UCP 600 이후 선화증권 하자관련 분쟁사례 (Case Study on the Discrepancies of Bill of Lading under UCP 600)

  • Bill of lading means the transport document ("marine", "ocean" or "port-to-port" or similar), however named, covering sea shipment only. Data in a bill of lading, when read in context with the credit, the document itself and international standard banking practice, need not be identical to, but must not conflict with, data in that document, any other stipulated document or the credit, according to UCP 600 and ISBP. This article has provided the general guideline of the discrepancies on the basis of UCP 600, ISBP 681 and the ICC Banking Commission Opinions, for the solution of the unpaid problems of the credit transactions. I have studied especially the ICC Banking Commission Opinions and the DOCDEX Decisions on the bill of lading after UCP 600, the international standard banking practice (ISBP 681), and the recent Korean cases. As such, this article would fill a need gap in the market between the general principles in the UCP provisions and the daily job of the practitioner. The credit practitioners are suggested to this resulting guidance whenever doubts arise as to how to check the credit documents in daily practice.

신용장통일규칙(UCP)상 운송주선인 운송서류의 수리요건에 관한 연구 (A Study on the Acceptance Conditions of a Freight Forwarder's Transport Document under UCP)

  • There can be analyzed severally on the acceptance conditions of freight forwarder's transport document under UCP. First, Bills of Lading issued by forwarding agents will be refused. This can be seen in the article 20 of 1933 Revision UCP(Brochure 82) and the article 20 of 1951 Revision UCP(Brochure 151). Second, Unless specifically authorized in the credit, Bills of Lading issued by forwarding agent will be rejected. It is prescribed in the front part (a) of article 17 of 1962 Revision UCP(Brochure 222) and the article 19 of 1974 Revision UCP(Publication No. 290). Third, Acceptance conditions are different according to the type of transport documents, that is either Bill of Lading or not. It is prescribed in the art 25 and article 26 of 1983 Revision UCP. Unless otherwise stipulated in the credit, transport document issued by a freight forwarder will be rejected unless it is the FIATA Combined Transport Bill of Lading approved by the International Chamber of Commerce or otherwise indicates that it is issued by a freight forwarder acting as a carrier or agent of a named carrier. On the other hand, unless otherwise stipulated in the credit, marine bill of lading issued by a freight forwarder will be rejected, unless it indicates that it is issued by such freight forwarder acting as a carrier, or as the agent of a named carrier. Fourth, transport documents issued by a freight forwarder will be accepted. This can be found in the article 30 of 1993 Revision UCP(ICC Publication No. 500) and the article 14 l of 2007 Revision UCP(ICC Publication No. 600). According to the former unless otherwise authorized in the Credit, transport document issued by a freight forwarder will only be accepted if it is appears on its face to indicate the name of the freight forwarder as a carrier or multimodal transport operator or its agent. The latter prescribed that a transport document will be accepted if it is issued by a freight forwarder by a agent of carrier or freight forwarder itself.

  • Bills of lading are crucial in international sales on shipment terms since they guard buyers against loss of or damage to the goods in transit by giving them the rights against carriers. A bill of lading, as document of title, gives the buyer the right to demand physical possession of the goods from the carrier and enables the buyer who is in possession of damaged or short-delivered goods to sue the carrier. In this context the buyer in sales on CIF or CFR terms or FOB terms with additional services benefits from the bill of lading which functions as a receipt of goods and a evidence of the terms of the contract of carriage. Protection of such buyer's interests can be provided in the sale contract through appropriate express or implied terms on the seller's documentary obligations: Which transport document, a bill of lading or a sea waybill, is required? Who should be named as the consignee in the transport document and, in case of bill of lading, by whom should the bill be endorsed? What should be stated in the bill of lading for the quantity of the goods? How about a bill of lading that contains so called "unknown clause"? How many bills of lading for the entire contract goods should be tendered? Can a bill of lading stating that the goods have been shipped in apparent good order and condition also state that the goods were damaged after shipment? This paper seeks to provide answers for these particular questions.

