한국기업의 해외시장에서의 위조상품 대응전략에 관한 연구 (Korean Firms' Intellectual Property Rights Protection Strategies to Deter Counterfeiting and Brand Piracy in Global Markets)

  • Recently, there has been rapid and spectacular increase in world wide counterfeiting and other forms of piracy. According to the World Customs Organization(WCO), counterfeiting accounts for 5 to 7 percent of global merchandise trade, equivalent to lost sales of as much as US$512 billion last year. Also Korean firms' damages arising from the infringement of intellectual property rights in global markets, especially in China market, are increasing. However, the existing studies on the intellectual property rights(IRP) protection have mainly focused on legal protection. Because the law is often not the best defense against theft of intellectual property rights, we must develop more effective defensive weapons for protection of IRP. Given this troublesome trend, the intention of this paper is to discuss strategic and tactical efforts, including legal protection, that can serve as proactive measures to deter counterfeiting and thus to assure the protection of Korean firms' intellectual property rights.

  • As digital economy has dramatically evolved, new intellectual property rights protection has emerged as a pivotal issue which companies need to actively restxnid to. At the new digital era, the possession of new intellectual property rights determines the company values, and thus the protection of new intellectual property rights is getting more importance in the dimension of global competitiveness. The paper analyzes the changing aspect of digital economy and e-commerce paradigm, and explores the protection plan of new intellectual property rights focusing on e-commerce and digital goods transaction so that it can help the companies to strengthen their global competitiveness. After various case studies, we can find out that even though the companies have difficulty in settling out the strategies and policy due to the radical change of cycle in internet-centered digital economy, companies need to establish the systemic strategic plan to protect the new intellectual property rights stage by stage. Also, appropriate legal, institutional basis to protect the new intellectual property rights should be rearranged. The unsloved problems which relates with the protection of new intellectual property rights will be left for next research project.

  • Under the influence of growing popularity of "hallyu" (Korean wave), corporates that have copyrights such as music, movie, drama as their core competitiveness are showing continuing growth. In Addition, they built on contents are rapidly growing, interests in protection and management of intellectual property rights linked to contents are growing. Global contents development corporates are making great efforts to create profits out of copyrights. They could utilize original contents to strengthen brand value use it to produce additional contents in current market. Also they take advantage of existing storyline of the contents and strong brand to explore new markets. This paper looks into Value articulation model by Professor James Conley and analyzed the firms that utilized intellectual property rights to extend the period of protection, strengthen their competitiveness and succeeded in breaking into new market by using the rights they possess. Also, this paper examines the usage of intellectual property rights and business expansion strategy of of Iconix, the Korean entertainment company, which gained tremendous popularity in last ten years using this model. In Value articulation model, Conley classifies the process of exploiting the portfolio of the single product's(or service's) intellectual property right for a period of time into three stages ; value transference, value translation, value transportation. Pororo's strategy of utilizing intellectual property right is suggestive to domestic entertainment companies. Under the influence of hallyu" (Korean wave), domestic contents such as movies, dramas and music are enjoying the high level of popularity recently not to mention animations. In reality, Korean entertainment companies who have no background or experience of Intellectual property rights are not creating enough added values compared to fast growing market. It is believed Iconix's intellectual property rights management strategy will suggest positive aspects to domestic companies. Moreover, I hope various intellectual property rights management strategies including Conley's value articulation are studied and they can make contributions to managing domestic entertainment companies.

Effective Patent Strategies for the Protection of Research Results

  • Objective: This study provides strategies of how to effectively convert an invention, created at universities or government-funded research institutes, into a strong patent with the clear understanding of its unique technological characteristics. Background: Regardless of the amount of research funds available in our country and the decent number of intellectual property rights created using the funds, there was a deficit of more than KRW 6 trillion in the technology trade balance related with intellectual property rights in the year of 2014. One of the reasons was that the vast number of patents that were being produced by universities or by government-funded research institutes were merely performance-based patents, namely, so called "patents for patents". Another reason is that developed technology from research and development could not be transformed into a strong patent right properly due to the lack of related knowledge. Method: After reviewing various references mentioned on the patent strategies, the definition of a strong patent and the strategies of producing a strong patent for an invention drawn out from research performance will be supplied. Results: To produce a strong patent right at universities or government funded research institutes, one should use strategies for strong specifications, strategies of product patents and method patents, strategies of patent portfolios, strategies of know-how, strategies of inventions defined by numerical limitation and strategies of parameter inventions for a more strategic approach. Conclusion: Strong patent rights will be produced with the use of effective patent strategies provided in this study. Application: It is estimated that the results of this study will aid the establishment of strong patents for inventions developed by research performance at universities or government-funded research institutions.

