반(反)성폭력 관점에서 본 친고죄 (On the CIC from the view of Anti Sexual Violence Crime)

  • The definition of Crime Indictable Upon Complaint (CIC) is crimes which can be prosecuted only with complaints from the victim or his/her direct parents. Sex crimes are the representative examples, rapes and indecent assaults. According to the research referenced in this paper, 74% of sex crimes which had been penalized based on Republic of Korea (ROK) Criminal Code amounts rape and indecent assault are CIC. However, only 20% of perpetrators were confined, and the rest received non-confinement or non-prosecution determination. The review of criminal history checks reveals that 67% of the perpetrators had criminal histories and 39% of them had more than three documented offenses. The CIC was established in order to protect the victim's rights and dignity, respecting the victim's opinion regarding the incident. All kinds of sex crimes then should have been the CIC, but those crimes such as Injury Resulting from Rape, Special Rape, Rape by Special Modus Operandi, Sexual Assault among Relatives and Domestic Violence which have to guarantee the opinion of the victims are prescribed as non-CIC. We therefore conclude that the CIC should be abolished. The abolition of CIC will play an important role in crime prevention because severe penalties for sex crimes will be imposed on the perpetrators. In addition, it will help the sex crime victims retrieve their dignity by spreading recognition widely through the community that sexual assault is not only a social assault but an infringement against human rights.

친환경 패션 제품의 객관적.주관적 속성 평가 연구 (A Study on the Evaluation of Environment-friendly Fashion Product Attributes - Focused on the Objective and the Subjective Attributes -)

  • This study aims to understand the evaluation of importance, satisfaction and repurchase intention after dividing the attributes of environment-friendly fashion product in details. Out of 400 surveys, 328 were used in the final analysis of this study, with 113 respondents having experience of buying Environment-friendly fashion products. The analysis of this study is done by SPSS 18.0(ver.). Through the literature review, the objective attributes were subdivided into seven factors, including brand, environment-friendly materials, quality, environment-friendliness when using/managing, environment-friendliness when discarding, color/pattern, and environment-friendly design. Though an empirical study, the subjective attributes were subdivided into three factors, including innovation/individuality, practicality, and dignity/popularity. In the analysis results of the importance of the attributes of environment-friendly fashion products, it was shown that it was considered as importance as above average. The effect of the satisfaction of the objective attributes on the repurchase intention was measured. In the results, the regression model was significant while it was understood that the satisfaction of environment-friendly materials, environment-friendliness when discarding, color/pattern and environment-friendly design had positive effect on the repurchase intention. The effect of the satisfaction of the subjective attributes of environment-friendly fashion products on the repurchase intention was measured. In the results, dignity/popularity and innovation/individuality factors had positive effect on the repurchase intention.

무대 의상에 나타난 블랙의 미적 특성 - 뮤지컬 '시카고'를 중심으로 - (The Study on the Aesthetic Characteristics in Black Shown in Stage Costume - Focused on Musical 'Chicago' -)

  • This study examined that the black dress is the one of having aesthetic value as well as symbolism while delivering specific image, from the perspective of color, which is essential element in forming design of the Stage Costume. This study carried out the theoretical research of centering on the literature consideration and the empirical research of centering on a case side by side. It analyzed the works and design based on the clothing, which had been performed in Korea with a revival version of Musical 'Chicago'. Aesthetic characteristics in more than two are being shown in one dress. If so, the following are the results that considered on aesthetics characteristics in black, which were shown in Stage Costume of Musical 'Chicago', which is increasing the theme consciousness through Stage Costume, which is simple and sexy black. First, as emotion of coming to stay in agony and sadness on the basic fact called death, the Stage Costume in black led to being shown sorrow of implying death, fear and murder. Second, the dignity, which corresponds to noble beauty in the aesthetic category, expresses dignity and elegance with flat material in black, and is revealed the aspect of expressing fashion, which emphasized spirit rather than body. Third, as the aesthetic characteristic of causing sexual desire, the sensuality was shown, which has the aspect of being expressed through exposure, concealment and emphasis. Fourth, it was expressed with androgyny, which evokes androgynous image. Fifth, black in Musical 'Chicago' formed the whole mood with a sense of weight by arranging the whole feeling with color in similar tone, thereby having been indicated the harmony of being formed with theme, which is aimed to be indicated in drama.

서양신발의 사적 고찰과 미적 가치 I (A Study on the Blistery of Western Shoes and Their Aesthetic Value)

