  • On 12 October 2017, the English Royal Courts of Justice delivered its decision about air carrier's compensation liability for the flight delay. In the cases the passengers suffered delays at a connecting point and, consequently, on arrival at their final destination. They claimed compensation under Regulation 261/2004 (the "Regulation"), as applied by the Court of Justice of the European Union (the "CJEU") in Sturgeon v. Condor [2009]. The principal issues were whether delays suffered by the passengers during the second leg of their respective journeys were compensable under the Regulation, whether there was jurisdiction under the Regulation and whether the right to compensation under the Regulation is, insofar as non-Community air carriers are concerned, excluded by virtue of the exclusive liability regime established under the Montreal Convention 1999. The passengers, the plaintiff, argued that the relevant delay was not that on flight 1 but that suffered at the "final destination". They maintained that there was no exercise by the EU of extraterritorial jurisdiction as the delay on flight 2 was merely relevant to the calculation of the amount of compensation due under the Regulation. The air carrier, the defendant, however argued that the only relevant flights for the purpose of calculating any delay were the first flights (flights 1) out of EU airspace, as only these flights fell within the scope of the Regulation; the connecting flights (flights 2) were not relevant since they were performed entirely outside of the EU by a non-Community carrier. Regarding the issue of what counts as a delay under the Regulation, the CJEU held previously on another precedents that the operating carrier's liability to pay compensation depends on the passenger's delay in arriving at the "final destination". It held that where the air carrier provides a passenger with more than one directly connecting flight to enable him to arrive at their destination, the flights should be taken together for the purpose of assessing whether there has been three hours' or more delay on arrival; and that in case of directly connecting flights, the final destination is the place at which the passenger is scheduled to arrive at the end of the last component flight. In addition, the Court confirmed that the Regulation applied to flights operated by non-Community carriers out of EU airspace even if flight 1 or flight 2 lands outside the EU, since the Regulation does not require that a flight must land in the EU. Accordingly, the passengers' appeal from the lower Court was allowed, while that of air carrier was dismissed. The Court has come down firmly on the side of the passengers in this legal debate. However, this result is not a great surprise considering the recent trends of EU member states' court decisions in the fields of air transport and consumer protection. The main goal of this article is to review the Court's decision and to search historical trend of air consumer protection especially in EU area.

  • As open skies polices have permeated all over the world, Korea's basic direction of aviation policy is promoting the benefit of the public and the national carriers' competitive power by establishing open skies agreements between the countries. The open skies' directions should be promoted by considering the relationships of various attributes such as governments, airlines, and passengers. To decide the right directions of open skies, we should investigate the economic effects of open skies policies. This research develops a simulation model to analyze the dynamic characteristics of open skies. By using the developed model, this research analyzes the economic effects of open skies. The results showed that open skies have direct impacts on not only frequencies, airfare, consumer welfare but also air transport industry and regional economy. Therefore, it is necessary to take suitable aviation policy that can increase the effects of open skies.

  • The hand performs functions such as grabbing and other movements. In order to accomplish these movements in various kinds of operational environments, appropriate gloves must be worn to protect your hands. Choosing the appropriate type of glove is very important when wearing gloves in these types of operational environments. The reasons one wears gloves varies depending on age and gender. Unmarried women in their early twenties, for example, occasionally wear gloves for decoration rather than for functional reasons. However, previous studies examined a range of topics, and as such investigations dealing with specific body shape and demands of consumer are needed. Therefore in this study, the hands of unmarried women ranging in age from 20 to 24 were measured and hand shape types were analyzed in order to present basal data which can be used to help design improved glove patterns and produce appropriate, functional gloves. A total of 261 Korean women were measured. Fifty-seven right hand dimensions were measured and five dimensions from both hands were measured. Six factors were identified through factor analysis and those factors constituted $73.259\%$ of total variance. Two clusters of hand shapes were categorized using 6 factor scores by cluster analysis. Type 1 hand shape is defined as long hands with small width, girth, and thickness, long and thin fingers, and high vertical palm height. Type 2 hand shape is defined as short hands with large width, girth and thickness, short fingers, thick knuckles, and short vertical palm height. The characteristics of type 1 and 2 hand shapes are similar to women's hand type classification results from previous reports, but there was a significant difference in subject distribution by type. Therefore, standard data on hand shapes should be produced by developing measuring instruments and selling more accurate standard measuring points. By doing this it could help in the development of improved glove patterns, and also aid in planning production based on hand type.

