A Comparative Study on the Foreign Corrupt Practices Act (FCPA) and Article 21.6 of the KORUS FTA (미국 해외부패방지법(FCPA)과 한미 FTA 제 21.6 조 비교연구)

  • Numerous discussions on the KORUS FTA has been centered around issues on trade in goods, services, or dispute settlement mechanisms. On the other hand, little attention has been given to Chpater 21 of the KORUS FTA on transparency, especially Article 21.6 which states about anti-corruption. Article 21.6 and the Foreign Corrupt Practices Act shares the common purpose to prevent corruptive business practice, and they show similarities in many aspects. The FCPA enforcement has dramatically increased over the past ten years by the U.S. Department of Justice and Securities Exchange Commission stretching its jurisdiction to foreign nationals and companies. Korean business professionals and corporations are exposed to both Article 21.6 and the FCPA on corruption issues. Thus, it is imperative to understand Article 21.6 to be equipped with anti-corruption compliance programs. This paper examines the FCPA and Article 21.6 through comparative analysis and proposes appropriate measures for Korea to take.

Well-Structured Inter-Oranizational Workflow Modeling for B2B e-Commerce

  • Today's enterprises take processes beyond their own organizational boundaries in order to electronically trade goods and services with partners under the concept of B2B e-commerce. In this environment, inter-organizational business processes are required and should be well defined not only in public processes between partners but in private processes within individual partners. For this purpose, we propose the method to represent inter-organizational business processes. First of all, a feasible modeling method for the inter-organizational workflow for B2B e-commerce is developed. This method is proposed based on BPSS in ebXML so that the binary and multiparty collaborations share a common process. In this method, message flows and control flows are separated in order to facilitate the design procedure of the inter-organizational workflow process. Second, a well-structured process modeling algorithm to design a well-structured inter-organizational workflow process is proposed. In the algorithm, a process is transformed to a Petri-net-based process model. This algorithm employs well-behaved modeling blocks, well-behaved control structures, and business transactions to develop well-structured process models by a top-down design.

A Case Study on Swine Farms for the Planning of Gnotobiotic Pigs' Facility - Focused on Space Organization and Circulation System - (무균돼지 사육시설 계획을 위한 사례연구 - 공간구성 및 동선계획을 중심으로 -)

  • According to the increase of demand for human organs such as kidney, heart, pancreas, joint, and cornea for therapeutic transplantation, the production of alternative organs based on Gnotobiotic Pigs gains a lot of concerns all over the world. However, it is not common to design and build Gnotobiotic Pigs' facility, and there are only a few those facilities and planning principles for them. Considering the situation above, this paper tries to develop planning guidelines for space organization and circulation system of standardized Germ Free Pig's facility on the bases of case analysis. The results of this study are as follows. At first, four swine farms including a Gntobiotic Pig's facility has been analysed from the point of space organization and circulation system. Secondly, the space zoning of Gnotobiotic Pigs' facility has been proposed into 5 groups : pigs' area, adminstration area, operating room and laboratory, service area, and mechanical area. Space components of each group have been presented also. Finally, circulation system of Gnotobiotic Pigs' facility has been explored from a operational point of view. This, also, includes human circulation, pig's circulation, and goods' circulation. This study has some limitations because it does not consider the SOPs(standard operational policies) of that facility to the fullest measure and does not suggest space area of each part, either. Despite of some weaknesses, it is expected that this study can give some useful guidelines for the design and planning of Germ Free Pigs' facilities.

A Study on Recognition and Preference of Korean Foods for Foreigners in Different Nationality (국내 체류 외국인들의 출신지역에 따른 한식에 대한 인지도 및 선호도 연구)

