의사의 설명의무는 의사가 환자에게 이미 시행한 의료행위, 시행 중인 의료행위 및 장래에 시행할 의료행위와 환자의 요양상 수칙에 관하여 적극적 체계적으로 진술함으로써 환자가 그 내용을 인식하게 할 법적 의무를 총칭한다. 이 의무는 환자의 알 권리에 대응하는 보고성 설명의무, 환자의 동의권 거절권에 대응하는 기여성 설명의무, 요양지도성 설명의무로 나뉜다. 설명의무를 분류하는 것은 각각의 기능과 법적 성질이 다르고, 법적 성질이 다름에 따라 그 위반 시의 효과, 특히 손해배상책임의 대상과 범위가 달라지기 때문이다. 이 주제에 관하여 우리나라에서는 지난 40년 가까운 기간 동안 많은 이론의 발전이 있었고, 그를 토대로 대법원 판결의 논리도 상당히 정치하게 전개되어 왔다. 그러나 여전히 학계와 실무계 일각에서는 용어와 개념의 혼동, 학설과 판례 논리에 대한 이해 부족을 목격하게 되고, 심지어 대법원 판결문 내의 전후 문맥에서 그리고 관련 있는 복수의 판례 사이에서 논리와 이론의 불일치를 발견하게 되는 것이 사실이다(이것은 합리적 근거와 설득력을 지닌 견해의 분립을 지적하는 것이 아니다). 위와 같은 견해와 문제의식을 기초로 해서, 의사가 부담하는 설명의무의 기능별 분류와 법적 성질 및 그 위반 시의 효과를 우리나라 학설과 판례를 중심으로 분석 정리한다.

대한변호사협회는 2014년 2월 변호사윤리장전을 개정하면서 변호사의 개인정보 보호 의무에 관한 규정을 신설하였다. 최근 빈번한 개인정보 유출로 개인정보 보호의 중요성이 어느 때보다도 강하게 인식되고 있는 상황에서, 개인정보 보호의무의 신설은 기존의 변호사의 비밀유지 의무로 보호되지 못하는 의뢰인이외 제3자의 개인정보를 보호하고 비밀의 누설 이외 수집, 기록, 보유, 가공, 편집, 검색, 출력 등의 각종 처리에 관하여 규율할 수 있다는 점에서 적지 않은 의의를 발견할 수 있다. 특히 주민등록번호와 같은 고유 식별정보의 암호화는 변호사가 보관 중인 각종 민감정보 유출로 인한 피해를 방지하기 위한 필수적인 조치라고 볼 수 있고, 정보주체의 접근 보장은 자기 정보에 대한 자기 결정권 등 헌법적 가치가 반영된 것으로서 시대의 요청이라고 할 것이다. 이 글에서는 현재 변호사윤리장전이 개인정보 보호의무의 구체적인 내용을 밝히고 있지 않은 가운데, 변호사의 개인정보 보호의무의 일반적인 내용을 살펴보고, 향후 구체적으로 개인정보의 처리가 문제될 수 있는 몇 가지 경우를 살펴본다. 해당 논의가 변호사의 개인정보 보호에 관한 논의에 작으나마 기여하기를 바란다.

우리나라는 2011년에 개인정보보호법이 제정되어 국민의 개인정보를 안전하게 보호하고 권익을 보호하는 많은 역할을 해오고 있다. 개인정보처리자는 안전한 개인정보 관리를 위하여 안전성 확보 조치 기준을 의무적으로 준수해야 한다. 이렇게 행정 규제가 수반되는 문제임에도 누구에게 언제 어떻게 적용되는지가 명확하지 않다. 법 적용의 원칙은 법의 적용 범위나 대상이 명확해야 하고 대상자의 법적 안정성과 예측 가능성에 있어야 한다는 것이다. 의무 부과에 따라 대상자에 대한 범위, 기준, 안전조치 항목, 절차 등이 명확하고 구체적으로 명시되어야 하지만 현행법 제도는 미흡하다. 따라서 본 연구에서는 선행연구와 개인정보보호 실태조사 자료를 기반으로 적용 대상자 분류 기준, 대상 판단 근거 기준, 안전성 확보 조치 기준 등에 대한 문제점과 합리적인 개선 방안을 제시하였다. 이를 통해 적용 범위와 기준을 명확화, 구체화하여 합리적인 방안을 제시하여 제도의 실효성을 높이는데 기여하고자 한다.

본 논문에서는 전자상거래에 대한 WTO의 논의들 중 전자상거래 무관세화 문제를 중심으로 그 무역정책적 함의를 고찰해 보고자 한다. WTO에서의 전자상거래 무관세화 선언은 개방적 무역환경을 보장함으로써 전자상거래 서비스무역의 성장에 기여하고 있지만, 그 중요성이 다소 과대 평가되는 측면이 있다. 특히 전자상거래 무관세화 선언은 다른 수입규제수단의 사용에 대한 여지를 남겨두고 있기 때문에 그 자체가 자유로운 시장접근을 보장해 주는 것은 아니다. 따라서 GATS 하에서 이루어진 제한된 양허약속을 심화·확대시키고, GATS 규범을 명료화함으로써 보다 자유로운 전자상거래 서비스무역 환경을 조성해 나가야 한다.

As cultural Heritages are source of the national history and a life transition, their extinction is a fatal shock as result of cutoff the genealogy of the creative national spirit. So, we have necessarily to protect them, and to get the duty and the responsibility which the cultural inheritance hands over tnem to descendants with preserving and meaning safely at present time. In these days, the risk of fire in the Cultural Heritages building is increased because of rash changing environments from the indiscreet development of them. Accordingly, in order to get the original transmission of the Cultural Heritages, this paper involves being intensive the fire safety information of the Cultural Heritage in kyonggi-do province, analyzing their diagnoses, and studying a Fire Safety Prevention Management model to protect and to maintain them continuously. Therefore, it is to contribute from this approach to collecting fire safety information, analyzing diagnostic problems in fire accidents, and to manage the prevention method for protecting and maintaining the Cultural Heritages.

