Suitability of Alternative Dispute Resolution for the Fashion Industry - Focused on Arbitration for the Fashion Industry - (패션산업의 대체적 분쟁해결제도 적합성 - 패션산업의 중재 제도 도입을 중심으로 -)

  • Intellectual property law is slowly fighting to keep pace with the rapid growth of the fashion industry. Copyright and patent law have proven only minimally effective in fashion, even in the US and other top fashion nations, forcing designers and fashion companies to rely on their trademarks to protect their work. Litigating trademark disputes in the fashion industry presents a host of problems as witnessed in a recent Christian Louboutin case, leading the parties to resort to Alternative Dispute Resolution(ADR) and Online Dispute Resolution(ODR). ADR methods, especially arbitration, are increasingly emerging as substitutes to litigation. Using these methods, the fashion industry (CFDA in the US case) should sincerely consider a self-regulating program in which its members, both fashion designers and corporations alike, can resolve disputes in a manner mutually beneficial to all parties in order to preserve the industry's growth, solidarity, and esteem In particular, for the US fashion industry, the ongoing Innovative Design Protection and Privacy Prevention Act(IDPPPA) anti-counterfeit legislation could have caused a chilling effect against innovation. New designers with no name and less resources who could normally flourish producing inspired-by designs may find themselves subject to copyright infringement legislation since the IDPPPA may expand the protection of established designers and brands with more resources. This fear and its implication could be solved by the fashion industry itself since fashion experts know best how to handle these fast-paced issues arising in the field. Therefore, stakeholders in the fashion industry should commit to protecting innovation within fashion on a long-term basis by establishing a panel handling an ADR process. This can mitigate the uncertainty created by the IDPPPA or any other legislation from elsewhere, which could result in a shying away from experimentation with inspired-by designs.

  • The purpose of this research is to provide a plan for improvement distribution structure of Korean fashion industry. This research points out the importance of Korean fashion industry and the change of consumer consciousness which is followed by domestic fashion market and also) this study deals the present condition of fashion distribution industry in Korea, the effects of opening of the distribution structure, the characteristics of domestic's and advanced contries, the problems of them and providing the improvements. 1. Korean fashion industry is needed to change to 'the industry of living culture' 2. Promodern distribution structure in Korean fashion industry has to be turning out to the distribution industry. 3. The returning goods system and buying system of department stores in Korea have to be executed gradually and also the corporation with department stores and fashion organizations are needed. 4. The information system which can make connection from up stream to down stream is needed . 5. It is needed that renovation of technology and development of manpower.

Trends and Effect of foreign Direct Investment in Fashion Industry (패션산업에서 해외직접투자 -무역과의 관계를 중심으로-)

  • With the advent of the globalization trend of the industry, the enterprises in the fashion industry around the world have witnessed a surge in exports and foreign direct investment (FDI). Many fashion enterprises in each country, along with the multi-national enterprises, have engaged in global outsourcing of the production process in order to increase their global competitiveness, and have attempted to expand their commercial presence in the world market by entering into other foreign markets. Such market entry attempts have lead to the increase of FDI and trade by the fashion enterprises. This study attempts to examine the interactive relation between FDI and export/import of fashion products in different fashion industries both worldwide and in Korea. First, we will look into the relation between export/imports and FDI of each regional fashion industry, then expand the study to the relation between those two factors found in the fashion industry of Korea in general, and finally, to the relation between the two factors in the fashion industry of countries that are the major export nations of fashion goods into Korea. The data which this study is based on were collected from the International Trade Statistics Yearbook Vol. II (UN, 1991-2002, New York: UN), UNCTAD Handbook of Statistics (UN, 1996-2001, Vienna: UN), UNCTAD database, the archives of the Korea Federation of Textile Industry and the archives of the Export-Import Bank of Korea. The methods of analysis used in this study were correlation, regression, and descriptive statistics of the data. The result of this study showed that each fashion industry of different regions was subject to a diversity of effects. For one, the fashion industry in Korea showed a significant correlation between outbound investment and both export and import. On the other hand, the apparel industry in Korea showed a significant correlation between outbound investment and imports, but no such correlation between outbound investment and exports.