  • In fashion, there are various cultural aspects that exist in complexity, where according to the era, even fashion items newly develop and prevail into various designs in the organic function with reality of related cultural phenomenon and aesthetic aim. Among the fashion items, the shoe is historically considered as the shield from lust and also the provision of praise against the most emotional incitement. Mankind has started wearing shoes out of the functional purpose of protection since the ancient Egyptian times. Thereafter humankind has been creating shoes artistically in respect to shape, color, and quality of material, etc, as an expression of aesthetical awareness and introspective desire for beauty. As modern fashion increasingly regards the total fashion image much more important than each items consisting the whole outfit, the role of shoe became essential more than ever. Contrary to its relative importance, little academic attention was given to this area yet, while prestigious museums and galleries in Europe and the USA have held exhibitions of shoes in view of both historical and artistic aspects. This study aims to make a historical inquiry of western shoes. through which their aesthetic values can be drawn. Literature on this subject including aesthetics, history of costume and arts were referred. Fashion magazines and catalogues were investigated for additional information. The process and results of this study are meant to be a suggestion not only to further studies but also to artistic and creative shoe design. Originated for the functional purpose, shoes have evolved in various shapes with different meanings attached to it. When the technological development made the satisfaction for functional needs possible, the intrinsic attribute, the aesthetic value was pursued. The historical contemplations of shoes from Egyptian times to the 1990's led to the results that the intrinsic aesthetic value of shoes can be summarized as follows: 1) protection and extension of body, 2) need for decoration, 3) erotic expression, 4) symbol of dignity and class, 5) fashion.

한국 여자전통 혼례복식에 나타난 미적 감성에 관한 연구 (A Study on Aesthetical Senses of Korean Traditional Women′s Wedding Dresses)

  • The purpose of this study is to determine aesthetical characteristics of the Korean traditional wedding dress for women by analyzing such dresses'aesthetical senses. For the purpose, the study showed four types of the dress, jukyee, whalot, weonsam and private weonsam and their photographed stimuli to subjects and then obtained data using the seven scale measures of meaning differentiation consisting of 25 pairs of adjective words. Results of the study are described as follows; Aesthetical senses shown in the Korean traditional dressing dress for women included six factors in total, among which attractiveness was found as the main factor, followed by chastity. For the four types of the dress, whalot adpated revelation as its main factor while the remaining three types, or jukyee, weonsam and private weonsam were found having dignity as their main factors. Adjective words which largely accounted for aesthetical senses included uncomfortable, warn, chaste, intellectual, bright, unique, regular, luxurious, classical, ornamental and beautiful suggesting that the Korean traditional wedding dress for women is somewhat unfunctional, but high in attractiveness and aesthetic beauty and has a better classical harmonization of dignity and revelation. Aesthetical senses were most different according to nationality(Korean and Japan) when they were analyzed in terms of nationality, gender and whether of specialization or non-specialization. Japanese people had unique and interesting senses while Korean people, chaste, calm and delicate aesthetical senses. According to gender, men revealed free senses and women, classical ones. According whether of specialization or non-specialization those who specialized in a related field had more unique, straight, regular, luxurious and interesting aesthetical senses that those who did not specialize.

출생 전 생명에 대한 헌법적 고찰 - 태아 및 배아의 생명권과 그 제한을 중심으로 - (A Constitutional Study on the Unborn Human Life : Focusing on the Right to Life of the Fetus and the Embryo)

  • The development of the biomedical science and technology has extended an argument about a status in constitutional law of unborn human life and a protection of the potential human life to that of an embryo and a gamete beyond a fetus. This argument has been focused on whether we should provide unborn or potential human life with human dignity and the right to life that are guaranteed by the constitutional law altogether or separately. If the right to life is given to unborn or potential human life, on what grounds can we restrict this right. Those who argue for the unity of the right to life with human dignity and the inseparability of those two claims that the right to life in itself should be guaranteed absolutely. According to the constitutional law, however, any constitutional right of the human person within the protection of essential part of the right can be compared with each other and restricted with some valid reasons from the legal perspective. This measure is unavoidable in reality because one right can come into conflict with another right frequently. Since fetus and embryo are in a process of developing into the human person, it is difficult to think that they are the same with the human person. For that reason, it is hard to consider that the right to life of fetus or embryo is the same with that of the human person. However, since a fetus has a special status as a potential human person, and an embryo also has a special value as a potential fetus upon an implantation, the right to life of fetus or embryo should be judged differently according to the stage of their development. A study on a constitutional status and protection of a fetus and an embryo is essential because unborn or potential human life is the origin of human person. Therefore, we have to make much account of their right to life and seek the legal respect for their inherent value.

생명윤리에 대한 이론 윤리학 탐구 - 싱어, 칸트, 아리스토텔레스 윤리학을 중심으로 - (A Study of the Theoretical Ethics Approach to Bioethics - Based on the ethics of Singer, Kant, and Aristotle -)

  • 본 논문의 목적은 생명윤리에 대한 이론 윤리학이 갖는 의미를 탐색하는데 있다. 첫 번째로 싱어가 제시하고 있는 이익평등고려의 원칙과 선호공리주의가 생명윤리 분야 내에서 어떠한 의미와 한계점을 갖는지 살펴본다. 두 번째로 칸트 윤리학이 생명윤리 분야에서 갖는 중요성을 강조해 보고, 그럼에도 부족했던 관점을 알아본다. 마지막으로 아리스토텔레스의 덕윤리가 생명윤리로 실현되어야 하는 이유를 살펴보고, 이를 통해 인간 삶의 의미를 제언하고자 한다. 싱어의 주장은 기존 윤리학사(倫理學史)에서 고려하지 못했던 진화한 생명에 대한 새로운 화두를 던져준다. 그는 당연시 되었던 인간 존엄에 대해 부정할 수 없는 차원의 의견을 제시하였다고 볼 수 있다. 또한, 생명 존중 대상에 대한 범위 확장을 합리적으로 이루었다고 평가할만하다. 이와 구분하여, 칸트 윤리학은 인간 존엄의 의미를 형이상학적 의미를 근거하여 설명한다. 더 나아가 인간 삶의 올바른 방향성을 제시한다. 그들의 주장을 수용함에도 결핍되었던 삶의 의미는 아리스토텔레스의 덕윤리의 적용을 통해 해소될 수 있을 듯하다. 인간을 비롯한 존재자의 삶의 의미는 생명, 더 나아가 존재 자체에 내재된 것일 수 있다.

