법인 아닌 사단의 법률관계 (Legal Issues on the Association without Legal Personality)

  • 교회는 법인 아닌 사단으로 인정되는 단체 중의 하나이며, 법인 아닌 사단에 관한 민법의 일반 이론에 따라 교회 실체를 파악하고 교회의 재산귀속에 대해서 판단한다. 법인 아닌 사단의 내부관계는 일차적으로 정관의 적용을 받고 정관의 규정이 없는 경우에는 총회 결의와 민법의 사단법인에 관한 규정을 유추적용하게 된다. 법인 아닌 사단의 채무에 대해서는 사원의 준총유이다(제275조, 제278조). 지난 50여년 동안 대법원 판례는 법인 아닌 사단인 개신교 교회에 대하여서만은 일반적인 법리와는 달리, 교회의 분열을 허용하고 분열시의 재산관계는 분열당시의 교인들의 총유라고 판시했다. 새로운 판례(대법원 2006. 4. 20. 선고 2004다37775 전원합의체판결)는 법인 아닌 사단의 분열은 허용되지 않으므로 비법인 사단의 분쟁해결을 위해 대법원은 종전의 분열인정에서 부인하는 쪽으로 판례를 변경한 것은 분쟁을 해결해야 한다는 당위성이 반영된 것으로 이해된다.

국내 교복브랜드 TV 광고에 나타난 상징적 의미 분석 -2000년 이후 광고를 중심으로- (Symbolic Meanings of The TV Commercials for Korean School Uniforms -Focus on CF Since 2000-)

  • The purpose of this study is to analyze the various signs seen on TV commercials for school uniforms since year 2000, thus uncovering the connotative meanings in them. For this study, the semiotic approach has been used. The signs seen on the TV commercials are separated into linguistic and visual signs. They are found to have symbolic connotations. The results are as follows: First, there are plenty of signs expressing the sense of belonging to the student group and sense of conformity to his or her peer group. They are intended to garner their collective identity in the peer group of teenagers. Second, the TV commercials express the self that is realizing one's value dynamically. The frequent designation of 'I', 'me' and 'myself' represents that I am at the center of the world. Furthermore, the suggestion of diverse student roles beyond mere academic pursuits symbolically shows the ideal self that most teenagers wish to have. Third, the TV commercials implied a commercial ideology. That is expressed in the emphasis on aesthetic value that teenagers can realize their self only by consuming expensive school uniform brands. Forth, there are many signs related to appearance and appearance care. They are expressed with very specific signs such as 3 : 7 proportion, long legs, small face, and so on. Repeating or emphasizing the importance of looks and a certain brand name as the tool to accomplish better looks indicates that it contains the ideology of appearance management.

한국 병원 최고 경영자의 책무성 인식 : 심층 면접 결과를 중심으로 (Perception of Korean Hospital CEOs on Organizational Accountability : Findings from In-Depth Interviews)

  • As misalignments among images, identity, and legitimacy of health professionals and institutions have been on the rise, CEOs of health care organizations have been required to enhance organizational accountability. Despite the accumulation of literature on the conceptual discussions of accountability, only a few studies empirically investigated key barriers to accountability and its facilitators. To identify perception on accountability with key barriers and facilitators of organizational accountability, a semi-structured interview with 11 CEOs of Korean hospitals was conducted. A short survey was taken to get quantitative data on CEO's perception on organizational accountability. To CEOs, accountability was very complex and unfamiliar concept, but understood as physician's code of ethics by nature and basic principle of hospital management. CEOs thought accountability could be improved through ethical leadership, financial stability and learning climate of hospitals. Distrust of the government, which failed to provide economic incentives for hospitals to increase accountability activities, was emphasized as a serious barrier to hospital accountability. There was consensus among hospital CEOs as to the importance of accountability in management. However, there were concerns that, without policy instruments to motivate hospitals toward increasing community benefits as well as collective efforts among health professionals to rebuild moral climate for being accountable, greater accountability would not be achieved in hospitals.

웹 생태박물관을 활용한 문화유산의 기록과 보존 : 무등산을 중심으로 (A Record and Conservation of Cultural Heritages through Web Ecomuseum : the Case of Mountain Mudeung)

  • 1968년 프랑스에서 출현하여 전 세계로 널리 확산된 생태박물관은 유물의 소장 전시보다 어떤 지역의 자연 문화유산 전체를 '본래의 장소에서' 보존 해석하여 그 지역의 장소적 의미를 찾고 주민의 참여와 지역 공동체의 발전을 도모하는 것을 목적으로 하는 새로운 유형의 박물관이다. 이 박물관이 갖는 의의는 사라져가는 지역의 집단 기억을 회복하여 주민의 문화적 정체성을 되찾고 낙후된 지역을 활성화하는 데 있다. 그런데 이 박물관은 분산형 야외박물관인 경우가 많기 때문에 흩어져있는 지역 유산 전반에 대한 원격 정보 제공과 종합적 해석이 가능하도록 유산을 디지털화하여 기록 보존 해석 활용하는 '웹 생태박물관'이 필요하다. 본고에서는 무등산이라는 지역을 예로 들어 웹 생태박물관의 가능성과 그 구성 내용 방법에 대해 고찰하였다. 특히 후자에 대해서는 지역 고유의 주제를 선정하여 관련 유산을 토대로 디지털 아카이브를 구축(기록 보존)하고, 웹 전시를 개최(해석)하고, 전자문화지도를 제작(활용)하는 방안을 제시하였다.

