their private benefits rather than creating value for shareholders, resulting in lower efficiency in labor investment. On the other hand, according to the incentive alignment hypothesis, managers tend to make labor investment decisions that will improve future firm performance as their interests are aligned with those of shareholders. In this situation, owner-manager firms are expected to have higher efficiency in labor investment. Our empirical results show that owner-manager firms engage in more efficient labor investment, which contributes to long-term firm value. This study provides empirical evidence that firms' labor investment behavior can vary depending on the characteristics of the ownership structure.