Transition of Fashion Trends and Fashion Colors in Recent 30 Years (최근 30년간의 패션 트렌드와 패션 컬러의 추이)

  • Color is infinitely more complex and challenging when the human element is factored in. The nature of fashion presents additional issues that must be addressed, allowing for even greater possibilities. Fashion trends and fashion colors could be used as a starting point for investigating many possible applications in fashion industry. Modern fashion industry received various information from many medias. Fashion trends and fashion colors must be referred to primarily when planning fashion goods among so much information. In this study, changes in fashion trends and fashion colors from 1966 to 1995 were investigated. The results indicated fashion trends and fashion colors were involved with community, culture and economy. Furthermore, important characteristics of fashion trends were summarized. In recent 30 years fashion trends and fashion colors appeared practical fashion and natural color, amenity fashion and mild color. According to the fashion changes in sensitivity, the color change was evaluated. Fashion colors displayed changes from sign effect to symbol effect. Especially black changed from minus image to plus image made it important fashion color.

An Analysis of Participating Style of Participating Company in Fashion Related Exhibition (패션관련 전시회 참가기업의 참가행태 분석)

  • Various types of industry, from manufacturing industry to service industry, can be a subject of exhibition. So, subdivided studies about exhibition for each type of industry or field are necessary. However, there are still insufficient studies about them. Also, fashion industry related exhibitions should be classified differently from other industries' exhibitions because of their special features. Therefore, this study examines that how an exhibition is utilized as a promotion means of a company and the present condition of a fashion exhibition. It also compares a fashion exhibition with other industrial exhibitions to suggest the effective operations and the progressive promotion of the fashion exhibition. This study uses questionnaire from 140 companies for 5 exhibitions, which participated fashion related exhibitions. Data of this study is statistically analyzed using SPSS for window ver. 10.0 program. It also uses frequency, cross tabs, paired t-test, Independent Samples t-test. As a result of this study, fashion related companies' recognition of exhibitions has been increased. However; in terms of exhibition participation, attitudes such as pre-promotion or pre-education for the staff, who are in charge of the exhibition booths, and the outcome of the exhibition aren't maximized because the right understanding concerning exhibitions is lacking and long-term preparation is insufficient. Also, advertisement for the exhibitions isn't enough because of insufficient preparation and absence of pre-promotion, so consultation with promising buyers can't be activated. Even though there are consultations, the consultations don't have much effect.

Are Business Cycles in the Fashion Industry Affected by the News? -An ARIMAX Time Series Correlation Analysis between the KOSPI Index for Textile & Wearing Apparel and Media Agendas- (패션산업의 경기변동은 뉴스의 영향을 받는가? -섬유의복 KOSPI와 미디어 의제의 ARIMAX 시계열 상관관계 분석-)

  • The growth of digital news media and the stock price index has resulted in economic fluctuations in the fashion industry. This study examines the impact of fashion industry news and macroeconomic changes on the Textile & Wearing Apparel KOSPI over the past five years. An auto-regressive integrated moving average exogenous time series model was conducted using the fashion industry stock market index, the news topic index, and macro-economic indicators. The results indicated the topics of "Cosmetic business expansion" and "Digital innovation" impacted the Textile & Wearing Apparel KOSPI after one week, and the topics of "Pop-up store," "Entry into the Chinese fashion market," and "Fashion week and trade show" affected it after two weeks. Moreover, the topics of "Cosmetic business expansion" and "Entry into the Chinese fashion market" were statistically significant in the macroeconomic environment. Regarding the effect relation of Textile & Wearing Apparel KOSPI, "Cosmetic business expansion," "Entry into the Chinese fashion market," and consumer price fluctuation showed negative effects, while the private consumption change rate, producer price fluctuation, and unemployment change rate had positive effects. This study analyzes the impact of media framing on fashion industry business cycles and provides practical insights into managing stock market risk for fashion companies.