다중 분류기 시스템을 이용한 자동 문서 분류 (Automatic Document Classification Using Multiple Classifier Systems)

  • 단일 분류기에 비해 높은 분류성능을 얻기 위해 다수의 분류기들을 결합하여 사용하는 방법은 폭넓게 이용되어 온 기술이다. 하나의 다중 분류기 시스템을 구성하는 일은 다음 두 가지 문제들을 가지고 있다. 첫째는 어떻게 기반 분류기들을 생성하느냐 하는 것이고 둘째는 이들의 예측결과를 어떻게 결합하느냐 하는 것이다. 본 논문에서는 Bagging, Boosting, Stacking 등 기존의 대표적인 다중 분류기 시스템들의 특징을 살펴보고, 문서 분류를 위한 새로운 다중 분류기 시스템들인 Stacked Bagging, Stacked Boosting, Bagged Stacking, Boosted Stacking들을 제안한다. 이들은 Bagging, Boosting, Stacking과 같은 기존 다중 분류기 시스템들의 장점들을 결합한 일종의 혼합형 다중 분류기 시스템들이다. 본 논문에서는 제안된 다중 분류기 시스템들의 성능을 평가하기 위해 MEDLINE, 유즈넷 뉴스, 웹 문서 등의 문서집합을 이용한 문서 분류 실험들을 전개하였다. 그리고 이러한 실험결과를 통해 제안한 혼합형 다중 분류기 시스템들은 전반적으로 기존 시스템들보다 우수한 성능을 보이는 것으로 나타났다.

  • 이용자의 요구에 의해 타 도서관 소장 자료를 복사해 주는 학술정보센터의 원문복사서비스는 저작권법상 저작권 제한 규정에서 그 법적 근거를 찾을 수 있다. 그러나 정보유통 기술의 발달과 함께 해외 저작물의 디지털 전송에 대한 이용자 요구가 증가하면서 보다 적극적인 정보서비스가 요구되고 있다. 이에 이 연구는 해외 저작물의 원문복사서비스에 대한 법적 근거 검토와 함께, 해외 정보서비스 기관의 저작권 권리처리 사례를 살펴봄으로써 해외 저작물의 디지털 복제 전송이 가능한 저작권 권리처리 방안을 제시하였다. 이를 통해 갈수록 첨예해지고 있는 저작권 분쟁 시대에 저작권자의 권리를 보호하는 한편, 학술정보센터 이용자의 다양한 정보요구를 충족시킬 수 있는 새로운 서비스 모델을 기획할 수 있을 것이다.

TMA의 운용과 주요 BPO 비즈니스 시나리오에 관한 연구 (A Study on the Transaction Matching Application and Major BPO Business Scenarios)

  • The BPO is an irrevocable undertaking given by an obligor bank to a recipient bank to pay a specified amount under the condition of a successful electronic matching of data or acceptance of mismatches. The BPO enables the participating banks to provide sellers and buyers with enhanced financing services. Therefore, BPO gives banks the tools to provide them with guarantees and other multi-banking services. All the participating banks must use the same Transaction Matching Application(TMA) for BPO business. In order to exchange BPO-related data, banks must be subscribed to the same TMA scheme. Participation in the TMA scheme is limited to banks only. The TMA is matching and workflow application as instrument to determine whether to pay the BPO or not. Therefore, TMA will have an important role to play in the business of the BPO. So, This paper is to review the mechanism of a TMA and the major business scenarios in Banking Payment Obligation Transactions. In Particular, it has been included the exchange and matching of data messages, the disposal of discrepancies, document payment and others based on URBPO. This study will be based on documentary research including swift com and icc.org and so on.

Usefulness of medical review in the insurance claims

  • Background : Many of internists have been working for insurance industry. Insurance medicine is use of medical knowledge for insurance industry. There is social role of insurance medicine in terms of soundness of insurance administration. Recently social role of internists also have been being watched. Although theme of insurance medicine is medical risk selection, insurance claims administration also needs medical experts'opinion. There are not any corroborative study of medical consulting for insurance claims. Among insurance industry, someone called this medical review of insurance claims as 'medical claims review'. Aim : To investigate usefulness of medical review of insurance claims. Design : Questionnaire survey with claim staffs in one of insurance claim adjustment company in Korea. Methods : 265 claim staffs were divided into 4 groups and conducted survey using a questionnaire of 20 questions. Utility score, job satisfaction score, and difficult factors of claims administration were measured. Results : Utility score and job satisfaction score are highest in medical claims review group. The most difficult in claim administration to claim staffs was demonstrated to medical knowledge. Conclusion : Medical review of insurance claims is proved to be worthy. Document-based consulting method, namely medical claims review, is more useful than telephone-based simple query among claim staffs...Subjects of the medical claims review are medical record and it's principle is independent medical examination with evidence-based approach, it also has role of protecting fraud of insurance claims. Two main question types of medical claims review are verification and advice.

