A Study on the Insurance System for Oil Pollution Risk (유류오염 리스크와 보험담보의 문제)

  • With the rapid development of oil and chemical industry in the late 20C, massive transportation of oil by oil tanker vessel has grown and it caused the big oil pollution accidents. When oil spill from the oil tanker, damages reach into the astronomical figures in economically and damages affect wide area and many people with break the balance of ecosystem. Recently in Korea, the oil pollution accidents has occurred frequently as growing of oil consumption and it caused large-scale damages to the victim. Oil pollution in Korea offshore takes not only Korean fisherman from their life ground and break the ecosystem but it takes too much time and money to recover. To minimize oil pollution damages, it is necessary to make pre-caution effort as a ship owner and relevant government bodies should endeavor to prevent from more damages. But once oil pollution accidents occurs in territorial sea, compensation for victim is very important. But it is true that compensation is not paid to victim smoothly. So this study aims at the problems of oil pollution compensation to the Korean victim and find the best way to get reasonable compensation.

Interim Measures in the United States' Arbitration (미국중재에서의 임시처분에 관한 고찰)

  • This paper investigates what are the types and legal grounds for interim measures in the U.S. arbitration practices. The statutory ground for the interim measures is the Revised Uniform Arbitration Act. Another ground, probably the most important, is the parties' own intentions to adopt the interim measures in their arbitration proceeding. Most typical interim measures in arbitration include preliminary injuction, attachment and antisuit injunction. In the U.S ex parte motion for interim measure is rarely allowed while the Revised UNCITRAL Model Law specified an ex parte interim measure. In launching the interim measures, the US courts have demanded several requirements including imparability, probability of success and passing of the balance test. In general, the U.S. courts have properly interfered with the procedural issues in arbitration unreined but leaving the substantive issues untouched. It is believed that such interference has helped to enhance the credibility in arbitration with respect to fairness and justice.

  • A Silk Road was connecting East and West with trade route. The role From the ancient, Silk Road is situated in the Central Asia such as Kazakhstan, thus logistics sector was important more than others. This theme is the study of the Export Competitiveness of Korea-Kazakhstan trade. This paper analyses between Korea and Kazakhstan's trade used by TSI(trade specification index), IITI(intra-industry trade index) and CTBI(contribution to trade balance index). The World Bank is already addressing Kazakhstan's logistics inefficiencies is the lowest tier. Thus, Kazakhstan governments should encourage efficiency in Logistic parts. And more Korea is supporting to decrease Logistic cost.

Exergy analysis on the storage performance of the sensible heat storage unit (현열 축열조의 성능에 관한 엑서지 해석)

  • The exergy analysis on the heat storage performance of the senible heat storage unit which consists of the heat storage material in the concentric annulus and the hot fluid flowing through the inner tube is performed. Heat transfer characteristics which are necessary for the performance of the exergy analysis is obtained from the energy balance equations and the second law of thermodynamics. As the index of heat storage performance, the exergy lossnumber $N_{s}$, and exergy storage ratio from the concepts of the second law of thermodynamics are defined. Results are ovtained for the grometry of the storage unit, the Biot number Bi, ambient temperature $T_{o}$ as parameters. From these results the exergy storage ratio can be considered as the efficiency of the hat storage unit and is introduced as a guide to design.

  • This paper presents the theoretical analysis of a flow driven by surface tension and gravity in an inclined circular tube. A governing equation is developed for describing the displacement of a non-Newtonian fluid(Power-law model) that continuously flows into a circular tube owing to surface tension, which represents a second-order, nonlinear, non-homogeneous, and ordinary differential form. It was found that quantitatively, the theoretical predictions of the governing equation were in excellent agreement with the solutions of the equation for horizontal tubes and the past experimental data. In addition, the predictions compared very well with the results of the force balance equation for steady.