성인의 심폐소생술 금지(DNR)에 대한 인식 및 태도에 대한 조사 연구 (A Study on the Perception and Attitude of 'Do Not Resuscitate' in Adults)

  • 본 논문은 성인의 심페소생술 금지(DNR)에 대한 인식 및 태도에 대한 서술적 조사 연구이다. 구조화된 설문지를 이용하였으며, 연구 대상은 210명이었다. DNR에 대한 인식에서는 '편안한 죽음을 위해(64.3%)' DNR이 도움이 된다고 긍정적으로 응답하였으며, 상황에 따른 DNR의 필요성은 '품위 있는 죽음을 위함(41.3%)' '환자의 고통을 줄여주기 위해(23.9%)' 등이었으며, DNR에 동의하지 않는 응답자의 이유는 '법적 문제가 제기 될 수 있기 때문(61.7%)', '인간의 존엄성은 생명유지가 최우선이기 때문(16.7%)' 등의 순이었다. DNR에 대한 태도는 '내가 불치병을 가졌을 때 사실을 알기 원하는지의 여부'가 평균 4.21점으로 가장 높았으며, 성인의 연령대별 DNR에 대한 태도에는 차이가 없었다. 심폐소생술 금지는 연명치료 중단의 방법이 아니라 인간이 임종과정과 죽음에 대한 자율권을 행사하는 포괄적 맥락에서 다루어져야 할 것이다.

승부조작 예방을 위한 스포츠 윤리의식 척도개발 (Development of Sports Ethics Consciousness Scale for Preventing Fixing Game)

  • 본 연구목적은 국외의 자료를 토대로 한국의 실정에 맞게 스포츠 윤리의식을 측정할 수 있는 승부조작 예방을 위한 스포츠 윤리의식 척도를 개발하는 것이다. 본 연구는 D광역시의 엘리트스포츠선수들을 모집단으로 선정하였다. 연구대상자는 유의표집법을 통해 중, 고, 대학생 엘리트스포츠선수 304명이 선정되었으며, 조사는 2018년 5월부터 7월까지 3개월간 실시되었다. 자료 분석은 문항특성 파악을 위해 기술통계분석을 실시하였으며, 신뢰도와 타당도 분석을 위해 내적일관성계수(α), 탐색적 요인분석, 확인적 요인분석을 실시하였다. 개발된 스포츠 윤리의식 척도의 하위요인으로는 집단주의, 공익, 존엄성, 생산성의 윤리 5개요인 23문항으로 확인되었다. 이 척도는 적합한 구조(χ2=420.151, df=220, p=.000, GFI=.996, NFI=.979, TLI=.960, CFI=.978, RMSEA=.055)를 갖는 것으로 나타났다.

현대사회와 한국 전통사상의 의의 - 근현대 인문학 사회과학에 대한 진단을 중심으로 - (Contemporary Society and the Meaning of Korean Traditional Thoughts)

  • 근현대 인문학과 사회과학은 근현대인들의 이상이었던 '자유와 풍요' 를 뒷받침했다. 그런데 오늘날의 '자유와 풍요'는 '사람다움'을 담보하지 못하며, '지속 가능한 것'도 못된다. 따라서 우리는 오늘날의 삶과 문명의 방향에 대해 다시 성찰해야 한다. 본고는 그 일환으로 근현대 인문학과 사회과학의 조류에 대해 진단하고, 한국의 전통사상이 지니는 의미를 살핀 것이다. 한국의 전통사상이 우리에게 제시하는 노선은 '천지인 삼재'와 '영육쌍전' 및 그에 입각한 '진정한 인도주의'로 요약할 수 있다. 이러한 노선은 다음과 같은 두 맥락에서 자유와 풍요의 노선이 초래한 문제점을 극복할 수 있는 출발점이 될 수 있다. 첫째, 오늘날 자유와 풍요의 노선이 '땅의 요소' 또는 '육(肉)의 요소'에 치우친 것과 달리, 한국의 전통사상은 애초부터 '하늘의 요소'와 '영(靈)의 요소'를 함께 주목하였으며, 따라서 이는 '진정한 인도주의'의 노선이 될 수 있다. 둘째, '진정한 인도주의' 노선은 '배부른 돼지들의 무절제한 자유와 풍요'를 비판하고, 존엄한 인간이 되기 위한 응분의 절제를 추구하는 것이므로, 그만큼 '지속 가능성'이 커진다.