국내 간호사의 재난간호 역량: 주제범위 문헌고찰 (The Competency in Disaster Nursing of Korean Nurses: Scoping Review)

  • Purpose: The aim of study was to identify ranges of Korean nurses' competency in disaster nursing. Methods: A scoping review was conducted using the Joanna Briggs Institute methodology. The review used information from four databases: RISS, ScienceON, EBSCO Discovery Service, and CINAHL. In this review, key words were 'disaster', 'nurs*', 'competenc*', 'ability' and 'preparedness'. Inclusion and exclusion criteria were identified as strategies to use in this review. The inclusion criteria for this review focused on the following: Korean nurse, articles related to disaster nursing competency, peer-review articles published in the full text in Korean and English. Review articles were excluded. Results: Nineteen studies were eligible for result extraction. A total of 10 categories of disaster nursing competency were identified: Knowledge of disaster nursing, crisis management, disaster preparation, information collection and sharing, nursing record and document management, communication, disaster plan, nursing activities in disaster response, infection management, and chemical, biological, radiation, nuclear, and explosive management. Conclusion: It is necessary to distinguish between Korean nurses' common disaster nursing competency, professional disaster nursing competency, and disaster nursing competency required in nursing practice. Therefore, future research will be needed to explore and describe disaster nursing competency.

전자무역(電子貿易)에서 제도상(制度上) 인증(認證)시스템의 문제점(問題點)에 관한 고찰(考察) (A Study on Problems of Certification System in International Electronic Commerce)

  • Electronic transaction using electronic documents be carried without direct person to person meeting, there is the possibility to use other's identity illegally without notice and to verity authenticity of transaction. It is very hard to find out that the electronic documents on the process of submitting is forged documents or not and also has much difficulty in maintaining transmitting secret. Therefore, to solve such problems on electronic transactions, certification system with cryptography skill are inevitably necessary. Also there is needed legal base in the electronic document as functional equivalent of the paper document. Recently there are so many commercial certification service provider(CPS) such as Identrus, Bolero, TEDI but their establishment of CPS, certification process, guideline and so on are different each CPS. Therefore, this kind of situation can make user confuse. To introduce and develop the electronic certification in the international electronic commerce not domestic electronic commerce, it need to authorize and operate certification authority under the uniform regulation base. But, because the laws and guidelines that related to electronic certification system are different among the nations and international organizations, it need to compare laws and guidelines. In conclusion, the most important thing to resolve problems surrounded certification and develope certification system in the international electronic commerce make uniform rule of international electronic certification to recognize internationally from each nation or at least, need to harmony laws and guideline in each nations.

해상운송서류 전자화에 관한 소고 - ESS-Databridge를 중심으로 - (A Study on Digitization of Sea Transport Document - Focusing on ESS-Databridge -)

  • So far several attempts have been made to digitalizing sea transport documents. Three notable examples are SeaDocs, Bolero, e-B/L Korea and Ess-Databridge. Ess-Databridge was established in 2003, with the aim of promoting the use of electronic alternative to shipping documents. The ESS-Databridge system was piloted from 2005 and went live in January 2010. The ESS-Databridge operates under a private legal outline, the Databridge Services and Users Agreement (DSUA). In the Ess-Databridge system, only the user who is in control of the original bill of lading will be able to indorse it on to another user. Once the indorsement is effected and unless the indorsee decide store turn the documents, the indorser loses control and retains access only to an electronic document marked 'copy' for its records. A feature that appears to have been crucial to the success of the CargoDocs service is that visually, e-B/Ls produced using ESS-Databridge appear identical to the paper documents. The ESS-Databridge may be even more successful if the legislators take certain steps that will increase uniformity and certainty in electronic transport documentation.