  • The study investigated the recognition and preference of foreigner to Korean foods in different nationality. Questionnaires consisted of two languages- Chinese and English were given to 180 residing foreigners in Insa-dong and COEX mall areas and interview methods were used. A total of 157 questionnaires were analyzed for statistical analysis. The statistical analysis was completed using SPSS Win(ver 11.0) for descriptive analysis, ${\chi}^2-test$, ANOVA and Tukey's test. Main results of this study were as follows: First, the factors foreigners considered when they chose food of other countries were; 1.new taste, 2.curiosity, 3.foreign culture, 4.foreign tradition. People from European and Asian countries were inclined to 'New taste' first, while people from American and Oceanian countries were inclined to "curiosity". Second, most of respondents have tried Bulgogi and Galbi before and many of them also have tried Kimchi, Kimbop, and Bibimbop as common Korean foods. Third, the preference was different according to their origins. Asian people liked diverse cuisines including Bulgogi, Galbi, Kimchi, Dubu Doenjan chige, and Samgaetang, while European and Oceanian people liked Bulgogi, Galbi, and Bibimbop. The preference for Kimchi was considerably high among Asian people, however, low among American and Oceanian people(p<0.05). Fourth, Deviation was little on the taste, color, and table settings of Korean foods; most of the respondents was satisfied on those factors. European and Oceanian people who were familiar with table setting according to time were satisfied at table setting of Korean foods, which focused on space, rather than time. Fifth, most of the respondents, especially Asian people, remarked that Korean foods were spicy. The opinion on the taste of Korean foods was variable according to their nations. Currently many of culinary companies from Korea were leading their active business in foreign countries such as China and United States. Their domain was not limited to traditional Korean foods, but expanding to various fields such as fast foods, bakery goods, and fusion snacks.

Compliance and Need Assessment for Diet Therapy among Diabetics and Their Caregivers (당뇨환자와 보호자의 당뇨식사요법 실천과 요구도 조사)

  • The purpose of this study was to investigate the compliance and need for diet therapy among diabetics and their caregivers. A total of 625 respondents participated in this survey. Appropriate management for long-term blood glucose control and difficult-to-manage cases appeared to be diet therapy, physical activity, medical treatment and folk remedies, in that order. The most important educational avenues for diet therapy were books, magazines and TV, Most respondents were educated in diet therapy within a year after diagnosis and had practiced diet therapy for over four years. The most common diet therapy Practices were food selection and Quantity control. Of the specific problems in practicing diet therapy, time and labor, taste, and meal planning appeared to be equally difficult factors. The prevailing diet therapy skills were controlling food amounts at breakfast and supper, and selecting food for lunch and refreshments. Respondents practicing both skills were about 20% of the participants; this shows the need to improve the current situation. The nutrients most frequently considered in diet therapy practice were simple sugars (sugar and sweet goods) , total fats and cholesterol. Since the perception of the role of dietary fiber among respondents was very low, nutrition education about the importance of dietary fiber and food sources of dietary fiber was needed. Diabetics seemed to be concerned about diabetic menus. Three difficult problems in planning diabetic menus were daily menu planning, patient's preferences, and the calculation of calories. As a means of nutrition counseling, they preferred interviews. The higher the educational status and the lower the age, the higher the preference was for internet or PC counseling. Therefore, it is necessary to develop nutrition educational programs so that diabetics can obtain practical knowledge of diet therapy. Furthermore, it is also necessary to develop additional means of informing diabetics about menu planning, while still considering Korean dietary behavior.

  • Nowadays, mobile commerce is having an increasingly profound impact on our daily lives, and offer interesting and advantageous new services. Mobile payment is an emerging and important application of mobile commerce in smart work, enabling users to use their mobile devices (especially mobile phones) for paying goods and services wherever they go. The appearance of m-payment is expected to provide us a convenient and bright future to enjoy. That is the common trend on over the world, but in Vietnam, although the number of smart phone users has been increasing rapidly, the adoption of m-payment system still didn't succeed completely. The research reviewed literature regarding mobile payment services, analyzed the impact of customer characteristics and system characteristics on m-payment adoption in Vietnam. To analyze the adoption behaviors of m-payment users, m-payment research model which consists of three customer-characteristics (m-payment trust, personal innovativeness, m-payment knowledge) and four m-payment system characteristics (mobility, reachability, convenience, compatibility) were studied. The results indicate that perceived usefulness, trust, and compatibility are the important predictors to the intention to use m-payment. This study will assist m-payment services suppliers in implementing appropriate business models and service strategies to successfully attract customer to use m-payment in Vietnam, allowing managers to exert appropriate investment, time, and effort for m-payment system development in designing smart working.