본 연구는 현재 정보기술의 급속한 발달로 인해 우리 일상 생활에 많은 변화를 야기하는 정보화가 진행되고 있는 현재 일반사회뿐만 아니라 국가가의 전쟁 양상도 기존 재래식 중심의 전쟁에서 정보화시대의 전쟁 즉 정보전의 개념으로 변화되어 가고 있는 시점에서 정보전의 개념과 미래 정보전의 개념, 특히 네트워크 중심의 전쟁에 대해 살펴봄으로써 정보전에 대한 개념 및 효율적인 운용방안을 제시함으로써 미래 정보전하에서 완벽한 임무수행에 기여할 수 있는 방법을 제시코자 한다. 이를 위하여 정보화시대의 전쟁양상을 시대별로 구분하여 정리하였으며, 미래전쟁양상의 변화에 대해서는 미래전의 기본구도, 미래전장의 변화, 미래 정보전의 양상에 대해 다루었으며 미래 정보전의 핵심인 네트워크 중심 전쟁에 대해 전쟁수행방식과 전쟁에서의 영향에 대해서 집중적으로 고찰해 봄으로써 네트워크 중심 전쟁의 올바른 운용방안에 대해 내용을 제시하고 있다.

Continuous conduction mode (CCM) boost converters are commonly used in home appliances and various industries because of their simple topology and low input current ripples. However, these converters suffer from several disadvantages, such as hard switching of the active switch and reverse recovery problems of the output diode. These disadvantages increase voltage stresses across the switch and output diode and thus contribute to switching losses and electromagnetic interference. A new topology is presented in this work to improve the switching characteristics of CCM boost converters. Zero-current turn-on and zero-voltage turn-off are achieved for the active switches. The reverse-recovery current is reduced by soft turning-off the output diode. In addition, an input current sensorless control is applied to the proposed topology by pre-calculating the duty cycles of the active switches. Power factor correction is thus achieved with less effort than that required in the traditional method. Simulation and experimental results verify the soft-switching characteristics of the proposed topology and the effectiveness of the proposed input current sensorless control.

This study aims to examine theoretical frame work of franchise restaurant, the characteristics of store manager's job and the level of their job satisfaction through an empirical investigation. Job satisfaction survey study shows that store managers consider important all work to be attended to as part of their duty with service management on top. It is also found that the majority of store managers consider their aptitude as most important job satisfaction factor and those, who are satisfied with their job content, advancement and the prospect, are more proactive in delivering qualify service and more than willing to commit themselves to their duties. Regrading demographical variables, store managers with scholarly competence and higher pay level are more likely to be satisfied with their job but married men are not satisfied with the work environment in general. Ergo, Businesses should correspond by capitalizing on those store managers content with their duty thus collecting additional information and providing opportunities to further contribute to the business. For those dissatisfied individuals, however, businesses should determine their demands and by educational training supply a motive therefore making possible the conversion of such individuals to satisfied store managers and their active participation in business management. But, as with any study, this one has a number of limitation which constraints the generalizability of the empirical findings. It has not been for long since franchise restaurants established in domestic market and has been few studies regarding this topic there. Furthermore, managers are not willing to release operation related data. Therefore, further study are urged to overcome this limitation and should examine other dimensions of job satisfaction such as relations between revenue and profit with the level of store manager's job satisfaction remain to be investigated.

본 우리나라는 전 세계 IT 생산량의 7%를 차지하는 IT 강국이지만 정보교육을 소홀이 다루고 있어 핵심 원천기술과 SW를 개발할 인력이 부족한 형편이다. 따라서 본 논문에서는 열악한 교육체제를 개선하고 정보교육을 활성화하기 위한 "정보교육진흥법"의 제정 방안을 제안하였다. 그리고 이 법에서 담아야할 내용으로 체계적이고 안정적인 정보교육의 활성화를 위한 국가와 지방자치단체의 "정보교육종합계획 수립"에 대한 책무, 정보교육의 활성화를 추진하기 위한 위원회 구성, 학교교육과 사회교육에서의 정보교육 활성화 방안, 정보활용능력인증제 도입 등에 대한 구체적인 방안을 제시하였다. 따라서 본 논문을 통해 도출되는 연구 결과는 침체되어 있는 우리나라의 정보교육을 활성화할 수 있는 "정보교육진흥법" 제정의 방향을 제시해 주는 지표가 될 수 있을 것으로 기대한다.

This study identifies the aspects of a managers' perceived work experience in a Multicultural Family Support Center and analyzes how work experience backgrounds are formulated. In-depth interviews were conducted with 10 managers from March to September 2015 to understand managers' work experience. Descriptions from the interviews were analyzed using phenomenological research methods. The result show that their work experience can be categorized into 73 meanings, 10 subcategories, and five themes. The five themes are 'program development,' 'employees assignment optimization,' 'use and control network resources,' 'deal with changes in needs of multicultural families,' and 'supports vs. controls.' The analysis of the themes and subcategories from each theme allows us to first interpret that managers consider their significant and diversified work tasks overwhelming. Second, they find their jobs fit them and feel personally interested with a sense of duty from their work to overcome stress from heavy workloads. Third, managers put a high value on their work as a hands-on experience that is an officially authorized position from the government. Fourth, they are proud that they contribute to offering welfare services to multicultural families as members of Multicultural Family Support Centers.
