Arbitration Clause Prohibiting Class Action in Consumer Contracts

  • For recent years, several disputes between Korean consumers and multinational companies have arisen. Since the disputes were big and material that children's safety was at issue, a question started if Korean law properly has protected consumers' rights against multinational companies. While the Korean legal society tried to legislate punitive compensation with this concern, the U.S. Supreme Court reached an interesting case law regarding consumer contracts. A recent trend on consumer contracts in the United States shows that general terms have arbitration clause with class action waiver. As much as international arbitration has worked as the most effective resolution in international commercial disputes, the concept is still foreign and the experts are not approachable to lay individual consumers. However, class action in arbitration can hugely help for lay individual consumers to bring a case before arbitration tribunal. California courts consistently showed the analysis that the practical impact of prohibiting class action in arbitration clause is to ban lay individual consumers from fighting for their rights. However, the Supreme Court held that the arbitration clause shall be enforced as parties agree even if consumers practically cannot fight for their rights in the end. Even though consumer contracts are a typical example of lack of parity and of adhesive contract, the Supreme Court still applies liberalism that parties are equal in power and free to agree. This case law has a crucial implication since Korean consumers buy goods and services from the U.S. and other countries in everyday life. Accordingly, they are deemed to agree on the dispute resolution clauses, which might violate their constitutional right to bring their cases before the adjudication tribunal. This issue could be more important than adopting punitive compensation because consumers' rights are not necessarily governed by Korean law but by the governing law of the general terms and conditions chosen and written by the multinational companies. Thus this paper studies and analyzes the practical reality of international arbitration and influence of arbitration clause with class action waiver with the U.S. Supreme Court and California case laws.

Bonding Performance of Adhesives with Lamina in Structural Glulam Manufactured by High Frequency Heating System

  • The bonding performance of two types of wood adhesives, namely phenol-resorcinol-formaldehyde (PRF) resin and melamine-urea-formaldehyde (MUF) resin for glued laminated timber manufactured by high frequency (HF) heating was evaluated. The HF heating system consists of HF oscillator with dielectric heating system for curing adhesives, and hydraulic press system for clamping glued laminated timber. The designed frequency and output power of the HF system was as 5 MHz and 60 kW, respectively. To verify dielectric heating mechanism under HF oscillation, the heat loss factors of laminae and adhesives were measured. The results show that it is possible to selectively heat adhesives for their curing due to the remarkably higher loss factor of the adhesives than those of wood laminae. The temperature of adhesive in the bonding line reached up to the set temperature within a few seconds by high frequency oscillating, which advanced the curing of adhesive afterwards. The bonding performance, such as shear strength of bonding line, water soaking delamination, and boiling water soaking delamination of PRF resin met the requirement of Korean Standard (KS), however the MUF resin did not meet the KS requirement of boiling water soaking delamination. These results indicate that the HF heating system is successful to manufacture glued laminated timbers with PRF resins to meet the bonding requirements.

A Study on Synthesis of Starch-acryl Pressure Sensitive Adhesive by Soap-free Emulsion Polymerization (무유화제 유화중합에 의한 전분-아크릴 점착제의 합성에 관한 연구)

  • The pressure sensitive adhesives (PSA) were synthesized by soap-free emulsion polymerization of acrylic monomers such as butyl acrylate, 2-ethyl hexyl acrylate, and acrylic acid in the presence of starch as a protective colloid and copolymer. The peel strength and holding power of PSA were increased with starch contents due to the enhancement of gel content, But the initial tackiness of PSA was decreased with starch contents. The contact angle analysis of PSA indicated that the wettability was increased with starch contents owing to the increase of polarity by hydroxy group in starch. In the pH measurement of emulsion with time for biodegradability, the starch in the PSA accelerated the lowering of pH due to the formation of organic acids followed by decomposition of starch.

  • The purpose of this study is to enhance durability of concrete structures that uses this surface protecting material by carrying out the performance test of the surface protecting material of concrete, and as s result, we reached out the conclusion as follow. 1. As a result of the test measuring the stability and adhesive power of conductive film against ultraviolet, freezing & thawing, and damage from seawater that deteriorate the surface protecting material, it was turned out to meet the performance criteria specifying in the KS standard enough to gain a good evaluation to use as a surface protecting material. 2. As a result of the test identifying the neutralization-furtherance, it was assessed to be capable of protecting effectively concrete structures from carbonic acid gas by a very low depth of 0.1mm of neutralization. 3. As a result of the test identifying Penetrated Resistance Properties of chloride ion, as it was turned out to have a very low value of 819 Coulombs, it was assessed that even in the environment where the corrosion by chloride such sea environment is very affective, the film can effectively protect the concrete structure. 4. As a result of the test identifying freezing & thawing, as there was no change in reduction of mass after 400 cycle, it was assessed that the film has a good resistance against freezing & thawing. According to the results of study above, it is expected that this technology can extend its durability of concrete structure and be widely used for concrete structure through means (methods) to prevent the neutralization and damage from seawater as original purposes of the surface protecting material.

