국제중재판정의 지연이자에 관한 고찰 (A Study of Delay Interest in International Arbitral Awards)

  • Awarding interest in international arbitration remains one of the most challenging areas for tribunals and parties given the myriad of issues that arise. This article seeks to provide an overview of how international arbitral tribunals grant delay interest. It reviews the various issues that international arbitral tribunals face concerning pre-award and post-award interest, determining the appropriate interest rate, surrounding simple or compound interest, and the complex issue of choice of law. A comparative context is provided by surveying the laws of major jurisdictions from both the common law and civil law and the regulations of leading arbitral institutions. It concludes with a review of the law, jurisprudence, and practice in Korea related to delay interest and how Korean tribunals under the KCAB Domestic and International Rules have determined delay interest in recent years.

Delay Factors Affecting the Completion of the Government Construction Projects in Vietnam

  • The delay in construction is the challenge often faced in the course of executing construction projects. To the government projects, the delays become very serious. This problem directly affects the lives, social welfare of the people, and the other negative social impacts. However, the government projects have not been much interest. The questionnaire surveys in Vietnam were conducted to determine the causes of the delay and to find solutions for dealing with the delay. The average index was used to rank the delay factors and the solutions. This study identified the 5 most highly ranked delay factors and the 8 best solutions from a list of 31 delay factors and 19 solutions for the delay. The five most highly ranked delay factors were: information delays and lack of information exchange between the parties; incompetent owner; incompetent supervision consultant; incompetent contractor; and difficulties in financing project by owner. The findings of the study can help the parties involved the government construction projects and practitioners to give appropriate strategies for countering the delay in their projects.

A STUDY OF TROPOSPHERIC EFFECT ON HIGH PRECISION GPS HEIGHT DETERMINATION

  • Constantly enhancing positioning accuracy by the Global Positioning System (GPS) technique is of great importance, but challenging, especially after the GPS positioning technique has been improved considerably during the past two decades. The associated main error sources have been reduced substantially, if not eliminated. Troposhpeic influence with its highly temporal and spatial variability appears to be one of the major error sources. It is hence an increased interest among GPS researchers to reduce the tropospheric influence or delay. Two techniques have been commonly implemented to correct the tropospheric impact. The first technique, known as parameter estimation, characterizes the path delay with empirical models and the parameters of interest are determined from the GPS measurements. The second strategy, termed as external correction, involves independent path delay measurements. The present study is an integration of both techniques in which the parameter estimation as well as external correction are used to correct the path delay for $110{\sim}210$ km range baselines. Twenty-four parameters have been obtained in 24 hours solution by setting the cutoff angle at 3 and 15 degrees for parameter estimation strategy. Measurements from meteorological instruments and water vapor radiometer (WVR) are applied in the GPS data processing, separately, as an external strategy of present research work. Interesting results have been found, indicating more stable repeatability in baseline when the external correction strategy is applied especially with the inclusion of WVR observations. The offset of an order of 1 cm is found in the baselines determined by the two strategies. On the other hand, parameter estimation exhibits more stable in terms of GPS height repeatability. The offset in the GPS height determined by the two strategies is on the order of few centimeters.

Measurement Scheme for One-Way Delay Variation with Detection and Removal of Clock Skew

  • One-way delay variation (OWDV) has become increasingly of interest to researchers as a way to evaluate network state and service quality, especially for real-time and streaming services such as voice-over-Internet-protocol (VoIP) and video. Many schemes for OWDV measurement require clock synchronization through the global-positioning system (GPS) or network time protocol. In clock-synchronized approaches, the accuracy of OWDV measurement depends on the accuracy of the clock synchronization. GPS provides highly accurate clock synchronization. However, the deployment of GPS on legacy network equipment might be slow and costly. This paper proposes a method for measuring OWDV that dispenses with clock synchronization. The clock synchronization problem is mainly caused by clock skew. The proposed approach is based on the measurement of inter-packet delay and accumulated OWDV. This paper shows the performance of the proposed scheme via simulations and through experiments in a VoIP network. The presented simulation and measurement results indicate that clock skew can be efficiently measured and removed and that OWDV can be measured without requiring clock synchronization.