Assessment of the Korean-Chinese Exports Competition in Sophisticated Markets

  • Purpose - This paper empirically investigates the competition effect of exports between Korea and China in their common-export markets considering market sophistication. Modern market sophistication includes an importing country's aggregate demand for products of high quality, design, novelty, eco-friendliness, and even IPR protection. Using an empirical analysis to identify the demand for product quality across countries, this paper estimates the effects of market sophistication on the competition between Korean exports and Chinese products. Design/Methodology - Our empirical model considers the relationship between an importing country's consumer sophistication and the export competition between Korea and China. This study employs the existing theoretical framework to identify the aggregate demand for product quality across countries. Using a quite direct measurement (the consumer sophistication index, our analysis investigates the differential effects of Korea's export market sophistication, particularly in markets where Korean exports are in competition with similar Chinese products. Findings - Our main findings can be summarized as follows: the negative effects of the export competition between Korea and China on Korea's exports are stronger in third markets where consumers are less sophisticated while the effects are not as pronounced in markets where consumers are more sophisticated. This result, however, best applies to differentiated goods which significantly vary in product quality. Originality/value - Existing studies focus on the supply side of production and make the assumption that the market preference for export quality is identical across countries. This paper attempts to evaluate the export competition between Korea and China from the demand-side perspective. This area of trade studies is underexplored both empirically and in theory, although the issue has long been important to Korean and world trade.

  • Objectives : Daily Dose of Apricot Kernel in Treatise on Cold Damage Diseases is usually written in the number, sometimes in the volume. The seed coat and acute end of Apricot Kernel must be removed, so author want to know its daily dose and proportion of seed coat and acute end. Methods : Assuming dosage by editions of Treatise on Cold Damage Diseases. And comparing it with measured weight of Apricot Kernel distributed in market. Results : The number of prescriptions including Apricot Kernel is ten, and eight of that are made to decoction, two of that are made to pill prescription. And two of decoction are made by reducing and uniting prescriptions. The daily dose of six decoction are 70, 47 or 35 in numbers. The 70 Apricot Kernel except seed coat and acute end are 1/2 Sheong ($33m{\ell}$) in volume, 3 Ryang (19.5 g) in weight. Weight of Apricot Kernel the most common in market is 0.28 ~ 0.38 g. 70 Apricot Kernel are 23.10 g, seed coats of that are 1.15 g, acute ends of that are 2.43 g, 70 Apricot Kernel except seed coat and acute end is 19.5 g. So, seed coat is 5%, acute end is 10% by proportion, which is the same with it assumed based on writings. Conclusions : 70 Apricot Kernel except seed coat and acute end are 1/2 Sheong, 3 Ryang, and it is 33 mL and 19.5 g respectively. It also correspond with current market goods.

Three-dimensional finite element analysis of the interference of adjacent moving trains resting on a ballasted railway track system

  • High-speed trains became common nowadays due to the need for fast and safe mean to transport goods and people. However, the use of high-speed trains necessitates the examination of the critical speed, which is the train speed at which the maximum settlement of the railway track occurs. The critical speed and railway track settlement have been investigated considering only one train in previous studies. However, it is normal to have two adjacent trains moving at the same time. This paper aims to understand how the interference of two moving trains affects the settlement and critical speed of ballasted railway track. Calibrated three-dimensional finite element models of railway track subjected to one moving train and two moving trains have been developed to address the aim of the study. It is found that the interference dramatically increases the railway track settlement with a percentage increase ranges between 5 and 100%. It is also found that the percentage increase of the railway track settlement depends on the train speed and the distance between the moving trains. In addition, it is found that the thickness of the ballast layer and the stiffness of the subgrade have minor influence on the percentage increase of the settlement. Importantly, the results of this paper illustrate the importance of the interference of the moving trains on the dynamic response of the railway track. Thus, there is a need to consider the dynamic interaction between the adjacent moving trains in the design of railway track foundation.

  • Traditional Industries were planning the major role for Taiwan's economy. However, we need to face the competition from developing countries. Moving manufacturing department to other low salary countries, such as China, can only temporarily release some limited pressure. The final and complete solutions are to equip on R&D, refine techniques, improve management capabilities, upgrade business, and reform physique. Currently there are some ERP systems on the market; however, they are designed for common purpose and difficult to introduce into industry. The expensive price is another factor to make them be popular. In this research we will Object Oriented, Visual Modeling, ER Model and Windows Environment to develop an Integrated Management System for Sports Requisites Industries (IMSSRI). We will integrate all information from all departments such as development, business, material administration, manufacture, shipping, and financial. When development people construct the all modules, components, cutting molds, materials and accessories, IMSSRI will calculate all needed materials and cost for each product. This cost will be used for quotation to report to our customers. When customers confirm the order, system will transfer all necessary materials into Material Administration System. IMSSRI can generate manufacturing forms and material raw lists for manufacture department. All related information such as stocking, returning goods, material requesting, and material returning can be integrated so we can control all details of the whole enterprise. Through the help of this system, we hope we can save man-power, reduce human mistakes, raise management capabilities for tradition manufacturing industries and create another possibility of eternal operating for Taiwan's Industries.
