특허권은 처음 새로운 아이디어를 생각해낸 창작자에게 독점권을 제공하여 꾸준한 창작에 도움을 주기 위한 권리이지만, 때로는 창작의 자유를 침해하는 결과를 낳기도 한다. 본 연구는 아케이드 게임기 분야에서의 음악게임 분야의 특허를 살펴보고, 이 분야의 주요 업체인 코나미사가 특허 소송을 반복함으로써 경쟁사를 견제하고 시장을 정체시킨 사례를 통해서 게임 분야에서의 기술 특허권의 남용 문제를 밝히고자 한다. 아이디어 산업인 게임 분야에서 새로운 기술에 대한 특허권을 보장하는 것은 타당하지만, 조작 장치 등 일부 하드웨어의 기술적 특허만을 근거로 소송을 반복하는 것은 새로운 창작의 가로막아 시장 전체에 부정적인 영향을 줄 수 있다는 것을 살펴본다. 한국, 일본 등 세계 각지에서 진행된 여러 소송 사례를 살펴보고 그로 인한 시장의 변화를 통해서 분석해 보았다.

This study is to be used for research material for pastoral counseling, by analyzing grounded-theoretically how substance abusers' awareness of self and experience of relations affects problems in abusing drugs. The subject of this study was chosen as 9 prisoners who were able to participate in group counseling, among those who were in prison for substance abuse and had more than 6 months of penal servitude left. In addition, in order to indicate counseling research methods through this study, 12 group counselings were carried out during October 24th. 2002 and February 14th. 2003 and verbatim were written out to be used as original material. After the research material was analyzed, they could be categorized into 60 concepts on the whole from 'conflict' and 'constraining thinking' to 'rationalization' and 'avoidance'. When these concepts were organized into groups of similarity, there were all together 20 categories. From this study, it can be found that substance abusers had "problems about self" and "problems about relations". The factor which affected their use of drugs was the area of relations, where as henceforth their use of drugs, the situation in which they could not escape from the use of substances was affected by problems within the area of self. When facing such problems as substance abuse, the pastoral counselor must create a holding environment through counseling, and perform good enough mothering by being insightful and providing active support on the problem. They must also help one's growth into "an empathizing self", "an accepting self", "a trusting self", "a hopeful self", who can empathize, accept, trust and hope, through experience in separation from the problem, conversion, meta-communication, self-rumination, relations and inspiration of hope. Likewise, the church must be able to act as a "place of growth and skill" which aids in the forming of relations and helps to be aware of self through experience in, and understanding of, relations.

Objectives : The concept of hidden Yin in summer by Zhu Danxi deals with the relationship between summer heat disease and hidden yin inside of human body. This paper attempts to ponder upon the clinical issues around which the discussions regarding the topic unfolded, and upon the texts on which the doctors of the discussions based their opinions. Methods : First, Danxi's argument as discussed in $G{\acute{e}}zh{\grave{i}}y{\acute{u}}l{\grave{u}}n$ is analyzed to find out his understandings of clinical issues and his textual sources on which he based his new perspective. Moreover, the prescriptions that Danxi thought was problematic and the concept of hidden yin as it existed before the time of Danxi are reviewed, and these findings are used understand Zhangjingyue's ground of criticism against Danxi. Lastly, this paper contemplates how these opposing opinions may be helpful to the general principles of medical theories. Results & Conclusions : There was a trend before the time of Danxi of abusing drugs as prescription based on warm-heat, understanding that a human body has yin-cold during summer. However, Danxi brought forth a new concept of yin deficiency in order to correct people's misunderstanding. Despite his effort, Zhangjingyue and other doctors contemporary to Danxi emphasized on one hand that human body is placed on a state of external heat inside the cold, and on the another, criticized Danxi of failing to fully understand the principle of "Abandon the time and follow the symptoms", a principle which asserts that the cold and warm of medicine should be decided by the symptom itself and not by the season. The value of these contradicting assertions seems to hold true even to this day because it helps us understand that the principles of "Counting Season as a Treatment Factor" and "Abandon the time and follow the symptoms" could be applied with balance in conjunction with each other.