  • This study was made on the poly(vinyl acetate) (PVAc) and poly(vinyl acetate- ethylene) (VAE) emulsion polymer blend which used PVA as protective colloid, and the PVA used as protective colloid was existed in each emulsion film before blend and even in the film after the blend consecutively. It makes us expect excellent adhesive power among particles that form the blend. Emulsion blends with different Tg are important target of concerning, and PVAc/VAE emulsion blend suggested simple and excellent research method. As a result of blend, elongation was lowered by the increase of PVAc, and the plasticizer used in making PVAc affected on the Tg of blend and lowered Tg of VAE emulsion, and the synergy effect of two blends was seen for the tensile strength, thermal resistance, and adhesive strength.

  • Interest and investment in renewable energy have increased worldwide, highlighting the need for renewable energy. Solar energy was the most promising energy of all renewable energy sources, and it has the highest investment value. Because photovoltaics require a certain amount of area for installation, high density and high output performance are required. Shingled module is a promising technology in that they are featured by higher density and higher output compared to the conventional modules. Shingled technology uses a laser scribing to divide solar cells that are to be bonded with electrically conductive adhesive (ECA) to produce and connect strings, which has a higher output in the same area than the conventional modules. In the process of producing solar modules, metal ribbons are used to interconnect cells, but they are also needed for string connections in shingled solar cells. Accordingly, in this study, we researched the interconnection that best suits the connector that joins the string to the string. The module outputs produced under the conditions of the string interconnection were compared and analyzed.

Effect of diamond-like carbon film as passivation layer on characteristics of power transistor (전력 트랜지스터의 특성에 미치는 다이아몬드상 카본 passivation 막의 효과)

  • Because of the novel characteristics such as chemical stability, hardness, electrical resistivity and thermal conductance, diamond-like carbon (DLC) film is a suitable materials for the passivation layers. For this purpose, DLC films are synthesized under various conditions and are characterized. Adhesive stregth is excellent and increased with the increase of the hydrogen gas flow rate. The resistivity of approximately 5.3X10$^{8}{\Omega}{\cdot}cm$ is measured by automatic spreading resistance probe analysis method. The thermal conductivity of DLC films is superior to that of PSG oxide and improved by increasing the hydrogen gas flow rate. The patterning techniques of the DLC films is developed using the lift-off and RIE methods to form 5${\mu}$m line. Finally, power transistor with the DLC film as passivation layer is fabricated and analyzed. The test result shows the improsved long-term stability and higher breakdown voltage.

  • The interconnecting shingled solar cells method shows extremely high ratio active area per total area and has the excellent potential for high power PV (photovoltaic). Compared to the conventional module, it can have much more active area due to busbar-free structure. The properties of ECA (electrically conductive adhesives) are significant to fabricate the shingled array PV since it should be used in terms of electric and structural connection. Various ECA were tried and characterized to optimize the soldiering conditions. The open circuit voltage of shingled array cells showed a three-fold increase and efficiency was also increased by 1.63%. The shingled array cells used in CE3103WLV showed the highest power and in CA3556HF the lowest curing temperature and very fast curing time.

  • Currently, functional patterns are formed by screen printing on stretchable films, and they are applied to wearable and stretchable devices. In this study, three types of silver paste were prepared using three polyester binders with different Tg and molecular weights in order to impart elasticity to the conductive pattern itself. Rheological properties and DSC measurements were performed for each silver paste. Then, each silver paste was screen printing and cured by an IR dryer to evaluate adhesive strength, pencil hardness, resistance and surface shape change according to strain. As a result, it was found that the silver paste using a binder with a low Tg and a high molecular weight has the smallest resistance change depending on the strain. Namely, it was found that it is most preferable to use a binder with a low Tg and a high molecular weight as the stretchable electrode.

Laser Welding Parameter Variations and its Application for Plastic Adhesion

  • a parametric investigation was conducted to evaluate the effect of the laser beam for plastic adhesion. To determine the best condition for plastic adhesion, the $CO_2$(wavelength $10.6{\mu}m$) and nd:yag(wavelength $10.6{\mu}m$) laser were experimented with. From the experiment results obtained, the nd:yag laser was revealed to be the most suitable for plastic adhesion. In this study, three adhesion parameters such as input power level, working time of laser beam and pps(pulse per second) were systematically adjusted for suitable adhesion. From these experiments, it was observed that the target plastic melted and was evaporated by the nd:yag laser. Furthermore, the relationships between adhesive surface by laser beam and above three parameters were discovered.