Disputes over the Intellectual Property Rights of Telecommunications Standardization

  • Both telecommunications standardization activities and an intellectual property rights (IPRs) system are regarded as effective mechanisms for improving social benefits. Because of inherent conflicts that exist between the two, however, serious problems are generated in the international arena where the competition for technology development and markets is becoming increasingly fierce. In this paper, ways of harmonizing the relationship between the two are explored and explained. For this purpose, telecommunications standardization and IPRs protection mechanisms are described, and their positive and negative effects as well as their inter-relationship are also analyzed. In addition, IPR case studies related to international standardization are explained and analyzed. The Current status and problems of IPRs policy of major international standardization organizations are analyzed as well. Finally, based on the results of the analyses, viable policy recommendations and research strategies for more comprehensive study of the above problems are proposed.

  • Geographical indications are place names (in some countries also words associated with a place) used to identify the origin and quality, reputation or other characteristics of products. Protection required under the TRIPS Agreement is defined in two articles. The purpose of this study is to select the representative geographical indication item of Korea, discuss of the new intellectual property rights, and promote the trade of that product. It is also discussed of a geographical indication registration system and the recognition with international point of view. The international geographical indication protection is strengthening in recent. There are many multilateral and bilateral discussions and talks for geographical indication system. In order to protect excellent Korean products locally and internationally, the 'Quality Management of Agricultural Products Act' has been introduced form July 1, 1999. The geographical indication registration of Korea currently is 31 cases. The geographical indication is limited the regional promotion in Korea. Therefore, it is studied the registered items on the list and analyzed the result of the registration. Consequently, this paper suggests that more effective ways have to be prepared for the systematic management of geographical indications, campaigns for the recognition as a property.

출연연 및 대학에서 연구성과물의 기술이전 시 개량특허와 원천기술의 보호에 관한 검토 : H대학교와 D제약사의 신약후보물질 관련 개량특허 탈취논쟁여부를 중심으로 (대상판결: 서울중앙지방법원 2014.12.24. 선고 2013가합85597 판결) (A Study on the Protection for Original Technology and Improved Patent when Research Institutes or Universities Transfer their Research Outputs)

  • 과학기술이 고도화, 전문화, 대형화됨에 따라 연구개발에 수반되는 비용과 위험을 최소화하거나 분산시키기 위해 물질이전계약 기술이전계약과 같은 특허라이선싱을 통한 상호협력이나 공동연구개발이 활발해지고 있다. 연구 개발에 있어 이러한 공동작업은 목표달성에 있어서 효율적인 자원 및 인력 등의 배분을 통한 분업의 효과를 달성할 수 있지만, 필연적으로 기존 선행특허를 활용한 개량발명의 귀속과 활용, 즉 후속연구나 공동연구로 진행된 성과물인 지식재산권의 귀속과 활용에 대해서는 많은 분쟁 가능성이 있다. 이 논문에서 살펴본 사례는 최근 개량발명과 관련하여 주목할 만한 판결로써 대학에서 보유한 특허의 완성기술에 대해 제약회사에서 기술이전을 전제로 시험이나 평가를 수행한 후, 독성을 이유로 계약을 파기하여 대학에서 기업을 상대로 계약위반에 따른 손해배상청구소송을 제기한 건이다. 즉 신약후보물질을 개발한 대학과 후속 기술이전을 협의하는 제약사 간의 분쟁사례로서 원천특허의 개량발명에 대하여 선행특허의 보호와 연구계약, 나아가 연구성과 보호를 위한 연구보안의 측면에서 많은 시사점을 주는 사례라고 생각된다. 이 논문에서는 대상판결을 살펴보고, 개량특허와 원천기술의 보호에 대해 살펴보며, 판결에 대한 평석으로써 이 사건 판결의 주요 쟁점을 정리한 후 개량특허탈취 관련 특허권침해판단기준 등에 대해 살펴보고자 한다. 이후 이 사건 판결을 통한 시사점 및 향후 대응전략 등에 대해서 제언하고자 한다.
