  • As the cinematographic works are familiar to us, the infringement of the cinematographic works is also increasing. Because we are always able to be closely accessible to the cinematographic works through the Internet, this phenomenon easily occurs across the genre of the cinematographic works or the borders. The case is typical that the Music Video "Sonata of Temptation" infringes the copyrights of the Japanese Animation "Final Fantasy 7". When the two works are compared and analyzed, a considerable portion of similarity is found; we can even express that no new scene is exist except it that the singer sings in the Music Video "Sonata of Temptation". Because this situation is not only a dishonor to the indivisual but also a great loss to the nation, we should thoroughly prepare not to infringe others' copyright even unconsciously.

  • Article 29 in the copyright law of Korea, public performance and broadcasting for non-profit purposes will be revised. The copyright agency has tried to impose copyright fees on the use of cinematographic works such as DVDs in public libraries. The paper studied that the individual watching cinematographic works in public libraries is included in the concept of public performance in the copyright law. Also, the study conducted a survey on the situation of use of cinematographic works in public libraries. As a result of the study, watching DVDs in facilities for 1~3 persons in public libraries could be included in the concept of public performance. But the main purpose of most of DVD users was for circulation or reading. The library service for individual DVD watching will therefore not affect the commercial income of the copyright holders. Finally the study suggested that if the service for the individual watching of cinematographic works in libraries is included in the concept of public performance, the copyright law needs to be revised so that the service is included in the exception to the right of public performance.

Also, content analyses were conducted to make sense of copyright problems in libraries. As a result, this study found that problems of copyright had occurred in various aspects related to public performance, lending, digitization and internet services according to the diversity of facilities for watching cinematographic works and library services. Also, the librarians' questions to the copyright were very various from the primary level to specific level. This study suggested that regular courses of study in library schools need to be opened to primitive understanding to copyright law and occupational training programs for librarians need to be opened to complementary education as revisions of copyright law. This study also suggested that the online Q&A services need to be started for librarians who have detailed copyright problems.

  • Public Performance in Copyright Law is a wider concept, which people generally think. It includes the presentation of a work to the public by acting, musical playing, singing, narrating as well as even the act of mechanical playing phonogram and cinematographic work. Article 29 in Korean Copyright Act is the restriction of an author's public performance right. It shall be permissible to perform publicly or broadcast a work already made public for nonprofit purposes and without charging any fees to audience, spectators, or third parties, provided that the performers concerned are not paid any remuneration for such performances. Commercial phonograms or cinematographic works may be played back for the public, if no fee is charged to the audience or spectators, except in cases as set forth by Presidential Decree. In recent year, public performance in libraries became a major issue of the Copyright Law. It is a claim that watching cinematographic works in libraries is one of the act that should apply public performance right, thus to use commercial cinematographic works before six months, which was published, need permission to copyright owners. But this claim is unfair because it can make impossible normal library service. Thus there is a need to revise the Copyright Law to understand the difference between act of viewing and public performance in libraries.

  • This research investigates the causes of infringements related to authors' moral rights which has most conflict among moral rights of authorship, through analysis of judicial precedents and compare whether there subsists any differences in viewpoints between judicial precedent trend and those on behind the scene of broadcast production. Copyright is divided into intellectual property and moral rights of authorship. Right to the integrity of the work is part of moral rights of authorship and produce one content and used in various media. When the edit is needed to fit the organization and advertisement time, advanced consultation from the rightful owner or written consent is needed. However, under the time pressure or ignorance of copyright, the arbitrary edits are made and content is used. This infringes the right of the integrity of the work. When we produce and use cinematographic works and other audiovisual works, there are considerable variablilies stemming from authorship, production cost and program staff. Therefore, prior conscent is needed to acquire and use the copyright in a proper manner. However, due to production-oriented environment and low understanding of the copyright protection, we usually depend on the users' work practices rhather than insufficiency of copyright laws in dealing with the infringement of right to the industry. In conclusion, we need to provide meticulous work manual and to focus on systematic eduction of professional copyright manpower.

  • In this paper, we tried to find out what is the cinematographic reality conceived by André Bazin. To this end, we examined the process of his long exploration of realism, focusing on his film criticism. Through this, we read his deep concern that the film medium, which is more imitative than any other medium, would not become artistic but rather stimulating mimicry. When photographs or movies first appear, people have been interested in saving money by simply storing scenes in front of them or imitating stimulating scenes before realizing their artistic value. In this way, Bazin warned us that when the cheap pleasure derived from the simple imitation of fact is concatenated with the logic of capitalism, the film falls into a subordinate medium and drops the value of human beings indescribably. He therefore argues that cinema must transcend simple imitative dimensions by exploiting various abstract expressions in its own language. His works about the realism in cinema is meaningful in that the value of true realism of the movie is important to build up humanism today in respect that the movie raises extensively the logic of capitalism through visual pleasure.

  • A video-work story analysis system based on emotional state measurement includes a content provision unit which provides story content of a video-work, a display unit which displays content provided by the content provision unit, an emotional state measurement unit which measures a tense-relaxed emotional state of a viewer viewing the displayed story content, a story pattern analysis unit which analyzes the tense-relaxed emotional state measured from the emotional state measurement unit according to a scene in the story content provided by the content provision unit, and a story pattern display unit which prints out an analysis result or displays the analysis result as an image. The emotional state measurement unit measures a tense or relaxed emotional state through one or more analyses among a brainwave analysis, a vital sign analysis, or an ocular state analysis. A writer may obtain support in an additional scenario modification work, and an investor may obtain support in making a decision through the above description. Furthermore, the video-work story analysis system and analysis method based on emotional state measurement may extract a particular pattern with respect to a change in an emotional state of a viewer, compile statistics, and analyze a correlation between a story and an emotional state.

  • Juan $Mars{\acute{e}}$ was born in 1933 in Barcelona. Being the son of a City cleaner, he was able to watch, from a very early age, all the films he desired, as many times as he wished. This privilege meant a great help in future years, when having to develop the plots and characters of his works. In his last (latest) novel, Caligrafía de los $sue{\tilde{n}}os$, published in 2011, as he has done in his previous works he uses a cinematographic frame again. The explicit references to Hollywood's Golden Age -such as John Ford's Stagecoach and Cecil B. DeMiller's The Plainsman- bring very specific and vivid images to the reader's mind, leading to clear physical and psychological associations. The aim is achieved: the reader's attention is caught immediately. However, characters, plot and cinematographic structures are actually distracting mirages. They make the reader expect a predictable ending which, in fact, will be very different. Therefore, the surprised reader must step back, in order to approach the main topics of the novel from a certain distance. Doing so, he's following the Theory of the Distancing Effect. He becomes aware of the need of a new perspective on social problems that he had considered as familiar justo a few moments before. Thus, he is getting prepared for a more objective interpretation, such as the futility of war and the ideological differences that led to the (Spanich) Civil War and all its devastationg effects.
