A comprehensive electronic trade portal such as the electronic bills of lading, e-negotiations and so on, is developed by the Korea Ministry of Knowledge Economy and International Trade Association and serviced by KTNET. The portal, so called u-TradeHub, formally started to provide its services on 22nd May, 2009. If the shipper issues electronic bills of lading, the negotiating bank examines it through the established e-Nego system. However, the issuing bank overseas cannot examine the electronic bills of lading, because any interactive system does not exist. So, after the e-Nego, the electronic bills of lading gets automatically transformed into the paper-type electronic bills of lading and issuing bank examine paper B/L. In process of examining documents, the beneficiary using electronic means in letter of credit transactions may face some risks such as the corruption to the electronic bill of lading after its issuance by the carrier, the corruption after e-Nego and the corruption after the presentation to the issuing bank. In this paper, we studied the problems on corruptions to occur in the middle of the examination process of the electronic bills of lading and suggestions how to solve them are discussed.

전자무역 해외시장조사, 계약, 신용조사, 거래알선, 결제, 보험, 운송 등 무역거래 전반의 프로세스를 통합하여 구매효율성을 높이고, 시간단축 등을 통해 전자무역 업무의 효율성 및 생산성을 높일 수 있는 장점을 가지고 있다. 본 연구는 전자무역업무의 몰입 요인인 무역업체 종업원이 해외시장조사업무의 몰입, 상역업무의 몰입, e-LC업무의 몰임, 통관업무의 몰입, e-B/L 및 Logistics업무의 몰입, 결제 및 e-Nego업무의 몰입 등을 개발하여, 전자무역업무의 성과에 미치는 영향을 분석하고 있다. 분석결과, "해외시장 조사업무의 몰입", "e-LC업무의 몰입", "통관업무의 몰입"과 "e-B/L 및 Logistic 업무의 몰입" 그리고 "결제 및 e-Nego업무의 몰입"의 요인들은 전자무역 성과에 유의한 영향을 미치고 있다. 반면 "상역업무의 몰입"은 전자무역 성과에 유의한 영향을 미치고 있지 않다는 분석 결과가 나왔다. 본 연구에서 나타난 바와 같이 전자무역은 무역업체에게 유효한 효과가 있기 때문에 글로벌 전자무역과 시스템 개발에 노력해야 하며, 각 관련부처간의 시스템 연계의 통일화를 기해야 할 것이다.

This study aims to examine similarities and differences of each e-B/L types as well as identify problems of e-B/L utilization and directions for improvement. Especially, it suggests strategies for the realization of e-B/L through reviewing and analyzing commercial types of e-B/L, which have been developed so far. Although e-B/L succeeded in realizing the function as a certificate of title and its distribution value, it has not been fully implemented due to operational problems. Subsequently, e-B/L was realized in the Bolero project as an attempt of system to make up for shortcomings in the failure of previous e-B/L types, but it has still a number of problems. To solve this problem and make use of e-B/L more efficiently, this study focuses on the specific ways to introduce e-B/L and suggest directions for the development of e-Nego system. Preparation of electronic documents is a prerequisite for the development of the e-Nego system, taking distribution of electronic documents into consideration. Next, compatibility of electronic documentation and paper-based documents should be realized, with the guarantee of authenticity of electronic documents.

우리나라는 2003년부터 2008년까지 전자정부 과제로 인터넷기반의 국가전자무역망(uTradeHub)을 성공적으로 구축하여 무역의 전자화를 활성화하고 있으며, 전자무역의 마지막 단계라고 불리는 선하증권(B/L)을 전자화한 '한국형 전자선하증권 서비스(e-B/L Korea)'를 정부와 민간의 협력 하에 구축하여 시범사업을 거쳐 2009년에 공식적으로 전자선하증권 서비스에 들어갔다. 국가적 차원에서 상법을 개정하고 시행령을 만들어 선하증권을 제도화한 것은 세계 최초이며 세계 각국이 이의 성공여부에 지대한 관심을 가지고 주목하고 있다. 한국형 선하증권의 성공은 2011년 말을 기점으로 우리나라가 세계에서 9번째로 무역 1조불 클럽에 가입한 '무역강국'의 위상을 높이고 실질적으로 우리 수출입기업의 무역거래비용을 절감함으로써 향후 무역 2조불시대를 앞당길 전자무역 활성화의 시금석으로 인식되고 있다. 하지만 아직은 국가 간 연계구축망이 부재하고, 서류의 보안성과 안전성올 높이기 위한 전자인중이 국제적으로 통용되고 있는 사적인증을 배제하고 국내공인인증만을 취급하는 등 e-B/L 서비스를 활성화하기 위해서 해결해야할 문제점도 산적해 있어 실질적으로 e-Nego 서비스가 크게 확산되지 못하는 실정이다. 따라서 본 연구는 e-Nego 또는 서면전환 과정에서 발생할 수 있는 한국형 전자선하증권의 변형에 따른 문제점을 비롯하여 구조적, 제도적 문제점과 사용상 장애요인을 도출하여 이에 대한 해결방안을 제시하였으며, 한국형 전자선하증권의 특성을 검토하고 통 서비스 활용을 활성화하기 위한 전략을 제시하였다.