To investigate the relationship between eating behavior and the prevalence of adolescents drug abuse and smoking, this survey was conducted among 349 male students(mean age ; 16.0 $\pm$0.9yrs) at technical high schools in Kyunggi-Do. It was shown that 58.7% of total subjects were smoking and 11.2% were abusing drugs. Drug abusers weighed Less than non-abusers especially, student smokers were 2.7kg lighter than non-smokers despite the same height. Although parents' education showed no relationship with drug abuse, educational level of student smokers' fathers was significantly lower than that of non-smokers' fathers. Drug abusers and smokers showed significantly higher incidence of runaway from home, absence from school without notice, and parents' divorce than non-abusers and non-smokers. Drugs abused were sleeping pills(n=20), bonds and butane gas(n=9), marijuana(n=3), tranquilizer(n=3), morphine and cocaine(n=2), and pep pills like amphetamine(n=2) 76.9% of the drug abusers had their first experience in junior high school and 81% of the smokers stared smoking as early as in junior high school. Also, 44% of the smokers reported that they smoke daily. The drug abusers tended to have more irregular eating habits than the non-abusers. The smokers showed irregular mealtime, ate either too fast or too slow, and especially, often skipped lunch or dinner. The drug abusers and smokers took little vegetable in their meals and often ate bread or noodles instead of rice for staples. In addition, they preferred taste to nutrition when they had meals. The smokers tended to ingest smaller amount of calcium source such as milk or dinner food and fish with bone although they consume more volume of total foods than the non-smokers. All subjects took less in calorie, calcium, iron, vitamin A, vitamin E, riboflavin, and folic acid than the Recommended Dietary Allowance Those findings suggest that drug abuse and smoking cause bad eating habits that influence unbalanced nutritional state. Therefore, nutrition education should be provided to the adolescents so that they can recognize the disadvantages of drug and smoking and its relation to dietary relation. 스팸메일이란 상대가 수신하기를 원치 않는 상업적인 광고를 내용으로 하는 이메일을 뜻한다. 사이버 공간에서 발생하고 있는 스팸메일의 폐해는 매우 다양하며 그로인한 손실액만도 2001년 경우 전 세계적으로 약 86억 달러에 해당하는 것으로 추산되었고, 2004년 국내의 경우는 2조 6451억 원이라는 엄청난 액수에 달하였다고 한다. 이렇게 엄청난 재산상 피해를 유발하고 있는 스팸메일은 수신자와 ISP 그리고 사회적 나아가 국제적으로 많은 문제를 야기하고 있다. 그러나 스팸메일을 규제하는 정보통신망보호촉진 및 정보보호 등에 관한 법률 등의 현행 법규만으로는 역부족한 것이 사실이다. 또한 스팸메일이 민사상 불법은 되지만 형사법적인 불법으로까지 긍정하기에는 아직 미흡한 면이 있어 불법행위로 구성하는데 한계를 나타내고 있다. 그러므로 본 연구에서는 스팸메일에 대한 국가적인 규제형태의 전환, 집단소송제도의 도입, 특별법의 제정을 통하여 효율적인 스팸메일에 대한 통제하는 방안을 제시하고자 한다.

Meridian Research Center, Division of Standard Research, Keora Institute of Oriental Medicine Objectives : Ear acupuncture needle is used to treat smoking, drug abusing, alcoholism frequently over time stability of ear acupuncture needle is important factor for safe acupuncture treatment. In spite of the importance, there has been few study about the quality of disposable acupuncture needle tip - using scanning electron microscope (SEM) in 2002, 2003. Moreover, there was no study about ear acupuncture needle. Methods : The three ear acupuncture needle, made in China, Japan, Korea was chosen. We used Hank's solution at the 38$^{\circ}C$ as a phantom tissue liquid. Except for the control group, five groups of needles are soused one to five days. Surface corrosion was observed using the SEM compared with control group. Results : There was no particular corrosion in all groups of ear acupuncture needles compared with the control group. Conclusions : All of the ear acupunctures used in this study are stable in body fluids at least 5 days.

A letter of credit transaction of the preexistence have been raising one's head fraud charge problem as a result of abusing the principles of independence and abstraction. Every society has certain rules and conventions which it regards as important and most of people in any society. The paper document means a document in a traditional paper form. The eUCP credit must specify the formats in which electronic records are to be presented. In these present times, the issuance of documentary credit are performed by the SWIFT(Society for Worldwide Inter bank Financial Telecommunication) system. The eUCP have been written to allow for presentation completely electronically or for a mixture of paper documents and electronic presentation. Presentation is deemed not to have been made if the Beneficiary's notice is not received. An electronic record that cannot be authenticated is deemed not to have been presented. The e-UCP is the supplement of current existing UCP but is superior to UCP under some circumstances. The document shall include an electronic record. The place for presentation of electronic records means an electronic address. The current e-UCP is not clear on this matter. We have to note followings in case of presenting the documents electronically and applying the e-UCP. There are three principles in the letter of credit transaction, that is to say, independence and abstraction, document dealing, strict compliance. IN the electronic letter of credit, these principles are called as independence and abstraction, electronic document dealing, strict compliance.