  • The United Nations General Assembly adopted the United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea(hereinafter referred to as "The Rotterdam Rules") on 11 December 2008. Rotterdam Rules aims to create a contemporary and uniform law providing for modern door-to-door container transport including an international sea leg. but not limited to port-to port carriage of goods. The structure of the liability regime in Rotterdam Rules are globally close to that of the Hague-Visby Rule even though it differs from that of the Hague-Visby Rules in some significant aspects. The Rotterdam Rules are very long. Therefore the Rotterdam Rules will be difficult to understand for even the skilled ship operator or owner or charterer or shipper or consignee or receiver because they are so complicated. This paper only seeks to highlight the salient features of the liability and limitation of liability regime under the Rotterdam Rules. It is expected that the harmonization and modernization of the international legal regime. coupled with the bold attempt to balance the carrier and cargo interests should lead to an overall reduction in transaction costs. increased predictability and greater commercial confidence for international business transactions.

Scaling law in MHD turbulence small-scale dynamo

  • Magnetohydrodynamics(MHD) dynamo depends on many factors such as viscosity ${\gamma}$, magnetic diffusivity ${\eta}$, magnetic Reynolds number $Re_M$, external driving source, or magnetic Prandtl number $Pr_M$. $Pr_M$, the ratio of ${\gamma}$ to ${\eta}$ (for example, galaxy ${\sim}10^{14}$), plays an important role in small scale dynamo. With the high PrM, conductivity effect becomes very important in small scale regime between the viscous scale ($k_{\gamma}{\sim}Re^{3/4}k_fk_f$:forcing scale) and resistivity scale ($k_{\eta}{\sim}PrM^{1/2}k_{\gamma}$). Since ${\eta}$ is very small, the balance of local energy transport due to the advection term and nonlocal energy transfer decides the magnetic energy spectra. Beyond the viscous scale, the stretched magnetic field (magnetic tension in Lorentz force) transfers the magnetic energy, which is originally from the kinetic energy, back to the kinetic eddies leading to the extension of the viscous scale. This repeated process eventually decides the energy spectrum of the coupled momentum and magnetic induction equation. However, the evolving profile does not follow Kolmogorov's -3/5 law. The spectra of EV (${\sim}k^{-4}$) and EM (${\sim}k^0$ or $k^{-1}$) in high $Pr_M$ have been reported, but our recent simulation results show a little different scaling law ($E_V{\sim}k^{-3}-k^{-4}$, $EM{\sim}k^{-1/2}-k^{-1}$). We show the results and explain the reason.

Liability for Damage due to Doctors' Unfaithful Medical Practice (의사의 불성실한 진료행위로 인한 손해배상책임)

  • In order to account for whether a doctor should indemnify damages resulted from violation of duty of care, the fact that a doctor violated duty of care, that damages were incurred, and the link between violation of duty of care and damages incurred, respectively, should be verified. So even though a doctor violated duty of care to patients, he or she will not bear the responsibility to indemnify damages unless it is not verified. If a doctor's negligence in medical practices is assessed that obviously unfaithful medical practice far exceeds the limit of admission of a patient, it will not go against people's general perception of justice or law and order to constitute a medical malpractice itself as an illegal action that will require liabiliy for damage. However, when the limit of admission is set too low, a patient's benefit and expectation of proper medical treatment can be violated. In contrast, if the limit of admission is set high, it can leave too little room for doctors' discretion for treatments due to a bigger risk of indemnification for damages. Thus, a reasonable balance that can satisfy both benefit and expectation of patients and doctors' right to treatment is needed.

Formulation for the Relativistic Blast Waves and GRB Afterglows

  • We present a detailed description of the blast-wave modeling technique for a very general class of GRB explosions. Providing a simple method of evaluating the blast energy, we demonstrate that a common approximation of pressure balance for the blast wave violates the energy-conservation law significantly for adiabatic blast waves. We show that the energy-violation problem is successfully resolved by the "mechanical model" that we developed. GRB afterglow lightcurves that are produced by the forward and reverse shock waves of the blast wave are presented.