Merchandising and the marketing strategies of traditional liquor are also addressed. The data was collected through a questionnaire survey given to 101 CEOs of traditional liquor manufacturers. The major results of this study were as follows: The management types of traditional liquor manufacturers were classified as the company 57 (56.4%), the corporation or the union 29 (28.7%), domestic industry 10 (9.9%), and marketing community or technology center 5 (5.0%). The competitive power degree of traditional liquor products was classified as strength 30 (31.6%), usual 30 (31.6%), weakness 35 (36.8%). The elements of strong competitive power were taste, functional (wellbeing) character, and attractiveness of the brand name. On the other side, reasons for weakness in competitive power were the marketing system, price competitiveness, and advertisement. The trademark registration of the traditional liquor appeared with 53%. The reasons not to pursue a trademark registration included the complicated and unnecessary process of registration acquisition, high registration expenses, etc. The perceptions of CEOs about the consumer's brand awareness for their product were low with an average 2.97. Explanations included insufficient advertisement and public relations, unrefined trademark design, and the meaninglessness of brand names. • The purpose of this study was to investigate differences in the perception and attitudes of middle school students toward food safety between those who possess high behavioral intentions to prevent contracting a foodborne illness and those who do not. The survey collected 871 usable data from several middle schools in Seoul, Korea in July 2007. Using six behavioral intention measurement items, a two-step cluster analysis approach was conducted resulting in a strong intention group and a weak intention group. Perception and attitudes toward foods safety were different between the two groups. Students with strong behavioral intentions to prevent foodborne illness tended to possess a stronger perception and attitude toward various food safety issues. Students with strong intentions were more certain of consumer's right to purchase safe foods, more concerned about foodborne illness and food safety, believed that the government should put more efforts toward establishing a safe food chain, possess more distrust for food suppliers, were more aware of specific foodborne illness pathogens, had more food safety education/training, and washed their hands more frequently than those with less strong intentions. No significant differences were found between the groups but, overall, chemical residues and food additives were perceived as more harmful and more serious food safety issues than those of foodborne illness pathogens despite that microorganisms are the main cause of foodborne illness outbreaks in schools. Participants seemed to underestimate the importance of temperature control for preventing foodborne outbreaks. Several implications and suggestions on how to improve the behavioral intentions of middle school students to prevent possible foodborne illness were provided.

  • Chinese cabbage, Braccica campestris has long been consumed as a staple food for Koreans in various forms of fresh, salted, and fermented Kimchi. Cultivation of the crop under greenhouse has become a general practices to fulfill its off-seasonal consumer's demand. However, agricultural practices of the crop have always accompanied with heavy applications of pesticides caused by severe outbreaks of diseases and pose under warm and humid circumferences. Since dissipation patterns of pesticide residues in/on the crop under greenhouse conditions ate quite different from those in the open-air, changes of diazinon, O,O-diethyl O-2-isopropyl-6-methylpyrimidin-4-yl phosphornthioate, in/on the Chinese cabbage applied by foliar spraying under greenhouse were studied. Diazinon 34% EC was applied with dilution of recommended and double dose to the crop. The shoots of crop were harvested immediately after this application and at regular intervals over a 10-day. After sample preparations, the diazinon residue was analyzed using gas chromatography equipped with electron capture detector (GC/ECD). Initially deposited amount of the chemical in/on the crop right after applications with recommended and double doses were 8.3 and 15.2 mg/kg, respectively. The residue levels after 10 days of application were 0.03 and 0.09 mg/kg with 1.3 and 1.5 days of half-life in/on the crop, respectively. In consequent 10 days of pre-harvest interval (PHI) for diazinon EC formulation in/on Chinese cabbage under greenhouse condition was fulfill maximum residue level set by Korea Food and Drug Administration (KFDA, 0.1 mg/kg).