This study is aimed to investigate ethics cognition to information of youths who are main users of computers, but yet not built up the own ethics and the sense of value, as ethical problems are raised in information-oriented society. The research was focused on youths ethics cognition to information according to contact of multimedia pornography, surreptitious use of others and abusion of indecent languages in chatting. The survey was conducted to 520 students from middle and high schools in Jeju region and analyzed Probit Regression. The major results of this study are as follows; First, most of youths possess own-computers, and use Internet. Second, looking into experiencing or not according to sub-spheres of ethics cognition to information, the experience of contacting multimedia pornography was few. but the primary place of using it was a house. Most of youths approach multimedia pornography in awareness of a ban on youths' contact. The experience of surreptitious use of others was less than other spheres, and mainly only once. The number of youths who have an experience of abusing indecent languages was less than that of youths who don't have, but the frequency of was high when the youths have an experience. Third, the experience or no experience on each sub-sphere has a significant difference on personal-relative variables such as gender, age, education levels, number of siblings, academic records, personal expenses, relationship with friends. The experience or no experience on each sub-sphere has a meaningful influence upon family-relative variables such as father's education levels, Job, mother's age, education levels, employment, family type, monthly household expense. The experience or no experience on each sub-sphere has a meaningful influence upon PC-relative variables such as deviation experience in PC rooms, the experience of request for age confirmation(I.D. card), average use hour of PC rooms. The experience or no experience on each sub-sphere has a more meaningful influence on personal-relative variables and PC-relative variables than family-relative variables.

The theory of liver by Jang suk-sun[張錫純] is that first, although liver exists at right side of body and spleen at left anatomically, function of liver presents at left side of body and function of spleen at right based on principle of 'interdependence between eum and yang' and 'join strength with elasticity', and in the relation between liver and spleen, if gi of spleen ascends, gi of liver also ascends, and if gi of stomach descents, gi of gall bladder also descents. So. care of spleen and stomach becomes main point in treating disease of liver. The meaning of 'the liver being in charge of the evaporation'[肝主氣化] is that first, it raises the primordial gi and forms the 'great g' for it's circulation of whole body. Second., it excretes the functional activity of gi and connects heart with kidney and guides the evaporation of the whole body by connecting innate nature with acquired nature. Third, 'the liver being in charge of the evaporation' is realized by the help of spleen and stomach. And he said that this functional activity of gi is one of distinctive features that distinguish Oriental medicine from Western medicine. He discoursed upon physiology of 'the liver being in charge of the evaporation' and 'the Body belonged to yin and the Use belonged to yang' after seeing an evil of abusing drugs that calm the liver and check hyperfunction of liver by contemporary doctors. And he established a treat of 'warming and recuperating the gi of liver' [溫補肝氣法] and used it for symptoms of 'deficiency of liver-gi'[肝氣虛], 'exhaution of liver-gi'[肝氣脫], and 'the liver-cold'[肝寒證].

인터넷 광고는 오프라인 광고에 비해 여러 장점을 가지고 있지만, 광고 인젝션(advertisement injection)으로 인하여 다양한 피해가 발생할 수 있다. 일반사용자에게는 추가 적인 광고 노출로 인하여 불편함을 주고, 웹 콘텐츠 제공자에게는 서비스 품질 저하의 문제를 발생시킬 수 있다. 또한 광고주에게는 계획되지 않는 광고 노출로 인하여 기대한 광고 효과를 얻지 못하기도 한다. 하지만, 이와 같은 인터넷 광고 인젝션으로 인한 피해가 발생 가능함에도 불구하고 아직까지 광고 인젝션 유형에 관한 연구는 거의 진행되지 않았으며, 다만 구글(Google)의 최근 연구에서 인터넷 광고 인젝션 이슈를 다루고 있다. 따라서 본 논문에서는 국내 인터넷 포털 사이트 네이버를 대상으로 한 인터넷 광고 인젝션 유형을 분석하였다. 다운로더 27개와 이들이 설치하는 199개의 프로그램을 분석하여, 여섯 개의 인젝션 유형을 정의하고 각 유형별 동작 및 특징을 분석하였다.