Developing Design Education Program concerning Sustainable Fashion (지속가능 패션 실용화를 위한 디자인 교육 프로그램 개발)

  • Sustainability has been a big issue over the whole global industry lately and is an important fashion trend that reflects the modern phase of the time. The concept of sustainable fashion includes physical fashion products made from eco-friendly or recycle materials as well as ethical value such as corporate social responsibility for environment, labor or working condition. Fashion companies of advanced countries who are aware of the geo-environmental and ethical issues found that generating profits by setting trends and pursuing external beauty can no longer be the ultimate goal of fashion companies, and started to recognize the importance of sustainable fashion as a future-oriented trend. Not only fashion industry but also governments of advanced countries have been playing a leading role to educate the people regarding the importance of sustainable fashion and making large investments to foster industry specialists in educational institution. The aim of this study is to propose sustainable fashion design education program that fits the domestic university curriculum and government-leading education program in order to set the foundation for sustainable fashion industry. Thus, this study investigates successful cases of foreign government-led sustainable fashion education that can be introduced to improve domestic sustainable fashion education. The empirical study of the research is developing 12-15 week university level education program to foster specialists in sustainable fashion. The survey carried out by the students who participated in the program shows the change of perception on sustainable fashion. Developed university level program can be spread to municipal corporation, school of continuing education, and etc. in order to derive participation and problem perception of the citizens on sustainability. Developing systemized sustainable fashion design education program would be the first step of sustainable fashion by educating students who will take the leading role in the future fashion industry. Moreover, it can strongly influence future customer education as well as a special education inducing interest on sustainability in everyday life. A follow-up study is expected to serve as a foundation for sustainable fashion to take root successfully in the fashion industry.

  • Korea may have the social environment that has a high interest and demand for the fashion industry, but the relative importance that the Hanbok industry occupies in the fashion industry is very low. It can be found that this is attributed to the difficulty in identifying the trends of Hanbok due to the smallness of Hanbok material producers and Hanbok producers, a change in consumers' consciousness of Hanbok, the difficulty of ties and integration between Hanbok-related organizations, the lack of support from government and the like. Given the recent trend that the principal factor that enables the Korean fashion industry to be competitive in the world fashion business community is based on the beauty of Hanbok, this indifference to the Korean Hanbok industry would be the roadblock to internationalizing the Korean fashion industry. Accordingly, this study attempted to identify the problem of Hanbok-rela1ed department as the basic work for the development of the Hanbok industry and present the plan to activate it, thereby providing basic materials for exploiting the new arena of the Hanbok cultural industry the domestic and foreign fashion market in the 21st century.

  • The purpose of this study was known the animation history, function of the animation character, the development process of the animation industry, and the industry process of the animation character in the center of the animation character of America and Japan occupying the internal character market largely. Also, it was examined how the animation character was used in the fashion industry and was recognized the importance of the character industry, and it was seen the design development of the fashion character in the future and the proceeding method of the fashion marketing strategy. The following this study was examined by using the various newspaper and magazine, the internal and external reference. In the result of this study, the animation character created in the TV and the screen is extended the related industry and is developed the various cultural products, and it is recognized as the product of the highly added value. The internal animation characters are mostly the characters of America and Japan, but now the internal animation productions is recognized the importance of the animation industry and is producted the animation to attack the internal and external market. The potential of the animation character was really excessive. The excellent animation product was important but the animation character and the activity of the accompaniment industry related to it was important. Also the animation character mostly had influence on the fashion industry.

  • The purpose of this study is for affirmation about fashion and film industry has very important relationship through the image of film fashion in 1990. To this processing , films in 1990 were analyzed by the back ground, time place, persons's status are expressed in period movie but the person's characters, development of story mood in contemporary movies. The contents of this study are as follows : First, film fashion which was related mass fashion design and concept development and fashion designers as constume services were considered. Second, the change of star image through the 20th century. The roles and new image of film fashion in period movies and contemporary movies in 1990 were searched. Third, proposal and results were confirmed for expansion of fashion industry and film industry together. Finally, from the latter of 20th century, a lot of fashion designers have participated in film works than before, So the images of films were sued and reflected as new mass trend . Especially retro-romantic mood was expressed in fashion trend due to period movie fashion. Also minimal city look and elegance glamourous look are represented cause of contemporary movie fashion. Therefore, the cooperation between film productions and fashion professionals is very important for promotion of Korean culture development in 21st century, 'the century of image'.