It is childhood yet in uTradeHub system practical use. According as company's necessity of cost-saving is increased according to trade terms aggravation such as uncertainty of international money market, commodities prices rise, necessity of e-trade practical use in company is increased. Use is inevitable by state that link with e-Nego and e-B/L service with related presentation e-L/C banks is not made. At the present users are doing specification only service this main point, and practical use activation through public information and marketing about service is needed situation because most of, companies which is not using service, do not know about existence availability of uTradeHub system, usage, availability. This study presented five such as early materialization of user center's link and integration, medium and small enterprises e-trade participation extension, utilization ratio raising through government's public information, e-trade cooperation business activation between the country, electronic documents standardization etc. by prompting competition about practical use of uTradeHub system.

ICC(International Chamber of Commerce) developed new rule on the presentation of electronic record in L/C transactions. This rule named as the e-UCP. The gists of this article are on the application of e-UCP in practice and it's some problems. The e-UCP is the supplement of current exisiting UCP but is superior to UCP under some circumstances. The e-UCP is only apply to the presentation of electronic record regardless of type of L/C(for example, traditional paper L/C or electronic L/C). The presentation of electronic record has some problems which has not seen in the presentation of paper document. These peblems are Time, Place of presentation, and format of electronic record and so on. The e-UCP provided on the basis of these problems. However, the e-UCP has some obscure provisions on the examination of electronic record and the corruption of electronic record. Who is responsible for the corruption of electronic record by the virus on the system of bank ? The current e-UCP is not clear on this matter. We have to note followings in case of presenting the documents electronically and applying the e-UCP. First, Beneficiary has additional duty to notice of completion of presentation. Second, It will be increasing the clean NEGO through prompt feedback of the descrepancy at the presenting time. Third, It is no use of L/G(Letter of Guarantee).

전자무역의 경제적 효과측면 따른 다양한 비용절감 효과와 영향요인을 바탕으로 한 무역거래는 신속한 수출입 통관을 통해 시장변화에 능동적으로 대응할 수 있는 기반제공에 따른 무역업체의 비용절감과 경영효율화를 통한 대외경쟁력제고 및 이미지제고와 더불어 기업내 실시간 정보공유를 통해 고객에 대한 서비스를 제공하는 유 무형의 효과를 발휘하고 있다는 것을 시사점으로 전자무역의 활성화가에 필요한 이유이다. 이러한 배경을 바탕으로 글로벌 무역체계를 구축하기 위한 전자무역 플랫폼을 구축에 의한 무역거래 업무를 실행함으로써 과거 전통적인 무역거래에서 이루어진 패러다임의 변화와 새로운 장치마련에 따른 무역거래관련 문서와 비용 측면에서 경제적인 효과를 극대화하기 위한 방안으로 전자무역 실행에 따른 파급효과에 대한 내용을 바탕으로 향후 대응방안을 제시하였다.

The purpose of this study is to propose a new mechanism for the global transmission of electronic trade documents and to promote them using it. Trade settlement methods are changed from L/C bases to non-L/C bases and in particular, the telegraphic transfer is dramatically increased since mid 1990. But the status of transmission of electronic trade documents still rely on the letter of credit and bill of lading. So it need to change the process of transmission of electronic trade documents utilizing non-negotiable sea waybill instead of bill of lading. In this study, I pointed out two problems as obstacle factors in global transmission of electronic trade documents. First is the system connection problem between domestic and foreign banks and second is the electronic right transfer problem in the bill of lading. Electronic bill of lading has already been made, but are not used and e-Nego has also not been activated under the above issues. Therefore, it should be solved previously the above problems for the global transmission of electronic trade documents under the letters of credit. However, in transactions of transfer, it does not need the inter-bank connection and also does not occur the electronic right transfer problem of bill of lading if using the non-negotiable seaway bill instead of bill of lading. In this paper, I recommend the global transmission strategies of e-trade documents using the non-negotiable sea waybill in transactions of transfer. Hopefully, I expect the activation of global transmission of e-trade documents through the utilization of electronic non-negotiable sea waybill as suggested by this study.