공감(compassion)이 업무성과에 미치는 영향 : 질적 연구를 통한 연구모형 개발을 중심으로 (The Effect of Compassion on Job Performance: Focusing on the Creating Research Model through Qualitative Research)

  • 본 연구의 목적은 질적 연구의 방법으로서 근거이론에 기반 하여 소방대원들이 조직 내에서 경험하는 핵심범주들의 인과관계를 연구모형을 통해 밝히는 것이다. 본 연구에서는 2014년, 2017년, 그리고 2018년에 걸쳐 서울지역에서 근무하는 50명의 소방대원 정보제공자들을 인터뷰하였고, 개방코딩, 축코딩, 선택코딩의 과정을 거쳐서 핵심범주들의 인과관계를 보여주는 연구모형을 도출하였다. 연구결과 정보제공자들이 조직에서 경험하는 공감이 핵심범주로 드러났고, 이러한 공감이 긍정적 업무관련 정체성, 집단적 자긍심, 그리고 업무성과에 긍정적인 영향을 미치는 것으로 밝혀졌다. 따라서 본 연구의 이론적 시사점은 질적 연구 방법론으로서 근거이론에 기반 하여 공감과 업무성과 간의 인과관계를 보여주는 연구모형을 도출했다는데 있고, 향후 소방서 조직 내에서 공감을 절실히 필요로 하는 소방대원들이 더욱 활발히 공감적 행위를 서로 주고받을 수 있도록 하는 조직문화 형성에 기여하게 될 것이다.

한국어의 탈지역과 한국적 이산의 미학 (Displacement of the Korean Language and the Aesthetics of the Korean Diaspora)

  • Korea has persisted in the notion of "ethnic nationalism." That is "one race, one people, one language" as a homogeneous entity. This social ideal of unity prevails, even in overseas Korean communities formed by voluntary and involuntary displacement in the turmoil of modern history: communities made intermittent with the Japanese colonial occupation and with postcolonial encounters with the West. Given that the Korean people suffered from the trauma of deprivation of the language caused by the loss of the nation, nation has been equated with the language. Accordingly, "these bearers of a homeland" are also firm Korean language holders. The linguistic patriotism of unity based on the intertwining of "mother tongue" and "father country" has become prevalent in the collective memory of the people of the Korean diaspora. Korean American literature has grappled with this concept of the national history of Korea and the Korean language. The aesthetics of Korean American literature has been marked by an influx of literary resources of 'Korea' in sensibilities and structure of feelings; Korean myth, folk lore, songs, humor, traditional stories, manners, customs and historic moments. An experimental use of the Korean alphabet, Hangeul, written down as pronounced, provides an ethnic flavor in the midst of the English texts. Despite its national framework of mind, however, Korean American literature as an interstitial art reveals a keen awareness of inbetweenness, and transnational hybrid identities. By exploring the complex interrelationships of cultural and linguistic boundary-crossing practices in Korean American literature, this paper argues that the poetics of the Korean diaspora challenges the closed structure of identity formation, and offers a transnational sphere to deconstruct a rigidly demarcated national ideology of "one race, one people, one language," for the world literary history.

중국 90후세대의 세대적 특성과 패션 경향 (Generational Characteristics and Fashion Trends of China's Post-90s Generation)

  • In December 2019, when the novel coronavirus (nCoV) was identified in Wuhan, Hubei, China, the number of people belonging to post-90s generation among about 42,000 medical staffs personnel supporting Hubei was 12,000 or more, accounting for about 33.3% of the total number of personnel. The term "post-90s generation" generally indicates young people born from 1990 to 1999. The study scope is the 1990-2020 period between the birth of post-90s generation and present. Literature and empirical studies are performed. Generational characteristics and fashion trends shown only by post-90s generation through precedent studies and reports are as follows: First, generational characteristics of post-90s generation can be categorized into the following three characteristics: "sang wenhua", "collective loneliness", and "diversified identity". Second, fashion trends of the post-90s generation can be categorized into the following three characteristics: "new Chinese style fashion", "masstige fashion", and "de-labeling fashion". The above results show that the post-90s generation uses "culture" and "me" as keywords. Further, the above trend is consequently divided into the following two characteristics: "diversification" and "individualization". This is because the post-90s generation is directly affected by the reform and opening and the 9-year compulsory education policy of China compared to the previous generations; hence, these people are greatly influenced by Western culture and fashion as well as their own culture and fashion. It refers having a tendency to express one's individuality with a variety of tastes and styles.