GPS 신호의 대류층 지연 예측을 위한 보정모델의 비교 (A Comparison of Correction Models for the Prediction of Tropospheric Propagation Delay of GPS Signals)

  • GPS의 SA 해제 이후, 상대적으로 비중이 작았던 대기층지연, 다중경로(Multipath) 등 모델링 연구를 통하여 측위 정확도를 보다 향상시킬 수 있는 오차요인의 보정에 관심이 모아지고 있다. 본 연구는 Goad&Goodman, A&K, Hopfield 및 Sasstamoinen 보정모델에 의한 대류층 지연량의 예측은 물론 천정방향의 지연량에 Niell, Chao 및 Marini 맵핑 함수를 적용한 조합 프로그램을 작성하여 기상센서가 운용되는 특정 관측소의 기상자료를 적용하고 GPS 위성의 고도 변화에 따른 대류층 신호 지연량의 변화와 보정모델 및 맵핑 함수의 조합에 따른 지연량의 변화 양상을 비교.고찰한 것으로 특히, 고도각이 $10^{\circ}$ 이하인 저고도 GPS관측자료의 대류층 지연보정시, 천정방향 보정모델과 맵핑 함수의 조합 및 맵핑 함수의 특성 등을 고려하여 보정함이 타당할 것으로 사료되었다.

  • 드모르간 및 재대입 논리변환은 unate gate network (UGN)을 보다 일반적인 balanced inversion parity (BIP) network으로 전환하는데 충분하다. 이러한 회로계층에 대해서도 자세히 논의하고 있다. 우리는 드모르간 및 재대입 논리변환이 경로지연고장 테스트집합을 유지한다는 것을 증명하였다. 본 논문의 결과를 이용하여 함수 z를 구현하는 모든 UGN에서 모든 경로지연고장을 검출하는 상위수준 테스트집합은 함수 z의 어떠한 BIP realization에서도 모든 경로지연고장을 검출한다는 것을 보일 수 있다.

  • In this paper we have considered a nonautonomous predator-prey model with discrete time delay due to gestation, in which there are two prey habitats linked by isotropic migration. One prey habitat contains a predator and the other (a refuge) does not. Here, we have established some sufficient conditions on the permanence of the system by using in-equality analytical technique. By Lyapunov functional method, we have also obtained some sufficient conditions for global asymptotic stability of this model. We have observed that the per capita migration rate among two prey habitats and the time delay has no effect on the permanence of the system but it has an effect on the global asymptotic stability of this model. The aim of the analysis of this model is to identify the parameters of interest for further study, with a view to informing and assisting policy-maker in targeting prevention and treatment resources for maximum effectiveness.

Multihop Vehicle-to-Infrastructure Routing Based on the Prediction of Valid Vertices for Vehicular Ad Hoc Networks

  • Multihop data delivery in vehicular ad hoc networks (VANETs) suffers from the fact that vehicles are highly mobile and inter-vehicle links are frequently disconnected. In such networks, for efficient multihop routing of road safety information (e.g. road accident and emergency message) to the area of interest, reliable communication and fast delivery with minimum delay are mandatory. In this paper, we propose a multihop vehicle-to-infrastructure routing protocol named Vertex-Based Predictive Greedy Routing (VPGR), which predicts a sequence of valid vertices (or junctions) from a source vehicle to fixed infrastructure (or a roadside unit) in the area of interest and, then, forwards data to the fixed infrastructure through the sequence of vertices in urban environments. The well known predictive directional greedy routing mechanism is used for data forwarding phase in VPGR. The proposed VPGR leverages the geographic position, velocity, direction and acceleration of vehicles for both the calculation of a sequence of valid vertices and the predictive directional greedy routing. Simulation results show significant performance improvement compared to conventional routing protocols in terms of packet delivery ratio, end-to-end delay and routing overhead.

최대 지연지터의 허용이 서비스 품질에 미치는 영향에 대한 분석 (An Analysis of Service Quality affected by Allowing Maximum Delay Jitter)

  • 멀티미디어 동기화의 주요 관심은 미디어내 동기화에서의 지터와 미디어간 동기화에서의 스큐를 어떻게 해결하는 것인가이다. 멀티미디어 응용 소프트웨어를 효과적으로 개발하기 위해서 시간적 미디어와 공간적 미디어를 혼합하여 표현할 수 있는 멀티미디어 동기화 모델을 제안한다. 제안한 논문은 미디어간 동기화에 대한 QoS 처리를 위하여 네가지 파라미터를 이용하였고, 상대적인 지속시간 알고리즘과 지터 보상시간 알고리즘을 제시하였다. 그리고 키 매체가 손상이 되었을 때 키 매체의 최대 지연 지터 값만큼 기다림으로써 키 매체 이외의 매체에 최대 지연 지터 값만큼 추가적으로 재생할 수 있도록 하였다. 최대 지연 지터 값의 적용은 서비스 품질을 향상시키는 결과를 가져왔다.