인구통계적 응집성이 기업성과에 미치는 영향에서 HR 제도의 역할 탐구: 순환근무와 탄력근무를 중심으로 (The Roles of HR Practices in the Relationship between Demographic Cohesion and Firm Performance: Focusing on Job Rotation and Flexible Work Arrangement)

  • Purpose - The purpose of this study is to specify the relationship between demographic cohesion and firm performance by examining the roles of HR practices, such as job rotation and flexible work arrangement. Design/methodology/approach - This study samples 1,093 firms in Korea and collects their data between 2007 and 2017 from Workplace Panel Survey, a database from Korea Labor Institute. The demographic cohesion is measured using the Herphindal-Hershman index and the firm performance is measured with net incomes. This study employs a fixed-effects model for the estimation of firm performance with respect to demographic cohesion, job rotation, and flexible work arrangement. Findings - There is a positive relationship between demographic cohesion and net incomes. And the relationship is positively moderated by job rotation. However, flexible work arrangement shows a mixed moderation. Research implications or Originality - Differentiated from the studies on demographic diversity, this study shows that demographic cohesion has a mixed impact on firm performance. While demographic cohesion can improve firm performance through trust building, in-group favoritism, and collective identity it entails internal conflicts. However the link between demographic cohesion and firm performance is moderated by job rotation and flexible work arrangement. While there is a positive moderation of job rotation, there is a negative moderation of flexible work arrangement.

The Poetics of Overcoming: Christopher Dewdney's Transhumanism and Dionisio D. Martinez's Transnational Cultural Contamination

  • In an attempt to demonstrate in context of Nietzsche's "overman" (ubermensch) and Heidegger's "Being-in-the-World" (Dasein) the collective human efforts to overcome humanism in crisis, I will provide the ground for the poetics of overcoming, the ground which are based upon the double movements of transhumanism and transnationalism. For this purpose, I will turn to the theories of two distinctive poets who reveal and disreveal their truths about the subjecthood or the subjectivity in terms of overcoming: Christopher Dewdney for posthuman transhumanity and Dionisio D. Martinez for transnational cultural contamination Transhumanism represented by Christopher Dewdney manifests an interfusion of outside and inside, thereby collapsing the boundary between the mind and the world, and provides a breakthrough from the limitedly defined mind to the transhuman perspective of overcoming by using terminalogy and techniques from science and technology. The emerging transhumanism reflects the growing interdependence between humans and bio technologies, and suggests a potential improvement of human beings. The main argument of transhumanism is that we humans can and should continue to develop in all possible directions, by overcoming our human limitations by shedding the body and having the disembodied consciousness which will liberate our mind. Kwame Anthony Appiah's "cultural contamination" is another form of overcoming as well as a way to otherness, a counter-ideal of cultural purity which sustains authentic culture, reversing the traditional binary opposition between enriching authenticity and threatening hybridization. Dionisio Martinez's poetry sublimates the negative side of Appiah's concept of contamination, by redeeming the value of the Appiah's list of the ideal of contamination such as hybridity, impurity, intermingling, the transformation that comes of new and unexpected combinations of human beings, a bit of this and a bit of that is how newness enters the world. When a poetic subject is doubly exiled and doubly homeless away from his/her native homeland and home of native language, one has no more identification with the authentic culture of both home and away, but rather anticipates a new identity as a transnational subject to cross the bridge beyond cultural authenticity and to enter into the field of cultural contamination.

수감되어 있는 성폭력 가해자의 경험에 대한 현상학적 연구 (A Phenomenological Study on Experience of Sexual Offender in Prison)

  • 본 연구는 교도소와 치료감호소에 수감되어 있는 성폭력 가해자의 경험에 대한 연구로서 이론적으로는 성폭력 가해자의 경험의 본질구조를 살펴보고자 했고 실천적으로는 성폭력 가해자들의 재범을 막고 치료적 감호프로그램을 제공하기 위한 사회복지실천 개입의 근거 자료를 구축하고자 했다. 연구는 Van-Manen(1990)의 분석틀을 원용하여 해석학적 현상학적 방법으로 수행했고 연구에는 7명의 성폭력 가해자가 참여했다. 자료는 심층면담으로 수집했으며 해석한 결과는 다음과 같다. 여론의 피해자라는 인식, 카인의 표식, 견본생활(show window)로 인한 성찰기회의 상실, 구별짓기(distinction)를 통한 집단차별화, 허물을 벗고자 하는 형이상학적 존재의 발현, 과학적 관리기술의 역이용, 상상계(the Imaginary)로부터의 미분화(undifferentiation), 도치된 소통으로 나타난 성행위, 통제받음의 반동형성으로서 지배영역을 찾음, 아동의 성마저 상품화하는 자본주의 속성에서 자유로울 수 없음, 성정체성 사회화과정에서의 왜곡, 억눌린 욕망의 화신으로 각인된 부상, 상실된 어머니의 순결성 회복, 산산이 부서진 이름으로서의 가족 등으로 나타났다.
